1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsBuild your immigration file before a layoff is announced. Start by identifying your exact status, the legally effective last day of employment, and every expiration date; then preserve complete, readable copies of your identity, status, work-authorization, employment, and termination records in a secure location. The correct deadline and next step depend on whether you are, for example, an employment-based nonimmigrant worker or an F-1 student on OPT.
This is a preparation guide, not individualized legal advice. A grace period does not itself authorize work, and a filing that is available to one category may be unavailable or have different effects in another. Confirm current rules and forms with qualified immigration counsel or, for F-1 matters, your designated school official (DSO).

Why your file should be ready before the layoff meeting
Once a technology employer announces a reduction in force, access to email, payroll portals, human-resources systems, and internal document stores can disappear quickly. Immigration decisions often turn on dates and documents that are easiest to verify while you still have access. A complete file lets counsel, a prospective employer, or your DSO evaluate your situation without waiting for a former employer to respond.

The two facts that control almost every first decision are your immigration category and the effective date employment ends. A verbal announcement, a final paycheck, or a severance payment may not identify that date clearly. Keep the written notice and ask for clarification in writing if the notice, separation agreement, or payroll record uses different dates.

Do not assume that every worker with a visa, approval notice, or employment authorization document receives the same grace period. The employment-based regulation discussed by USCIS covers specified categories and provides up to 60 consecutive days after cessation of employment, or until the authorized validity period ends if that is sooner. It is not a universal rule for every immigration document.
Step 1: Create a private status-and-deadline sheet
Make one page that a lawyer or DSO can read in a minute. Store it separately from the document scans so you can update dates without altering originals. Use the dates printed on official notices, not estimates from a manager or an online account.
| Item | What to record | Where to verify it |
|---|---|---|
| Current immigration category | For example, an employment-based nonimmigrant classification or F-1 with post-completion OPT; include any dependents’ categories. | Most recent approval notice, I-20, employment authorization document (EAD), or other official record. |
| Employer and sponsored role | Legal employer name, petitioning entity, job title, worksite or remote-work arrangement, and the person or team handling immigration matters. | Approval notice, petition copy, offer letter, and employment-verification records. |
| Actual last day employed | The effective termination date, including time zone if the employer operates across locations. | Written layoff notice, separation agreement, HR email, and final payroll record. |
| Authorized validity end | The expiration of the current status or petition approval, and the EAD expiration if you use an EAD. | I-797 approval notice, I-94, passport admission record, EAD, or I-20. |
| Pending filings | Receipt numbers, filing dates, biometrics or interview notices, and the attorney or preparer responsible for each matter. | I-797 receipt notices, USCIS account notices, and counsel’s filing copy. |
| Family information | Each dependent’s status, expiration date, passport validity, and pending applications. | Dependent approval notices, I-94 records, passports, and I-20s where applicable. |
Write down the date you first learned of the layoff and the date you sent any required report. Keep a running log of calls and emails with HR, counsel, USCIS, and your DSO. A simple format—date, person or office, question, answer, and promised follow-up—prevents conflicting recollections.
Step 2: Preserve a secure digital and paper file
Scan complete pages in color when possible, including pages that appear blank except for a page number, barcode, or continuation. Name files consistently, such as 2026-03-01_I-797_receipt.pdf, and keep a separate index. Do not crop out edges, annotations, or the reverse side of a document.
Identity and admission records
- Passport biographical page and every page containing a visa, entry stamp, extension, or annotation.
- Most recent Form I-94 and any prior I-94 that helps establish a change or extension of status.
- Current and prior approval or receipt notices (Form I-797) connected to your status, petition, extension, change of employer, or adjustment filing.
- For F-1 students, the current Form I-20 and OPT recommendation or employment authorization endorsements.
- Current EAD, front and back, if employment authorization depends on it.
Employment and compensation evidence
- Offer letters, employment-verification letters, and copies of petition or support materials that you are entitled to retain.
- Job title, duties, worksite, remote-work terms, and dates of employment.
- Recent pay statements showing employer, pay period, and compensation.
- W-2 forms and relevant tax records. USCIS form instructions identify pay stubs, W-2s, tax records, employer letters, a passport, and an I-94 as examples of evidence in particular filings; they are not a universal layoff checklist.
- Records of approved leave, unpaid leave, or payroll interruptions if they could affect the employment timeline.
Layoff and separation records
- The written layoff or termination notice, including the stated effective date and reason if provided.
- Severance or separation agreement, release, benefits-continuation notice, and any amendment.
- Final pay statement, accrued-leave payout, bonus statement, and correspondence confirming when active employment and payroll ended.
- Emails or letters from HR that clarify whether notice pay is salary continuation, severance, or payment for work already performed.
Keep originals in your possession and make at least one backup in a secure account that is not controlled by your employer. Use a strong unique password and multifactor authentication. A physical accordion organizer can help with paper copies, but USCIS does not require a particular organizer or filing system.
Step 3: Pin down what “last day” means
Immigration analysis generally needs the date employment actually ceased, not simply the date a manager announced a reduction. Compare the notice, separation agreement, payroll calendar, and final pay statement. If the documents disagree, ask HR to state the effective employment date in writing and retain the response.
Severance paid after termination does not automatically mean that immigration employment continues. A lump-sum payment, salary continuation, garden leave, or payment in lieu of notice can have different legal and payroll treatment. Do not select a date that is convenient for a benefits claim or a job search; have counsel interpret an unclear arrangement.

Rules differ by immigration category
Employment-based nonimmigrant workers
For specified covered categories, 8 CFR 214.1(l)(2), as quoted in USCIS nonimmigrant employment materials, provides up to 60 consecutive days after cessation of employment, or until the end of the authorized validity period if that is sooner. The rule is category-specific. Your I-94, approval notice, and the facts of the termination determine whether and how it applies.
That period is time to pursue an eligible filing or another lawful plan; it is not an employment authorization document. You may not start work for a new employer merely because a grace period is running or because a petition has been filed. Ask counsel exactly when a particular filing permits work, whether a new employer must file before work begins, and what happens if USCIS requests evidence or denies the filing.
USCIS has described possible routes for some recently unemployed nonimmigrant workers, including a new-employer petition, a change of status, adjustment of status, or a compelling-circumstances EAD application. Availability, filing effects, and work authorization differ by case. No route is automatic, and a route that preserves a period of authorized stay may not authorize employment immediately.

If you are on F-1 OPT, contact your DSO promptly. ICE/SEVP Practical Training guidance says specified changes, including loss of employment, must be reported to the DSO within 10 days. Ask the DSO how to report the employer’s name, end date, and any new qualifying employment, and keep the confirmation of your report.
The F-1 60-day period after program completion or post-completion OPT serves a separate departure or new-program purpose. It is not the same rule as an employment-based cessation-of-employment grace period. Do not use an employment-based checklist or deadline to decide an OPT question.
Your DSO can explain SEVIS reporting and school procedures, but cannot replace legal advice on another status, a pending adjustment application, or a filing by a new employer. If you are considering a change of status or have a complicated employment history, consult qualified counsel as well.

Dependents and family members
List each dependent separately. A worker’s employment ending can affect a principal status while a dependent’s status, expiration date, and pending filing follow different rules. Gather each dependent’s passport, I-94, approval notice, EAD, and school or employment records where relevant. Ask counsel how a proposed filing, departure, or change of status affects every family member; do not assume that a principal worker’s deadline automatically applies to dependents.

What to ask counsel or your DSO
Send a concise packet rather than a long unorganized email. Include your status-and-deadline sheet, the termination notice, the latest I-94 and approval notice, your EAD or I-20 if applicable, and a chronology of employment and filings. Ask for written answers to questions such as:
- What is my legally relevant cessation-of-employment date?
- Does the category-specific grace period apply to me, and what is the last day of the applicable period or authorized validity?
- Can a new employer file, and when could I lawfully begin work?
- Would a change of status, adjustment filing, or another application be available based on my current history?
- Does a pending filing change my authorized stay, work authorization, travel, or ability to rely on the current status?
- What evidence is missing, and who can lawfully provide it now that employment is ending?
- How would the proposed step affect my spouse or children and any planned international travel?
USCIS Director Ur M. Jaddou wrote to Representative Anna G. Eshoo on January 25, 2023: “The 60-day grace period not only gives nonimmigrant workers time to find new employment, but also permits them the option to change their status to another nonimmigrant status, among other options, in the event their employment search takes longer than 60 days.” The statement describes options in general; it is not a promise that a particular worker qualifies or that a filing will be approved.
Compare possible paths without assuming an outcome
When counsel identifies more than one route, compare each on the same axes. This keeps a financially stressful decision from becoming a mistaken assumption about work authorization.
| Question | What to establish | Why it matters |
|---|---|---|
| Eligibility | Whether your category, petition history, job, maintenance of status, and family facts satisfy the route’s requirements. | A route described by USCIS may still be unavailable on your facts. |
| Timing | Who must file or report, the filing or reporting deadline, and the date your current authorization ends. | A complete file is useful only if the action is taken before the controlling deadline. |
| Status effect | Whether the action maintains status, requests a change, supports adjustment, or affects a period of authorized stay. | A receipt notice does not necessarily produce the same status effect as an approval. |
| Work authorization | Whether the action itself permits work, whether a separate EAD is required, and when employment may begin. | Do not start a new job based only on a pending filing or a grace period. |
| Family and travel | How dependents, international travel, visa processing, and a pending application could be affected. | These consequences are fact-specific and should be confirmed before booking travel or changing a dependent’s plans. |
A practical 48-hour file-building workflow
- Before access ends: download personal immigration and payroll records you are permitted to retain. Do not copy proprietary code, customer data, or confidential business material.
- On the notice date: save the written termination notice and separation documents, and record the employer’s stated effective date.
- That day: update the status-and-deadline sheet with the last day employed, authorized validity end, EAD expiration, pending receipt numbers, and dependent dates.
- Within the applicable reporting window: if you are on F-1 OPT, send the loss-of-employment report to your DSO within 10 days and save the confirmation.
- As soon as possible: provide the organized packet to qualified immigration counsel and ask for a written timeline, work-authorization analysis, and list of missing evidence.
- After submission: calendar every receipt, biometrics, interview, evidence-request, and expiration date. Keep copies of anything filed and proof of delivery.
Protect privacy while sharing the file
Immigration records contain passport numbers, dates of birth, addresses, financial information, and signatures. Use an encrypted or access-controlled storage service, limit sharing to the people handling your case, and remove access for a former employer or outside vendor when it is no longer needed. Do not place scans in an unsecured shared folder or send an entire passport and tax archive to an unverified contact.
When emailing documents, ask counsel or the DSO which secure portal to use. If you must send an attachment, confirm the recipient’s address, use a password-protected file if instructed, and transmit the password separately. Retain the transmission record and the final version submitted.
Common mistakes and how to correct them
Treating a grace period as permission to work
A grace period can provide time to seek a filing or status solution, but it is not itself work authorization. Stop and obtain a category-specific answer before starting for a new employer, changing duties, or working after payroll ends.

Using the announcement date instead of the effective date
A company-wide announcement may precede the legal end of employment. Use the date in the written termination or separation documents, reconcile it with payroll, and ask HR to clarify discrepancies.
Assuming severance extends status
Severance payments may arrive after employment ends and do not automatically extend immigration employment. Preserve the agreement and ask counsel to analyze the arrangement.

Missing the OPT reporting requirement
F-1 OPT students should not wait for a new job or a final payroll statement before contacting the DSO. ICE/SEVP guidance sets a 10-day reporting window for specified changes, including loss of employment.
Relying on an old form or online summary
USCIS forms and procedures change. The USCIS evidence examples cited here come from instructions for particular applications, not a permanent universal checklist. Confirm the current edition, filing address, fee, and evidence requirements before submitting anything.
Final document checklist
- Status-and-deadline sheet with category, employer, effective last day, authorized validity, EAD or I-20 dates, pending filings, and dependent information.
- Passport identity and visa pages, I-94, I-797 notices, EAD, and I-20 or OPT endorsements as applicable.
- Offer and employment-verification letters, petition or support copies you may retain, job and worksite details, pay statements, W-2s, and relevant tax records.
- Layoff notice, separation or severance agreement, final pay and benefits records, and written clarification of the effective employment date.
- Secure digital backup, intact originals, document index, and a log of communications and deadlines.
- Written questions for counsel or your DSO addressing eligibility, timing, status effect, work authorization, family consequences, and travel.
Having this file ready does not decide which immigration route will work. It does ensure that the people who can evaluate your case have the dates and evidence needed to act before a category-specific deadline expires.
