How to Protect an Older Adult From High-Pressure Financial Advice

The safest response to a high-pressure financial pitch is to pause, keep control of the accounts with the older adult, obtain the complete offer in writing, and verify the person and firm independently before any money moves. Urgency, secrecy, guaranteed returns, missing paperwork, or unexplained withdrawals are warning signs that justify investigation; they do not, by themselves, prove fraud. The steps below are U.S.-focused and designed to protect an older adult’s choices while giving family members and caregivers practical ways to help.

Why pressure deserves a pause

A legitimate professional should be able to explain an offer, its fees, and its risks without demanding an immediate answer. Investor.gov, the U.S. Securities and Exchange Commission’s (SEC) investor-education site, states: “No reputable investment professional should push you to make an immediate decision about an investment.” Pressure can occur in an investment solicitation, an insurance or annuity sale, a loan, a purported debt service, a contractor payment, or a request from someone who already has a relationship with the older adult.

Pressure alone is not proof that the seller is committing a crime. It is a reason to stop the transaction long enough to check facts with sources the seller did not provide. The older adult remains the decision-maker unless a valid legal arrangement says otherwise. A family member’s concern does not automatically give that family member authority to block a transaction or access an account.

Warning signs of a potentially unsafe pitch

The SEC’s February 5, 2024 alert for older investors lists indicators that may signal investment fraud. Treat the combination of signs, not any single item, as a reason for extra verification.

Warning sign What to do
“Act today” language, repeated calls, or refusal to allow time for questions End the conversation politely and set a later time, or decline entirely. Do not send money or sign while being rushed.
Unsolicited calls, messages, seminars, or visits Do not use the contact details in the message to verify the sender. Find the firm independently and call a number shown in its official records.
Guaranteed returns or unusually high returns described as having little or no risk Ask for the risk disclosures and independent documentation. A guarantee is not credible merely because it is repeated.
The older adult cannot explain what is being purchased or how money can be lost Stop. Do not proceed until the product, costs, liquidity, and downside are understood in plain language.
No written proposal, prospectus, fee schedule, or risk description Request the complete documents. Missing details are a warning sign identified by the SEC.
Repeated requests for additional money Do not treat an earlier payment as proof that the next payment is safe. Seek an independent review.
Unexplained withdrawals, wires, checks, or new payees Ask the financial institution to review the activity immediately and preserve statements and messages.
A salesperson cannot be found in official licensing or registration records Do not invest until the person and firm are verified through Investor.gov and any applicable state regulator.
Requests for secrecy or instructions to hide the transaction from family, a bank, or another adviser Decline secrecy. Invite a trusted person chosen by the older adult to the discussion.

These signs call for caution and investigation, not an accusation. An unfamiliar product can be legitimate, and a familiar person can still make an unsuitable or unauthorized request.

What to do when someone is pressuring your older parent to invest

  1. Pause the decision

Say, “We do not make financial decisions during a sales call. Please send the information in writing.” Do not transfer funds, sign documents, disclose account passwords or one-time codes, or agree to secrecy. The SEC advises taking time to investigate before sending money or signing an agreement.

  2. Secure the immediate conversation

If the caller is on the phone, hang up and call back only through an independently obtained number. If a visitor is present, end the meeting and do not hand over checks, cards, identification, or account statements. Save voicemails, emails, text messages, letters, caller IDs, and screenshots.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  3. Request the complete offer in writing

Ask for the seller’s full legal name, firm name, physical address, registration or license information, product name, minimum investment, fees and commissions, conflicts of interest, withdrawal restrictions, tax consequences, and every material risk. For securities, request the relevant disclosure document or prospectus and the firm’s Form CRS (Client Relationship Summary). If the seller will not provide understandable documents, stop.

  4. Verify independently

Search the professional and firm through Investor.gov rather than relying on a link, telephone number, email address, or website supplied by the pitch. To make sure you are speaking with the real professional and not an impostor, use the telephone number or website listed in the firm’s Form CRS. Check that the name, employer, registration status, and contact details match. For advice outside securities, use the appropriate state or federal licensing agency or consumer-protection office.

  5. Check understanding and suitability

Ask the older adult to explain, in their own words, what they would own, how returns would be earned, what could be lost, when money could be accessed, and what all fees would be. Compare the proposal with the person’s income needs, emergency reserves, time horizon, tax situation, and tolerance for loss. An independent fiduciary adviser, attorney, accountant, or counselor can help evaluate questions, but the older adult should choose whom to consult.

  6. Invite support without taking over

Ask, “Would you like me to sit with you while you review this?” A trusted person can take notes, help list questions, and notice inconsistencies. Do not remove checkbooks, passwords, or decision-making authority merely because the person is older. If the adult appears confused, frightened, coerced, or unable to understand the transaction, seek professional and legal help promptly.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  7. Decide only after verification

There is no legitimate reason to sacrifice a cooling-off period for a complex financial decision. If facts cannot be confirmed, decline. If the offer is legitimate, it should still be available after an informed review.

How to tell whether a financial adviser is legitimate

Use records the firm is required to provide

For an investment adviser or broker, obtain the firm’s Form CRS and read the sections describing services, fees, conflicts, standard of conduct, and disciplinary history. Use the contact information printed in that document, not a number dictated by a caller. Investor.gov can help locate a professional or firm and identify registration information. A registration check does not decide whether an investment is suitable and does not guarantee honest conduct; it confirms that the identity and regulatory record can be examined.

Match every detail

  • Confirm the spelling of the person’s name and the exact legal name of the firm.
  • Check that the email domain, office address, and telephone number match official records.
  • Ask who will custody the assets and where checks or wires must be sent. Never send payment to a personal account or a destination that differs from the written instructions.
  • Review disciplinary disclosures and complaints, while recognizing that a clean record is not a guarantee.
  • Be wary of a professional who discourages a second opinion, refuses to explain compensation, or says ordinary verification is insulting or unnecessary.

For insurance, mortgages, tax services, debt relief, or other non-investment advice, the SEC’s investment resources may not apply. Contact the relevant state insurance, banking, professional-licensing, or consumer-protection regulator and verify the provider through that agency’s official channel.

Trusted contact

A trusted contact is a person a financial institution may reach if it suspects exploitation, notices unusual circumstances, or cannot contact the account holder. The designation is an alert route, not ownership. The CFPB explains that a trusted contact does not automatically receive access to money or authority to make transactions; separate authorization is required. The older adult chooses the contact and can ask the institution how and when it may be used.

Financial power of attorney

A financial power of attorney (POA) is a legal document that authorizes an agent to act for the principal within the document’s terms. It can be useful for planned assistance, but it is much broader than a trusted-contact designation. The CFPB warns that an agent may pressure someone to grant authority they do not want. State law, the document’s wording, and whether it is effective immediately or only after a specified event all matter.

Before signing, the older adult should select an agent voluntarily, understand the powers granted, and discuss safeguards. One option described by the CFPB is requiring the agent to report financial transactions to another person. An attorney or legal-aid program familiar with the state can explain execution, witnessing, notarization, revocation, and the agent’s duties.

Safeguard What it does What it does not do When to consider it
Trusted contact Lets an institution reach a chosen person about suspected exploitation or difficulty contacting the account holder. Does not make the contact a co-owner, signer, or decision-maker. During ordinary account planning, before a suspicious pitch.
Financial POA Gives an agent legal authority defined by the document and applicable state law. Does not justify granting unlimited access without understanding the risks; it does not eliminate the principal’s rights. When the older adult voluntarily wants planned help with financial tasks.
Joint ownership or account authorization May allow another person to transact, depending on the account agreement. Can create access and ownership consequences that differ from a notification-only safeguard. Only after the older adult understands the legal and financial effects and obtains appropriate advice.

Build a prevention file

With the older adult’s permission, organize a current list of accounts, recurring bills, insurers, advisers, important documents, and emergency contacts. Record where originals are stored and how to reach institutions, but do not place passwords or security codes in an unsecured shared file. Review the list after major life events and ask brokerage firms about their trusted-contact procedures.

If money or account access may already be at risk

  1. Call the institution immediately

Contact the bank, credit union, card issuer, brokerage, payment service, or other provider that holds the account. Use the number on a statement, card, or official website. Explain that you suspect exploitation or an unauthorized transaction, ask what protective actions are available, and request confirmation of any fraud claim or transaction dispute. The institution may be able to help recover funds, depending on the facts and timing.

  2. Preserve evidence

Keep account statements, transaction records, receipts, contracts, messages, call logs, envelopes, and names of everyone contacted. Write a dated timeline while memories are fresh. Do not delete messages or confront a suspected exploiter in a way that could put the older adult at risk.

  3. Report suspected exploitation

Contact the state or local Adult Protective Services (APS) agency. If there is immediate danger, call 911. Otherwise, contact local law enforcement. Reporting routes and APS procedures vary by state.

  4. Use the specialized channel that fits

    • Report scams to the Federal Trade Commission (FTC).
    • For a suspected investment fraud or an unregistered securities seller, use Investor.gov’s professional-lookup resources and the SEC’s Tip, Complaint and Referral process.
    • Contact the local prosecutor when criminal exploitation may be involved.
    • Notify the relevant licensing or care-facility oversight body when a licensed professional or facility is implicated.
    • Contact the Social Security Administration about suspected representative-payee misuse.
    • Contact the Department of Veterans Affairs about suspected fiduciary misuse.
    • Contact the appointing court about suspected guardian or conservator misuse.
  5. Get advice about legal options

An attorney or legal-aid program can explain possible civil remedies, emergency court orders, POA concerns, and state-specific reporting duties. Federal guidance cannot substitute for advice about a particular state’s law.

What the numbers show—and what they do not

A July 17, 2019 CFPB analysis of 180,000 elder-financial-exploitation suspicious-activity reports filed from 2013 through 2017 found an average reported loss of $41,800 among adults over age 70 who sustained a reported loss. The same analysis found that 7 percent of adults with a reported loss lost more than $100,000. These are findings from reports submitted to authorities, not estimates of the average loss for all older adults or all exploitation incidents.

That figure describes reporting in those records; it does not measure how often exploitation occurs or how often victims recover money.

Free prevention and caregiver education

The CFPB and FDIC jointly developed Money Smart for Older Adults. CFPB provides free English and Spanish resource guides and instructor materials, along with financial-caregiver guides addressing powers of attorney, court-appointed guardians, trustees, and government fiduciaries. These materials can help an older adult and supporters recognize scams, plan assistance, and discuss safeguards before a crisis.

Questions families commonly ask

How do I protect my elderly parent from financial scams without taking away control?

Ask permission to help, establish a pause rule for unsolicited offers, and agree on who will review documents. Add a trusted contact if the parent wants one, organize account information together, and use independent verification. A parent’s age alone does not establish incapacity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What if my parent insists the salesperson is trustworthy?

Do not argue about character. Focus on process: obtain the written offer, verify registration through an independent channel, review fees and risks, and wait before any transfer. If coercion, confusion, or unexplained transactions appear, contact the institution and APS even if the parent initially resists, while considering safety and state reporting rules.

Can a trusted contact stop a transaction?

Not merely by being listed. A trusted contact generally gives the institution someone to reach; it does not itself grant authority to access funds or direct transactions.

Does a power of attorney let an agent do anything?

No. Authority depends on the document and applicable state law. The older adult should understand the powers granted and safeguards such as transaction reporting before signing. Obtain state-specific legal advice.

What if the pitch is not an investment?

Use the same pause, written-details, independent-verification, and trusted-support steps, then contact the regulator or consumer-protection agency responsible for that product or profession. SEC guidance is most direct for investment pitches, while other transactions may follow different rules.
