How to Make a Cyber Insurance Claim After Identity Theft or Online Fraud

By TheFinanceBase Team 10 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Act immediately: stop further transactions, secure compromised accounts, preserve evidence, report the identity theft, and notify the insurer through the claims contact in your policy. Then submit a dated timeline, financial records, reports and receipts that match the policy’s proof-of-loss rules.

The difficult part is coverage, not the form. Cyber and identity-theft policies differ on whether they cover stolen funds, recovery expenses, business-email compromise, social engineering, notification costs or forensic work. Your declarations page, endorsements, exclusions, deductible, limits, sublimits and notice deadline determine the result. This guide shows how to make the claim while protecting your other recovery options.

1. Contain the loss before you discuss coverage

Insurance should not be your first technical response. Every hour an attacker retains access can create another transfer, account takeover or fraudulent application. Take containment steps that are appropriate to the incident, and record when you took each one.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Contact every affected financial institution

  • Call the bank, card issuer, payment app, brokerage or lender using a number from a statement or the provider’s official app—not a number in a suspicious message.
  • Tell the fraud department which transactions are unauthorized, when you discovered them and whether an account or device is still compromised.
  • Ask the institution to block transfers, stop payments, replace cards, close or freeze accounts and provide a case number.
  • Follow up in writing through the provider’s secure message system and keep copies of statements showing the disputed entries.

Secure accounts and devices

  • Change passwords and PINs from a known-clean device. Do not reuse a compromised password on another service.
  • Enable multifactor authentication where available, revoke unknown sessions and review recovery email addresses and phone numbers.
  • Ask email, cloud, payroll, shopping and social-platform providers to preserve logs and remove unauthorized recovery methods.
  • Do not wipe or reset a device that may contain evidence unless a qualified responder or the insurer instructs you to do so. Disconnect a suspected malware-infected device from networks while preserving it.

Place a fraud alert or security freeze

Use the credit-reporting protections available in your country. In the United States, the Federal Trade Commission’s recovery process provides a free one-year fraud alert. A security freeze is a separate control that restricts new-credit access until you lift it. Record confirmation numbers and the date each protection was placed.

2. Report the identity theft and preserve an official record

File a report at IdentityTheft.gov, the federal government’s one-stop resource for identity-theft victims. The process produces an FTC Identity Theft Report and a recovery plan that can help you challenge fraudulent accounts and explain the incident to an insurer.

Make a police report when the insurer requests it, when the policy requires it, or when law enforcement can investigate the fraud. Ask for the report or incident number and the officer or department’s contact details. A police report is useful evidence, but it does not automatically establish coverage or prove that every loss is payable.

Preserve original evidence in read-only form where possible. Keep the original email, text, message header, call detail, screenshot, URL, malware alert and device image; send copies or secure uploads to the insurer unless it gives different instructions. Do not edit screenshots or crop away dates, account identifiers or sender information.

3. Find out what your policy actually covers

Cyber insurance is contract-specific. Policies may be personal identity-theft products, standalone cyber policies, endorsements to homeowners or renters insurance, or commercial policies. Ordinary commercial property and general-liability policies often do not cover cyber risks, and a policy can cover response costs while excluding the money a scammer transferred.

Coverage questions to answer in writing

Question Why it controls the claim
What is the covered event? The wording may require identity theft, unauthorized access, a data breach, computer fraud, funds-transfer fraud or another defined trigger. A payment made after social engineering may be treated differently from a hacked account.
Are direct stolen funds covered? Some policies insure a defined financial loss; identity-theft insurance commonly pays recovery expenses instead. A fraud or social-engineering exclusion can remove a transfer loss even when the incident is otherwise a cyber event.
Which response costs are covered? Possible categories include forensic investigation, notification, credit monitoring, legal help, copying, postage, notarization, lost wages and business interruption. Each can have its own limit or conditions.
What exclusions apply? Look for exclusions involving employee dishonesty, voluntary payments, business-email compromise, social engineering, unapproved security practices, war or infrastructure failures, and losses payable under another policy.
What deductible, limit and sublimit apply? A deductible reduces the payable amount. A sublimit can cap a category such as legal fees or fraudulent-transfer loss even when the overall policy limit is higher.
When and how must notice be given? The policy may require prompt notice, notice within a stated number of days, a telephone call followed by written notice, or use of a breach hotline or portal. Missing a condition can delay or jeopardize a claim.
What security controls were required? Commercial policies can condition coverage on multifactor authentication, dual approval for transfers, backups, endpoint protection or other controls. Ask how the insurer applies any alleged failure.
How does other insurance coordinate? Homeowners, renters, bank, card-network and payment-provider protections may respond under different rules. The cyber policy may be excess, may share costs, or may exclude an amount another provider should pay.

Ask the adjuster to identify the applicable insuring agreement, exclusion, deductible, sublimit, proof-of-loss requirement and deadline. Request the explanation in writing rather than relying on a telephone summary.

4. Build a claim packet that an adjuster can verify

Organize the material in the order an adjuster must answer three questions: what happened, what did it cost, and why does the policy respond? Keep a duplicate outside the compromised account and use a consistent file name with the date and document type.

Policy and contact file

  • Complete policy, declarations page, endorsements, renewal documents, deductible schedule and any certificate showing the insured person or business.
  • Claims number, breach-hotline details, broker information and the insurer’s instructions for urgent notice or secure upload.
  • A copy of every reservation-of-rights, coverage-position or information-request letter.

Incident timeline

Prepare a one-page chronology with the first suspicious contact or transaction, the time you discovered it, containment actions, reports to banks and platforms, the IdentityTheft.gov filing, any police report and the first insurer notice. Include time zone, channel, person contacted and reference number for each entry. Distinguish facts you observed from statements someone else made.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Financial proof

  • Bank, card, payment-app and credit-account statements with unauthorized entries highlighted.
  • Transfer confirmations, merchant disputes, chargeback results, account-closure notices and records showing any refund or recovery.
  • A schedule separating direct stolen funds from fees, lost wages, legal help, copying, postage, notarization, monitoring and other recovery expenses.
  • Receipts and invoices for each claimed expense, with the date, supplier, purpose and amount. If claiming lost wages, retain the employer’s calculation and the time spent on recovery.

Technical and communications evidence

  • Screenshots, emails, text messages, caller IDs, spoofed addresses, URLs, malware or account alerts and relevant device or cloud logs.
  • Copies of messages to banks, card issuers, platforms and law enforcement, plus their responses and case numbers.
  • For a business, evidence of the relevant approval workflow, access logs, multifactor-authentication status, backups and any forensic report.

Keep originals unchanged and provide copies unless the insurer supplies a secure collection process. Do not send passwords, full authentication codes or an unredacted identity document through ordinary email; ask how sensitive material should be uploaded.

5. Notify the insurer correctly and on time

Use the claims number, breach hotline, online portal or broker shown in the policy. Give notice as soon as practical, even if the financial amount is still developing. State that you are providing notice of a potential cyber or identity-theft claim, describe the known event, list immediate containment steps and ask what additional notice format is required.

  1. Make the first contact. Record the date, time, representative, claim number and instructions. Ask whether a telephone report must be followed by an email, portal submission or signed notice.
  2. Submit a concise initial statement. Include the incident date or discovery date, affected accounts, known transactions, reports already filed and whether access remains active. Do not speculate about facts you cannot verify.
  3. Ask for the insurer’s forms and deadlines. Obtain the claim form, proof-of-loss form, document checklist, examination or interview requirements and the deadline for supplemental amounts.
  4. Protect evidence and access. Confirm how to preserve a device, provide logs and share sensitive documents. Ask whether the insurer wants its own forensic vendor and whether you need approval before incurring professional fees.
  5. Submit a complete packet. Use an index that maps each claimed amount to a statement, receipt, report or policy provision. Keep proof of delivery and a copy of the exact upload.
  6. Respond to requests in writing. Answer each numbered question, identify documents already supplied and state when any unavailable record will be provided. Ask the adjuster to explain why a requested item is relevant if the request is unclear.

6. Will identity-theft insurance reimburse money a scammer stole?

Usually, not under a basic identity-theft recovery benefit. FTC consumer guidance says identity-theft insurance generally will not reimburse money scammers stole or financial loss from the theft. It may instead pay documented out-of-pocket recovery expenses such as copying, postage, notarization, lost wages and legal fees when the policy allows them. It may also refuse an expense that another policy or provider should cover.

A cyber, computer-fraud or funds-transfer endorsement can use different wording, but never assume that the label “cyber” means direct reimbursement. Check the event definition, voluntary-payment and social-engineering exclusions, deductible and sublimit. Report the stolen-funds loss separately to the bank, card issuer, payment provider and any applicable homeowners or renters insurer because those channels can have different dispute deadlines and protections.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Do you need a police report?

There is no universal rule. A policy may require a police or other official report, an insurer may request one during investigation, or the report may help correct fraudulent accounts. If the policy says it is required, file promptly and send the report or incident number with the claim. If it does not, ask the adjuster in writing whether one is necessary and what substitute evidence is accepted.

Police cannot decide whether an insurance contract covers a loss. Their report supports the factual record; the insurer still applies its definitions, exclusions, limits and conditions.

8. Coordinate every possible recovery source

Notify each provider whose rules may apply, without assuming that one notice substitutes for another. A bank may investigate an unauthorized electronic transfer; a card network may apply separate billing-dispute procedures; a payment app may have its own reporting window; and a homeowners or renters policy may cover a different category of expense. Tell the cyber insurer about refunds, chargebacks, settlements or other payments so the claim is not overstated.

For a business, separate first-party costs (forensic work, restoration, notification, interruption and fraud loss) from third-party obligations (claims by customers, vendors or regulators). Commercial cyber policies can cover one category and exclude another. Ask whether the insurer will appoint breach counsel, a forensic firm or a notification vendor and whether using an outside provider without consent affects reimbursement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

9. Track the claim and challenge an unfavorable position

Maintain a claim log with columns for date, contact, method, issue, documents sent, response promised, deadline and next action. Keep the log separate from the compromised email account. Calendar every insurer deadline and every bank or card-dispute deadline.

If the insurer reserves rights

A reservation-of-rights letter is not necessarily a denial. It identifies coverage questions while the investigation continues. Ask which facts could change the position, which documents are missing and whether undisputed expenses can be paid while disputed amounts are reviewed.

If payment is partial or denied

  1. Request the exact policy wording, factual findings, calculations, deductible and exclusion or condition the insurer relied on.
  2. Ask for a written list of missing evidence and the deadline for a supplemental submission.
  3. Compare the decision with the declarations page, endorsements and definitions—not just the policy’s marketing summary.
  4. Use the insurer’s internal complaint, reconsideration or appeal process and retain delivery proof.
  5. Contact the relevant state insurance regulator or consumer-protection authority if the insurer does not follow the policy or applicable claims rules. A licensed insurance adviser or attorney can explain contract wording, especially for a large or business loss.

10. Common mistakes that weaken a cyber-fraud claim

Mistake Better practice
Waiting until the amount is known Give timely notice of a potential claim and supplement the amount later.
Using contact details in a suspicious message Use the number or portal printed in the policy, statement or official app.
Deleting messages or resetting a device Preserve originals and ask about secure collection before altering evidence.
Claiming all losses as one figure Separate stolen principal, recovery expenses, interruption and third-party costs.
Assuming a police report guarantees payment Use the report as evidence while proving the policy trigger and amount.
Ignoring another provider’s deadline Report to banks, card issuers, payment apps and other insurers in parallel.
Accepting a verbal denial Request the policy basis, calculations and appeal route in writing.
Sending sensitive documents through ordinary email Use the insurer’s secure portal or ask for an approved transfer method.

11. A practical decision checklist

Before submitting, confirm that you can answer these questions without searching through scattered messages:

  • What account or identity information was compromised, and when did you discover it?
  • What did you do to stop additional access or transfers, and at what times?
  • Which transactions are unauthorized, and which amounts have already been refunded or disputed elsewhere?
  • Which policy provision appears to respond, and what exclusion, deductible or sublimit could affect it?
  • What recovery expenses are you claiming, and where is the receipt or other proof for each one?
  • Have you filed the FTC report, obtained any police incident number and notified every affected provider?
  • What is the insurer’s notice deadline, proof-of-loss deadline and preferred submission channel?
  • Who is responsible for the next action, and when will you follow up?

A well-documented claim cannot create coverage that the contract excludes, but it can prevent avoidable delays, preserve evidence and make the insurer explain its decision against the actual policy language.
