How to Prepare for an ITAT Hearing After Your Appeal Is Restored (India)

After the Income Tax Appellate Tribunal (ITAT) restores an appeal, prepare from the signed restoration order, the latest hearing notice and listing, the filed grounds of appeal, and the existing case record. Restoration alone does not establish which issues, documents or arguments the Bench will hear; the directions in your order and the current notice control.

What happens after ITAT restores an appeal?

A restoration order generally puts the appeal back before the Tribunal for the procedural step or hearing directed in that order. It may revive an appeal dismissed for non-appearance, restore a matter for a fresh hearing on merits, or impose conditions. There is no single scope for every restored appeal.

Read the order as the controlling document for your case. Note whether it:

  • identifies the appeal number, assessment year, bench or date;
  • sets aside, recalls or modifies an earlier dismissal or disposal order;
  • directs a fresh hearing, service of notice, filing or appearance;
  • limits the restoration to particular grounds or issues; or
  • requires compliance with a condition before the appeal is listed.

Do not infer that every original ground, document or additional argument will automatically be considered. The restoration order, the memorandum of appeal, subsequent directions and the live hearing notice must be read together.

Compare the restoration order with the earlier orders

Keep the order that was appealed, the ITAT order that dismissed or disposed of the appeal, and the restoration application or order that revived it. Compare the wording line by line. This can reveal whether the Bench intended only to cure a non-appearance, to reopen the appeal for arguments, or to make a broader procedural direction. If the wording is unclear, ask your representative to seek clarification or address the uncertainty at the next listing rather than assuming the widest possible scope.

First steps once restoration is granted

  1. Obtain the signed restoration order. Save the complete order, including the cause-title, appeal number, assessment year, bench, date and operative directions. A short order extract or an unsigned copy may omit information needed for filing or appearance.
  2. Record every direction and date. Create a one-page compliance list for any filing, service, appearance or payment condition. Mark whether a direction is addressed to the appellant, respondent or both.
  3. Match the order to the appeal record. Place the memorandum of appeal and numbered grounds beside the restoration order. Identify which grounds were originally raised and whether any later order altered them.
  4. Check the live listing. Search the ITAT case-status service using the appeal number, filing date, assessee name or acknowledgement number. Select the correct bench and appeal type. Recheck close to the hearing because dates, venues and benches can change.
  5. Review the e-Filing Appeal Dashboard. Look for defects, rectification requests, filed documents, petitions and acknowledgements. Resolve an open defect through the official portal and retain the acknowledgement or submission receipt.
  6. Confirm who will appear. Make sure the authorised representative has the complete indexed record, the latest notice and all filed applications. If the hearing is online, follow the access instructions in the notice and test the connection and documents before the listed time.

How to verify the hearing date, bench and notice

The ITAT case-status service and the e-Filing Appeal Dashboard are the practical official records for listing and filing information. Use the search fields available for your matter, then check that the displayed appeal number, assessment year, appellant, respondent, bench and appeal type match your papers.

Rule 19(1) of the Income-tax (Appellate Tribunal) Rules, 1963 states: “The Tribunal shall notify to the parties specifying the date and place of hearing of the appeal and send a copy of the memorandum of appeal to the respondent either before or with such notice.” Treat the actual notice and current portal entry as decisive for where and when to appear. A previous listing, calendar entry or informal message should not replace the latest notice.

What to check on the notice

  • the exact appeal number and assessment year;
  • the listed bench and physical venue, or online-hearing instructions;
  • the date and session details;
  • the parties and authorised representatives shown;
  • whether the matter is marked for admission, directions, hearing, compliance or another purpose; and
  • any instruction about paper books, applications, written submissions or service.

Save a PDF or print the latest notice. If the portal and a notice appear inconsistent, preserve both records and have your representative confirm the position with the registry before the hearing.

What documents are needed for an ITAT hearing?

Build the hearing file around the live grounds and the directions in the restoration order. Include only material that is relevant to the issues actually before the Bench, while keeping the complete procedural history available for reference.

Document Why it belongs in the file Preparation check
Signed restoration order Defines what was restored and any procedural conditions. Mark the operative paragraph and every deadline or limitation.
Latest hearing notice and listing record Confirms date, bench, venue and hearing purpose. Use the most recent version and retain the portal acknowledgement where available.
Order that was appealed Shows the findings and relief challenged before ITAT. Highlight the paragraphs corresponding to each ground.
Memorandum of appeal and grounds Defines the formal issues on which submissions should be organised. Use the filed version; do not substitute an amended draft unless it was accepted.
Assessment order and first-appellate order Provides the factual and procedural findings leading to the appeal. Mark page references for each disputed addition, disallowance or legal conclusion.
Material already on the record Supports factual propositions and demonstrates what was previously filed. Use legible copies and identify the authority and filing stage.
Prior ITAT orders and applications Shows earlier directions, adjournments, defects, restoration requests or compliance. Include orders that affect the present listing, not unrelated history.
Paper-book service proof Demonstrates that relied-on material was served as required. Keep delivery receipts, email acknowledgements or portal records together.

Prepare a chronology

Write a short chronology with the assessment, first appeal, ITAT filing, dismissal or disposal, restoration request, restoration order and current listing. Add only dates that help explain the live issue or compliance. A chronology lets the Bench understand the procedural history without searching through every page.

Create a one-page issue list

For each numbered ground, record the challenged finding, the supporting record pages, the legal or factual question, and the precise relief sought. Note whether the ground is jurisdictional, factual, computational or procedural. This page is an index for oral argument, not a replacement for the filed grounds.

How to prepare an ITAT paper book under Rule 18

For documents on which you intend to rely, the Rule 18 paper-book framework calls for an organised, legible and verifiable compilation. The paper book should generally contain an index, continuous pagination, descriptions of relevance, certification that copies are true, and identification of the authority before which each document was filed.

Paper-book assembly checklist

  1. Arrange documents in a logical order, normally beginning with the index and grounds, followed by the orders and record material supporting each issue.
  2. Paginate continuously and use the same page numbers in your written and oral notes.
  3. Insert a short description beside each item explaining its relevance to a ground or direction.
  4. Identify whether and before which authority each document was filed, such as the Assessing Officer, first appellate authority or ITAT.
  5. Certify copies as true copies in the form required by the applicable rules or bench directions.
  6. Check every scan or photocopy for missing pages, unreadable figures, cut-off annexures and inconsistent pagination.
  7. Serve the paper book on the other side in the manner and within the period currently required, and preserve proof of service.

The Income Tax Department’s 2016 procedure manual describes filing a paper book at least one day before the hearing and serving the other side at least one week before, with proof of service. That manual is not a substitute for current law. Before relying on those intervals, verify the current Rule 18 text, later amendments, registry practice and any directions issued by the relevant bench. A notice or case-specific direction may require a different timetable.

Keep the record traceable

Use labels such as “Assessment order, page 42” or “First-appellate order, paragraph 18” in your notes. If a document appears in more than one filing, identify the version actually on record. Do not add new pages to an already served paper book without a revised index, pagination and fresh service where required.

Can you submit additional evidence before ITAT?

Yes, but additional evidence is handled separately from the ordinary paper book. The Rule 18 framework and departmental procedure describe an application for admitting additional evidence that explains why the material is being tendered and why it was not previously placed on record.

What the application should address

  • identify each proposed document or item of evidence;
  • explain its direct relevance to a numbered ground;
  • state why it was unavailable, overlooked or otherwise not filed before the lower authority;
  • describe the steps taken to obtain it and the date it became available;
  • explain how the other side will be protected from prejudice, including proposed service; and
  • request a specific procedural direction, such as admission, remand for comments or another course the Bench considers appropriate.

File the application through the prescribed channel and serve it as directed. Attach a clear index and legible copies, but do not assume that uploading or handing over the documents means they have been admitted. The Bench must decide whether to receive them, and may seek a response from the Department or direct further verification.

If the restoration order limits the hearing or directs a fresh hearing on the existing record, explain why the proposed evidence fits within that direction. Keep the evidence out of the main paper book until the Tribunal gives appropriate directions, unless the registry or Bench expressly instructs otherwise.

How to prepare oral submissions

Organise the argument around the filed grounds rather than presenting the case as an unstructured narrative. The opening should acknowledge the restoration order and state the limited relief requested. Then proceed ground by ground.

For each ground, prepare Question to answer
Challenged finding Which paragraph, computation or conclusion in the order under appeal is disputed?
Record support Which paper-book pages establish the relevant fact or filing history?
Issue What legal, factual, jurisdictional or procedural question must the Bench decide?
Answer What rule, provision, precedent already on record or factual explanation supports the appellant?
Relief What exact order should ITAT pass on this ground?

Address the restoration history briefly

If non-appearance, delay or a missed listing led to restoration, prepare a concise factual explanation consistent with the restoration order. Do not reargue the restoration application unless the Bench asks. Explain any compliance the order required and move promptly to the merits or procedural issue listed.

Use a controlled speaking outline

  • state the appeal number, assessment year and restoration direction;
  • identify the grounds being pressed, withdrawn or not pressed, if applicable;
  • give the record page before making a factual assertion;
  • answer the Bench’s question directly before returning to the outline;
  • distinguish evidence already on record from material for which admission is sought; and
  • end each ground with the relief requested.

Bring a separate list of authorities and page references. A representative should be able to locate every cited document immediately rather than asking for an adjournment to find it.

Hearing-day checklist

For a physical hearing

  • Carry the restoration order, latest notice, grounds, relevant orders, indexed paper book and service proof.
  • Arrive with enough time for registry or security procedures and confirm the courtroom or bench shown on the latest listing.
  • Keep one working copy for the representative and one clean copy for reference.
  • Have filed applications and their acknowledgements in a separate, clearly marked section.

For an online hearing

  • Use the access method and meeting details stated in the notice or official communication.
  • Test the device, microphone, camera, connection and document-sharing method beforehand.
  • Keep the indexed record open locally so a page can be identified without searching during submissions.
  • Join early, use the appeal number when identifying the matter, and follow the Bench’s instructions about muting, documents and recording.

In either format, keep the latest notice, proof of paper-book service and filed applications readily available. If the matter is not called or the listing changes, note the result shown by the registry or portal and obtain the next direction before leaving.

Common mistakes and how to fix them

Mistake Why it creates risk Practical fix
Assuming restoration automatically reopens every issue The order may contain a narrower direction or condition. Map the operative paragraphs to the grounds and ask for clarification if necessary.
Relying on an old hearing date Listings, benches and venues can change. Recheck case status and the latest notice near the hearing.
Submitting an unindexed bundle The Bench and the other side cannot verify the relied-on pages efficiently. Use an index, continuous pagination, relevance descriptions and legible copies.
Missing certification or service proof The other side may object to the compilation or the Tribunal may require compliance. Certify copies as required and retain delivery or portal acknowledgement.
Putting new evidence into the ordinary paper book Additional evidence requires a separate request and is not automatically admitted. File a reasoned additional-evidence application and await directions.
Arguing beyond the filed grounds New issues may not be properly before the Bench. Stay within the grounds and seek permission before pursuing a new contention.
Having no page references Factual submissions become difficult to verify during a short hearing. Prepare a ground-by-ground page map and mark key passages.
Ignoring an e-Filing defect A defect can delay processing or affect the filing record. Rectify it through the Appeal Dashboard and keep the acknowledgement.

When professional assistance is especially useful

Consider qualified tax-litigation assistance where the restoration order is ambiguous, the appeal involves several assessment years or complex jurisdictional questions, additional evidence is necessary, or the record contains unresolved defects. Give the representative the complete indexed file rather than only the restoration order. The representative should verify the current rules, amendments, registry instructions and bench-specific directions before committing to a filing date or procedural position.

Procedural preparation does not decide the substantive tax law governing a particular assessment year. The applicable statute, transitional provisions and case-specific record must be analysed separately from the mechanics of restoring and listing the appeal.
