For an Indian Income Tax Department notice, the legally relevant response date is the date stated in the complete notice and its matching e-Proceeding—not a date inferred from an SMS, a generic internet article, or the issue date alone. Sign in to the official e-Filing portal, download the full notice PDF, identify its section and assessment year, compare it with the linked proceeding, and then submit through the route the notice specifies. There is no single number of days that applies to every direct-tax notice.
What a direct-tax notice is—and why the deadline cannot be guessed
A direct-tax notice is a formal communication from India’s Income Tax Department asking for information, an explanation, a payment-related action, or a response under a stated legal provision. The document may be connected to an online e-Proceeding, or it may fall within a limited class that can be answered through the portal’s pre-login Comply To Notice service.

The notice section controls the procedure. The assessment year or tax period controls which return, transaction, or records are being examined. The issue date and service date can affect how a period is counted, but the document or governing provision must tell you how. A general article cannot replace those case-specific instructions.

Start with the complete notice PDF
An SMS or email alert is only a prompt to check your account. It is not a reliable substitute for the notice itself. The Income Tax Department’s e-Proceedings manual directs users to open the notice from the relevant proceeding and download the document. Read every page, including annexures and instructions about attachments.
Record the identity of the notice
At the top of the document, write down the details that distinguish this proceeding from every other communication:
- the issuing authority or office;
- the notice type and the section of the Income-tax Act cited;
- the assessment year or tax period;
- the notice reference and DIN, if shown;
- the issue date and, where stated, the service date; and
- the taxpayer, PAN or other identifier to which the notice relates.
A notice reference is especially important when several communications concern the same year. Do not answer an older or unrelated proceeding just because its subject appears similar.

Translate the request into a task list
Mark the exact action requested. A notice may ask for a written explanation, a response to a proposed adjustment, supporting records, confirmation of a transaction, or a response to a show-cause question. Note whether the document requires a particular file type, a maximum attachment size, a signed statement, or separate answers to numbered questions.
Separate facts you must provide from conclusions you may need to explain. For example, “upload bank statements for the period” is a document request; “explain the source of the credit” calls for a factual narrative supported by records. Keeping those tasks separate reduces the chance that an attachment is uploaded without answering the question in the notice.

Locate every date and label it
Look for wording such as response due date, reply by, or a date in the response instructions. Also note any issue date, service date, hearing date, or period described as a proceeding limitation date. Do not silently substitute one for another.
If the notice says that a period is calculated from issue or service, follow that wording and the cited provision. If it gives a calendar date, treat that date as the working deadline unless the authority confirms a correction or extension. The absence of a date in a summary message does not mean that no deadline exists.
Match the PDF to the online e-Proceeding
After reading the PDF, open the corresponding e-Proceedings record in your logged-in e-Filing account. The Department’s materials describe proceeding details that can include the notice reference, section, issue and service dates, and response due date. Use the proceeding tied to the notice you read; do not choose a different item with a similar subject.
- Open the proceeding record. Confirm that the taxpayer identity, notice reference, assessment year or tax period, and section match the PDF.
- Inspect the notice details. Compare the issue date, service date, stated due date, and any proceeding status or limitation date.
- Open or download the portal copy. Make sure the file is complete and that annexures or embedded instructions are available.
- Check for a response action. The proceeding should show the facility for submitting a response when the authority has enabled it.
- Save a record of the displayed dates. Keep a screenshot or downloaded copy with the notice reference, while preserving the original PDF.
The e-Proceeding FAQ gives a specific warning: “If there is no Proceeding Limitation date, the Income Tax Authority can close the e-submission option.” That warning means a missing portal field is not a safe assumption that the matter is open indefinitely. If the response action is absent, disabled, or inconsistent with the PDF, seek clarification promptly.
How to find the response deadline without making a false assumption
Use the date hierarchy
Work through the dates in this order:
- Use the explicit response due date in the complete notice, if one is stated.
- Confirm that the same proceeding displays a matching due date or response limitation.
- Read the cited section and any instruction explaining whether the period runs from issue, service, or another event.
- If the dates conflict, do not pick the earlier or later date by guesswork. Treat the matter as urgent and ask the issuing authority or a qualified Indian tax professional which date governs.
Issue and service dates are not interchangeable. A notice can be generated on one date and served on another, and the governing provision may use only one of them. The notice’s own calculation instruction and the applicable section control.

Understand the section 148A example
For a show-cause notice under section 148A, the official statutory text describes a period of at least seven days and not more than 30 days from the date of issue, with an extension possible. The range is a legal boundary for that provision, not a promise that every section 148A notice will allow the same number of days. The individual notice may state the precise date and any extension arrangement.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsDo not calculate from an SMS or a generic article
A message saying that a notice is available may arrive before you have opened the document, and a website may describe a different section or an older procedure. Neither establishes your deadline. Calculate only after identifying the notice section and reading the notice and proceeding attached to your account.
Choose the response route shown for your notice
| Situation | Route | Important limitation |
|---|---|---|
| The notice appears in a logged-in proceeding | Open the notice PDF in e-Proceedings and use Submit Response. | Follow the fields and attachment instructions for that proceeding, then retain the transaction ID and confirmation email. |
| The notice is eligible for the pre-login service | Use Comply To Notice, enter the complete DIN, complete the validation, and submit the requested response. | The service is limited to specified notice classes, including certain notices not linked to PAN or TAN and eligible section 133(6) notices. It does not provide adjournment and a submitted response cannot be edited. |
| The deadline or proceeding status is missing or unclear | Check the original notice and portal record, then contact the issuing authority or a qualified Indian tax professional. | A missing portal date is not proof that no deadline exists, and the authority may close e-submission when no Proceeding Limitation date is present. |
The Income Tax Department describes Comply To Notice as “a pre-login functionality given to the assessee, on the income tax portal, to submit response to the notices issued.” That label does not make the service universal. Confirm that your notice is eligible before entering a DIN or uploading documents there.
Submit a response through logged-in e-Proceedings
Once you know which proceeding and deadline apply, prepare the response before opening the submission screen. Use a folder containing the notice PDF, a copy of the relevant return or computation, and the records that answer each numbered request.
- Open the matching e-Proceeding. Verify the notice reference, section, year or period, and taxpayer details one more time.
- Select Submit Response. Read the on-screen declaration and any instructions about mandatory fields, file formats, and attachment limits.
- Answer every requested item. Use the notice’s numbering where practical. State the relevant fact, identify the supporting document, and explain any item you cannot provide.
- Attach supporting material. Use clear file names that identify the document and period. Do not upload unrelated records that obscure the answer.
- Review before sending. Check that the response is attached to the correct assessment year and section, that files open correctly, and that the contact email shown by the portal is current.
- Submit and wait for confirmation. Do not close the session merely because an upload appears complete; wait for the portal’s submission result.
- Record the transaction ID. The e-Proceedings manual states that a successful submission generates a transaction ID and confirmation to the registered email.
- Use View Response. Reopen the proceeding’s response view and confirm that the text and attachments displayed are the ones you intended to file.
Keep the final response package exactly as submitted, together with the transaction ID, confirmation email, notice PDF, and a note of the submission time. Those records help establish what was sent if the portal later displays a different status.

Using Comply To Notice before login
Comply To Notice is a separate pre-login route, not a replacement for e-Proceedings. The FAQ describes it for specified cases. The eligibility examples include certain notices that are not linked to PAN or TAN and eligible notices under section 133(6).
- Check the notice instructions and confirm that the notice class is supported by Comply To Notice.
- Enter the complete DIN exactly as printed. A partial or mistyped DIN will not validate the notice.
- Complete the portal’s validation steps and review the notice information returned.
- Provide the requested response and attachments in the fields shown.
- Save the acknowledgement or transaction details after submission.
This route has two material restrictions. The FAQ says that it does not offer adjournment, and a response already submitted through it cannot be edited. Another response may be submitted only while the proceeding remains open and has not been blocked or closed. If you discover an error, do not assume that an edit button or automatic correction is available; check the proceeding status and contact the appropriate authority promptly.

Missing from the PDF
Compare the PDF with the online proceeding and read the section cited in the notice. If neither provides a usable date, contact the issuing authority as soon as possible and keep evidence of that attempt. A qualified Indian tax professional can help interpret the governing provision, especially where a reply could affect assessment, reassessment, or a proposed demand.
Different in the PDF and portal
Do not submit to the wrong proceeding and do not rely on a casual calculation. Preserve both versions, note the notice reference and the dates displayed, and ask which instruction controls. If time permits, submit a clarification request through the channel the notice identifies; if not, obtain professional advice immediately about protecting your position.

The deadline is imminent
Prioritize a complete, accurate response to the questions actually asked. Do not delay filing while assembling unrelated records. Explain any unavailable document and identify when it can be supplied, but do not promise an extension unless the authority confirms one. The general portal guidance does not establish a universal extension or cure for a missed or unclear date.
How to check whether a notice is genuine
Open the official e-Filing portal directly rather than using a link in an unexpected message. A genuine portal record should identify the taxpayer, notice reference or DIN where applicable, section, assessment year or period, and the issuing authority. Match those details with the PDF and the e-Proceeding.
For a notice handled through Comply To Notice, enter the complete DIN only on the official service and verify that the returned details correspond to the document you received. If no matching record appears, or the document asks you to use an unrelated payment or communication channel, stop and seek confirmation from the Income Tax Department or a qualified professional before disclosing information.
Common mistakes that can cost time
- Reading only the SMS. The alert does not contain the full request, legal section, or reliable due date.
- Using the wrong year. A response attached to another assessment year may not answer the live notice.
- Counting from the wrong date. Issue and service dates can differ, and the governing provision may specify which one starts the period.
- Assuming every notice allows the same number of days. The section 148A range cannot be generalized to other notices.
- Choosing Comply To Notice automatically. The pre-login service is limited to specified notice classes.
- Submitting without retaining proof. A transaction ID, confirmation email, and portal view of the filed response are the core records identified by the e-Proceedings manual.
- Expecting to edit later. Comply To Notice does not provide editing of a submitted response; another response is possible only while the proceeding remains open.
- Waiting because the portal shows no limitation date. The authority may close the e-submission option when that date is absent.
A practical deadline-and-response checklist
- Open the complete notice PDF from the official account or the eligible official service.
- Record the authority, notice reference, DIN if shown, section, assessment year or period, issue date, service date, and stated due date.
- List every question, document request, format requirement, and declaration.
- Open the matching e-Proceeding and compare its details and response dates with the PDF.
- Check whether a Proceeding Limitation date and an active response action are displayed.
- Confirm whether the notice belongs in logged-in e-Proceedings or qualifies for Comply To Notice.
- Prepare a numbered answer and attach only relevant, readable records.
- Submit before the stated deadline when possible and wait for the portal confirmation.
- Save the transaction ID, confirmation email, submitted files, and the result shown by View Response.
- If anything is missing, inconsistent, blocked, or high-stakes, contact the issuing authority or a qualified Indian tax professional immediately.
What the deadline really means
The deadline is a case-specific instruction tied to a particular notice, section, year or period, and response channel. The safest process is therefore documentary: read the whole PDF, verify it against the matching e-Proceeding, follow the route named for that notice, and preserve proof of what you submitted. Only the cited provision and the individual notice can establish the exact calculation and any available extension.
