How to Protect and Access Your Crypto When a Project Founder Is Detained

By TheFinanceBase Team 11 min read

A founder’s detention does not automatically transfer, freeze or unlock cryptocurrency. Control follows the signing keys and the custody design: you may still be able to transact from a self-custody wallet, while assets held by an exchange, founder-controlled server, bridge or single-signature treasury may depend on a company, court order or replacement operator.

First identify who can sign, which interfaces are merely access tools, and whether any lawful freeze, seizure or insolvency process applies. Preserve records, secure recovery material and get jurisdiction-specific legal advice before moving disputed or restricted funds.

What detention actually changes

Blockchains generally continue validating transactions when a person is arrested or detained. The event changes the people and services around the keys, not the cryptographic rules recorded on-chain. Your practical outcome depends on the control point that can authorize a transaction.

Arrangement Who normally controls movement What detention can affect First question to answer
Self-custody wallet The person or organization holding the private key or seed backup A founder’s website, wallet app, RPC endpoint or domain can disappear while the key remains usable Do you possess and can you safely use the signing key?
Exchange or hosted wallet The provider’s internal systems and withdrawal controls Withdrawals may be paused, accounts frozen, records seized or assets moved under an insolvency or court process Is the provider honoring withdrawals, and is there a legal restriction?
Multisignature treasury A defined quorum of independent signers One detained signer may be unavailable; access survives only if the remaining signers can meet the quorum What is the current M-of-N policy and which keys remain valid?
Founder-held single key The founder or a device they alone control Operations can stop even though the blockchain is working; replacement may require governance or legal action Does anyone else hold a valid backup key?
Founder-operated server, bot or bridge On-chain keys plus an off-chain service or administrator A seized domain, server, API, validator or signing bot can block the normal interface Can you reach the underlying contract and sign through an independent, verified tool?

“Self-custody” is a description of key control, not a guarantee that a product is secure or legally unrestricted. A 2025 submission to the SEC Crypto Task Force states: “Self-custody wallets are not considered custodians under U.S. securities law as users retain exclusive control over their private keys and assets.” That is a regulatory characterization; it does not make every wallet marketed as non-custodial trustworthy, recoverable or suitable for your jurisdiction.

Separate keys from the interface

People often confuse a project’s front end with the wallet or contract that holds funds. A founder may run the website, publish an RPC endpoint, operate a validator, host a signing bot or control an exchange account without personally holding every user’s private key. Conversely, a project can advertise “non-custodial” access while a single administrator still controls an upgrade key, withdrawal key or server required to complete a transaction.

What can fail without destroying the key

  • A domain or front-end application can be seized or taken offline.
  • An RPC provider can stop returning data even though the network is operating.
  • A hosted wallet app can be unavailable while a compatible wallet can still import the same key.
  • A trading, staking or bridge service can halt withdrawals while assets remain recorded on-chain.
  • A signing bot can stop submitting transactions even when authorized keys are still available.

The U.S. Department of Justice’s 2024 Samourai case illustrates the distinction. Prosecutors alleged more than $2 billion in unlawful transactions and more than $100 million in criminal proceeds; agents arrested the founders and seized the domain. The announcement described users’ private keys as held in the application rather than shared with employees. The lesson is not that every application has the same design, but that losing a founder or domain does not by itself answer whether users still possess usable keys.

Immediate response: an evidence-first checklist

Use this sequence before changing addresses, rotating signers or attempting a withdrawal. Pause only long enough to establish what you control; do not delay a lawful emergency action indefinitely.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Inventory every control point. List each chain, wallet address, token contract, exchange account, bridge, staking service, withdrawal whitelist, admin key, validator, signer and recovery method. Record the legal owner and the person who can currently authorize a transaction.
  2. Preserve the prior state. Export account statements, transaction histories, governance proposals, signer lists, device serial information, contracts, policies and relevant communications. Save them in read-only copies with dates and transaction IDs so later accounting or legal review can reconstruct what happened.
  3. Confirm whether you hold a signing key. Open a known-good wallet application, compare the receiving address with the address displayed on your hardware device, and sign only a harmless message or very small test transaction where appropriate. Never type a seed phrase into a website, chat window or support form.
  4. Check for a lawful restriction. Determine whether a court order, sanctions rule, seizure notice, subpoena, receiver, bankruptcy process or provider policy limits movement. Detention alone is not permission to evade a freeze, conceal property or transfer assets that do not belong to you.
  5. If you control the keys and no restriction applies, use a preplanned destination. Move funds to an address or multisig quorum you independently control. Verify the destination on the signing device, send a small test first when network conditions permit, then record the transaction ID and the resulting balances.
  6. If a provider controls the keys, contact it through its published channel. Ask how withdrawals, account verification, lawful requests and insolvency procedures are being handled. Keep copies of your request and the provider’s response; do not rely on an unofficial “recovery” contact.
  7. For a treasury, convene the authorized signers out of band. Verify each signer through a pre-existing channel, confirm the quorum and policy, and document any key rotation or replacement through the project’s governance process.
  8. Expect impersonation attempts. Arrests and outages attract phishing campaigns. Ignore unsolicited recovery offers, do not disclose seed words or private keys, and verify every destination address on the device that approves the transaction.

How to determine whether a self-custody wallet is usable

You have the seed or private key

If you possess the original recovery phrase or private key and can restore it in a compatible, trusted wallet, the founder’s availability may be irrelevant to basic signing. Use a spare device or a clean installation, verify the derivation path and network, and compare the restored addresses with records made before the detention. A wrong network, account index or derivation path can make a valid wallet appear empty.

Do not “test” a seed by entering it into a browser form. If you must restore, disconnect unnecessary extensions, download wallet software from its verified publisher channel, and check addresses on the hardware device screen before approving a transaction.

You have only a password, username or project login

A password to a dashboard is not proof that you hold the blockchain keys. The login may authorize the project’s server to act for you, or it may be an exchange account where the provider remains the custodian. Ask whether you can export a standard private key or recovery phrase and whether withdrawals require an administrator, whitelist or manual approval. If no key can be exported, treat the arrangement as custodial or founder-dependent until documented otherwise.

The front end is offline

Do not install an unverified replacement advertised in social media. First identify the underlying chain and contract addresses from records you already trust. An independent wallet or block explorer may let you inspect balances, but inspection does not prove that you can spend them. For a contract interaction, verify the contract address, function, permissions and destination on a device you trust before signing.

Protecting a shared treasury or DAO

A treasury should not depend on one founder’s device, phone number or cloud account. Use a documented M-of-N multisig in which a defined number of independent keys must approve each transaction. For example, a 2-of-3 policy tolerates one unavailable signer; a 3-of-5 policy tolerates two. The correct threshold depends on the value, signer reliability and legal governance of the entity.

Minimum operational controls

  • Give each signer a separate device, seed backup and physical location.
  • Use independent signers rather than several devices controlled by one person.
  • Record the exact wallet address, chain, quorum, signer identities and replacement rules in approved governance documents.
  • Verify a new signer through an out-of-band channel before changing the policy.
  • Perform small test transactions and a recovery rehearsal before a crisis.
  • Keep an emergency contact tree that does not rely on the detained founder’s email, phone or server.

When one signer disappears, do not immediately lower the threshold or replace a key based on a message in a public chat. Confirm the identity of remaining signers, check whether the governing documents permit replacement, and create an auditable proposal. Rotate a key if it may have been exposed, but preserve the old policy and transaction history for legal and accounting review.

Exchange, hosted-wallet and bridge assets

An exchange balance is an account claim, not direct possession of the exchange’s blockchain keys. A provider may lawfully freeze, seize or transfer assets in response to a court order, sanctions requirement, receiver, liquidator or bankruptcy process. It may also halt withdrawals because its own systems are unavailable. Do not attempt to bypass controls with false identity documents, multiple accounts or a third party’s wallet.

Ask the provider, preferably in writing, which of these applies:

  • a temporary technical outage;
  • identity, fraud or sanctions review;
  • a law-enforcement request or court order;
  • an insolvency, restructuring or liquidation process; or
  • a project-specific suspension affecting a bridge, token or validator.

The scale of custodial risk is illustrated by a 2023 statement from CFTC Commissioner Kristin N. Johnson: in the Celsius bankruptcy, customer liabilities exceeded $4.7 billion while digital assets totaled $1.75 billion. The figures do not predict the outcome of every provider failure, but they show why a displayed balance is not equivalent to direct key control.

Preserve deposits, withdrawals, tax lots, account statements, support tickets and wallet addresses. If a provider enters bankruptcy or a receivership, follow the official claims process and obtain advice on ownership, priority and tax treatment before signing a settlement or transferring a claim.

Hardware wallets and recovery backups

A hardware wallet is a signing device, not a magic vault. Ledger documents that private keys remain in the device’s Secure Element and that transactions are approved on the device screen. Trezor’s terms warn that losing both the device and the wallet backup may make funds inaccessible. The security benefit comes from keeping the signing secret away from ordinary computers and checking transaction details on a trusted screen.

Safer backup practices

  • Write the recovery phrase on a durable offline medium and keep copies in separate secure locations.
  • Never photograph, email, upload or paste the phrase into a support ticket.
  • Do not store every backup with the device or in the same building.
  • Record any passphrase or second-factor requirement in a documented succession plan; a phrase without the passphrase may restore the wrong wallet.
  • Verify a backup by following the manufacturer’s documented recovery procedure on a spare device, without exposing the phrase to an internet-connected computer.

Anyone who sees the seed can usually sign as the owner. Treat a support representative, project moderator or “recovery agent” asking for words from the seed as an attacker, regardless of how urgent the request sounds.

Succession and incapacity planning

Plan for detention, illness, death and loss of communications before they occur. A useful plan names the legal owner, authorized signers, replacement procedure, emergency contacts, storage locations, quorum, recurring obligations and the person who can explain the records to an adviser or executor.

Do not solve succession by handing one person an unrestricted seed unless the legal and security consequences are understood. A controlled inheritance process can release instructions or a device to a designated recipient after defined conditions. Casa’s documented inheritance workflow, for example, requires advance setup and controlled unlocking; some configurations involve giving the recipient a hardware wallet and seed phrase. That illustrates the design problem, not a universal legal solution.

Have local counsel review entity documents, wills, trusts, powers of attorney, community-property rules, tax obligations and sanctions exposure. A plan valid in one jurisdiction may not authorize a transfer in another, and a token held for a DAO, company or client may not be yours to move personally.

Choosing an architecture before the next crisis

Criterion Self-custody Custodian Multisig treasury Founder-operated service
Control User-held key Provider-held key or internal ledger Quorum of user-held keys Often one founder or admin key plus off-chain systems
Availability Works if the key, device and network access are available Depends on provider uptime, verification and legal status Works when enough independent signers are available Can stop when the founder, domain, server or bot is unavailable
Recovery Depends on accurate backups; a lost sole key can be fatal Provider may restore account access, subject to its policy One lost key need not destroy access if the quorum remains achievable Often unclear unless replacement and backup rules are documented
Legal process Private key control does not override a lawful order Provider can freeze, seize or transfer under applicable process Entity documents and signer authority govern responses Authorities may target the operator, service or admin infrastructure
Operational complexity Backup, device and address verification are your responsibility Lower signing burden but higher counterparty and withdrawal risk Requires signer coordination, policy changes and test transactions Simple until the single operational dependency fails
Inheritance Requires secure instructions and a legally valid recipient plan Depends on account terms, identity checks and estate procedures Can distribute authority, but the quorum and successor rules must be documented Usually fragile unless a successor can lawfully obtain the keys and systems

Common failure modes and the correct response

“The founder is arrested, so I can take the project’s treasury.”

Detention does not establish ownership or authorization. A treasury may belong to a company, DAO, client or other contributors. Follow the governing documents, preserve records and obtain counsel before signing or redirecting funds.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The website is gone, so the coins are gone.”

The website may be only an interface. Identify the chain, addresses and contract permissions from records you already trust. Do not use an unverified replacement front end.

“Support needs my seed to restore the wallet.”

Legitimate support should not need your recovery words. Stop communicating, secure the device, and assume any seed already disclosed is compromised. Move assets through a clean, verified setup only when lawful and technically safe.

“I will split the balance across many new wallets to avoid a freeze.”

Splitting transfers does not remove a court order, sanctions obligation or ownership dispute and can make records harder to reconcile. Get legal advice before moving any potentially restricted asset.

When professional advice is essential

Consult qualified counsel before acting if the founder’s detention involves allegations of fraud, money laundering, sanctions violations, stolen assets, a seizure warrant, a receiver, a bankruptcy, disputed ownership or a regulated token offering. Ask specifically about the governing jurisdiction, entity authority, reporting duties, tax treatment and whether a proposed transfer could be viewed as obstruction or dissipation of assets.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep a contemporaneous log of who authorized each action, which policy permitted it, the addresses used, transaction IDs, exchange notices and the evidence relied upon. That record protects legitimate users and helps an administrator, court or trustee distinguish an authorized recovery from an unauthorized transfer.
