Usually, you cannot remove your name from a co-signed mortgage just by asking the servicer to edit the account. The first option to investigate is an assumption by the borrower keeping the home, combined with a formal, written release of liability for you. The remaining borrower must satisfy the loan program’s eligibility, credit, income, and other underwriting requirements. If the servicer or loan owner will not approve that path, the practical alternatives are refinancing into a new mortgage or paying off the existing loan through a sale or other funds.
A deed, quitclaim deed, divorce decree, or private agreement can change ownership between the parties, but none of those documents by itself proves that the mortgage creditor released you from the note. Do not treat your name as removed until the servicer gives you written confirmation of a completed release. The guidance below concerns U.S. mortgages; state law and the specific loan owner, insurer, guarantor, and servicer rules control an individual case.

Understand the two obligations you may be trying to separate
A mortgage situation has at least two distinct legal relationships:
- Title or ownership: who owns the real estate under the deed and applicable state property law.
- Mortgage liability: who promised the creditor to repay the note and is responsible if payments are missed.
Those relationships can change at different times. A divorce judgment may award the house to one spouse. A deed may transfer one owner’s interest to the other. Neither event automatically rewrites the promissory note. If you remain a borrower, the servicer may still report the account, pursue you for a deficiency where permitted, and count the debt in future credit or mortgage underwriting.

Fannie Mae’s servicing instructions distinguish processing an exempt transfer from granting a release of liability. The servicer may accept a transfer of ownership under applicable rules while still requiring a separate review before releasing an existing borrower. See Fannie Mae’s transfer exemptions and its credit and financial-capacity review guidance.
Your goal, therefore, is not merely to get off the deed. It is to obtain an express creditor-approved release of liability, or to have the existing loan paid in full.
Option 1: An assumption with a written release of liability
An assumption lets the borrower who keeps the home take responsibility for the existing mortgage rather than replacing it with a new loan. A release of liability is the creditor’s removal of an existing borrower from the obligations on that mortgage. These are related but separate actions: an assumption alone does not automatically release the departing borrower.
What the remaining borrower must usually prove
The servicer applies the rules of the loan’s owner, insurer, guarantor, and program. A review can include:

- Credit history and score requirements.
- Documented income, assets, employment, and debt obligations.
- Capacity to make the payment without the departing borrower.
- Compliance with the loan’s assumption and transfer provisions.
- Mortgage-insurance consent or other insurance requirements, where applicable.
- Evidence supporting the transfer, such as a divorce decree, settlement agreement, death certificate, or recorded title documents.
Fannie Mae directs servicers to evaluate the transferee’s credit and financial capacity before approving a release, and mortgage insurance can affect the result. Other investors and programs use different standards. Ask for the exact criteria for your loan rather than relying on a rule described for another mortgage.
Why this route can be attractive
- The existing interest rate and remaining term may stay in place, subject to the loan’s rules.
- It may avoid the full closing costs and qualification process of a new mortgage.
- It directly addresses the departing borrower’s liability if the servicer signs and records the release required for the loan.
What can still make it difficult
- The loan may not permit the requested assumption, or may permit it only after a qualifying life event.
- The remaining borrower may not meet credit, income, debt-to-income, or asset standards.
- Processing may require extensive documentation, fees, title work, or mortgage-insurance approval.
- The servicer may approve a transfer of title but deny a release of liability.
First identify who owns or guarantees the loan
The logo on a payment statement is not enough to determine the governing rules. The servicer collects payments, but the loan may be owned or guaranteed by a federal housing program, a government-sponsored enterprise, a bank, or another investor. Ask the servicer which entity owns or guarantees the loan and which assumption procedure applies.
| Loan or program possibility | What the published guidance establishes | What you must confirm |
|---|---|---|
| Fannie Mae | Its guidance addresses allowable ownership-transfer exemptions and a separate review of the transferee’s credit and financial capacity before a release. | Whether this loan is owned or guaranteed by Fannie Mae, whether your transfer qualifies, mortgage-insurance requirements, forms, fees, and the exact release document. |
| Freddie Mac | Freddie Mac says most conventional mortgages do not allow ordinary third-party assumptions, while describing assumption pathways for certain life events. | Whether your situation is one of the permitted life events and whether the remaining borrower can qualify. |
| FHA, VA, or USDA | Program-specific assumption and transfer rules apply and may differ from conventional-loan rules. | The program, current servicer procedure, eligibility conditions, and any required agency or insurance approval. |
| Bank portfolio or private-label investor | The note, security instrument, investor agreement, and applicable law control. | Whether the creditor permits an assumption and what underwriting and release standards it uses. |
Do not generalize a Fannie Mae rule to every conventional loan, or assume that an FHA, VA, USDA, portfolio, or private-label mortgage follows the same process.
Follow this action sequence
- Collect the account information. Find the latest mortgage statement and record the servicer’s name, phone number, mailing address, loan number, property address, loan type if known, and every borrower named on the account. Keep a copy of the note, deed, and any prior assumption or modification papers you have.
- Contact the correct department. Ask for the assumption, transfer-of-ownership, or successor-in-interest team rather than treating this as a routine name-change request. Use a written message or secure portal when available so the request is date-stamped.
- Use precise language. Ask: “Can the borrower keeping the home assume this loan and obtain a written release of liability for me? What forms, supporting documents, qualification standards, fees, and processing steps apply to this loan?” Ask for the name and address of the department handling the request.
- Confirm the investor and program. Ask whether the loan is owned or guaranteed by Fannie Mae, Freddie Mac, FHA, VA, USDA, or another investor. Request the applicable assumption package and a list of required documents.
- Submit transfer evidence. Provide only the documents requested, such as a final divorce decree, marital settlement agreement, death certificate, recorded deed, probate document, or evidence of title. Requirements vary by situation and jurisdiction. Retain complete copies.
- Complete the remaining borrower’s financial review. The borrower keeping the home may need to submit pay stubs, tax returns, bank statements, employment verification, authorization forms, and other underwriting documents. Ask whether mortgage insurance or a separate insurer approval is required.
- Track every submission and conversation. Keep a dated log of calls, employee names or identification numbers, secure messages, document-upload confirmations, letters, and promised response dates. Send important documents through a traceable method and keep delivery proof.
- Request a written decision. If approved, obtain the executed assumption documents and the express written release identifying you and the loan. If denied, request the specific reason, the governing rule, and any reconsideration or appeal process. Do not rely on a verbal assurance.
- Verify after completion. Check a later statement and your credit reports. Confirm that the release is effective as of the stated date and that you are no longer listed as an obligor. Keep the final release indefinitely with your loan and property records.
Option 2: Refinance into a new mortgage
Refinancing pays off the existing joint mortgage and replaces it with a new loan in the name of the borrower who will keep the property, or in the names that borrower chooses. Because the old loan is paid in full, the former co-signer’s liability under that loan ends when the payoff is completed and any related obligations are satisfied.
Compare the full economics, not just the payment
| Item | Questions to answer before choosing a refinance |
|---|---|
| Interest rate | Is the new rate fixed or adjustable, and how does it compare with the existing rate? |
| Monthly payment | What will principal, interest, taxes, insurance, mortgage insurance, and association dues cost each month? |
| Closing costs | What lender fees, appraisal charges, title costs, recording fees, points, and prepaid items are due? |
| Loan term | Will the new term extend repayment and increase total interest, even if the payment changes? |
| Qualification | Can the remaining borrower qualify alone using current income, credit, assets, and debt? |
| Payoff | What is the exact payoff amount, including per-diem interest and any permitted charges? |
| Cash-out or equity | Will the refinance return money to either party, and how will that affect the balance and ownership agreement? |
A refinance may be unavailable or more expensive than an assumption, and it could produce a higher rate or payment. Obtain a written loan estimate and a written assumption-and-release quote, then compare them on the same facts. The Consumer Financial Protection Bureau has warned that homeowners dealing with divorce or a death may encounter delayed or duplicative paperwork and pressure to refinance; documentation and escalation matter.

Option 3: Pay off the mortgage through a sale or other funds
A sale can pay the loan in full from the closing proceeds, after which the joint mortgage obligation ends. The parties must still resolve title, sale authorization, payoff timing, taxes, liens, and the division of net proceeds. If one party has enough funds to pay the balance, request an official payoff statement with a good-through date and confirm that the creditor will release its lien after payment.
“Continue paying” is not a removal method. A private agreement that the other borrower will make every payment may allocate costs between you, but it does not bind the creditor unless the creditor formally changes or extinguishes the obligation. You can remain exposed to missed payments, collection activity, credit reporting, and future underwriting consequences.

Divorce, death, and transfers of ownership
Divorce-related transfers
Some transfer rules treat a qualifying divorce or legal-separation transfer differently from an ordinary sale. Fannie Mae lists qualifying divorce transfers among exemptions from due-on-sale processing, subject to its stated conditions. An exemption can permit the ownership transfer without immediate acceleration; it does not itself release the departing borrower from the note.
If a divorce decree awards the house to your former spouse, send the decree and any settlement agreement to the servicer and separately request an assumption and release. Ask whether the order must be final, whether a deed must be recorded, and whether the remaining spouse must qualify. If the decree requires a refinance by a deadline, that deadline is a matter between the parties and the court; it does not guarantee that a lender will approve the new loan.

Death and successor situations
When a borrower dies, the estate, surviving owner, and potential successor should notify the servicer promptly and provide the requested death and title documents. Federal servicing rules can give a confirmed successor in interest borrower treatment for specified servicing protections. The CFPB’s Regulation X interpretation states that a confirmed successor must be considered a borrower for purposes of that subpart and the mortgage-servicing rules, regardless of whether the successor assumes the mortgage obligation under state law. Read the rule at 12 CFR § 1024.30.
Those servicing protections do not by themselves decide who is contractually liable for the debt or grant a release. Liability still depends on the note, applicable state law, and any approved assumption or payoff.
What to do if the servicer delays or denies the request
Ask for a complete written explanation
Request the denial reason in writing, including whether the problem is the loan type, transfer facts, missing documents, credit, income, debt-to-income ratio, mortgage insurance, title, or an investor restriction. Ask whether the decision can be reviewed and what deadline applies. A denial based on missing paperwork may be fixable; a program prohibition may require refinancing, sale, or legal advice.
Use the servicer’s complaint and escalation channels
Send a focused written complaint through the servicer’s designated process. Include the loan number, property address, dates, names of representatives, documents submitted, and the specific remedy requested: an assumption review and written release decision. Keep the original documents and send copies.

Escalate unresolved servicing problems
If the servicer does not correct a documented servicing problem, you can submit a complaint through the CFPB’s consumer complaint channel. The CFPB’s December 17, 2024 issue spotlight describes complaints involving delays, repeated requests for documents, and pressure to refinance. A complaint channel cannot guarantee approval, but a clear record can help identify a servicing failure and obtain a response.
How to decide among the available paths
| Path | What changes | Main checks before committing |
|---|---|---|
| Assumption plus release | The remaining borrower takes responsibility for the existing loan; you are released only if the creditor formally approves and documents it. | Investor and program eligibility, credit and capacity review, mortgage-insurance consent, fees, processing time, and the exact written release. |
| Refinance | The existing loan is paid off and replaced with a new mortgage. | Qualification, rate, term, closing costs, payment, payoff amount, title, and any cash-out terms. |
| Continue without release | No creditor obligation changes; all original borrowers remain liable. | Credit exposure, payment risk, future borrowing capacity, and a written private agreement that still does not bind the lender. |
| Payoff or sale | The existing loan is paid in full from sale proceeds or other funds. | Official payoff, lien release, title and closing requirements, timeline, taxes, and allocation of proceeds. |
Start with the assumption-and-release question when preserving the existing loan could matter. Obtain a refinance estimate at the same time if the assumption is uncertain, and compare the documented results rather than relying on a promise that one route will be cheaper.

- Signing a quitclaim deed and assuming the mortgage disappeared.
- Relying on a divorce decree without obtaining the creditor’s written release.
- Accepting a payment arrangement as proof that the note was changed.
- Assuming every conventional mortgage is assumable.
- Confusing a confirmed successor’s servicing rights with contractual assumption of the debt.
- Stopping payments before the release, payoff, or refinance has actually closed.
- Failing to keep copies and dates for documents sent to the servicer.
- Comparing only the new monthly payment and ignoring rate, term, closing costs, insurance, and total interest.
When to obtain legal or housing help
Consider advice from a lawyer licensed in the state where the property is located when the divorce order is disputed, title and note obligations conflict, an estate is involved, there are multiple liens, or a party refuses to cooperate. A local housing counselor may help organize documents and compare an assumption with a refinance, but neither a counselor nor a generic form can create a lender-approved release. Ask any professional what exact service is provided, what it costs, and whether it has authority to communicate with your servicer.
Bottom line
The cleanest way to remove your name is a servicer-approved assumption by the borrower keeping the home together with an explicit written release of liability. If that is unavailable, compare a refinance and a full payoff or sale. Ownership paperwork alone is not enough, and you remain responsible until the creditor’s records and written documents show that your obligation has ended.
