To open a custodial investment account, choose a UGMA or UTMA structure, confirm your state’s transfer rules, compare brokerage features, complete the custodian and minor’s application, and fund the account. The crucial decision comes first: money deposited is an irrevocable gift that belongs to the child. The custodian controls and invests it only for the child’s benefit until state law ends the custodianship. Because the child—not the adult contributor—ultimately owns the assets, a custodial account is fundamentally different from saving in your own account for a child.
How a custodial brokerage account works
A Uniform Gifts to Minors Act (UGMA) or Uniform Transfers to Minors Act (UTMA) account holds investments in a minor’s name. The adult who opens the account is the custodian; the minor is the beneficiary and legal owner of the property. The custodian makes investment and administrative decisions while the child is a minor, subject to the applicable state statute and the requirement to act for the child’s benefit. FINRA Regulatory Notice 20-07 describes these as the account’s common characteristics, but state law determines the precise rules.

The child owns every contribution
When you deposit cash or transfer securities, you are making a gift to the child. FINRA states that “Depositing assets into an UTMA/UGMA Account represents an irrevocable transfer from the donor to the beneficiary.” You generally cannot take the contribution back, change the beneficiary, or treat the account as your personal emergency fund. The custodian may spend or distribute money only in a way that benefits the child and fits the governing law.
The custodian manages, but does not own
The custodian can select investments, reinvest income, keep records, and request distributions for qualified child-related needs. Those powers do not turn the account into the custodian’s property. Keep the account titled correctly, separate from personal accounts, and document decisions so that a later review shows how each action served the child.

Control does not transfer at one national age
People often ask, “When can my child take over a UTMA account?” There is no single answer for every state. The governing state’s law may set a standard termination age, provide a later age for certain transfers, or allow an extension when statutory conditions are met. The brokerage’s process may also require forms, signatures, identity verification, and a new account registration. State law controls when the custodian’s authority ends; a provider’s generic description cannot replace a state-specific review.
Decide whether custodial ownership fits your goal
Before comparing brokers, decide whether you are comfortable giving the child an unconditional ownership interest. A custodial account can provide broad investment choice and flexible use, but the child will eventually control the money and may use it for any lawful purpose after the custodianship ends. If you want to retain ownership or restrict use to a particular purpose, a different structure may fit better.
Questions to answer before contributing
- Am I willing to make an irrevocable gift that cannot be reclaimed if family circumstances change?
- Is flexible use for the child’s benefit more important than restricting withdrawals to education?
- Can I keep the account invested and documented until the state’s termination event?
- Will the child’s eventual control fit the family’s expectations about spending, education, housing, or other goals?
- Who will serve as custodian if I become unavailable, and does state law permit that person?
Compare the main account types
| Feature | UGMA/UTMA custodial account | 529 education savings plan | Custodial IRA |
|---|---|---|---|
| Who owns the assets? | The child is the beneficial owner; an adult custodian manages the account during minority. | The account owner is generally the person designated under the plan; the beneficiary receives the education benefit. Plan documents determine ownership and change rules. | The child is the IRA owner; an adult custodian manages it while the child is a minor. |
| Permitted use and access | Withdrawals must benefit the child while the custodian serves. After the statutory transfer, the young adult controls the money and use is not limited to education. | Designed for qualified education expenses under applicable federal and plan rules. Nonqualified withdrawals can have different tax consequences. | Retirement-account distribution and contribution rules apply. A child must have earned income to be eligible to contribute. |
| Eligibility and contributions | Any minor who can be named under the provider’s and state’s rules; contributions are gifts and are not reversible. | Eligibility, contribution limits, investment menus, and state benefits depend on federal law and the specific plan. | Requires the child to have eligible earned income; annual contribution limits and other IRA rules apply. |
| Tax and reporting | Investment income belongs to the child and can create child-level filing obligations. | Tax treatment depends on qualified use, plan rules, and the taxpayer’s state and federal circumstances. | Tax treatment follows the applicable traditional or Roth IRA rules and the child’s reporting situation. |
| When the child gains control | At the termination point set by the governing state’s law, using the provider’s transfer process. | Control follows the plan’s ownership and beneficiary rules rather than a UTMA/UGMA termination age. | The child owns the IRA from the start; custodial administration ends under the applicable minor-account rules. |
| State-law variation | Termination ages, extensions, custodian restrictions, and procedures vary by state. | State tax benefits and plan terms vary. | Federal IRA rules apply, with custodial procedures and some state-law issues affecting administration. |
Investor.gov identifies 529 plans as education savings plans and custodial IRAs as options when a child has earned income. Confirm current federal rules, state benefits, and plan documents before choosing among them. Do not open a UTMA/UGMA merely because it is familiar if its ownership and access rules conflict with the purpose of the money.
Check your state’s UGMA/UTMA rules first
Find the law for the state that governs the account before you apply. FINRA’s notice explains general UTMA/UGMA features but does not resolve the law for every state. The brokerage may ask for a governing state, and the answer can affect the child’s transfer date and the custodian’s authority.
Verify these points
- Whether the account will be governed by the Uniform Gifts to Minors Act or Uniform Transfers to Minors Act.
- The age at which the child may demand delivery or control, and whether different ages apply to different types of property or transfers.
- Whether the statute permits an extended termination age and what conditions must be met.
- Who may serve as custodian, whether a successor may be named, and what happens if the custodian dies, resigns, or becomes unable to act.
- Whether the state requires a particular notice, accounting, court action, or delivery method.
Use the statute, a qualified legal professional, or a provider’s state-specific legal materials for this check. Do not rely on a friend’s experience in another state or on the common shorthand that every UTMA ends at age 18.
Compare brokerage providers without choosing on name alone
Brokerage applications and custodial services differ. Compare the features that will affect the account for years, then read the firm’s relationship summary and investigate the firm and any professional you will use. A provider’s current official fee schedule and account agreement are the controlling documents; fees, minimums, investment menus, and transfer procedures can change.

Do not assume that a standard individual brokerage agreement covers a custodial account. Ask specifically how the provider handles the governing state, successor custodians, cash withdrawals for the child, and the final conversion or delivery.

1. Define the purpose and accept the ownership consequence
Write down what the money is intended to accomplish and whether unrestricted young-adult control is acceptable. If your aim is education-only saving, examine a 529 first. If the child has earned income and the priority is retirement saving, examine a custodial IRA. If you need to keep ownership while saving for a child-related expense, a custodial account may not be the right legal structure.
2. Confirm the governing state and termination rules
Identify the state whose law will govern the registration. Verify the act, termination age, extension provisions, custodian eligibility, and successor process. Save a copy of the relevant provider disclosure and your notes. Put the expected transition date on a calendar, but treat it as a planning reminder rather than proof that the account will transfer automatically.
3. Select a provider using current documents
Shortlist providers whose fees, investment availability, cash treatment, statements, and transfer services suit the goal. Read the account agreement, relationship summary, privacy disclosures, and current fee schedule. Ask customer service for the exact custodial application and a sample of the conversion instructions so you know what will be required later.
4. Gather the information the application requests
SEC Investor Bulletin guidance indicates that a brokerage application commonly requests names, Social Security numbers or taxpayer identification numbers, addresses, dates of birth, and identity information. You will normally provide this information for both the minor and the custodian. The provider—not a generic checklist—determines which identification documents, certifications, signatures, and successor-custodian details are required. Submit only through the provider’s secure application process.

6. Fund the account and choose investments deliberately
Fund with cash or eligible securities according to the provider’s instructions, remembering that each contribution is an irrevocable gift. Before submitting an investment order, consider the objective, time horizon, risk tolerance, liquidity needs, cash handling, and account type—the factors highlighted in the SEC’s account-opening guidance. Confirm whether the account permits margin, options, or other features and whether any default setting would activate them. Do not use a model allocation as a substitute for assessing your family’s circumstances; the appropriate investment mix depends on the goal, time until the child gains control, and ability to tolerate loss.
7. Save confirmations and establish a review routine
Keep the application confirmation, account agreement, state-law notes, contribution records, trade confirmations, statements, and tax forms in a durable file. Verify that the first deposit and each security appear correctly. Set a calendar reminder to review the account at least annually and before the anticipated termination date.
Manage investments and cash after opening
Match risk to the actual time horizon
The account may remain invested for years, but the relevant horizon ends when the child can obtain control under state law—not when the adult hopes the money will be used. Review whether the current holdings still match that horizon and the family’s ability to withstand market declines. Diversification, costs, liquidity, and tax consequences all matter; avoid making a concentrated bet simply because the account is small.

Understand cash and order mechanics
Uninvested contributions may sit in a sweep vehicle or money-market option selected by the provider. Check the yield, fees, settlement timing, and whether dividends and distributions are automatically reinvested. Keep enough liquidity for an authorized child-related expense without selling an investment at an unsuitable time, but do not leave long-term funds in cash solely because the default is convenient.
Make distributions only for the child’s benefit
Document the purpose, amount, date, and supporting receipt for every withdrawal. Paying a cost that is genuinely for the child is different from using the account to cover the custodian’s personal bills or another family member’s expenses. When the purpose is uncertain, pause and obtain professional advice rather than assuming that a parental obligation automatically permits a withdrawal.
Keep contributions and ownership records distinct
Record the donor, date, amount, security, and account value for every contribution. Do not mix custodial assets with the custodian’s individual brokerage holdings. Separate records make it easier to answer the provider’s questions, prepare tax documents, and demonstrate that the custodian acted for the beneficiary.

Tax reporting for a child’s investment income
The child’s property and the income it produces are not the custodian’s personal assets. The IRS explains that a child’s unearned income includes income produced by property belonging to the child, regardless of who transferred or purchased that property. Dividends, interest, capital-gain distributions, and realized gains can therefore create a filing obligation for the child.

The 2025 Form 8615 threshold
For tax year 2025, the IRS instructions for Form 8615 state that a child who meets the listed age, filing, and other conditions and has more than $2,700 of unearned income must file Form 8615. The amount is specific to the 2025 filing year and the conditions in those instructions; it is not a permanent threshold. Check the instructions for the tax year being filed, retain all brokerage tax forms, and ask a tax professional whether the child or parent must file additional forms.
Build tax administration into the routine
- Download the child’s year-end statements and every tax form issued by the brokerage.
- Track interest, dividends, distributions, sales, and realized gains separately from contributions.
- Check whether a corrected tax form is issued before filing.
- Give the tax preparer the account registration and the child’s identifying information, not just the custodian’s information.
- Recheck thresholds and filing instructions every year because tax rules and forms change.
This is general information, not individualized tax advice. A preparer can determine the child’s filing requirement and the correct treatment of a particular transaction.
Prepare for the child’s takeover before it arrives
“What happens to a UTMA account when my child turns 18?” depends on the governing state and the account agreement. The statutory event may occur at 18, 21, or another age, and some laws permit an extension. Even when the child becomes entitled to the property, the brokerage may not retitle or deliver it without a request and supporting documents.
- At least several months before the applicable termination date, ask the brokerage for its conversion or delivery packet.
- Confirm which signatures, identification documents, tax forms, and new-account applications are required from the child and custodian.
- Ask whether assets can transfer in kind or must be liquidated, and how cost basis and tax forms will be reported.
- Review recurring deposits, dividend reinvestment, standing instructions, and electronic access; cancel or update them before authority changes.
- Keep proof of delivery, the final custodial statement, and the new registration for your records.
Do not promise that the child will receive a check automatically on a birthday. The custodian’s authority ends according to state law, and continuing to act after that point can create legal and administrative problems. If the child does not respond to the provider, ask the firm what its unclaimed-property or court-directed process is rather than continuing to trade as though nothing changed.

Treating the account as a parent’s savings bucket

Assuming every state uses age 18
Problem: A family plans around an online rule of thumb and misses the actual termination date or an available extension. Correction: Verify the governing statute and provider process when the account is opened and again before transition.
Choosing investments before defining the goal
Problem: The account holds a volatile or illiquid position when the child is about to gain control. Correction: Reassess horizon, liquidity, risk tolerance, and diversification on a scheduled basis; do not trade solely in response to headlines.
Ignoring cash defaults and fees
Problem: Contributions accumulate in an unsuitable sweep vehicle or recurring service charges go unnoticed. Correction: Read the current fee schedule, inspect statements, and confirm cash and reinvestment settings after each material account change.
Missing the child’s tax paperwork
Problem: The family reports income under the custodian’s information or overlooks a corrected brokerage form. Correction: Maintain a tax-year file for the child, compare forms with statements, and consult a preparer before filing.
Waiting until the transfer date to contact the broker
Problem: The child cannot access the assets because identity verification or a new registration is incomplete. Correction: Start the provider’s conversion process months in advance and document every submission.
Annual custodial-account checklist
- Confirm the account title, governing state, custodian, and successor information are still correct.
- Review holdings, diversification, risk, liquidity, cash sweep, reinvestment, and fees against the goal.
- Reconcile contributions, withdrawals, transfers, and statements.
- Save trade confirmations, year-end statements, tax forms, and records supporting each distribution.
- Check whether the child has an upcoming termination date and request updated transfer instructions.
- Revisit whether a UTMA/UGMA still fits future contributions; new money can be directed to a different account even though past gifts cannot be reclaimed.
A custodial brokerage account can be useful when you want to give a child an investment asset with broad eventual flexibility. Its defining trade-off is permanent ownership: the child receives the property, the custodian manages it temporarily, and state law determines when control must pass. Make that decision first, then open, invest, document, and transition the account with the same care you would apply to any legally owned financial asset.
