Apply to the tax authority in the country where you claim tax residence. Use that authority’s current certificate-of-residence procedure, and prepare the destination country, applicable treaty, income type and covered tax period. Then check the destination country’s rules: it may require a local claim form, an endorsement, the original certificate or additional evidence. A certificate supports a treaty claim, but it does not guarantee reduced or refunded tax; the authority in the country where the income is taxed decides whether treaty relief applies.
What a tax residency certificate does
A tax residency certificate (also called a certificate of residence or certificate of tax residence) is issued by the tax authority of the country in which you claim residence. It confirms that the authority treats you as resident under that country’s tax rules, or confirms residence for treaty-documentation purposes, for a stated period.

You normally give the certificate to a foreign tax authority or to a payer that is withholding tax. It is evidence for applying a double tax agreement (DTA), also called a double tax treaty. The document does not independently create treaty rights, determine your final tax liability, or require the foreign authority to grant a lower rate. The foreign authority applies the treaty’s wording, the relevant income article and its domestic procedures.

Establish the facts before you apply
1. Identify the residence country for the relevant period
Start with the country that treated you as tax resident for the period in which the income arose. Residence is a legal tax status, not simply the country where you have a home, citizenship or immigration permission. If two countries treat you as resident, the treaty may contain a tie-breaker test that requires additional analysis and evidence.
2. Identify the source country and income
Write down where the income is taxed or withheld and what it is: employment pay, dividends, interest, royalties, pensions, business profits, capital gains or another category. Treaty rates and exemption rules are usually article-specific, so a certificate for one type of income or period may not answer a different claim.
3. Confirm that a DTA applies
Check that the residence country and source country have an agreement in force for the period concerned. Read the article covering your income and any provisions on beneficial ownership, permanent establishment, limitation of benefits, remittance, anti-abuse rules or relief-at-source procedures. Do not assume that residence alone establishes entitlement to every treaty benefit.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problems4. Determine the covered period
Authorities generally ask for a tax year or a specific period. A certificate cannot normally be used to prove a future status that has not yet occurred. If the source authority asks for a certificate for several years, confirm whether one application can cover them or whether separate requests are required.
How to apply: the general sequence
- Find the issuing authority’s live procedure. Use the tax authority website for your residence country and choose the route for your applicant category: individual, company, partnership, trust or another entity.
- Collect the core details. Have your legal name, address, tax identification number, date of birth or entity registration details, residence period, destination country and income type ready.
- Check the destination authority’s claim form first. Some countries require a local form to be completed by you and certified or endorsed by the residence authority. Others accept the residence certificate directly. Foreign forms and references can change, so use the current version.
- Read special-status instructions. Dual residents, citizens or green-card holders living abroad, residents of territories, nonresident applicants and entities may need extra evidence or a treaty tie-breaker analysis.
- Submit through the specified route. This may be an online portal, a secure message, a downloadable form, email or post. Follow file-format, signature, translation and payment requirements exactly.
- Keep proof of submission. Save the receipt, transaction number, submitted form and attachments. Retain the issued certificate and any covering letter.
- Complete the foreign claim. Send the certificate to the destination tax authority or payer with its required claim form and supporting income or withholding records. Confirm whether an original, certified copy, translation, apostille, authority endorsement or validity statement is required.
- Monitor the result. The destination authority may approve a reduced rate, refund tax already withheld, request more information or reject the claim. A rejected claim may have an objection or repayment deadline separate from the certificate application.
Documents and information commonly required
- Full legal name and current residential and postal address.
- Tax identification number or account number in the residence country.
- Date of birth for an individual, or registration and authorised-contact details for an entity.
- The destination country or territory and the specific DTA.
- The income category and payer details, where requested.
- The tax year or exact period for which residence must be certified.
- Evidence of residence under domestic law, such as filed returns, assessment notices, registration data or other documents listed by the authority.
- A completed destination-country form, if the foreign authority requires one to be signed or endorsed.
- Extra material for a dual-residence claim, such as home, centre-of-vital-interests, habitual-abode or nationality evidence relevant to the treaty tie-breaker.
Do not send unrelated documents merely because they are available. Use the issuing authority’s checklist and redact information that is not required where its rules permit.

Official procedures in selected countries
These examples illustrate different systems; they are not interchangeable instructions. Always use the current page for your country, applicant type and tax period.
| Residence country | Issuer and route | Key requirements or limits | Published timing or fee |
|---|---|---|---|
| United States | Internal Revenue Service (IRS); request Form 6166 by filing Form 8802 | Form 8802 is mandatory. Evidence and processing depend on applicant category and tax year. Dual residents, U.S. citizens or green-card holders abroad and U.S. territory residents may need additional evidence. Some United Kingdom relief-at-source or repayment claims may need an additional UK certification form. | For requests effective October 1, 2026, the IRS page states a fee of $105 for an individual applicant and $230 for a business applicant, replacing $85 and $185. Verify the fee and current instructions before filing. |
| United Kingdom | HM Revenue & Customs (HMRC) certificate of residence or letter of confirmation | You must be classed as UK resident and a DTA must exist with the destination country. The request identifies the agreement, country, income type and period. Future dates cannot be requested. HMRC will not issue a certificate if you are not entitled to treaty benefits under the agreement. | No general processing time or fee is stated on the cited guidance. The overseas authority decides whether relief is granted. |
| New Zealand | Inland Revenue; individual request through myIR, web message or post | Provide name, residential and postal address, date of birth, IRD number, destination country or territory and a statement that you are solely or dually resident under the relevant treaty. | A complete myIR request is usually available the next business day. Complete web-message requests have a 15-working-day target; postal requests have a 30-day target after all necessary information is received. Incomplete or incorrect requests can take longer. The page was updated June 18, 2026. |
| Singapore | Inland Revenue Authority of Singapore (IRAS); Certificate of Residence application | The COR is a letter certifying Singapore tax residence for claiming DTA benefits. The application route depends on the applicant profile. | IRAS reports processing of two to three weeks. Confirm the current route for your profile. |
| India | Income Tax Department; current Form 42 application and Form 43 certificate | The current Form 42 manual says an Indian resident seeking a certificate under sections 159(1) and 159(2) of the Income-tax Act 2025 applies to the Assessing Officer through the e-Filing portal. Complete applicant details, certificate details, attachments and verification. An older page describes Form 10FA/10FB, so confirm the form framework for the relevant tax year and filing context. | The cited manual does not state a universal fee or processing time. |
United States: Form 8802 to obtain Form 6166
The IRS issues Form 6166, a letter certifying that listed persons or entities are residents of the United States for U.S. income-tax-law purposes. You request it by filing Form 8802; the IRS states that use of Form 8802 is mandatory. Follow the instructions for your applicant category and requested tax year at the IRS certification page and the Form 8802 instructions.
If you are dual resident, a U.S. citizen or green-card holder living abroad, or a resident of a U.S. territory, read the additional-evidence provisions before submitting. The certificate confirms U.S. residence for the stated purpose; it does not decide how the other country applies its treaty. The IRS fee figures above are effective-date information and can change.
United Kingdom: request the certificate for a specific treaty claim
HMRC’s procedure asks for the treaty, destination country, income type and period. It may also ask whether you are the beneficial owner and subject to UK tax on the relevant income. HMRC says it cannot issue a certificate for future dates and will not issue one where you are not entitled to treaty benefits under the agreement. Apply through HMRC’s certificate guidance.
Before requesting the certificate, check whether the foreign authority requires a particular form or an HMRC endorsement. HMRC’s international manual warns that overseas form references can become outdated; its guidance is at INTM162020. HMRC also makes clear that “The relevant overseas authority decides if relief from foreign taxes can be granted.”

New Zealand: choose the route that matches your deadline
For individuals, Inland Revenue lists the identity, address, IRD number, destination and sole-or-dual-residence information required. A complete request in myIR is usually available the next business day, while the stated targets are 15 working days for a complete web-message request and 30 days for a complete postal request after receipt of all necessary information. Use Inland Revenue’s individual application page, updated June 18, 2026, and allow extra time if information is missing or incorrect.

IRAS describes its COR as a letter certifying Singapore tax residence for DTA benefits. Because the application path depends on the applicant profile, select the applicable route on the IRAS application page. IRAS reports a two-to-three-week processing period; treat that as an estimate rather than a guaranteed deadline.
India: verify which statutory form applies
The current Income Tax Department Form 42 user manual says an Indian resident applies in Form 42 to the Assessing Officer under sections 159(1) and 159(2) of the Income-tax Act 2025. If satisfied, the officer issues the residence certificate in Form 43. The manual describes e-Filing portal steps for applicant details, certificate details, attachments and verification: current Form 42 manual.
An older department page describes the former Form 10FA/10FB process: older double taxation relief page. Because the official material reflects different statutory and form frameworks, match the form to the tax year and filing context instead of relying on an old checklist.
Dual residence and other special cases
Dual residence
If both countries classify you as resident, ask whether the DTA’s tie-breaker makes you resident of one country for treaty purposes. The analysis may consider a permanent home, centre of vital interests, habitual abode and nationality, in the order specified by the treaty. The IRS Form 8802 instructions expressly warn that a dual-resident applicant may need to establish residence under the treaty tie-breaker. Other authorities can require comparable evidence.

Individuals living outside the claimed residence country
A citizen or green-card holder abroad may remain resident under one country’s domestic rules while also meeting another country’s rules. Follow the special instructions rather than assuming that citizenship, an address or a prior certificate is enough.
Companies, partnerships and trusts
Entity applications often require formation details, tax numbers, management or control information, beneficial-owner data and evidence that the entity is subject to tax in the claimed residence country. Select the entity route; an individual certificate cannot establish an entity’s treaty residence.
Relief at source versus repayment
A payer may need the certificate before withholding to apply a treaty rate. A repayment claim may instead require the certificate, a local tax form and proof of the tax withheld. Ask the destination authority which process applies to the payment and whether the certificate must be renewed for each period.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Timing, fees and document handling
Start before the source-country filing, withholding or refund deadline. Processing estimates generally assume a complete request and can pause when an authority asks questions. Use the destination authority’s deadline as the controlling date, because obtaining the residence certificate is only one stage.

Common problems and how to fix them
The authority says you are not resident
Check the tax year, residence test and evidence used. If your facts involve two countries, analyze the treaty tie-breaker instead of simply repeating a domestic-law assertion. Ask the issuing authority what additional evidence it accepts.
The certificate covers the wrong period or income
Request a corrected certificate for the precise period and explain the income category or treaty article requested. Do not alter the issued document yourself.
Recommended Free Tools
The foreign payer rejects the certificate
Ask whether it needs a local claim form, authority endorsement, original paper document, certified copy, translation or a newer certificate. Confirm that the payer is applying the correct treaty article and that the claim is for the person or entity named on the certificate.
The online request is delayed
Check for missing fields, unreadable attachments, mismatched names or unpaid fees. Use the authority’s transaction number when contacting it, and retain evidence that the complete request was submitted before a deadline.
A treaty benefit is denied even though the certificate is valid
A valid certificate proves the stated residence fact; it does not prove beneficial ownership, the correct income classification, sufficient subject-to-tax status or compliance with anti-abuse provisions. Review the foreign authority’s decision and its appeal or repayment procedure.
When specialist advice is worthwhile
Consider a qualified cross-border tax adviser when residence is disputed, two countries claim you, a company or trust is applying, the income falls under several treaty articles, or a large withholding or refund is at stake. An adviser can help document the treaty analysis, but the government authorities still issue the certificate and decide the claim.
