To recover an unpaid loan to a partner, first prove the money was a loan rather than a gift, calculate the balance, send one clear written demand with a firm deadline, and then use the correct court or other civil process if payment does not arrive. Your options, limitation period, filing ceiling, interest rules, and enforcement methods depend on the country, state or province, and sometimes the agreement’s governing-law clause.
Start by identifying what you actually lent
A romantic partner, spouse, former partner, or domestic partner may describe a transfer differently from you. Courts generally look at the parties’ objective evidence: Was repayment expected, and can you show the terms? A shared household, affectionate messages, or the fact that you trusted the person does not by itself turn a transfer into a loan. Conversely, the absence of a formal contract does not automatically make recovery impossible.

Separate the money into individual transactions. A transfer for rent, a gift for a birthday, a contribution to jointly owned property, and an advance that was to be repaid are legally different. Make a schedule for each advance instead of treating every payment between you as one debt.
Evidence that supports a loan
- A signed loan agreement or promissory note naming the parties, principal, repayment date, installments, and any permitted interest.
- Messages or emails using words such as “loan,” “borrow,” “repay,” “due,” or “I will pay you back.” Context matters; a message saying “thanks for helping with the house” is weaker than an acknowledgment of a specific balance.
- Bank or payment-app records showing the amount, date, recipient, and account used.
- A due date, repayment schedule, or later messages acknowledging that the debt remains outstanding.
- Partial repayments. Even small payments can help show that both people treated the transfer as debt, although local limitation rules can make the legal effect of a payment significant.
- Invoices, receipts, or documents showing that you paid a creditor on the partner’s behalf with an agreement that the partner would reimburse you.
- Witnesses who personally heard the agreement or saw a written acknowledgment. A witness who only knows that you were upset about nonpayment usually adds little proof of the loan terms.
The South African Department of Justice and Constitutional Development identifies a contract, acknowledgment of debt, or promissory note as documents that can support a small-claims case. That is a useful illustration of the kind of proof a court may value, not a rule that applies everywhere.

Evidence that can point toward a gift
- Messages calling the transfer a present, contribution, support, or “no need to pay me back.”
- A pattern of similar transfers to the partner or household with no requests for repayment.
- No due date, no repayment discussions, and no record of the partner acknowledging a balance.
- Money used for an expense that both parties treated as a shared relationship cost, unless you can show a separate reimbursement agreement.
Do not edit, delete, or selectively crop messages. Preserve complete conversation threads, original files, transaction statements, and the dates on which they were created. Keep a private chronology while events are fresh; it can help you explain gaps without changing the underlying evidence.
Calculate the balance before asking for payment
Use a simple ledger. For every advance, record the date, amount, purpose, payment channel, and evidence reference. Subtract every payment received, including cash or payments made directly to a creditor for your benefit. State whether the result is principal only or includes contractually permitted interest.
| Ledger item | What to record | Why it matters |
|---|---|---|
| Advance | Date, amount, recipient and transfer reference | Shows the principal actually delivered |
| Agreed terms | Due date, installments, interest and permitted fees | Defines what was payable and when |
| Credits | Date and amount of each repayment or offset | Prevents an inflated demand |
| Balance | Principal less credits, plus only lawful or agreed additions | Gives the demand and any claim a precise figure |
Do not add a late fee, collection charge, or interest merely because payment is overdue. The Federal Trade Commission’s text of the Fair Debt Collection Practices Act states that interest, fees, or expenses may be collected only when expressly authorized by the agreement or permitted by law. That provision directly governs covered debt collectors, while contract and local law govern many private disputes; either way, unsupported additions can undermine your credibility.
Send one factual demand with a deadline
A written demand creates a final opportunity to resolve the matter and gives you evidence that you tried to settle it. Send it through a method that produces a delivery record, and keep the letter, attachments, receipt, and any response together. Use a neutral tone. A demand is not a place to discuss the relationship, assign blame, or threaten consequences you cannot lawfully take.
What the demand should contain
- Identify the parties and the date or dates on which the money was advanced.
- State the original total, each credit for repayment, and the current balance.
- Describe the agreed repayment terms and identify any term that was never fixed.
- Give a specific deadline and a payment method or account.
- Offer a written repayment-plan discussion if a lump-sum payment is unrealistic.
- State what you will do if the deadline passes, such as filing in the appropriate civil court, without claiming that a lawsuit has already been filed.
- Request that any dispute about the amount or loan status be explained in writing by the deadline.
The South African Department of Justice and Constitutional Development’s 2025 small-claims guide recommends a letter of demand that states the amount and facts, allows 14 days to settle, and is accompanied by proof of delivery. A 14-day period is an example from that guide, not a universal deadline. Your local pre-action rules, contract, or court procedure may require a different period.

Subject: Demand for repayment of personal loan
On [date], I advanced [currency and amount] to you as a loan. The agreed repayment terms were [terms]. You have paid [credits and dates]. The balance now due is [currency and amount].
Please pay the balance by [deadline] to [payment instructions]. If you dispute the loan, the amount, or the credits shown above, send the factual basis and supporting documents by the same deadline. If payment or a written resolution is not received, I may use the civil process available in the appropriate jurisdiction, without further notice where the rules permit.
This letter does not waive any rights or add interest or fees not authorized by our agreement or applicable law.
[Your name and contact details]
Send one complete demand rather than a stream of emotional messages. Repeated contact can create harassment allegations, damage negotiations, and complicate any later account of what was agreed.
Offer a written repayment plan when it improves the chance of recovery
A plan can preserve a relationship and produce money sooner than a lawsuit, but it should not be an informal promise made over chat. Put the agreement in a document that both parties accept and keep proof of acceptance.
Terms to include
- The confirmed principal and current balance.
- Each installment amount, exact due date, and payment method.
- Whether an early payment is allowed and how payments are credited.
- What happens after a missed installment, including any cure period.
- Whether the plan replaces the earlier schedule or merely extends it.
- Whether a discounted amount is full and final settlement, and the date on which that release takes effect.
- Any security or guarantor, only if legally valid and actually provided.
Do not sign a release or describe a discounted payment as “full and final” until the money has cleared, unless you intentionally accept that risk. Conversely, do not promise to suspend legal rights indefinitely without checking the effect on the limitation period. A new acknowledgment or token payment may affect limitation in some places, so obtain local advice before accepting one solely to “keep the account alive.”
Choose the escalation route after the deadline
The best route depends on the amount, evidence, relationship, location, and whether the partner has assets or income from which a judgment could be collected. A judgment establishes liability; it does not guarantee that money can be recovered.
| Route | Strengths | Costs and risks | Questions to check |
|---|---|---|---|
| Informal plan | Fast, inexpensive and least damaging to the relationship | Depends on voluntary compliance; weak wording may be hard to enforce | Will the partner sign a clear acknowledgment and make affordable payments? |
| Formal demand or lawyer letter | Signals seriousness and can correct a disputed balance | Professional fees; wording must fit local law | Is a lawyer required or useful for the amount and complexity involved? |
| Small claims | Usually simpler and less expensive than a full civil action | Monetary ceiling, service rules and evidence limits apply | Which court has jurisdiction, what is the filing limit, and how must the partner be served? |
| Ordinary civil lawsuit | Can handle amounts or issues outside small-claims jurisdiction | More formal pleadings, time and legal expense | Can you prove the contract and afford the process if the partner defends? |
| Collection agency | May handle repeated follow-up after a judgment or assigned debt | Fees, acceptance policies, regulatory limits and relationship consequences | Will it accept a single private loan, and what authority and documentation does it require? |
Before filing, confirm the borrower’s legal name, current address, venue, filing fee, service method, monetary ceiling, pre-action requirements, and whether interest or costs are recoverable. Procedures described online for one country are not automatically valid in another.

How a small-claims or civil filing generally works
- Identify the proper defendant and venue. Use the legal name, not a nickname. Venue may depend on the borrower’s residence, where the agreement was made, where payment was due, or a contract clause.
- Check the limitation period. A claim filed after the deadline can be dismissed even when the debt is genuine.
- Prepare the claim and evidence. Attach or organize the agreement, messages, ledger, bank records, demand, delivery proof, and responses. Arrange them chronologically and label each item.
- File and pay the required fee. Keep the stamped claim, case number, and payment receipt.
- Serve the partner exactly as required. Filing alone is not notice. A defective service can delay or invalidate the case.
- Attend every conference, mediation, or hearing. Bring originals or admissible copies and a concise explanation of how the balance was calculated.
- Request judgment for the amount actually proved. Ask for interest and costs only when authorized.
The South African Department of Justice and Constitutional Development’s 2025 guide gives a R20,000 small-claims limit. That figure is specific to the guide’s South African process and should not be used as a general small-claims limit elsewhere. Another official South African directory describes enforcement of acknowledgments and promissory notes, illustrating why the document’s form can matter in that jurisdiction.
Check limitation rules before waiting or restarting negotiations
Limitation law determines how long you have to sue, and the clock may run from the due date, a demand, the last payment, or another event depending on local law and the type of agreement. The U.S. Federal Trade Commission and Consumer Financial Protection Bureau both explain that the period depends on the debt type, state law, and sometimes the contract’s governing-law clause.
In some U.S. states, a payment or written acknowledgment can restart the period. The CFPB advises that, before making a payment or agreeing to a plan on an old debt, you should find out the statute of limitations for filing suit. That warning matters to both sides: a borrower can unintentionally revive a claim, while a lender can mistakenly assume that negotiations stopped the clock.
Do not rely on a general internet deadline. Check the law where the case would be filed and the law selected by the agreement, if any. If the deadline is close, consult a local lawyer before sending a new acknowledgment, accepting a token payment, or waiting for another promised date.
Use debt-collection rules carefully
Rules written for professional debt collectors do not automatically apply to every person asking a partner for repayment. The U.S. Fair Debt Collection Practices Act’s validation provisions apply to covered debt collectors and require specified information within five days after the initial communication. A written dispute sent within 30 days triggers the collector’s verification duties under 15 U.S.C. § 1692g. Those five-day and 30-day periods are federal statutory deadlines for covered collections, current through 2026; they are not a universal timetable for a private lender’s personal message.

If you hire an agency, ask whether it is licensed where the borrower lives, whether it accepts a single private loan, what percentage or fixed fee it charges, and what documents it needs. Give the agency an accurate balance and the communication history. Do not instruct it to use threats or public pressure.
Conduct that can create legal trouble
- Do not threaten arrest, imprisonment, eviction, or other consequences that do not legally follow from nonpayment.
- Do not claim that a lawsuit has been filed, a warrant exists, or a judgment has been entered when that is untrue.
- Do not publish the debt, contact an employer or relatives to shame the borrower, or disclose private messages online.
- Do not repeatedly call, message, or visit after the person has asked you to stop, especially at work or at home.
- Do not misrepresent the balance, add unauthorized fees, or conceal credits for payments already made.
Federal Trade Commission guidance warns that collectors cannot claim a person will be arrested or threaten legal action if it is untrue. Even when a private lender is outside that federal statute, truthful, proportionate communication is the safer standard.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. If your partner sues you or you receive court papers
Do not ignore service. The FTC’s consumer guidance is direct: “Don’t ignore a lawsuit.” Read the summons for the response deadline, court, case number, and required method of response. File a written answer or appear as instructed, even if you believe the debt is too old or the amount is wrong.
Check that the claimant has the legal right to sue, that the named defendant is correct, that the calculation credits every payment, and that the claim is filed within the limitation period. The CFPB warns that a time-barred claim can still result in a judgment if the defendant does not appear and raise the limitation defense. Bring proof of gifts, payments, a different agreement, fraud, lack of authority, improper service, or any other defense recognized by local law.

Plan for collection after a judgment
A court order is not the same as cash. Before investing in litigation, make a realistic assessment of collectability. Consider whether the partner has regular income, a bank account, vehicles, real property, or other reachable assets, and whether those assets are jointly owned, exempt, pledged to someone else, or located in another jurisdiction.

Post-judgment tools vary widely but may include an installment order, wage or account garnishment, a lien, a writ against nonexempt property, or examination of the debtor’s finances. Each tool has forms, exemptions, notice rules, and fees. Never seize property yourself or threaten an employer; use only the procedure authorized by the issuing court.
If the partner is insolvent, has no reachable assets, or is likely to move, a settlement paid voluntarily may produce more than a judgment that cannot be enforced. That practical calculation is separate from whether your legal claim is valid.
Protect yourself while preserving the relationship where possible
Keep loan discussions separate from arguments about commitment, household chores, or access to shared accounts. Use one written channel for the debt and avoid withholding jointly owned property or essential documents as leverage. If you live together, check whether a proposed repayment schedule affects rent, utilities, childcare, or other obligations that are legally separate from the loan.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsIf the relationship ends, update your records with the partner’s legal address and preserve evidence before accounts or devices are closed. If you are married or in a civil union, property-division, support, and family-court rules may affect how the debt is treated; a small-claims court may not be the correct forum for every dispute between spouses.
A decision checklist
- Can you show that each disputed transfer was a loan and not a gift?
- Do your bank records, messages, agreement, and ledger produce one consistent balance?
- Have you credited every payment and excluded unauthorized interest or fees?
- Have you sent a factual demand with proof of delivery and a lawful deadline?
- Have you checked the limitation period before accepting a new promise or payment?
- Do you know the correct venue, filing ceiling, fee, service method, and pre-action rule?
- Is the partner likely to have assets or income from which a judgment can be enforced?
- Can you communicate without threats, public disclosure, harassment, or false legal claims?
- Would a signed installment plan recover money faster and at lower cost than litigation?
If the answers support a genuine debt and a realistic recovery path, follow the written-demand and forum process in the jurisdiction that governs the transaction. If the evidence is mainly verbal, the deadline is uncertain, the amount is substantial, or the relationship includes shared property, obtain advice from a lawyer or qualified legal-aid service in the relevant location before filing.
