How to pay a GST appeal pre-deposit through the electronic credit or cash ledger

For a first appeal against a GST demand, the GST portal generally requires payment of the admitted tax plus a pre-deposit of at least 10% of the disputed tax before the appeal can be filed. The safest way to make that payment is the portal’s Payment towards Demand function, because it records the amount against the relevant Demand ID. A payment made through Form GST DRC-03 is not automatically linked to that Demand ID, so the portal can continue to show the pre-deposit as unpaid even when money has left your ledger.

You may be able to use either the electronic cash ledger or, subject to section 49 restrictions and the current portal workflow, the electronic credit ledger. A reported Karnataka High Court ruling dated 14 August 2025 supports using eligible electronic credit for the section 107(6)(b) pre-deposit in the case before it, but that decision does not guarantee automatic acceptance in every order type or portal transaction. Confirm the legal basis and then verify the Demand ID entry before submitting APL-01.

What the GST appeal pre-deposit covers

The first appellate authority appeal is filed in Form GST APL-01 against an adjudicating-authority demand order. The GST Portal FAQ states that a minimum of 10% of the disputed tax must generally be paid as pre-deposit before filing the appeal. The amount is separate from any tax that you admit as payable. In practical terms, the portal normally works with two components:

One-click scans. No signup required.

  • Admitted amount: the tax, interest, penalty or other amount you accept under the order and that the portal includes in its demand calculation.
  • Pre-deposit: at least 10% of the disputed tax for the first appeal, subject to the governing law and the order details.

The portal can calculate the amount due as the admitted amount plus the required pre-deposit, after taking into account amounts already recorded against the demand. The relevant procedural explanation is in the GST Portal FAQ on appeal against a demand order.

This article addresses the first appeal to the appellate authority. It is not a calculation or filing opinion for a particular order. Your order type, tax head, dates and the law applicable to the transaction determine the amount that must actually be paid.

Check the order and Demand ID before paying

Do not start by depositing an arbitrary percentage into a ledger. First identify the demand that the appeal will challenge and the exact amount the portal is using.

Information to collect

  • The adjudicating-authority order and its communication date.
  • The disputed tax figure and the amount admitted, if any.
  • The GSTIN and the Demand ID shown in the electronic liability register or demand details.
  • The tax head or heads under which the liability is recorded.
  • Current balances in the electronic cash ledger and electronic credit ledger, including the relevant tax-head allocation.
  • Any earlier payment made for the order, including a DRC-03 reference number and date.

If the order has not been uploaded to the portal, the FAQ says that a self-certified copy must be submitted within seven days. Keep the order, calculation and payment evidence together so that a mismatch can be traced to a specific demand rather than treated as a new liability.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Confirm the appeal deadline

The portal FAQ describes a general three-month period from communication of the decision or order for filing the appeal. The appellate authority may condone up to one further month when sufficient cause is shown. A payment problem does not automatically extend that statutory period, so begin reconciliation early enough to file APL-01 within the applicable window.

How the portal calculates and matches a pre-deposit

The portal does more than check whether money exists in a ledger. It compares the appeal calculation with amounts already paid against the particular demand.

  1. It identifies the demand order selected for appeal.
  2. It calculates the admitted amount and the required pre-deposit from the order and applicable rules.
  3. It checks amounts recorded against that demand in the electronic liability register.
  4. It displays the remaining amount, if any, that must be paid before the appeal can be submitted.

That matching step is why the payment route matters. The official advisory explains that payment made through Payment towards Demand is adjusted against the selected Demand ID. The same advisory warns that a payment made through DRC-03 is not linked to the Demand ID. Read the advisory in full at the GST Portal’s pre-deposit payment and DRC-03 advisory.

Paying through the electronic cash ledger

The electronic cash ledger, PMT-05, records funds deposited with the government and can be debited for tax, interest, penalty, fees and other amounts. The payment rules describe that ledger and the demand-recording process at CBIC’s GST Payment Rules page.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 1: Put enough money in the cash ledger

If the cash ledger does not have enough balance in the required head, create a payment challan through the normal GST payment process and wait for the amount to appear in the ledger. Check the head-wise balance rather than only the total balance. A total balance can be adequate while the amount available under the tax head needed for the demand is not.

Step 2: Open the appeal application

  1. Sign in to the GST portal.
  2. Open Services > User Services > My Applications.
  3. Choose the option for an appeal to the Appellate Authority and start a new application.
  4. Select Demand Order and choose the order and Demand ID that will be appealed.

The labels and sequence are described in the portal FAQ. If the application displays an admitted amount plus a pre-deposit, compare both figures with your order before making the debit.

Step 3: Use Payment towards Demand

Choose the portal’s Payment towards Demand function for the selected Demand ID. Select the cash-ledger amount and the applicable tax head, review the amount, and submit the payment. The portal advisory says this route automatically adjusts the payment against the Demand ID.

Step 4: Verify the adjustment

Return to the demand details or electronic liability register and confirm that the payment is shown against the same Demand ID. Do not rely only on a successful challan or a reduced cash-ledger balance. Save the payment reference, date, amount, tax-head split and the screen showing the demand adjustment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 5: Recheck the appeal amount

Reopen the APL-01 calculation. The remaining amount should reflect the payment that has actually been matched to the demand. If the portal still shows an amount due, stop before paying a second time and follow the reconciliation process described below.

Paying through the electronic credit ledger

The electronic credit ledger, PMT-02, contains eligible input tax credit. Under the payment rules, debits from that ledger are subject to section 49 and the restrictions that apply to the credit. It is not a general-purpose cash account.

What supports credit-ledger use

A Karnataka High Court decision reported as VK Building Services on 14 August 2025 held, in the case before it, that electronic credit ledger funds could satisfy the 10% pre-deposit required by section 107(6)(b). The decision relied in part on CBIC Circular 172/04/2022-GST and earlier authority. The reported judgment is available at Indian Kanoon’s copy of VK Building Services.

This is useful legal authority, but it is not a universal portal guarantee. The ruling does not remove the need to check the current statute, the applicable CBIC guidance, the state or jurisdiction involved, the order type and the way the portal implements the transaction. A portal screen that permits a debit is not, by itself, a ruling on whether every category of credit is legally usable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When credit is a poor choice

  • The balance is not eligible input tax credit or is subject to a restriction, reversal or dispute.
  • The required amount is available only under a tax head that cannot be used for the liability shown.
  • The particular demand workflow does not offer an electronic-credit debit.
  • You cannot obtain a clear Demand ID adjustment after the debit.

In any of these situations, using cash may be operationally safer, but it does not eliminate the need to check the legal and accounting treatment of the payment.

Credit-ledger payment sequence

  1. Confirm the credit balance in PMT-02 and identify the credit type and tax head.
  2. Check that the order and Demand ID selected in the appeal application are correct.
  3. Open Services > User Services > My Applications > Appeal to Appellate Authority, select Demand Order, and review the admitted amount plus pre-deposit calculation.
  4. Use Payment towards Demand if the workflow offers the electronic credit ledger as a source.
  5. Authorize only the amount required for the demand calculation, subject to the legal advice applicable to your case.
  6. Confirm that the debit and the corresponding adjustment appear against the correct Demand ID and retain the ledger and demand records.

If the credit debit succeeds but the demand remains unpaid, do not assume that the debit was lost or that another payment is automatically required. Compare the PMT-02 entry, the electronic liability register and the appeal calculation, then seek appropriate reconciliation with the jurisdictional authority before paying again.

Electronic credit ledger versus electronic cash ledger

Issue Electronic credit ledger Electronic cash ledger
What it records Eligible input tax credit in PMT-02. Deposited funds in PMT-05.
Legal use Debits are limited by section 49 and the rules governing eligible credit. A reported 2025 Karnataka High Court decision supports use for the section 107(6)(b) pre-deposit in that case. Available for tax, interest, penalty, fees and other amounts described in the payment rules.
What to check first Eligibility, restrictions, tax-head allocation and whether the portal offers the credit debit for this demand. Available balance, tax-head allocation and whether the funds have settled into PMT-05.
Demand matching Must still be recorded against the selected Demand ID through the demand-payment workflow. Payment towards Demand is stated by the portal advisory to adjust automatically against the selected Demand ID.
Main operational risk A debit may be legally arguable but not reflected in the demand calculation if the workflow or tax-head treatment is wrong. A payment can reduce the cash balance without satisfying the demand if it is made outside the Demand ID workflow.

The ledger distinction and the treatment of demand payments are set out in the CBIC GST Payment Rules. The court decision should be read alongside the current rules and portal instructions, not as a substitute for them.

Why a DRC-03 payment may not satisfy the portal

DRC-03 is a separate payment route. The GST Portal advisory expressly states that a DRC-03 payment is not linked to the Demand ID. Consequently, the appeal screen can continue to request the admitted amount or pre-deposit even though the amount appears in a cash or credit ledger history.

What’s actually slowing this PC down?

How to diagnose the mismatch

  1. Record the DRC-03 ARN or reference, payment date, amount and tax-head split.
  2. Open the demand details and electronic liability register for the exact Demand ID in the appeal application.
  3. Check whether the DRC-03 amount appears as an adjustment against that Demand ID. A ledger debit alone is not proof of demand adjustment.
  4. Compare the portal’s admitted-amount-plus-pre-deposit calculation with the amount actually recorded against the demand.
  5. Do not make a second payment merely because the screen still shows a balance. First seek appropriate reconciliation and provide the DRC-03 evidence and the demand record.

If a further payment is ultimately required, use Payment towards Demand and verify the Demand ID adjustment. Keep the first payment evidence so that any duplicate or unallocated amount can be addressed separately.

File APL-01 after the payment is matched

Once the portal shows the required amount as paid against the demand, complete the appeal application rather than treating the payment receipt as the appeal itself.

  1. Review the order details, disputed tax, admitted amount and pre-deposit displayed in the application.
  2. Upload the required order and supporting documents in the format and size accepted by the portal.
  3. Submit Form APL-01 electronically within the applicable three-month period, or include the information needed for a condonation request if the authority permits the additional month for sufficient cause.
  4. Save the submission reference and acknowledgment.
  5. Confirm that the final acknowledgment in Form APL-02 and the appeal number are generated. The portal FAQ identifies APL-02 with the appeal number as the final acknowledgment of the filed appeal.

Where the order was not uploaded, follow the FAQ’s instruction to submit a self-certified copy within seven days. A payment without a completed APL-01 does not preserve the appeal deadline.

Common failure points and the response

The portal asks for the full pre-deposit after you paid

Check whether the payment was made through DRC-03 or another route that did not carry the Demand ID. Review the electronic liability register and the appeal calculation. If no adjustment is shown, seek reconciliation before paying again.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The cash balance is enough but payment is rejected

Inspect the head-wise balance and the tax-head allocation. A total ledger balance can be sufficient while the required head is short or unavailable for the liability. Correct the allocation through the permitted portal process or use another legally available source.

The credit-ledger option is missing

Do not treat the absence of a button as proof that credit can never be used, or as proof that it must be accepted. Check the current section 49 restrictions, the applicable circulars, the order type and the portal’s implementation. Obtain case-specific professional or jurisdictional confirmation before choosing cash solely to overcome a screen limitation.

The payment appears under a different demand

Stop the filing and preserve the transaction reference and screenshots. Compare the GSTIN, order number and Demand ID. A payment against another demand does not automatically satisfy the appeal pre-deposit for this order; seek correction or reconciliation through the appropriate authority.

The order is not visible

Use the appeal FAQ’s procedure for a self-certified copy when the order has not been uploaded, and observe the seven-day submission instruction. Keep proof of communication and upload attempts because the communication date controls the normal appeal period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The deadline is close and reconciliation is unresolved

Do not wait for an informal ledger assumption to expire the appeal period. Assemble the order, calculation, payment references and Demand ID record, and obtain prompt advice on filing, condonation and reconciliation from the appropriate GST authority or adviser.

Illustrative calculation

Assume, only as an illustration, that an order shows ₹20,000 of admitted tax and ₹1,00,000 of disputed tax. The 10% first-appeal pre-deposit on the disputed tax would be ₹10,000, so the portal could require ₹30,000 before filing, subject to the order and applicable law. If ₹10,000 was previously paid through DRC-03 but is not linked to the Demand ID, the portal may still display the full ₹30,000 requirement. The example demonstrates why the amount paid and the amount matched to the demand are separate checks; it is not a calculation for any particular taxpayer.

Records to retain

  • Communicated adjudication order and proof of the communication date.
  • Calculation showing disputed tax, admitted amount and the pre-deposit percentage used.
  • Demand ID and screenshots or downloaded records from the electronic liability register.
  • Cash-ledger challan, credit-ledger debit record or DRC-03 ARN, with date and tax-head split.
  • Evidence that the amount was adjusted against the correct Demand ID.
  • Submitted APL-01, submission reference and final APL-02 acknowledgment with appeal number.
  • Correspondence or reconciliation requests concerning an unlinked or duplicate payment.

These records let you demonstrate both payment and correct demand allocation if the portal calculation changes or the appeal file is reviewed.

Authorities and current-use caveat

The procedural starting point is the official GST Portal appeal FAQ. Ledger functions and demand recording are described in CBIC’s GST Payment Rules, while filing and acknowledgment provisions are in CBIC’s Appeal Rules. The DRC-03 matching warning appears in the GST Portal advisory. The reported Karnataka decision supporting credit-ledger use is VK Building Services, 14 August 2025.

Portal labels, tax-head behavior and legal guidance can change. Before filing, verify the current screen, the governing rule and the Demand ID entry for the specific order. The practical test is not merely whether a ledger was debited: the required amount must be legally permissible, paid through an appropriate route and recorded against the demand that APL-01 identifies.
