How to Protect Your Identity After Sharing Tax Information With a Fraudulent Preparer

Stop communicating with the preparer, secure your IRS and financial accounts, preserve every record, and report through the correct channel. Sharing tax documents creates a serious risk, but it does not by itself prove that a fraudulent tax return was filed or that your identity has been stolen. Use the steps below to contain the exposure, watch for evidence of tax identity theft, and respond if the IRS or a financial institution confirms misuse.

What to do in the first 24 hours

Move quickly, but do not panic or send more information to “fix” the situation. A person who already has your tax file may try to obtain additional documents, an authentication code, a payment, or access to an account. Treat every new request from that preparer as untrusted until you verify it through an independent channel.

As an Amazon Associate I earn from qualifying purchases.

  1. End the contact. Do not provide more Social Security, tax, bank, identity-document, or login information. Do not send another payment or click links in messages from the preparer. If you need to communicate for recordkeeping, use a brief written message and keep a copy; do not negotiate or threaten the person.
  2. Secure your IRS Online Account. Sign in directly through the IRS website, not through a message or link. Change the password to a unique, complex password that you do not use anywhere else. Review notices, account activity, filing history, payment information, and any changes you do not recognize.
  3. Protect exposed email and financial logins. Change the password for the email account used for tax matters first, then tax software, banking, payment, payroll, and investment accounts. Turn on multifactor authentication where available. If the same password was reused elsewhere, change it on every affected service.
  4. Call banks and payment providers promptly if their details were shared. Use the number on a statement, the institution’s independently typed website address, or the back of your card. Ask what monitoring, account restrictions, replacement account numbers, or payment recalls are appropriate. Tell the institution exactly what information was disclosed and when.
  5. Save the evidence before deleting anything. Preserve emails, texts, social-media messages, caller-ID information, engagement letters, invoices, payment confirmations, tax-return copies, uploaded files, refund-account details, and IRS correspondence. Export or print records with dates and full headers when possible.
  6. Start an identity-theft recovery file. Record the date of discovery, the preparer’s name and contact details, what you supplied, where it was sent, amounts paid, account numbers or last four digits involved, and every call or letter that follows. Keep originals unchanged and work from copies.

The IRS advises identity-theft victims to stop interacting with the identity thief, change the IRS Online Account password, follow any IRS notice, report identity theft, use IdentityTheft.gov for recovery steps, obtain an Identity Protection PIN, and keep records of letters, calls, and emails. Its individual guide puts the urgency plainly: “Act now to report, prevent and recover from tax-related identity theft.”

Exposure is not the same as a confirmed fraudulent return

A fraudulent preparer may have copied or retained your information without filing anything. Until there is evidence of misuse, describe the situation as suspected exposure. That distinction matters: it helps you choose the right IRS process and prevents an unsupported accusation from becoming part of an official complaint.

Signs that tax identity theft may have occurred

  • An IRS notice says a return has already been filed for your Social Security number or Individual Taxpayer Identification Number.
  • Your legitimate e-filed return is rejected as a duplicate.
  • The IRS sends a notice about income, a refund, a balance, or collection activity that does not match your records.
  • Your IRS account shows a return, transcript request, payment, address change, or other activity you did not authorize.
  • A refund was directed to a bank account or prepaid account you do not recognize.

These signs warrant an immediate IRS response, but they do not establish who acted or why. Conversely, the absence of a notice does not prove that no misuse occurred; continue monitoring your accounts and correspondence.

Preserve a usable record of the preparer’s conduct

A complete file makes it easier for the IRS, a bank, a police department, or a state regulator to understand what happened. Save documents in their original form and create a chronological summary.

Include these items

  • The preparer’s legal and business names, office address, telephone numbers, email addresses, website or social-media pages, and any preparer identification information shown on a return.
  • The date and method of your first contact, the engagement agreement, consent forms, privacy notices, and instructions for uploading documents.
  • Copies of every return or draft return, including all schedules, e-file authorizations, signatures, and pages showing direct-deposit information.
  • Messages in which the preparer requested documents, promised a refund, changed a bank account, asked for a code, or claimed that a filing was complete.
  • Invoices, receipts, canceled checks, card statements, wire records, cash-payment details, and the payment method used.
  • The exact information disclosed: Social Security number or ITIN, date of birth, address, driver’s-license or passport details, wage forms, bank information, investment records, dependent information, and business data.
  • IRS letters, e-file rejection screens, transcripts, account alerts, and notes of calls. Write down the date, the number or website used, the name or identification of the representative if provided, and what the representative told you.

Do not alter screenshots or forward suspicious messages in a way that removes technical details. If a message contains a link, do not open it merely to document it; save the message or use a screenshot from a safe device.

Use the right reporting route

There are two different IRS problems: misconduct by a paid preparer and identity theft involving your tax account. They can overlap, but one report does not replace the other.

Situation Primary route What to provide What it does not do
The preparer filed without your knowledge or consent, diverted a refund, or put someone else’s direct-deposit information on the return. IRS paid-preparer misconduct complaint process. Specific, credible facts; the return and related documents; dates, names, contact details, amounts, payment records, and evidence of where a refund was directed. It is not a substitute for reporting suspected identity theft or responding to an IRS notice.
Your personal or business tax information was stolen, or you are an actual or potential identity-theft victim and want the IRS to mark the account. Form 14039, Identity Theft Affidavit, when IRS guidance indicates it applies. The facts supporting the identity-theft concern and the requested account protection. It does not prove that the preparer committed the theft, erase a disclosure, or guarantee that a fraudulent filing can be reversed.
You received an IRS notice about a suspicious return or account activity. Follow the response method and contact details printed on that authentic notice. The notice, requested verification, and any documents the notice specifies. Do not use a different filing route simply because it appears faster online.
You need broader identity-theft recovery help, such as account and credit steps. IdentityTheft.gov recovery plan. A description of the information exposed and any confirmed misuse. It does not replace the IRS’s notice-specific process or a preparer misconduct complaint.

Submit a preparer complaint only with information you can support. Do not convert suspicions into allegations of a specific crime, and do not guess at a refund amount or account number. If the preparer gave you a return showing another person’s bank details, include that evidence.

When and how Form 14039 fits

The IRS says a person who is an actual or potential identity-theft victim and wants the IRS to mark the account may complete Form 14039. The correct route depends on how the case arose. If an IRS notice tells you to respond, use the instructions and contact information on that notice. If you are not responding to a notice, follow the current IRS instructions for submitting the form.

Do not submit Form 14039 repeatedly through different methods. Duplicate submissions can make the file harder to process and do not accelerate protection. Keep a copy of the signed form, proof of delivery or submission, and any confirmation number.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If an e-filed return is rejected as a duplicate

  1. Save the rejection message and the return you attempted to file.
  2. Confirm that the rejection is genuine through your tax software or the IRS instructions, not through a message from the preparer.
  3. Follow the IRS direction for filing the return on paper when required.
  4. Submit Form 14039 by the route the IRS specifies for that situation, rather than sending it multiple ways.
  5. Keep proof of mailing or delivery and continue responding to any subsequent IRS correspondence.

A duplicate rejection is evidence that the IRS system has received a return using your identifying number; it does not, by itself, identify the filer or establish that the preparer was responsible.

Get an IRS Identity Protection PIN

An Identity Protection PIN, or IP PIN, is a six-digit number the IRS uses to help prevent another person from filing a federal return with your Social Security number or ITIN. The IRS recommends obtaining one after identity-theft exposure or a related incident. Request it through the IRS’s current IP PIN process and keep the number private.

  • Do not give the PIN to the suspected preparer, an unsolicited caller, or anyone claiming to “activate” it.
  • Enter it only in the legitimate filing process or when the IRS specifically requests it.
  • Tell any future preparer that you have an IP PIN, but provide the number only through a secure, verified process.
  • Keep the IRS notice or account record that contains the PIN with your tax files.

An IP PIN helps prevent certain future federal filings; it cannot retrieve documents already copied, reverse a bank transfer, or prove whether a return was filed.

Secure and monitor your IRS account

Use a unique password for the IRS Online Account and protect the email address used for account recovery. Review the account regularly for unfamiliar filings, transcripts, payment arrangements, notices, address changes, or authorization activity. Save a PDF or screenshot of anything that appears incorrect before contacting the IRS.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Be cautious with calls, texts, and emails that mention your case. The IRS may contact you about a notice, but a message demanding an immediate payment, a gift card, a password, or a one-time authentication code is a warning sign. Open the IRS website by typing its address yourself and use the contact path shown on an authentic notice. Never rely solely on caller ID.

Protect bank, payment, and credit accounts

If the preparer saw bank numbers, card details, payroll information, or payment credentials, treat those accounts as exposed even if no unauthorized transaction is visible yet.

Financial accounts

  • Ask each institution whether it recommends a new account number, replacement card, changed online credentials, payment blocks, or additional verification.
  • Review recent and pending transactions, linked external accounts, beneficiaries, mailing addresses, telephone numbers, and authorized users.
  • Set transaction alerts at an amount and frequency that will reveal suspicious activity quickly.
  • Report unauthorized transactions promptly and follow the institution’s written dispute process.
  • Close accounts opened without your permission and retain the closure confirmation.

Credit reports and new-account protection

The IRS advises taxpayers affected by a data breach to consider a fraud alert with a major credit bureau and to consider a credit freeze. They have different practical effects:

Protection Practical effect When it may fit
Fraud alert Signals prospective creditors to take additional steps to verify that an applicant is really you. You want an extra verification signal while keeping applications relatively accessible.
Credit freeze Restricts access to your credit file for most new-credit applications until you lift or remove the freeze. You are not applying for new credit and want a stronger barrier against accounts being opened in your name.

Check your credit reports for unfamiliar inquiries, addresses, employers, loans, cards, collection accounts, and public-record information. Dispute inaccurate entries with the relevant bureau and creditor, and keep copies of every dispute and response. Bureau procedures, identity checks, and service terms can change, so use the current instructions published by each bureau.

Continue filing and paying legitimate tax obligations

Identity-theft concerns do not cancel the requirement to file a genuine return or pay an amount you actually owe. Continue the filing process while following the IRS identity-theft instructions. If an electronic return is rejected as a duplicate, use the paper-filing and Form 14039 procedure the IRS specifies for your case.

Do not let the suspected preparer “correct” the situation by asking you to sign a blank return, cash a refund check, create a new account, or send another copy of your identity documents. If you need professional assistance, independently verify a new tax professional’s credentials and contact information before sharing anything.

Common mistakes that make recovery harder

Sending more documents to obtain a refund

A demand for a second identity document, a selfie, a bank-login screenshot, or an authentication code may be an attempt to deepen the compromise. Verify any request through the IRS, your bank, or another institution using a contact method you found independently.

Deleting the conversation

Deleting messages can remove dates, payment instructions, and evidence of what was requested. Preserve copies first. If you must block a number or email address, do so after saving the record.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using only a preparer complaint

A misconduct complaint can alert the IRS to improper preparation, but it does not automatically place an identity-theft marker on your tax account. Use the identity-theft route when the IRS guidance says it applies.

Filing Form 14039 several times

Multiple submissions through different channels are not a substitute for following the notice or form instructions once and keeping proof of submission.

Assuming a freeze solves every problem

A credit freeze concerns most new credit accounts. It does not secure your IRS account, stop a fraudulent tax return, recover a diverted refund, or protect a bank account whose credentials were exposed. Address each risk separately.

Ignoring state and business exposure

This plan covers U.S. federal tax identity theft. State tax agencies may use different forms and deadlines, and a business return may expose employer-identification numbers, payroll records, or customer information. Contact the relevant state tax agency and business financial institutions when those records were included.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical recovery calendar

Time Tasks
Today Stop contact; change IRS, email, bank, and tax-software passwords; enable multifactor authentication; call affected financial institutions; preserve records; check the IRS account.
Within the next few days Start the IdentityTheft.gov recovery steps; request an IP PIN; decide whether a fraud alert or credit freeze fits; review credit reports and account activity; organize the evidence file.
When an IRS notice or filing problem appears Use the notice’s contact and response instructions; determine whether Form 14039 applies; follow the paper-filing process if an e-filed return is rejected as a duplicate; keep proof of every submission.
Over the following months Monitor IRS correspondence, account activity, bank and card statements, and credit reports; report new unauthorized activity promptly; retain the complete file until the matter is resolved.

How to work with a replacement tax professional

If you need help filing or responding to the IRS, select a professional independently rather than accepting a referral or link from the suspected preparer. Verify the person’s identity, office address, credentials, engagement terms, privacy practices, and refund process. Ask who will sign the return, where records will be stored, how documents will be transmitted, and how you will receive a complete copy.

Never sign a blank return or a return you have not reviewed. Confirm your name, dependents, income, deductions, bank-routing and account numbers, and the preparer’s signature or required identification information. Keep your own copy and retain control of your IRS Online Account and IP PIN.

What the IRS process can and cannot accomplish

The IRS recovery process can help identify suspicious filings, protect an account, and guide you through filing after a duplicate rejection. An IP PIN can help prevent certain future federal returns from being filed with your identifying number. Credit protections and bank controls can reduce the risk of new financial harm.

None of these steps can make an already-shared document disappear, guarantee that a fraudulent preparer will be prosecuted, or ensure that every loss will be reimbursed. Keep monitoring after you submit reports, respond to genuine notices by their deadlines, and update your plan when new evidence appears.
