Build an evidence packet before you contact the mortgage servicer: a copy of the check or payment stub, the bank record showing the debit or a canceled-check image, the mortgage statement with the amount and due date, your dated USPS receipt, tracking history, and any delivery or attempted-delivery record. Send a written notice of error to the servicer’s designated error-resolution address—not necessarily the payment address—and keep paying later installments while the investigation is pending.

The key distinction is timing. Servicers generally judge whether a payment was timely by when they received it, not when you mailed it. Proof that you mailed before the due date can support your dispute, but it does not automatically prove timely receipt. Certified Mail can document mailing and delivery or an attempted delivery; Return Receipt adds a signature record; Certificate of Mailing proves only the date USPS accepted the item.

What actually proves a mailed mortgage payment?

No single document answers every question. The strongest file connects four events: you owed a specific amount, you sent that amount to the correct address, USPS recorded delivery or an attempted delivery, and your bank shows what happened to the check.

Evidence of the payment itself

  • A photocopy or scan of the front and back of the canceled check, if your bank provides one.
  • The payment stub or online bill-pay confirmation showing the mortgage account number and amount.
  • Your bank statement or transaction detail showing when the check cleared or the electronic debit occurred.
  • The mortgage statement or coupon showing the installment amount, due date, payment address and any grace-period language.

Evidence that you mailed it

  • The USPS receipt with the date and tracking number.
  • A retained envelope, mailing label or postmarked receipt showing the destination.
  • USPS tracking history showing delivery, an attempted delivery, or another dated scan.
  • A Return Receipt, in electronic or hardcopy form, showing the signature of the person who accepted the item.

Attach copies, not irreplaceable originals. Keep the originals, screenshots and downloaded PDFs in a dated folder, together with every letter and response from the servicer.

Mailing proof, delivery proof and receipt proof are different

These terms are often treated as interchangeable, but they establish different facts.

Record What it establishes What it does not establish
Certificate of Mailing The date USPS accepted the item for mailing. That the servicer received it or that the envelope contained your payment.
Certified Mail Proof you sent the item, plus a USPS delivery or attempted-delivery record. That the servicer posted the payment correctly after receipt.
Certified Mail with Return Receipt Certified Mail evidence plus a signature record for the person who accepted the mailing. That the signer had authority to apply the payment or that the amount was correct.
USPS Tracking without Certified Mail Dated scans that may show delivery or an attempted delivery, depending on the service used. A signature record or proof of the check’s contents.
Bank debit or canceled-check image That your bank paid or debited the instrument and can show the check number, amount and endorsement details. When the servicer received the envelope.

USPS describes Certified Mail as a way to “Prove you sent it,” see when it was delivered or that a delivery attempt was made, and obtain the recipient’s signature when Return Receipt is added. A Certificate of Mailing is cheaper but records only presentation to USPS. In 2026, USPS lists a $5.55 retail price for Certified Mail and $2.45 for Certificate of Mailing; postal prices can change, so verify the current amount when you mail.

Receipt date versus postmark date

Under the Consumer Financial Protection Bureau’s mortgage-servicing guidance, a servicer generally assesses timeliness by the date it receives the payment. Mailing a check before the due date therefore does not guarantee that the account will be credited on time. The servicer can generally charge a late fee if it receives the payment after the due date, even when you mailed it on time.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The reverse situation matters just as much: if the servicer received a conforming payment by the due date but posted it later, a late fee is generally inappropriate. Your tracking record, delivery signature or attempted-delivery scan can help establish when the payment reached the servicer’s designated location. Your bank record helps show that the check was actually funded, while the mortgage statement establishes the amount and date that were required.

What “conforming payment” means in practice

A payment can be delayed or rejected when it omits required information, is sent to the wrong address, is for less than the amount due, or otherwise fails the servicer’s stated payment instructions. Compare the address, account number, amount and any coupon requirements on the statement you used. If the servicer has separate instructions for overnight payments or payoff amounts, those instructions may not apply to an ordinary monthly installment.

Reconstruct the missing payment before calling

Write a one-page chronology while the details are available. Record:

  • Mortgage account number and property address.
  • Check number or other payment identifier.
  • Payment amount and the installment due date.
  • Date the check was signed and date it was placed in the mail.
  • Exact payment address printed on the statement or coupon.
  • USPS service, receipt number and every tracking event.
  • Date the bank debited or paid the check, if it cleared.
  • Dates and names of every conversation with the servicer.

Save the front and back of the canceled check when available. The endorsement, deposit stamp or electronic image can reveal whether the servicer or a lockbox received it. If the check has not cleared, your bank statement still shows that you issued it, but it does not prove delivery.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check the servicer’s rules and addresses

Use the most recent monthly statement, coupon book or servicer website to confirm the payment address. Then locate the separate address designated for “notices of error” or other error-resolution correspondence. Regulation X allows a servicer to designate an address for these notices, and it may differ from the address printed for payments.

Do not write your dispute on the payment coupon or place the notice only in the payment envelope. A notice sent to the wrong location can delay or defeat the special response process. If the statement is unclear, call the servicer and ask for the exact error-resolution address, then document the date, representative’s name and instructions you received. Send the notice separately from any regular payment.

Step-by-step dispute workflow

  1. Assemble the packet. Put the mortgage statement, check copy or stub, bank debit record, USPS receipt, tracking printout, delivery or attempted-delivery record, and your chronology together. Number the pages so the servicer can follow the sequence.
  2. Identify the alleged error precisely. State whether the payment was not accepted, not credited, credited late, applied to the wrong account, or followed by an improper fee. Regulation X covers failure to accept a conforming payment, failure to apply an accepted payment, failure to credit as of receipt, unreasonable fees and other servicing errors.
  3. Prepare a written notice of error. Include your name, property address, mortgage account number, payment amount, payment date, mailing address, USPS service and tracking number, and the correction you want.
  4. Send it to the designated address. Use a trackable mailing service and retain the receipt and delivery record. Keep a complete copy of the signed letter and every enclosure.
  5. Calendar the response dates. The servicer generally must acknowledge receipt within five days and provide a substantive response within 30 days, excluding weekends and legal public holidays. A written 15-day extension may be available in some circumstances.
  6. Continue scheduled payments. A notice of error requires an investigation; it does not cancel later installments or create a payment holiday. Pay future amounts as directed while the dispute is pending, and keep proof of those payments.
  7. Review the written response. Check whether the servicer corrected the posting date, removed the late fee, applied the payment to the right account and supplied the explanation or documents requested. Compare the corrected statement with your chronology.
  8. Escalate if necessary. If the servicer does not acknowledge or resolve the issue, file a complaint with the Consumer Financial Protection Bureau and include your packet. CFPB also directs borrowers to HUD-approved housing counselors. If foreclosure is imminent or you have received legal papers, seek prompt advice from a qualified attorney.

How to write the notice of error

Use a clear subject line such as “Notice of Error under 12 C.F.R. § 1024.35 — payment not credited.” Avoid a long narrative that buries the requested correction. The letter should let the servicer identify the account, locate the transaction and understand the remedy you seek.

Sign and date the letter. Attach legible copies of the check or stub, bank record, mortgage statement, USPS receipt, tracking history and delivery record. Do not send your only original canceled-check image or receipt.

Deadlines and what happens after delivery

For a covered notice of error, the servicer generally acknowledges receipt within five days, counting business days rather than weekends and legal public holidays. The general response period is 30 days, with a possible 15-day extension when the servicer gives the required written notice. Keep the delivery confirmation because it anchors the start of the process.

The response should address the specific error. A generic statement that the payment was “not received” may not resolve whether the servicer’s lockbox received an envelope, whether the check was rejected, or whether the account was posted late. Ask for a corrected payment history and an explanation of any fee that remains.

Common failure points and how to fix them

You have only a postmark

A postmark or Certificate of Mailing proves when the item was presented to USPS, not when the servicer received it. Add the bank record and any tracking, delivery or attempted-delivery evidence you can obtain. In the notice, acknowledge the distinction instead of claiming that the postmark alone proves receipt.

The check cleared but the account is still delinquent

Submit the front and back of the canceled check, the bank debit date and the statement showing the missing installment. The endorsement or deposit image may help the servicer’s research team trace the payment. Request correction of the posting date and removal of any fee caused by late posting.

The payment was delivered, but to an address that was not designated for errors

Send a new notice to the servicer’s published error-resolution address and explain the original mailing path. Include both the payment-address evidence and the new notice’s delivery proof. Do not assume that a successful delivery to the payment lockbox automatically satisfies the separate notice requirement.

USPS shows an attempted delivery

An attempted-delivery scan is useful evidence that USPS presented the item or tried to present it. Include the scan and ask the servicer to investigate its receiving procedures, refused mail and lockbox records. Do not describe an attempted delivery as a signed delivery if no signature exists.

The servicer says the check was never received

Ask for the basis of that conclusion and provide the check image, bank debit, tracking history and statement. If the check cleared, point out the endorsement details and request a payment trace. Keep the dispute focused on the specific account error and the correction sought.

You are close to foreclosure or have received legal papers

Do not rely solely on ordinary correspondence. Submit the notice and evidence promptly, contact a HUD-approved housing counselor, and obtain legal advice from an attorney familiar with mortgage servicing and foreclosure deadlines. Court and foreclosure deadlines can run independently of the servicer’s error-resolution timeline.

Choosing a mailing service for future payments

Your choice should match the risk and the time available. Ordinary mail is the least documented. Certificate of Mailing creates a dated USPS acceptance record at a lower listed retail price, but it does not show delivery. Certified Mail adds delivery or attempted-delivery tracking. Adding Return Receipt creates a signature record, which is stronger when you need to show who accepted the item.

Situation Practical documentation choice Important limitation
You need only a record of when you mailed a routine document. Certificate of Mailing. No delivery evidence.
You need to show the servicer received or was offered the item. Certified Mail. No signature unless Return Receipt is added.
You anticipate a dispute about who accepted the item. Certified Mail plus Return Receipt. A signature does not prove the payment was posted correctly.
You are sending a notice of error. Trackable service with a retained receipt and delivery record. Use the designated error-resolution address, not just the payment address.

Prices shown by USPS for 2026 are $5.55 for Certified Mail and $2.45 for Certificate of Mailing at retail. Those figures are time-sensitive and do not by themselves establish the total postage for a particular envelope or any added service.

What a successful resolution should look like

A complete correction normally identifies the payment, states the date credited, removes any improper late fee, updates the payment history and confirms the account’s current status. Save the corrected statement and response with your original packet. If the account still shows delinquency, request a written explanation of the remaining balance and the exact transaction history rather than relying on a telephone assurance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The most persuasive record is chronological and modest in its claims: the check was issued, the item was presented to USPS on a documented date, delivery or an attempted delivery occurred (if shown), the bank paid the check (if it cleared), and the servicer’s ledger does or does not reflect the payment. That distinction lets the servicer investigate the right failure—mail handling, payment acceptance, posting or fee assessment—without treating mailing proof as automatic proof of crediting.
