Choose the document the asset holder and the law actually require. A legal-heir certificate is normally obtained through a state or district revenue service. A succession certificate is issued by a competent District Judge under Part X of the Indian Succession Act, 1925, and covers the debts and securities named in the certificate. They are not interchangeable in every claim.
Before filing anything, ask the bank, post office, company, registrar, broker or other institution holding the asset for its current deceased-claim checklist. Its rules can determine whether a legal-heir certificate is enough, whether a succession certificate is required, and whether additional forms, consents, indemnities or identity documents are needed.

Legal-heir certificate and succession certificate: the difference
The two documents prove different things and come from different authorities. Selecting the wrong route can add months of delay or leave an institution unable to release the asset.

| Question | Legal-heir certificate | Succession certificate |
|---|---|---|
| Issuing authority | A state or district service, commonly linked to a revenue authority such as a Tehsildar. The exact authority depends on the state. | The District Judge with jurisdiction under Part X of the Indian Succession Act, 1925. |
| Main purpose | Government proof identifying a deceased person’s legal heirs where the receiving authority accepts it. | Court authority for collecting or transferring the debts and securities specified in the certificate. |
| Typical route | State or district portal, prescribed form or local service channel. | Signed and verified petition, court notice, hearing and judicial order. |
| Geographical rule | State-defined service area and eligibility rules. | Ordinarily the deceased’s residence at death; if there was no fixed residence, a court where part of the property is located may have jurisdiction. |
| Universal acceptance? | No. The institution receiving the claim may ask for another document. | It is valid throughout India under section 373(10), but it is not a universal inheritance or title document and may not be demanded for every asset. |
A legal-heir certificate does not by itself transfer ownership of land, settle a contested will or replace probate, letters of administration or other procedures. A succession certificate likewise does not decide every inheritance question; its statutory focus is the debts and securities included in it.

Which certificate do you need?
Start with the asset holder
Ask the institution that controls the asset for written or clearly recorded instructions. Tell it the asset type, approximate value, whether there is a nomination, whether a will exists and whether all heirs agree. A bank may use one process for a small undisputed balance and another for a disputed claim. A post office, listed company, registrar and transfer agent can have different forms and evidence rules.
Use a legal-heir certificate when the institution accepts state proof
This route is commonly considered for administrative claims in which the institution wants an official list of surviving heirs rather than a judicial collection order. Acceptance is not automatic. Confirm the specific state service, required relationship evidence and the asset holder’s policy before applying.
Use a succession certificate when court authority over specified debts or securities is required
Part X of the Indian Succession Act, 1925, governs this certificate. Section 370 limits when it can be granted, including situations in which the right must instead be established through letters of administration under the Act. The petition must identify the debts and securities sought; the certificate is not a general declaration covering every property interest.
Escalate when the claim is contested or legally complex
A dispute among heirs, an unclear or challenged will, probate or administration questions, uncertain residence, or an asset outside the statutory category can change the correct procedure. A qualified lawyer or legal-aid service in the relevant state can review jurisdiction and the appropriate proceeding. Do not sign a petition or heir declaration that you cannot verify.
How to apply for a legal-heir certificate in India
There is no single all-India application form, fee, processing time or portal established for every state. State and district instructions control.
- Identify the correct state and district service. Usually begin with the state or district in which the deceased ordinarily lived or where the claim is being administered. Use the official state Revenue Department or government-services portal, not an unauthorised checklist. Confirm whether the issuing officer is a Tehsildar, revenue inspector, taluk or other designated authority.
- Read the current service page and form. The Government Services Portal illustrates the variation: Jammu and Kashmir lists an online application for issuance by a Tehsildar, while Tamil Nadu provides an application form and guidance for legal-heirship certification. These examples do not create a national procedure; your state’s current page governs.
- Collect only the documents that local instructions require. A death certificate and proof of relationship are commonly relevant, but the official national listings do not establish a universal checklist. Depending on the state, the service may ask for identity and address evidence, details of all surviving heirs, an affidavit or declaration, photographs, proof of residence, or other records. Follow the named service’s list and keep originals available for verification.
- File through the prescribed channel. Complete the online form or paper application exactly as the local instructions specify. Enter every heir and relationship accurately. Upload readable files in the required format, or submit copies through the designated office if the process is offline.
- Save proof of submission. Keep the acknowledgement, application or reference number, payment receipt if any, uploaded files and a dated copy of the form. These records let you respond to a deficiency notice without restarting the application.
- Respond to verification requests. The authority may seek clarification, local verification or additional relationship evidence. Reply through the stated portal or office and keep proof of each response.
- Check the issued certificate. Verify the deceased’s name, date of death, every heir’s name and relationship, spelling, address and certificate number. Ask the issuing office about correction procedure before presenting an inaccurate certificate to an institution.
- Submit it to the asset holder. Give the bank, post office, company or other institution the certificate in the format it accepts. Ask whether it also needs a claim form, death certificate, identity documents, consent or no-objection declarations, indemnity, account closure form or tax paperwork.
How to apply for a succession certificate
Sections 370 to 373 of the Indian Succession Act, 1925, provide the national framework. Local court rules determine filing mechanics, copies, publication practice and costs.

1. Confirm that the asset fits the certificate
List each debt or security you want covered: for example, a specific bank debt, government security, company shareholding or other security within the Act. Record the institution, account or folio number, holder name and available statement. Do not use a succession petition as a substitute for a property title case or for a process that requires probate or letters of administration.
2. Select the District Judge with statutory jurisdiction
Section 371 refers to “the District Judge within whose jurisdiction the deceased ordinarily resided at the time of his death.” If the deceased had no fixed residence, jurisdiction may be available where any part of the deceased’s property is found. Gather residence evidence and asset-location details so the court can assess venue. If more than one court appears possible, obtain local advice before filing.
3. Prepare the petition required by section 372
The petition must be signed and verified and should state:
- the date and place of the death;
- the deceased’s ordinary residence at death and, where relevant, property within the court’s limits;
- the family or other near relatives and their residences;
- the petitioner’s right to apply;
- the absence of a statutory impediment to granting the certificate; and
- the “debts and securities in respect of which the certificate is applied for.”
Attach the documents and copies required by the court registry, such as the death certificate, identity and address evidence, relationship records, asset statements and details of other heirs. The exact filing bundle is local, so obtain the current registry checklist. Verify every statement: section 372 addresses false verification.
4. File and pay the court charges required locally
Submit the petition in the form and number of copies the registry directs. Court-fee rules, process fees and publication expenses vary by jurisdiction and case. The Act does not promise one national fee or processing time. Keep the filing number, stamped petition and every receipt.
5. Complete notice and hearing
Under section 373, the Judge gives notice to people the court considers should receive it and directs posting or publication in the manner considered appropriate. Interested relatives or other claimants may appear. The court hears evidence and may grant or refuse the certificate, or grant it for only some of the requested debts or securities.

6. Use the order with the institution
After issuance, obtain the certified copies and follow the asset holder’s transmission or payment procedure. A certificate’s all-India validity does not remove the institution’s own requirements or resolve a separate dispute about title.
What institutions may ask for
Banks and other deposit holders
Ask for the institution’s deceased-customer or claim-by-legal-heirs form before choosing a certificate. It may distinguish between a nominated account, an account with no nomination, an uncontested claim and a dispute. It can also require the death certificate, claimant identification, proof of relationship, declarations from other heirs, an indemnity or a court certificate.
Post Office savings accounts
The Department of Posts’ SB Order No. 01/2023 describes documentation for claims relating to deceased Post Office accounts and differentiates procedures by eligible amount and dispute status. Those rules are specific to the Post Office process. They should not be generalized to a bank, securities account or every certificate application. Obtain the current Post Office checklist for the account and claim circumstances.
Do these 3 things before closing this tab:

SEBI material on transmission of securities lists possible documentary conditions that can include an indemnity or no-objection documents, depending on the circumstances and applicable value or procedural thresholds. A registrar, listed company, depository participant or broker may require a particular form of certificate and additional identity or tax documents. Confirm the current version and applicability directly with the intermediary handling the holding.
Income-tax matters
The Income Tax Department’s “Register as Legal Heir” facility is an e-filing representative-assessee process for acting for a deceased taxpayer. It is separate from a state legal-heir certificate and from a court succession certificate. Registering in that tax service does not establish that a bank or securities issuer will accept the registration as inheritance proof.
Documents and preparation checklist
Because state and institution rules differ, treat this as a preparation list rather than a universal submission checklist.

Costs, timing and validity: what can and cannot be generalized
No single India-wide fee or processing-time commitment applies to legal-heir certificates. State pages can change their service channels, required documents and charges. A succession certificate involves local court fees, filing expenses, notice or publication costs and possible professional fees; the Act itself does not set one nationwide total or deadline.

Check the current official service page or court registry and ask the asset holder whether an interim acknowledgement is useful while the certificate is pending.
Section 373(10) gives a succession certificate validity throughout India. That means an institution in another state can generally recognise the court certificate, subject to its verification and claim process. It does not convert the certificate into a universal inheritance title or eliminate a dispute about who ultimately owns an asset.
Common mistakes and how to fix them
Applying for the wrong document
Symptom: the institution rejects a legal-heir certificate or asks for court authority. Fix: obtain the institution’s written checklist, then determine whether the asset is a debt or security covered by Part X and whether a succession petition is appropriate.
Using one state’s rules as a national rule
Symptom: a fee, portal link or document list from another state does not match your office. Fix: return to the current state or district government service page and preserve its acknowledgement and guidance.

Symptom: verification objections, a later challenge or refusal by the asset holder. Fix: disclose all relevant near relatives in the state application or section 372 petition and correct errors through the issuing authority or court rather than submitting a second inconsistent story.

Listing assets without enough detail
Symptom: the institution cannot match the certificate to an account or security. Fix: obtain statements and include the exact holder name, account or folio number, issuer and security description requested by the court or institution.
Assuming a certificate settles a will or property dispute
Symptom: another claimant alleges a forged will, competing title or entitlement outside the certificate’s scope. Fix: pause the administrative claim and obtain advice on probate, letters of administration, a declaration, partition or another appropriate proceeding.
Confusing tax registration with inheritance proof
Symptom: a bank or registrar refuses the Income Tax Department’s legal-heir registration. Fix: treat tax registration as authority to deal with the deceased taxpayer’s e-filing matters only, and follow the asset holder’s separate succession documentation rules.
A practical decision path
- Identify the exact asset and the institution controlling it.
- Ask that institution which documents it accepts for the claim, including whether nomination, consent, indemnity or a court order changes the route.
- If it accepts state proof, check the deceased’s state or district legal-heir service and follow that service’s current instructions.
- If court authority is required, confirm that the asset is a debt or security within Part X, identify the District Judge under section 371 and prepare the section 372 particulars.
- If there is a dispute, will issue, uncertain residence or asset outside the statutory scope, obtain qualified local advice before filing.
- After receiving the document, submit it with the institution’s own forms and retain stamped copies, acknowledgements and correspondence.
Frequently asked questions
Frequently Asked Questions
How do I get a legal heir certificate in India?
Use the official legal-heir service of the relevant state or district, commonly handled through a revenue authority. Read the current local instructions, submit the prescribed online or paper application with the documents named there, save the acknowledgement, answer verification requests and then confirm that the asset holder accepts the issued certificate.
How do I apply for a succession certificate in India?
File a signed and verified petition before the District Judge having jurisdiction under section 371 of the Indian Succession Act, 1925. State the death details, residence or property jurisdiction, relatives, your claimed right, statutory eligibility and the specific debts and securities sought. The court gives notice, hears evidence and may issue the certificate for all or only some of the listed assets.
Can a legal-heir certificate be used to withdraw money from a deceased person’s bank account?
Only if the bank’s current deceased-claim policy accepts it for that account and circumstances. The bank may instead require nomination documents, heir consents, an indemnity or a succession certificate.
Is a succession certificate required for every inheritance in India?
No. It is a court certificate for specified debts and securities under Part X. Land, contested wills and matters requiring probate or letters of administration can involve different proceedings, and an institution may accept another proof for an uncontested claim.
