You can challenge a condo board’s decision without attacking a director’s character. The safest approach is to describe one identifiable event, distinguish documents and observations from assumptions, send the concern to the people responsible for addressing it, and request a specific response. Keep circulation limited and use the condominium’s formal processes before turning to a public accusation.
Ontario has several defined routes, including contacting the manager, writing to the board, requesting an owners’ meeting, raising the matter at an annual general meeting, requesting records, and using the Condominium Authority Tribunal for eligible disputes. The procedure and defamation law differ elsewhere, so owners outside Ontario should check their statute, declaration, bylaws, rules, and dispute-resolution body.

Start with a precise governance question
A useful complaint identifies the decision, event, repair, charge, rule, or communication that needs attention. “The board is corrupt” is a broad conclusion about people. “The minutes dated 14 March record approval of a $12,000 contract; section 7 of the procurement policy appears to require two quotations, and I cannot find them in the records provided” gives the board something verifiable to answer.

Before writing, reduce the issue to one sentence that does not assign a motive. Examples include:

- “I am asking how the board applied the visitor-parking rule on 6 May.”
- “I am asking whether the emergency-repair exception in the declaration was used for this invoice.”
- “I am asking when the water-damage repair approved in the minutes will be completed.”
- “I am asking whether owners were given the notice required before this rule change.”
If several unrelated problems exist, make separate requests or clearly numbered sections. A focused message is easier to investigate and less likely to turn into an argument about personalities.
Separate what you know from what you infer
Use labels in your notes and draft:
- Observed: what you personally saw or heard, with the date, time, and location.
- Documented: what a notice, invoice, email, rule, contract, or meeting minute says. Quote only the relevant passage and identify the document.
- Reported: what another person told you. Identify it as a report rather than presenting it as your own knowledge.
- Uncertain: what you cannot yet verify and want the board or manager to clarify.
That distinction prevents a suspicion from becoming an asserted fact. “I have not found the required notice” is materially different from “the board deliberately hid the notice.” Ask for the missing information instead of filling the gap with a motive.
Keep a dated file
Save the governing documents, notices, invoices, relevant emails, photographs, work orders, and your own chronology. Record when you sent each request and the response received. A contemporaneous file helps the board understand the sequence and lets you identify a process failure without relying on memory.
Recommended Free Tools
Do not collect or distribute personal information that is irrelevant to the issue. If a document contains another owner’s private details, request an appropriate redaction or summary rather than circulating the unredacted copy.
Choose a channel that matches the problem
In Ontario, the government identifies four initial ways to raise a concern: speak with the condominium manager, write to the board requesting formal consideration, request an owners’ meeting, or raise the matter at the annual general meeting (AGM). The Condominium Authority of Ontario (CAO) also identifies records requests and the Condominium Authority Tribunal (CAT) for disputes within its jurisdiction. See Ontario’s owning-a-condo guidance and the CAO’s What Owners Do page.
| Route | Typical recipient or forum | Written record | What it can accomplish | Eligibility, cost, or timing |
|---|---|---|---|---|
| Conversation with management | Condominium manager or management office | Not necessarily; follow up in writing | Clarifies facts, service requests, maintenance status, or the next administrative step | Specific timelines and outcomes are not stated in the official guidance; check the management agreement and governing documents |
| Written request to the board | Board through the designated email or delivery method | Yes, if retained and acknowledged | Places a defined issue before the directors for consideration and creates a dated record | Use the notice and submission rules in the declaration, bylaws, rules, or board policy |
| Owners’ meeting request | Owners and the board under the condominium statute and governing documents | Yes, through the requisition and meeting materials | Allows owners to discuss a matter and seek a formal decision or direction | Requisition requirements, signatures, notice, and timing are jurisdiction-specific |
| AGM question or motion | Owners at the annual general meeting | Usually reflected in the agenda or minutes, subject to the meeting’s rules | Raises the matter in the condominium’s regular accountability forum | Agenda deadlines, voting rights, and permitted business depend on local law and documents |
| Records request | Corporation, manager, or records custodian | Yes, through the request and response | Tests what records exist and supplies evidence for a focused follow-up | Access rights, fees, response periods, exclusions, and redactions are set by applicable law |
| CAT application (Ontario) | Condominium Authority Tribunal | Yes, within the tribunal file | May provide a dispute-resolution route for matters within CAT’s jurisdiction | Not every condominium dispute is covered; check current CAT jurisdiction and procedure |
The official sources do not establish a universal response time, success rate, or cost for each route. Do not promise one. If a conversation does not resolve a specific service issue, a short written request usually creates the clearest next step.

Write a measured request to the board
Use a fact–rule–request structure
- Fact: identify the date, decision, document, or event.
- Rule or standard: identify the declaration, bylaw, rule, statute, policy, contract term, or promised service that you believe may apply. If you are unsure, say so.
- Request: ask for one identifiable action, such as an explanation, correction, records access, a meeting agenda item, or a review at the next meeting.
- Attachments: list the documents that support the question and label them accurately.
- Deadline or follow-up: use a reasonable date only where the governing documents or an urgent safety issue makes one appropriate.
Neutral wording is not vague wording. It can be firm about the outcome you need while leaving room for facts you do not yet have. “Please identify the approval authority and provide the relevant minutes” is stronger than “Please stop wasting owners’ money.”
Example letter
Subject: Request for clarification about the [date] [decision or event]On [date], the minutes record that the board approved [decision]. I am concerned that the decision may not follow [identified rule, policy, or process], because [specific document or event].
I may be missing information. Please:
- explain the basis for the decision;
- identify the rule or approval process relied on; and
- confirm whether the board will consider this at its next meeting.
I have attached [document names]. Please correct any factual errors in my understanding and advise how I may request any additional records available to owners.
Sincerely,
[Your name and unit]
The sample is a drafting model, not a legal safe harbor. Replace every bracketed item with a verifiable fact. Do not insert accusations of dishonesty, fraud, corruption, or unlawful conduct merely to make the letter sound forceful.
Ask for an answer the board can actually give
Questions about a process or record are usually more answerable than demands that a director “admit wrongdoing.” Consider asking:

- Which provision of the declaration, bylaw, rule, or statute was applied?

- Where can owners inspect the relevant contract, invoice, or minutes?
- Will the board place a review of this decision on the next meeting agenda?
If the issue is urgent—such as an active leak, electrical hazard, or threatened loss of essential service—state the immediate risk and the practical action required. Avoid exaggerating the risk or naming a person as its cause unless the evidence supports that identification.

Understand the defamation guardrails
The Canadian common-law starting point
Defamation rules depend on jurisdiction. In Canada, the Supreme Court’s decision in Grant v. Torstar Corp., 2009 SCC 61 describes three elements a plaintiff must prove in a common-law defamation action: the words are defamatory, they refer to the plaintiff, and they were published to at least one person other than the plaintiff. Read the decision at the Supreme Court of Canada.
“Published” in this context does not mean posted on a website or printed in a newspaper. Sending an allegation to another owner, a board member, a manager, or an employer can satisfy the communication component if the other elements are also present. Whether a statement is legally defamatory depends on its words, meaning, context, identification, and applicable defenses.
The Court recognized a responsible-communication defense for matters of public interest. Its formulation is: “The law of defamation should therefore be modified to recognize a defence of responsible communication on matters of public interest.” The defense is not an automatic pass for condo disputes. It considers whether the publisher was diligent in trying to verify the allegations and the relevant circumstances.
Why “in my opinion” is not enough
An opinion can imply underlying facts. “In my opinion, the treasurer stole the reserve fund” communicates an allegation of theft, not merely a personal preference. Labels such as “allegedly,” “I feel,” or “in my view” do not cure a statement that a reasonable reader would understand as asserting a damaging fact.
If you genuinely hold an evaluative view, tie it to disclosed facts: “Based on the invoice and the procurement policy, I am concerned that the process may not have been followed.” That still should be accurate and fair; it is not a guarantee against liability.
Limit the audience
Send the request to the manager, board, records custodian, meeting chair, or other person who can address the issue. Do not copy every owner, post in a building-wide chat, or publish on social media simply to increase pressure. Wider circulation can magnify harm, expose inaccuracies, and make a dispute harder to resolve. Share supporting documents only with people who need them for the stated process.

Do not repeat a rumor to “ask whether it is true.” Repeating the allegation may still communicate it. Instead ask for the underlying record or state that you have received an unverified report and want the proper process for checking it, without naming a person unless identification is necessary and supported.
When to obtain legal advice first
Get advice from a lawyer in your jurisdiction before publishing or sending a serious allegation that names an individual, especially an allegation of fraud, theft, corruption, harassment, criminal conduct, or regulatory wrongdoing. The same caution applies if someone has threatened a lawsuit, if you plan a public campaign, or if the issue is outside an administrative tribunal’s jurisdiction. A lawyer can assess local limitation periods, privileges, defenses, evidence, and the risks of the exact wording.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Use Ontario’s records and meeting processes intelligently
Request minutes without treating them as a transcript
The CAO says condominium meeting minutes should record basic meeting details, motions or votes, and short summaries of business. Owners may request minutes, subject to specified exceptions, including records relating to other owners and some litigation or insurance-investigation material. The CAO’s Meeting minutes guidance explains the content and access limits.
A minute can show that a motion was made and what was decided; it is not necessarily a word-for-word account of every discussion. If a minute is incomplete, ask what record is available and identify the exact gap. Do not infer from a short minute that a conversation never occurred.
Make a records request that can be processed
Name the record, date range, and subject. For example, request “the signed landscaping contract approved in the 18 April minutes and the invoice for work performed in May,” rather than “all documents about landscaping.” Ask whether electronic copies are available and accept lawful redactions. Keep the request separate from accusations so the custodian can process it without debating motives.

An owners’ meeting is appropriate when the concern requires owner discussion or a vote rather than an explanation from management. Follow the condominium statute and the corporation’s governing documents for the required wording, signatures, delivery method, notice, and agenda. A meeting request should state the business to be considered; it should not be a vehicle for circulating personal allegations.

Raise the issue at an AGM
Use the AGM for matters permitted by the agenda and meeting rules. Submit a concise question or motion through the stated process and bring the supporting document, not a stack of unrelated accusations. The chair may enforce time limits and relevance rules. If a decision is needed before the AGM, use the board or owners’ meeting route instead of waiting.
Consider CAT only for an eligible Ontario dispute
The CAO identifies the Condominium Authority Tribunal as an option for disputes within its remit. Jurisdiction is not universal; confirm that the subject, parties, and required pre-steps fit the current CAT rules. The CAO notes that issues outside CAT’s jurisdiction may call for legal advice. A tribunal application should present the documents, chronology, and remedy sought—not rhetorical claims about a director’s character.
If you are outside Ontario
Do not import Ontario’s routes or tribunal assumptions into another province, territory, state, or country. Check:

Common mistakes and safer replacements
| Risky approach | Why it creates trouble | More useful alternative |
|---|---|---|
| “The directors are lining their pockets.” | It alleges a serious dishonest motive without identifying evidence. | Identify the payment, approval, conflict-disclosure record, and rule that you want reviewed. |
| Forwarding an unverified story to all owners | It increases publication and may turn a rumor into an apparent fact. | Ask the records custodian or board for the underlying document through a limited channel. |
| Calling a decision “illegal” when you have not checked the governing document | The legal conclusion may be wrong and can distract from the process issue. | Say which provision may apply and ask the board to explain its interpretation. |
| Posting a director’s name and home details | It is unnecessary for governance and creates privacy and harassment risks. | Use the official board or management contact and identify only the unit or role needed to process the request. |
| Sending a long message covering every historical grievance | The immediate issue and requested remedy become unclear. | Send a numbered request for the present issue and keep a separate chronology for escalation. |
A practical pre-send checklist
- Can a reader identify the exact event, decision, document, or date?
- Have you marked each point as observed, documented, reported, or uncertain?
- Did you remove claims about a person’s motive or character that the evidence does not establish?
- Have you identified the rule, policy, contract term, or record that makes the question relevant?
- Is the requested response concrete and within the recipient’s authority?
- Are attachments necessary, accurate, and appropriately redacted?
- Are you sending the message only to people who need to address it?
- Have you checked the condominium’s notice, records, meeting, and escalation procedures?
- Would a lawyer in your jurisdiction review the wording before you make a serious allegation or public post?
A disciplined complaint can be persistent without being personal. It gives the board a fair opportunity to correct the record, explain its process, or put the issue before owners, while preserving your evidence and reducing avoidable publication risk.
