Moving back to India does not, by itself, require you to cash out a US 401(k). Your practical choices are usually to leave the balance in the former employer’s plan, complete a direct rollover to an eligible US retirement account, or take a distribution. The right choice depends on the plan’s rules, your US and Indian tax residence for the relevant year, whether the money is traditional or Roth, your age, the form of payment, and your need for cash.

Before requesting any transaction, get the plan administrator’s answer on servicing an India address and have the exact payment reviewed for both US and Indian tax. A withholding amount is not necessarily your final tax, and a US–India treaty provision for pensions does not automatically make every lump-sum 401(k) withdrawal tax-free.

What changes when you move to India?

The account does not disappear when you leave the United States. A former employer’s plan may allow you to keep the balance, but that is a plan-specific decision. Ask the administrator in writing whether a participant who lives in India can retain the account, use the website and telephone service, change beneficiaries, update an address, receive payments to an Indian bank account, and request a direct rollover.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Moving also changes the tax questions. You may be a US tax resident for part of a year, a nonresident alien under US rules, an Indian resident or nonresident under Indian rules, or a dual resident whose treaty position requires analysis. The same payment can produce different results depending on whether it is periodic or a lump sum, whether it is taxable or Roth money, and whether you are a US citizen or other person covered by the treaty’s saving clause.

Keep these distinctions separate:

  • Withholding: tax deducted by the payer when money is paid.
  • Final liability: tax calculated on your return after applying the rules, treaty provisions, credits and exceptions.
  • Account administration: whether the plan or receiving account will actually service you in India.

Do not choose an option solely because a payer says a percentage will be withheld. That percentage is an advance collection mechanism, not a personalized prediction of what you ultimately owe.

Compare your three main choices

Choice What it does Questions to answer first
Leave the balance in the former employer’s plan Avoids an immediate distribution and preserves the existing plan arrangement. Will the plan keep an account for someone living in India? Are investments, fees, minimum-balance rules, beneficiary changes, identity checks, online access and payments to India supported?
Direct rollover to an eligible US plan or traditional IRA Moves eligible retirement money directly to another qualifying US retirement account, generally deferring current US tax. Will the destination accept the assets? Does the former plan permit the distribution now? Will the new custodian service an India address? How will India treat the account and later withdrawals?
Take a distribution Provides cash for a known need or a deliberate tax strategy. What is taxable in the US and India? Will age-based additional tax apply? What withholding, currency, filing, foreign-tax-credit and treaty issues arise?

Compare the choices using your tax residence, traditional versus designated Roth amounts, age and possible exceptions, lump-sum versus periodic payments, plan fees and investments, current cash needs, beneficiary administration, and the treatment of foreign tax credits. The sources available do not establish a universal policy for any particular plan provider or brokerage.

First, identify exactly what is in the account

Download the latest statement and request the plan’s distribution paperwork before deciding. Separate the following components:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Traditional or pre-tax 401(k): amounts generally not previously included in US taxable income.
  • Designated Roth 401(k): contributions and earnings subject to qualified-distribution rules that differ from pre-tax money.
  • After-tax basis: employee contributions that may have a different tax basis from earnings.
  • Employer stock: special rules can apply, so do not assume ordinary rollover treatment.
  • Outstanding loan: a loan offset or default can create a distribution that needs separate analysis.
  • Prior rollovers and distribution history: these affect records, basis and whether a proposed payment is eligible for rollover.
  • Required minimum distributions, hardship payments or corrective distributions: some categories are excluded from rollover treatment.

Ask for the plan’s tax-basis information, the gross and net amount for each proposed payment, the expected tax form, and an explanation of any amount that cannot be rolled over. Keep this information with your US and Indian tax records.

Option 1: Leave the money in the former employer’s plan

Leaving the balance can be the least disruptive choice when the plan has acceptable fees and investments and will continue to service you abroad. It avoids triggering a distribution simply because you changed countries.

Questions for the plan administrator

  1. Is a former employee living in India permitted to keep the account, and is there a minimum balance?
  2. Can you change your mailing address, telephone number, email, beneficiaries and trusted contacts from India?
  3. Will login, two-factor authentication, customer service and identity verification work with an Indian address or phone number?
  4. Can the plan send a distribution to India, and in what currency and through which payment method?
  5. What investment choices, administrative fees and transaction restrictions apply after separation from service?
  6. How will the plan handle required distributions, tax forms and a future address change?

Request the answers in writing. A plan’s willingness to retain the account does not guarantee that every online feature, payment method or identity check will work outside the United States.

Option 2: Complete a direct rollover to an eligible US account

The Internal Revenue Service describes a rollover as moving a distribution from one qualified retirement plan to another qualified plan or a traditional IRA. A qualifying direct rollover generally defers current US tax because the money is paid directly to the receiving plan or IRA rather than to you.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How a direct rollover works

  1. Ask the former plan whether the proposed distribution is eligible for rollover and whether the plan can make a trustee-to-trustee transfer.
  2. Confirm with the receiving US plan or traditional IRA that it accepts this type of asset and can service an owner living in India.
  3. Obtain the receiving account’s exact registration, mailing instructions and transfer language. A mismatch can delay or reject the transaction.
  4. Instruct the former plan to pay the eligible amount directly to the receiving trustee or custodian, not to you personally.
  5. Keep the distribution statement, rollover confirmation and account statements showing the transfer.

Most eligible distributions can be rolled over, but the IRS lists exceptions including required minimum distributions, hardship distributions, certain corrective distributions and certain long-duration payment series. Ask which rule applies to your specific payment rather than assuming that every amount in the account is eligible.

Why participant-paid rollovers are riskier

If an eligible rollover distribution is paid to you, the IRS generally requires 20% withholding. You generally have 60 days to complete the rollover. To roll over the full gross amount, you would have to replace the withheld 20% from other funds; otherwise, the withheld portion may remain taxable. The 60-day deadline and 20% withholding are current IRS guidance accessed in 2026. They are procedural rules, not a statement of your final tax.

A direct rollover avoids sending the eligible distribution to you and therefore generally avoids that mandatory 20% participant-payment withholding. Confirm with both administrators that the destination is eligible and that the transaction will be coded as a direct rollover.

Option 3: Take a distribution

A distribution can make sense when you have a documented cash need or a deliberate, professionally reviewed tax plan. It can also create the most immediate tax and filing work.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

US age-based additional tax

The IRS says the taxable portion of a distribution before age 59½ may be subject to a 10% additional tax unless an exception applies. One listed exception involves a series of substantially equal periodic payments that begins after separation from service and continues for the required period. That is a technical rule with strict conditions, not a general recommendation to start periodic withdrawals.

Check whether the proposed payment is taxable, whether an exception is documented, and whether another rule applies before requesting funds. Do not treat a plan’s withholding election as proof that the 10% additional tax does or does not apply.

Traditional and Roth money

Traditional 401(k) amounts and their earnings generally require a different analysis from designated Roth amounts. A Roth distribution can depend on qualification and holding-period rules, while Indian law may not mirror the US characterization. After-tax basis, employer stock, an outstanding loan, a required minimum distribution or a scheduled series can change the result. Obtain the plan’s component breakdown and have the exact transaction reviewed in both countries.

US tax residence and nonresident withholding

If you become a US nonresident alien, the IRS says payments from pensions and annuities are generally subject to withholding under Internal Revenue Code section 1441 unless a treaty withholding exemption applies. The payer may require foreign-status and treaty documentation. Changing your mailing address or submitting a US resident withholding form does not, by itself, establish eligibility for a treaty rate.

The IRS distinguishes effectively connected income from US-source fixed, determinable, annual or periodical income. A nonresident alien may need Form 1040-NR when taxable US income was not fully satisfied by withholding, and may file to claim a refund or a treaty benefit. The classification of a particular retirement payment depends on its facts and the applicable rules.

Before the payment is made

  • Ask the payer what payment classification it will use and which tax form it expects to issue.
  • Ask what foreign-status or treaty forms it requires and the date by which they must be renewed.
  • Request an estimate of gross payment, federal withholding, any state withholding, fees and net proceeds.
  • Keep the withholding statement even if you believe the treaty eliminates or limits US tax.

In your records, treat withholding as tax paid on account until a qualified adviser establishes the final liability and whether a refund or additional payment is due.

How the US–India tax treaty fits in

The US–India Income Tax Treaty entered into force on December 18, 1990. Article 20(1) states: “Any pension, other than a pension referred to in Article 19 (Remuneration and Pensions in respect of Government Service), or any annuity derived by a resident of a Contracting State from sources within the other Contracting State may be taxed only in the first-mentioned Contracting State.” Article 20(3) defines a pension as “a periodic payment made in consideration of past services or by way of compensation for injuries received in the course of performance of services.”

Those words make residence and payment character central. They do not establish that every lump-sum cash-out, or every distribution from every type of 401(k), is a qualifying treaty pension. The IRS notes that pension results depend on the particular treaty, the taxpayer’s residence, the relevant article and any special rule for lump sums.

Residence, citizenship and the saving clause

Determine domestic-law residence in each country before using a treaty tie-breaker. Under the US–India text, the tie-breaker looks first to a permanent home, then to closer personal and economic relations, then to habitual abode and then to nationality. If both or neither nationality applies, the competent authorities may settle the question by mutual agreement.

The treaty also contains a saving clause that preserves taxation by a country of its residents and citizens in specified circumstances, subject to limited exceptions. A US citizen, green-card holder, dual resident and nonresident alien should not assume the same outcome. Ask an adviser to analyze citizenship, immigration status, residence for the payment year, the payment form and the exact treaty article before claiming exemption from US tax.

Indian tax residence and reporting

India’s Income Tax Department says determining residential status is essential to determining taxability. Its general guidance says a resident taxpayer is generally taxable in India on income regardless of where it is earned or accrued. A nonresident generally is not taxed on foreign income, except for listed connections such as income received in India or certain income from a business controlled or profession set up in India.

This framework must be applied to the relevant Indian tax year and to the particular 401(k) event. The official guidance reviewed does not establish a single Indian treatment for annual 401(k) investment accruals, a universal deferral election, or every lump-sum payment. Do not assume that an amount excluded from current US tax is also excluded from Indian tax.

Foreign tax credit

India’s foreign-tax-credit guidance says a resident may claim credit for qualifying foreign tax paid on income also taxed in India. The credit is limited to the lower of the Indian tax attributable to that income and the foreign tax paid, and documentation requirements apply. The guidance lists Form 67, a statement of income and tax, and supporting proof such as payer or foreign-authority documentation.

A US withholding amount does not automatically qualify. The foreign tax and the corresponding income must be reported and matched under Indian rules. Keep the US tax statement, proof of payment or withholding, Indian income computation, exchange-rate calculation and any treaty documentation needed to support the claim.

A transaction checklist before you act

  1. Inventory the account. Record traditional, designated Roth and after-tax amounts, employer stock, loans, prior rollovers, beneficiaries and any required distribution or scheduled payment.
  2. Get plan rules in writing. Confirm continued participation from India, address and identity procedures, investment and fee information, beneficiary updates, payment methods and eligible rollover options.
  3. Model all three choices. For staying, rolling over and distributing, request gross amount, withholding, fees, expected tax forms, currency, deadlines and net proceeds.
  4. Establish residence. Determine US federal status and Indian residential status for the tax year in which the payment, rollover or other event occurs.
  5. Analyze the treaty payment form. Ask specifically whether the proposed payment is periodic or a lump sum, which Article 20 rule is being relied on, and whether the saving clause changes the result.
  6. Check early-distribution rules. If you are under 59½, identify the taxable portion and document any claimed exception before taking funds.
  7. Confirm receiving-account eligibility. For a rollover, obtain acceptance from the new US plan or IRA and verify that it services an India-based owner.
  8. Prepare filing and credit records. Plan for any US Form 1040-NR filing, refund claim or treaty disclosure, and for Indian income reporting and Form 67 if the credit rules are met.
  9. Execute only after reconciliation. Match the requested gross amount, withholding, destination, currency and beneficiary information to the written instructions, then retain confirmations.

Common mistakes and how to avoid them

Assuming relocation forces a cash-out

It usually does not follow from the move alone. Ask the plan whether it permits the account to remain open and what services are restricted for an India address.

Confusing a direct rollover with a check mailed to you

A payment to you can trigger 20% withholding and the 60-day rollover deadline. A direct trustee-to-trustee transfer is generally the cleaner process for an eligible rollover.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Calling every 401(k) payment a treaty-exempt pension

Article 20 refers to a pension and defines it as a periodic payment. A lump sum needs separate analysis, as do citizenship, residence and saving-clause issues.

Treating withholding as the final bill

US withholding can be higher or lower than final liability. A return may be needed to report the payment, claim a refund or establish a treaty position.

Ignoring Indian residence

Indian taxation turns heavily on residential status and the nature of the income. A US rollover that defers current US tax does not automatically answer when India taxes the account or payment.

Relying on an address change as treaty paperwork

The payer may require specific foreign-status or treaty documentation. Complete the forms it requests only after confirming that the claimed status is accurate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Failing to preserve exchange-rate and tax-credit evidence

Foreign-tax-credit claims require documentation and matching income. Keep contemporaneous statements, payment proofs and the exchange rates used in Indian reporting.

What to keep in your permanent file

  • Final and current 401(k) statements, including tax-basis and Roth information.
  • Plan descriptions, fee schedules and written servicing answers for an India address.
  • Rollover instructions, acceptance confirmations and trustee statements.
  • Distribution notices, withholding certificates and US tax forms.
  • Residency determinations, treaty forms and advice supporting any exemption or reduced rate.
  • Indian returns, Form 67 and proof of foreign tax paid when claiming a credit.
  • Bank records, payment dates, currencies and exchange-rate calculations.
  • Beneficiary designations and evidence of every update.

The safest sequence is to establish both countries’ tax status, confirm the plan’s operational rules, compare staying, directly rolling over and distributing, and obtain advice on the exact proposed payment before money leaves the account. Do not convert, withdraw or roll over solely to obtain an assumed tax result.
