Start with the turnover test, then treat GST and tourism approval as two separate registrations. The Central Board of Indirect Taxes and Customs (CBIC) registration FAQ cited for Jammu and Kashmir gives an aggregate annual, PAN-based threshold of INR 10 lakh. If your liability arises (or you elect voluntary registration), apply online at gst.gov.in. A homestay, hotel or guest house must still complete the separate registration process of the J&K Tourism Department; a GSTIN does not replace that local tourism approval.
The INR 10 lakh figure comes from an older CBIC FAQ, so verify the threshold and any later notification that applies to your filing date in 2026. The guide below shows the evidence-based process, the accommodation rates in the cited CBIC table, the electronic-commerce-operator (OTA) exception, and the local tourism steps you must handle in parallel.

1. Decide whether GST registration is required
Use the INR 10 lakh J&K threshold as your first check
The cited CBIC GST System Project registration FAQ states that registration is mandatory when aggregate annual PAN-based turnover exceeds INR 20,00,000, but gives a lower INR 10,00,000 threshold for a person with a place of business in Jammu and Kashmir. Because that FAQ is an older publication, confirm the current threshold, exemptions and notifications before submitting an application.

If the same proprietor or entity operates other taxable activities under that PAN, include them in the assessment. Keep a month-by-month record of room rent, food or other taxable supplies so you can show how the total was calculated.

Check for compulsory-registration triggers separately
Crossing the threshold is not the only question. Review whether another compulsory-registration provision applies to your facts. The CBIC circular on accommodation supplied through an electronic commerce operator is relevant to small homestays, but it does not eliminate every possible compulsory-registration trigger. If you have unusual supplies, several premises, a partnership or company, or bookings that involve another taxable activity, ask a J&K GST practitioner or chartered accountant to review the position.
Voluntary registration
You can choose to register even when your turnover is below the applicable threshold. That can be useful when business customers request a GST invoice or when you need a formal GSTIN for your operating model, but registration also means maintaining GST records, issuing compliant invoices and filing returns as applicable. Make the choice only after pricing the administrative work and confirming the treatment of your supplies and input-tax-credit position for the relevant financial year.
2. Understand the GST rate for accommodation
The CBIC rate table cited for this topic classifies “hotel accommodation” by the value charged per unit per day:
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →| Value of accommodation per unit per day | CGST | SGST/UTGST | Total rate |
|---|---|---|---|
| Up to INR 7,500 | 6% | 6% | 12% |
| Above INR 7,500 | 9% | 9% | 18% |
These are the figures in the cited CBIC table. For a property in the Union Territory of Jammu and Kashmir, confirm whether the invoice should show CGST plus UTGST for the particular supply and financial year. Check later rate notifications, invoice treatment and input-tax-credit conditions before using the table for current bookings. The INR 7,500 test is stated per unit per day; do not substitute an annual room average or a whole-property average.

Build a rate decision into your booking records
- Record the tariff for each unit and each date of stay.
- Keep evidence of discounts, complimentary nights or package components that affect the value charged per unit per day.
- Separate accommodation from food or other services in your records when the transaction includes more than a room.
- Have your accountant confirm the rate and tax split before you issue invoices for a new season or change your tariff.
3. Gather information before opening the online application
The GST portal generates a property-specific upload list. It can vary with your constitution (individual proprietor, partnership, company or another form) and with whether you own, rent or otherwise occupy the premises. Prepare the following core information, then follow the list generated in the application:
- PAN and the legal name linked to that PAN.
- Business constitution and details of the proprietor, partners, directors or other responsible persons.
- Details of the authorised signatory.
- An email address and mobile number that can receive OTPs.
- Proof of the principal place of business and information about possession of the premises.
- Bank-account details when requested by the portal.
- Photographs, signatures or other identity and authorisation files when the portal requests them.
- A description of the accommodation service and the property’s business details.
Use legible, current documents and make the legal name consistent across the PAN, bank information and authorisation documents. Keep the originals and a copy of every uploaded file so you can answer a clarification notice without reconstructing the application.
4. File the GST application on the portal
- Open the registration service. Go to gst.gov.in, choose Services, then Registration, and select New Registration.
- Select the applicant type and location. Choose Taxpayer, select Jammu and Kashmir and the relevant district, and enter the PAN-linked legal name.
- Enter contact details and verify OTPs. Provide the email and mobile number, complete the portal’s OTP verification and submit the initial form.
- Save the TRN. The portal issues a Temporary Reference Number. Store it securely; you need it to return to the unfinished application.
- Complete Part B. Use the TRN to reopen the application and fill in the business constitution, proprietor or entity details, authorised signatory, principal place of business, additional premises (if applicable), bank information and other requested fields.
- Add the service. Describe the accommodation activity in the goods-and-services section using the service option that matches your homestay, hotel or guest-house operation. Do not add a different activity merely because it appears in a booking package; ask for advice if you supply food, transport or other services separately.
- Upload the generated documents. Attach premises proof, identity and authorisation documents, photographs, signatures and any other files shown in the portal checklist. The exact list can differ by constitution and premises possession.
- Submit with the prescribed electronic verification or signature method. Complete the final verification available for your applicant type and retain the acknowledgement.
- Monitor the application. Use the portal’s tracking facility. If the officer issues a clarification notice, answer it within the stated period and upload the requested explanation or document.
- Download the certificate after approval. Once approved, download the GST registration certificate, note the GSTIN and display or use it on invoices and returns as applicable.
What to do if the application is queried
A clarification notice is not the same as a rejection. Read the exact question, identify the document or field that caused the query, and respond through the application record rather than starting a second application. Common practical causes include a mismatch between the PAN legal name and the application, unclear premises proof, an unauthorised signatory or an unreadable upload. Keep a dated copy of your response.
5. Apply separately for J&K Tourism registration
GST registration concerns indirect tax. Tourism registration confirms that the property is authorised under the J&K tourism-trade framework. Complete both tracks; neither certificate substitutes for the other.

Homestays and paying guest houses
J&K Tourism Order No. 89-JK(TSM) of 2022 contains “Procedural Guidelines for Registration of Homestay/Paying Guest Houses in the UT of J&K.” The guideline describes a homestay as a family business operated by the owner in the owner’s house, providing accommodation, or food and accommodation, to tourists. If your operation does not fit that description, ask the Tourism Department whether it belongs in a hotel, guest-house or another category before applying.
Hotels and guest houses
Hotels and guest houses follow the Tourism Department’s registration process under the J&K Registration of Tourist Trade Act framework. JanSugam lists a public service called Registration of Hotel/Guest House. The public-services notification identifies the Deputy Director (Registration) or the jurisdictional Assistant Director, Tourism, and states a 30-day stipulated service timeframe.
Documents, inspection, fees and renewals
The exact Tourism Department checklist, fee, inspection requirement, category standard and renewal obligation can vary by property type and district. Obtain the current checklist from your jurisdictional Tourism office or the relevant portal before submitting. Do not rely on a checklist prepared for another district or an older season, and do not assume that the GST portal’s upload list covers tourism documents.

6. How OTA bookings affect a below-threshold homestay
Many owners worry that listing on an online travel agency automatically forces GST registration. CBIC Circular No. 27/01/2018-GST addresses accommodation supplied through an electronic commerce operator by a person below the applicable threshold. It states that the platform supply, by itself, does not automatically make that below-threshold person registrable solely for that reason, and it describes the operator’s GST payment mechanism.

Apply that circular narrowly:
- First establish that the person is genuinely below the applicable threshold.
- Check whether another compulsory-registration trigger applies.
- Keep OTA statements, booking records, cancellations and payout records so the PAN-based turnover can be reconciled.
- Review the OTA’s current tax-collection, invoice and onboarding rules separately; a platform’s commercial requirements are not the same thing as a statutory GST registration test.
- If you register voluntarily, tell the platform and configure invoices and tax details consistently with the GSTIN.
The circular does not waive J&K Tourism registration, local operating permissions or foreign-guest reporting duties.
7. Foreign guests: a separate Form C duty
Tourism and immigration reporting is distinct from GST. Directorate of Tourism Jammu guidance states: “Any Hotel/ Guest House/ Dharmashala/Individual House … who provide accommodation to foreigner(s) must submit the details … in Form C … within 24 hours of the arrival.” If you host a foreign guest, set a procedure for collecting the required details and submitting Form C within that 24-hour window. Do not treat a GST certificate as proof that this reporting has been completed.

| Turnover below the cited J&K threshold, direct bookings only, no other trigger | Registration may not be mandatory; verify the current threshold and facts. | Complete the applicable J&K Tourism registration. | Daily tariff, invoices or receipts, bank records and annual PAN-based turnover calculation. |
| Below threshold but bookings arrive through an OTA | OTA use alone is not automatically a registration trigger under Circular No. 27/01/2018-GST; check other triggers. | Tourism registration remains separate. | OTA statements, payouts, cancellations, guest records and turnover reconciliation. |
| Turnover exceeds the applicable threshold | Apply online; the cited CBIC FAQ says a liable person should apply within 30 days after liability arises. | Maintain tourism approval and any local requirements. | Turnover calculation showing the date liability arose, application acknowledgement and certificate. |
| Owner elects voluntary GST registration | Apply through the same portal process and plan for ongoing invoices and returns as applicable. | Tourism registration is still required where applicable. | Written decision record, rate analysis, invoices and return-supporting records. |
| Foreign guests are accepted | GST position depends on turnover and other triggers. | Submit Form C within 24 hours of arrival as described by Directorate of Tourism Jammu guidance. | Guest identity and arrival information, Form C submission evidence and booking record. |
9. A practical compliance calendar
Before opening or relaunching
- Confirm the PAN-based turnover position and check the current threshold or notifications.
- Decide whether direct and OTA bookings will be handled under the same books and bank account.
- Obtain the current Tourism Department category and document checklist.
- Set the room tariff and identify whether each unit is at or below INR 7,500 per day or above it for the applicable rate period.
- Create an invoice and receipt format that can show the legal name, GSTIN if registered, taxable value and tax split required for your circumstances.
Each month
- Reconcile direct bookings, OTA statements, refunds and bank credits.
- Update the aggregate annual PAN-based turnover calculation.
- Review tariff changes that could move a unit across the INR 7,500 per-day rate line.
- Save copies of invoices, supporting documents and portal correspondence.
Whenever a foreign guest arrives
- Collect the information needed for the Form C submission.
- Submit it within 24 hours of arrival under the Directorate of Tourism Jammu guidance.
- Retain evidence of submission with the booking file.
10. Mistakes that delay registration
Using the wrong turnover figure
Do not count only cash received at the property or only the amount paid out by an OTA. Reconcile gross booking records, refunds and other supplies, then document the basis used for the aggregate PAN-based calculation.
Assuming the GST certificate is the tourism licence
A GSTIN answers a tax-registration question. It does not certify a homestay, hotel or guest house under the J&K Tourism Department. Submit the tourism application separately and follow its inspection, fee and renewal instructions.

Uploading a generic document set
The portal creates a checklist based on the applicant and premises. Uploading an irrelevant file while omitting the property-specific proof can create a clarification. Generate the list first, then label files clearly and keep copies.
Applying an old rate without checking the year
The 12% and 18% figures come from the cited CBIC rate table. Verify later notifications and the correct CGST/UTGST treatment before invoicing a current stay.
Ignoring the 30-day timing rule
The cited CBIC FAQ says a liable person should apply within 30 days after liability arises. Track the date your facts crossed the applicable line and do not wait until the end of the tourist season.
11. When professional help is worthwhile
Consider a GST practitioner or chartered accountant who regularly handles J&K accommodation businesses when ownership is shared, the PAN has several activities, the property supplies meals or other services, rooms cross both tariff bands, or an officer sends a clarification notice. Ask the professional to state what is included: threshold analysis, application preparation, response to notices, invoice design, return support and coordination with Tourism Department requirements are different services. Fees and program availability are not established here, so obtain a written scope and quote before engaging anyone.
12. Final filing checklist
- Current threshold and compulsory-registration review completed.
- PAN, legal name, constitution and authorised-signatory details match.
- Principal-place-of-business proof is current and readable.
- TRN is saved and the Part B application is complete.
- Accommodation service and tariff records are ready for the rate analysis.
- Electronic verification or signature is completed and acknowledgement retained.
- Clarification notices are monitored and answered on time.
- GST certificate and GSTIN are downloaded after approval.
- J&K Tourism homestay, hotel or guest-house application is filed separately.
- Form C procedure is ready if foreign guests will be accepted.
The practical sequence is therefore: verify the current J&K threshold, gather property-specific documents, submit the GST application at gst.gov.in, and complete the separate Tourism Department registration. Keep the OTA circular, tariff evidence and guest-reporting procedure in your records so a platform booking or foreign arrival does not create an avoidable compliance gap.
