The child—not the adult—owns the assets. You manage them only until the termination age required by the governing state and account agreement, commonly somewhere between 18 and 25. Because control must eventually pass to the child, confirm that this ownership structure fits before depositing money.
What a custodial brokerage account is
A custodial brokerage account is an investment account an adult opens and manages for a minor under a state-law framework generally called the Uniform Gifts to Minors Act (UGMA) or Uniform Transfers to Minors Act (UTMA). The custodian handles investing, record-keeping and transactions, but the property is held for the child.
As an Amazon Associate I earn from qualifying purchases.
This is different from putting money in your own brokerage account and mentally earmarking it for a child. In a custodial account, the child is the beneficial owner of the contributed money, securities and resulting investment income. The account registration and the provider’s terms identify the custodian, the minor and the state law that controls the eventual change in control.
Ownership and control are separate
During the custodial period, the adult usually has authority to manage the investments and make decisions for the child’s benefit. That authority does not turn the assets into the adult’s property. When the applicable termination age arrives, the child must receive control under the governing rules. Fidelity describes the termination age as varying by state, generally between 18 and 25; the exact age can depend on state law and the account’s registration.

State rules and provider procedures are not interchangeable. Before opening or contributing, ask the provider which state’s law governs the account, what termination age it will apply, and how it handles the handoff. Do not rely on a general age range as a substitute for that confirmation.
Treat contributions as a lasting gift
Once money or investments are placed in the account, the child owns them. The structure is therefore a lasting commitment: do not contribute money you may later need for your own expenses, expect to reclaim, or plan to redirect to a different beneficiary. The sources establish child ownership and mandatory transfer, but the legal effect of a particular transaction can depend on the applicable state law and account agreement. Consult a qualified attorney for an unusual transfer, dispute or estate-planning question.

- Can you accept the handoff? You will not retain custodial control indefinitely; the required transfer occurs at the applicable age.
- Is the purpose broad enough? Custodial funds can generally support the child’s benefit beyond education, subject to the provider’s terms and applicable law.
- Will you maintain records? Interest, dividends, capital gains and tax forms may need to be tracked for the child.
- Does the governing state and provider support the registration? Availability, termination age and transfer procedures vary.
If you need assets to remain under your control after the child becomes an adult, pause before making a gift and investigate a different account structure. A custodial account is appropriate only when eventual child control is an intended outcome, not an unwelcome surprise.
UGMA versus UTMA
UGMA and UTMA are related custodial-account frameworks, not two investment products with identical rules in every state. The provider will offer the registration permitted for the governing state and will identify the applicable termination provisions. Ask the firm:
- Which registration—UGMA, UTMA or another state-specific form—will be used?
- Which state’s law governs the account?
- At what age does the custodianship terminate for this registration?
- Can the termination age be extended under the account’s terms or state law, and if so, how?
- What documents and steps are required when control changes?
Do not infer your state’s exact rule from another state’s account or from a provider’s general marketing page. Get the answer in writing from the firm’s current account materials or service team.
How to open the account: a practical sequence
1. Define the goal and funding source
Write down why you are contributing, how much you can permanently dedicate, and whether the money is a one-time gift or recurring contribution. A clear purpose helps you choose investments and prevents accidental use of funds for the adult’s expenses. If grandparents or other relatives will contribute, establish who will make deposits and who will retain tax records.

2. Verify state availability and the termination age
Review the provider’s current custodial-account page and application disclosures for your state. Confirm both the registration offered and the age at which the child takes control. Provider descriptions commonly give a broad range, but only the governing state law and the account’s actual registration answer the question for your child.
3. Compare providers on terms that matter
Before entering personal information, compare the current account terms rather than choosing solely by brand recognition. At minimum, check:
| Term to compare | Questions to ask |
|---|---|
| Availability | Is a UGMA or UTMA account offered for the governing state and the child’s circumstances? |
| Application process | Can you apply online, and does the firm require identity verification or follow-up documents? |
| Investments | Which stocks, bonds, mutual funds, exchange-traded funds or other investments are available? |
| Fees | Are there account, transaction, fund, advisory, transfer or other recurring charges? |
| Contributions | How can you deposit money, and are there minimums or restrictions? |
| Withdrawals | What process does the provider use to document a withdrawal for the child’s benefit? |
| Handoff | How will the child establish control at termination, and what notice does the firm provide? |
Large brokerage firms publish custodial-account information, but their fees, investment menus, forms and transfer procedures can change. Read the current disclosures for the exact account you are opening.
4. Gather the information the provider requests
There is no single universal document list established for every brokerage. Use the chosen firm’s current checklist. The application commonly asks for identifying and contact information for both the custodian and the child, the governing state, citizenship or tax details, and the bank information used to fund the account. The firm may request identity verification or additional documentation before approving the registration.
Enter the child’s legal name and identifying information exactly as requested. Do not substitute the adult’s information for the child’s simply because the adult is completing the form. Save a copy of the completed application, disclosures and account number in a secure location.
5. Submit the application and verify the registration
After submission, check the confirmation carefully. It should show the adult as custodian and the minor as the owner or beneficiary under the selected UGMA or UTMA registration. Correct an error before funding. Confirm that the state, termination provisions and tax-reporting name match your understanding.
6. Fund the account
Transfer only money or investments you are prepared to place under the child’s ownership. Follow the provider’s instructions for an electronic bank transfer, check, securities transfer or recurring contribution. Keep the deposit confirmation and record the date, amount, asset and source of every contribution.

If someone else is contributing, give that person the account’s instructions and explain that the deposit becomes the child’s property. Do not describe the account as a temporary holding place or promise that you can return the money.
7. Choose investments for the child’s benefit
Select investments from the provider’s available menu using the child’s time horizon, risk tolerance and the purpose you documented. A custodial account is not restricted to tuition; provider information indicates that custodial funds may be used for the child’s benefit beyond education. Before selling or withdrawing, review the account terms and applicable law and document why the transaction benefits the child.
Avoid treating the account as a personal emergency fund or as a way to pay the adult’s household bills. Keep a simple investment policy in writing: target allocation, contribution schedule, circumstances for rebalancing and who will review statements.
8. Organize records from the first transaction
Create a folder—digital or paper—for statements, trade confirmations, contribution records, tax forms and notices. Record dividends, interest, sales, capital gains and any withdrawals. These records will help determine who reports income, support the child’s tax return if needed and make the eventual handoff easier.
Tax treatment: what the family must monitor
Investment income generated by property belonging to the child is the child’s income for tax purposes, even while a custodian manages the account. Interest, dividends and capital gains can therefore create filing obligations separate from the adult’s return. The correct filing depends on the child’s age, income, filing status, the parents’ circumstances and the tax year.

For tax year 2025, IRS instructions say Form 8615 may apply when a child has more than $2,700 of unearned income, provided the other age, filing and parent-related conditions are met. The IRS describes unearned income as including taxable interest, dividends and capital gains, and includes income from property belonging to the child. The $2,700 figure is specific to the 2025 instructions; it is not a timeless threshold.
Possible parent election under Form 8814
For 2025, the IRS says a parent may be able to elect to report a child’s interest, dividends and capital-gain distributions on the parent’s return when the child’s gross income is less than $13,500 and the other requirements are satisfied. This is an election with specific eligibility conditions, not a general exemption from filing. Check the current-year IRS instructions before choosing it.

Records that make tax season manageable
- Keep each brokerage Form 1099 and any corrected form.
- Record the purchase date, cost basis and sale date for every security sold.
- Separate contributions from investment income; a contribution is not the same as taxable earnings.
- Note the child’s other unearned income, because thresholds apply to the child’s total qualifying income.
- Ask a tax professional about the child’s filing requirement, the kiddie-tax rules and whether a parent election is available.
Tax rules change. Recheck the IRS instructions for the year being filed rather than carrying forward the 2025 figures automatically.

A custodial brokerage account is not interchangeable with every account marketed for children. Compare the purpose, ownership, eligibility and transfer rules before choosing.
| Account type | Primary purpose | Who owns or controls the assets | Key eligibility or timing point |
|---|---|---|---|
| UGMA/UTMA custodial brokerage account | Broad investment for the child’s benefit | The child owns the property; an adult manages it during the custodial period | Control transfers at the applicable state and account termination age, generally within the 18–25 range described by provider materials |
| 529 education account | Education savings | Account ownership and control follow the 529 plan’s rules rather than a UGMA/UTMA registration | Review the plan’s qualified-use, withdrawal and beneficiary-change rules; do not assume the tax or aid result is always superior |
| Teen brokerage account | Investing with a different access or ownership arrangement for a teenager | Depends on the specific product and agreement | Read the provider’s age, supervision and control terms; it is not automatically a custodial account |
| Custodial IRA | Retirement saving for the child | Established for the child under custodial IRA rules | The child must have earned income; investment income from a custodial brokerage account does not by itself satisfy that requirement |
Financial-aid treatment, tax effects and control can differ substantially among these choices. Verify current rules for your family instead of assuming one account always produces a better result.
Common mistakes and how to prevent them
Opening the wrong registration
An ordinary individual brokerage account in the adult’s name is not a custodial account. Read the confirmation and statement header to ensure the child is identified as the owner under the intended UGMA or UTMA registration.
Assuming the adult keeps control until any chosen age
The termination age is governed by the applicable state and account terms. Ask for the exact age before contributing and calendar the handoff well in advance.
Using a generic document checklist
Brokerages do not necessarily request the same documents. Follow the selected provider’s current checklist and respond promptly to identity-verification requests rather than relying on another firm’s requirements.
Free tools Windows power users keep installed
One-click scans. No signup required.
Spending money without documenting the child’s benefit
Keep receipts, notes and approvals for withdrawals. Review the provider’s rules and applicable law before using funds for anything that is not clearly for the child.

Ignoring small amounts of income
Dividends, interest and realized gains can accumulate even when no cash is withdrawn. Reconcile statements annually and check the relevant IRS instructions for the child’s total income.
Waiting until termination to think about the transfer
Confirm the provider’s handoff process early. The child may need to establish an account, provide identification or complete forms before control can be changed. A record of contributions and cost basis will help the new owner understand the holdings.
Preparing for the eventual handoff
Several months before the applicable termination age, contact the provider and ask for its current transfer checklist. Confirm the date, documents, account registration that will replace the custodianship and how pending trades or distributions will be handled. Explain to the child what the account contains, how statements work and which tax forms may arrive.
Recommended Free Tools
At transfer, save the final custodial statement and confirmation of the change in control. The child should understand that the assets are now under the child’s control and that future investment, withdrawal and tax decisions belong to the new owner under the provider’s and state’s rules.
Questions to ask the brokerage before funding
- Is this account available in my state, and is it registered as a UGMA or UTMA?
- Who is listed as owner, custodian and successor custodian, if applicable?
- Which state law governs, and what exact age ends the custodianship?
- What investments, fees and minimums apply today?
- How are contributions, withdrawals and transfers documented?
- What tax forms will the firm issue, and under whose taxpayer identification number?
- What is the step-by-step process for transferring control to the child?
Write down the answers and keep the provider’s disclosures with your account records. Terms can change, so revisit them before making a large contribution or approaching the transfer date.
Bottom line
Open a custodial brokerage account only when you are comfortable making the child the owner and eventually giving the child control. Verify the state-specific termination age, use the chosen provider’s current application requirements, invest solely for the child’s benefit, preserve complete tax records and prepare early for the handoff. For tax-year 2025, the IRS figures to watch are the possible Form 8615 threshold above $2,700 of unearned income and the possible Form 8814 parent-election ceiling below $13,500 of gross income, subject to all other requirements; confirm the rules for the year you are filing.
