Act quickly, obtain the correct MOV forms, verify the tax-and-penalty calculation, and choose either payment or statutory security. A truck detained under Section 129 of the Central Goods and Services Tax Act, 2017 (CGST Act) is generally released through the proper officer after the amount demanded under Section 129(1) is paid or security for that amount is furnished. The working sequence is: obtain FORM GST MOV-06 and MOV-07, submit a written response and hearing request, confirm whether the owner is coming forward, pay or furnish acceptable security through the GST process, and obtain MOV-05 as the release order. The officer should also issue MOV-09, the penalty order.
Section 129 applies when goods and the vehicle carrying them are transported or stored in transit in contravention of GST law or rules. State-level logistics and litigation outcomes vary, so have a GST practitioner or advocate check the actual notice, documents, and calculation before you sign an admission or select a payment route.

What Section 129 detention means
Section 129 covers the goods and the conveyance when a GST officer finds a contravention while goods are being transported or stored in transit. The trigger may involve the tax documents, the e-way bill, the classification or exemption claimed, or another requirement of the GST law or rules. Detention is not the same as a final finding that the tax and penalty calculation is correct. You are entitled to see the reasons, challenge factual or calculation errors, and be heard before the penalty is determined.

The MOV forms and what each one does
| Form | Purpose | What to check |
|---|---|---|
| MOV-06 | Detention or seizure order issued in the CBIC workflow. | Vehicle number, goods description and quantity, invoice and e-way-bill references, date and place, officer’s stated contravention, and the signature or digital details of the issuing officer. |
| MOV-07 | Notice proposing the tax and penalty under Section 129(3). | The legal basis, tax classification, taxable value, tax amount, penalty formula, owner status, and the response or hearing deadline. |
| MOV-05 | Release order after the required payment or security is accepted. | That it identifies the same conveyance and goods and records the amount or security on which release is granted. |
| MOV-09 | Statutory order determining the penalty. | The final calculation, reasoning, dates, and whether it matches the notice, your response, and the amount paid or secured. |
CBIC Circular 41/15/2018-GST describes the detention, notice, hearing, payment and release sequence. Ask the officer or office for a copy of every form; do not rely only on a verbal instruction at a checkpoint.
Step 1: Secure the documents and record the timeline
Start a file on the day of detention. Record the vehicle registration number, driver’s name and contact details, location, time, officer’s identity and department, and the exact point at which the truck was stopped. Request MOV-06 and MOV-07 immediately. If either form is delivered electronically, save the original file and the delivery record; if delivered on paper, scan every page.
Use this checklist before responding:
- Tax invoice or bill of supply, including serial number, date, supplier and recipient GSTINs, item description, quantity and value.
- E-way bill, its validity dates, vehicle number, transporter details and any update history.
- Vehicle registration certificate and the driver’s authorization or transporter appointment.
- Delivery challan, purchase order, lorry receipt, packing list and proof of the movement’s destination.
- Your GST registration details and, where relevant, exemption or rate documents.
- MOV-06, MOV-07, all correspondence, and proof of when each was served.
Compare the documents character by character. A single digit in a vehicle number, an expired e-way-bill validity period, a mismatch in the invoice value, or a different description can affect the officer’s theory. Do not alter an original document; explain any correction or update with a dated record.

Step 2: Respond within the statutory notice and hearing timetable
Section 129(3) requires the notice to be issued within seven days of detention or seizure and the order to be issued within seven days after service of the notice. Section 129(4) says: No penalty shall be determined under sub-section (3) without giving the person concerned an opportunity of being heard.
Request that hearing in writing even if you have already supplied documents at the roadside.

- Calculate the service dates. Keep the detention date, the date and method of MOV-07 service, and the proposed hearing date in a calendar. Preserve email headers, portal acknowledgements, courier tracking and receipt stamps.
- Submit a written reply. Identify the consignment and vehicle, answer each stated contravention, attach indexed evidence, and show your own calculation if the demand is wrong.
- Ask for a hearing. State the names of the person attending, request an accessible date and time, and ask that the submissions and documents be taken on record.
- Attend and obtain an acknowledgement. Carry originals for inspection and copies for the file. After the hearing, send a short confirmation of what was submitted and any additional document requested.
If the notice is late, omits the calculation, identifies the wrong vehicle, or gives no meaningful chance to respond, record that objection specifically. A procedural objection is not an automatic release order; its value depends on the facts and the proper officer’s decision, and any court challenge is fact-specific.
Step 3: Verify which Section 129(1) formula applies
The amount depends first on whether the owner comes forward to claim the goods. The current text displayed by CBIC, accessed in 2026, states the following formulas. Because Section 129 has been amended, confirm the operative statutory text and any later notification before paying.
| Situation | Taxable goods | Exempt goods |
|---|---|---|
| Owner comes forward | Applicable tax plus a penalty equal to 200% of the tax payable. | 2% of the value of the goods or ₹25,000, whichever is less. |
| Owner does not come forward | 50% of the value of the goods or 200% of the tax payable, whichever is higher. | 5% of the value of the goods or ₹25,000, whichever is less. |
Make the officer’s assumptions visible: value of goods, applicable rate, tax split, exemption status, and the identity of the owner. Ask for an arithmetic breakdown rather than accepting a rounded figure. If the goods are exempt, verify both the exemption and the value used; the percentage and ₹25,000 ceiling are alternatives, not cumulative charges.

| Route | Advantages | Costs and risks | Best fit |
|---|---|---|---|
| Pay the assessed amount | Usually the quickest route when the calculation is verified and the payment channel is working. | Immediate cash or bank outflow; recovery or challenge may require later proceedings if the demand is disputed. | A truck carrying time-sensitive cargo, where liquidity is available and the documentary objection is weak or can be pursued separately. |
| Furnish security | Can preserve working capital while the dispute is considered. | Bank fees, collateral or margin requirements, documentation time and the risk of encashment if the statutory conditions are breached. | A business that can obtain an acceptable instrument quickly and needs to preserve cash. |
| Provisional release under Rule 140 | Seized goods may be released against a bond and bank guarantee instead of waiting for final disposal. | The bond and guarantee remain live; failure to produce the goods when required can lead to encashment or recovery. | Cases in which goods must move but the authority requires the Rule 140 security package. |
A bank guarantee is not automatically interchangeable with every security request. Ask the proper officer for the exact format, beneficiary, validity, claim period and amount. Rule 140 provides for provisional release of seized goods against a FORM GST INS-04 bond for the value of the goods and a bank guarantee equal to applicable tax, interest and penalty. The goods must be produced when lawfully required.
Step 5: Make payment through the GST system
CBIC payment rules route tax, penalty and other amounts through the electronic cash ledger and electronic liability register. Permitted channels include internet banking, card, NEFT or RTGS and specified over-the-counter deposits. Use the payment method accepted for the particular demand and taxpayer account; do not hand cash to an individual officer.
- Reconcile the amount in the notice or agreed calculation with the payment particulars before generating a challan.
- Complete the payment in the GST system using an authorised signatory or approved bank channel.
- Save the challan, payment reference, bank confirmation, electronic cash-ledger entry and electronic liability-register update.
- Send the proof to the proper officer with a covering letter identifying MOV-06, MOV-07, the vehicle and the date of payment.
- Ask for written confirmation that the amount has been credited and that no additional amount is being demanded as a condition of release.
A failed or pending transaction is not the same as credited payment. Check the ledger, not just a bank debit, and keep screenshots or downloaded statements showing the status.

The officer should also pass the statutory penalty order in MOV-09. A 2025 Supreme Court report states that making payment does not eliminate that order requirement. This is important even where Section 129(5) applies. The statute says: On payment of amount referred in sub-section (1), all proceedings in respect of the notice specified in sub-section (3) shall be deemed to be concluded.
Treat that provision as closing the notice proceedings after payment, while still insisting on the formal order and preserving it for accounting, audit and any challenge.
When Rule 140 provisional release is the better route
Rule 140 addresses provisional release of seized goods. The prescribed security package is an INS-04 bond for the value of the goods plus a bank guarantee for applicable tax, interest and penalty. Confirm whether the officer has treated the matter as detention, seizure or both; the form and security demanded should correspond to that status.
Before signing the bond, check the description and value of the goods, the bank guarantee’s expiry and invocation terms, and the conditions for producing the goods. Maintain the inventory and photographs so that the goods can be identified. If the goods are not produced when required, the security may be encashed, so a release that solves today’s transport problem can create a larger financial exposure later.

Section 129(6) provides that if the penalty is not paid within 15 days from receipt of the order, the goods or conveyance may be sold or otherwise disposed of to recover the penalty. The Act also provides that the conveyance is released on payment by the transporter of the penalty or ₹1 lakh, whichever is less, subject to the statutory provisos. That ceiling is not a universal substitute for the goods-related demand: check whether the transporter, owner, goods and statutory conditions fit the proviso. Perishable or hazardous goods may face a shorter disposal period, so notify the officer immediately if the load can spoil, become unsafe or lose value.
How to write a useful objection
An objection should be short enough to follow and detailed enough to test the calculation. Use numbered paragraphs that correspond to the notice:
- State why the truck and goods were being transported and identify the supporting invoice, e-way bill and delivery documents.
- Identify each factual mismatch, such as a transposed vehicle digit, a document that was updated, or a description that is consistent with the invoice even if the officer read it differently.
- Explain the tax treatment, rate or exemption and attach the relevant registration or exemption evidence.
- Show the alternative calculation and identify exactly which figure in MOV-07 is wrong.
- Ask for withdrawal or correction of the notice where the evidence resolves the stated contravention; alternatively, ask for release on payment or security without waiving the legal objection, subject to professional advice.
- Request a hearing under Section 129(4) and identify the documents that must be considered before an order is passed.
Do not sign a statement that describes an error as an admission unless that is the intended legal position. If the officer offers a reduced or different figure orally, ask for it in writing and reconcile it with the statutory formula.
Evidence and hand-off checklist
Keep one chronological digital folder and one paper set. It should contain:
- Invoice or bill of supply, e-way bill and all updates.
- Vehicle registration, driver authorisation, transporter appointment and delivery records.
- GST registration, exemption or classification material and the officer’s tax calculation.
- MOV-06, MOV-07, your written reply, hearing request, attendance proof and follow-up letters.
- Payment challan, bank confirmation, electronic cash-ledger and liability-register entries.
- INS-04 bond and bank guarantee, if used, including the bank’s acceptance and validity details.
- MOV-05, MOV-09, the release time and any inventory or condition report.
Log who received each submission, the date, the mode of delivery and the acknowledgement number. Give the complete file to a qualified Indian GST practitioner or advocate if the amount is material, the vehicle is repeatedly detained, the goods are perishable or hazardous, or you are considering a writ or other court proceeding. No objection or filing guarantees a result; implementation and litigation can vary with state practice, facts, document defects, tax classification and the identity of the proper officer.
Quick Recap
A practical decision path
- Truck needed immediately? Obtain MOV-06 and MOV-07 and ask for the earliest hearing. If the demand is arithmetically clear and cash is available, payment followed by MOV-05 may be fastest.
- Demand disputed but cash constrained? Ask whether the officer will accept the statutory security route and obtain the exact instrument terms. Compare bank fees, collateral and encashment exposure with the cost of leaving the truck detained.
- Goods seized or likely to be treated as seized? Prepare the Rule 140 INS-04 bond and bank guarantee package, with an inventory and a plan to produce the goods.
- Goods perishable or hazardous? Put that fact in the first letter and request urgent handling because disposal periods may be shorter.
- Order already served? Count 15 days immediately, arrange payment or security, and do not assume that filing an objection alone prevents sale or disposal.
