Paying a home-loan EMI does not, by itself, give you the right to claim the property’s tax deductions. Start with the registered deed, not the bank account: tax eligibility can depend on your ownership share, loan role, actual interest contribution, property use, tax regime and the stage of your income-tax filing.
If a home is registered in your parents’ names while you pay the EMIs, a zero ownership share is a critical problem for a Section 24(b) interest claim. CBDT’s AY 2026–27 validation rules do not permit that claim where the assessee’s property share is zero. A co-owner’s claim, by contrast, must reconcile to a definite recorded share and a defensible contribution toward the interest repayment. Use the reconciliation process below before filing or correcting a return.

First, identify what is actually wrong
Ownership, borrowing and payment are separate facts. You may be the person whose bank account is debited, a borrower or co-borrower on the loan, and still not be an owner of the property. Conversely, you may own a stated percentage while another person makes the EMI payment. Each fact affects a different part of the claim.

For the common situation in which a child pays the loan but the conveyance deed names only the parents, do not assume the child can claim the interest or principal merely because the child funded the instalments. Read the deed and loan documents together, then test the proposed claim against the relevant assessment-year rules. The CBDT AY 2026–27 ITR-3 validation rules expressly require co-owner percentages to reconcile to 100% and reject a Section 24(b) claim when the claimant’s share is zero.

How the legal and payment facts fit together
Ownership is established by the property records
Use the registered sale or conveyance deed and related ownership records to establish the legal share. Do not substitute the EMI mandate, a bank statement or a loan sanction letter for the deed. Where shares are definite and ascertainable, Section 26 of the Income-tax Act treats each co-owner’s share of property income in that person’s own total income. The statutory wording is: “Where property consisting of buildings or buildings and lands appurtenant thereto is owned by two or more persons and their respective shares are definite and ascertainable, such persons shall not in respect of such property be assessed as an association of persons, but the share of each such person in the income from the property as computed in accordance with sections 22 to 25 shall be included in his total income.” Read the full provision at Section 26 of the Income-tax Act.
For a multi-owner return, enter shares that add to 100 percent. If the deed does not state a percentage clearly, obtain advice before allocating one in the return; do not create a split simply because several people pay the EMI.
Borrower status helps document the loan but does not rewrite ownership
The sanction letter, loan account and lender certificate show who borrowed and what interest was charged. They do not, on their own, transfer a property share to a borrower. Section 24(b) concerns interest on capital borrowed for acquiring, constructing, repairing, renewing or reconstructing the property. The statutory text is available at Section 24 of the Income-tax Act.

Before claiming, check that the lender certificate identifies the claimant where required and separates interest from principal. Current return guidance also asks for lender details such as the name, loan-account number, sanction date, amount, year-end outstanding balance and interest for the year.

Actual payment contribution is relevant for co-owners
The Income Tax Department’s guidance for a self-occupied house says a co-owner may claim interest according to that person’s contribution in repaying the interest. Therefore, reconcile the amount claimed by each owner with both the lender’s total interest and evidence showing who funded it. A single account making the entire debit is not enough to prove each person’s share if other owners reimbursed the payer.
Keep the payment trail year by year. If one person’s account pays the instalment and the others transfer money back, preserve the transfer statements and a simple explanation linking each reimbursement to the relevant EMI. This is practical record-keeping rather than a prescribed form, but it makes the claimed allocation reviewable. The contribution guidance is at Self Occupied House tax benefits.
Interest and principal are separate claims
Do not treat the total EMI as one deduction. The interest component is considered under Section 24(b); eligible housing-loan principal is considered under Section 80C, subject to that provision’s conditions and overall limit. The Income Tax Department’s AY 2026–27 guidance distinguishes the two, and the statutory Section 80C text is at Section 80C.

| Claim | AY 2026–27 old-regime guidance | AY 2026–27 new-regime guidance | What to verify |
|---|---|---|---|
| Section 24(b) interest for a qualifying self-occupied purchase or construction loan | Up to ₹2,00,000, subject to the statutory conditions | Self-occupied interest is excluded in the CBDT return validations | Ownership share, qualifying loan purpose, lender certificate and selected regime |
| Section 24(b) interest for qualifying let-out property | Actual qualifying interest, subject to the related income and loss rules | Listed for let-out property, subject to the related rules | Let-out status, property-income computation and applicable loss restrictions |
| Housing-loan principal under Section 80C | Part of the combined ₹1,50,000 Section 80C ceiling, with conditions | Check the current regime guidance before claiming | Eligible payment, ownership and the assessment-year rules |
Use the official AY 2026–27 individual return guidance together with the CBDT validation rules. Do not carry the ₹2,00,000 or ₹1,50,000 figures into another year without checking that year’s instructions.
Step-by-step reconciliation before you file or correct a claim
- Freeze the assessment year. Write down the year for which the deduction was claimed or will be claimed. Gather the return form used, filing date, acknowledgement, processing intimation and any notice. The same loan can have different treatment in different years.
- Map the deed. Make a table listing every named owner, the recorded percentage and whether the shares are definite. Confirm that the percentages total 100 percent. Mark any proposed claimant who has no recorded share; that person needs specialist advice before a house-property deduction is entered.
- Map the loan. Record every borrower and co-borrower, the sanction date, account number, purpose and the lender’s annual certificate. Ask the lender for a corrected certificate if names or component amounts do not match the account records.
- Split each EMI into components. For every payment, record the date, total debit, interest portion, principal portion and the account used. Total the year’s interest separately from the year’s principal. Never derive interest by subtracting an assumed principal amount from the EMI when the lender has supplied a component statement.
- Trace the money. For each owner or borrower, identify the amount that person supplied. Where another person paid first, attach reimbursement transfers and note the dates and amounts. Make sure the sum of all claimed interest portions does not exceed the lender’s actual interest for the year.
- Apply the tax conditions. Classify the property as self-occupied or let out for that year, record the selected tax regime and test the relevant cap and purpose conditions. Check that the Section 24(b) interest entry and Section 80C principal entry are not the same amount or duplicated in two schedules.
- Compare the draft return with the evidence. Match the deed share, lender certificate, contribution schedule and return fields line by line. Resolve any zero-share, over-100-percent or excess-interest validation before submission.
How common ownership-and-payment patterns should be analysed
| Pattern | What the records show | Issue to resolve |
|---|---|---|
| Parents are the only owners and their child pays every EMI | Child has payment evidence but no deed share | Payment alone does not cure a zero ownership share for the child’s Section 24(b) claim. Review whether the parents, as owners and eligible borrowers, have a supportable claim and whether the child’s loan role creates any separate issue. |
| Two spouses are owners and both are borrowers; one account pays the EMI | Both have recorded shares, but debits come from one account | Document reimbursements or other funding and allocate interest consistently with each owner’s contribution and the lender total. |
| One owner is not a borrower but contributes money | Deed shows a share; loan documents name another person | Obtain advice on the interaction between the ownership share, lender certificate and actual interest contribution before entering a claim. |
| Borrower’s name appears on the loan but not the deed | Loan evidence exists; property share is zero | Do not infer ownership from borrower status. The CBDT validation specifically flags a zero-share Section 24(b) claim. |
| Shares are not stated clearly in the deed | Several owners and an ambiguous document | Do not invent percentages to make the return balance. Clarify the legal record first. |
Choose the correction path by filing stage
Only the employer’s tax withholding estimate is wrong
Give the employer accurate particulars and supporting evidence through the Form 12BB process. Form 12BB is the employee’s declaration of deduction particulars and evidence for salary withholding; Form 16 records the employer’s annual salary, deductions and tax deducted. Use the Income Tax Department’s salary and form guidance to check the current requirements.
Correcting Form 12BB or receiving a different Form 16 does not amend the sale deed or establish ownership. When the return is later prepared, the deed, lender certificate, payment trail and return schedules must still agree.
The return has not yet been filed
Rebuild the claim from the reconciliation table rather than copying the figure from payroll. Select the correct property-use and regime options, enter only the eligible interest and principal in their separate schedules, and retain the documents with the filing records.

The return was filed or processed
First identify the assessment year, filing date, processing status, intimation number and the exact field that is wrong. Then check the current official instructions for the correction mechanism available to that status. Depending on the facts, taxpayers may need to examine a permitted revised, updated or rectification route, but no single route or deadline applies to every return. The Income Tax Department’s ITR-1 FAQ is one official starting point for filing-process information; use the guidance for the actual return form and assessment year.
A notice or assessment is underway
Do not send an informal calculation that changes the ownership story. Assemble the deed, loan documents, lender certificate, contribution schedule, bank statements, filed return and notice, and respond through the channel and deadline stated in the notice. A tax professional can determine which facts and legal provisions should be presented for that proceeding.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Build a defensible document file
Keep one folder for each assessment year. Include:
- Registered sale or conveyance deed and any document that records ownership percentages.
- Loan sanction letter, loan-account statements and annual lender certificate.
- A certificate or statement that separates principal repaid from interest charged.
- Bank statements showing EMI debits and transfers used to reimburse the paying account.
- A spreadsheet with columns for date, total EMI, interest, principal, payer, source account, reimbursement and cumulative totals.
- Employer Form 12BB submission and Form 16 if the discrepancy began in salary withholding.
- Filed return, computation, acknowledgement, processing intimation and every notice for the relevant year.
- A written note explaining unusual items such as a loan takeover, refinancing, prepayment or a change in occupancy.
Retain the original electronic statements and download lender certificates rather than relying only on screenshots. The goal is to let a reviewer trace the amount in the return back to both the lender’s annual total and the person who actually funded it.

Using the total EMI as “interest”
Principal and interest have different provisions. Replace the EMI total with the lender’s component figures and report each part only in its relevant schedule.
Splitting interest by ownership percentage without checking payments
A deed percentage and an interest-contribution percentage are not automatically identical. For co-owners, reconcile the proposed split to actual interest repayments and documented transfers, while ensuring the collective claim does not exceed the lender’s total.
Ignoring the selected regime
A figure that was supportable under an old-regime self-occupied calculation may fail under the new regime. Record the regime in the year-by-year worksheet before applying any cap.

Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Assuming Form 16 settles eligibility
Form 16 reflects the employer’s withholding computation. It does not replace the deed, lender certificate or payment evidence, and it does not prevent a return validation from rejecting an inconsistent claim.
Using a prior-year correction deadline
Filing options and deadlines depend on the assessment year and processing status. Verify the current official instruction for the exact return instead of copying a date from an older case.
When a tax professional is warranted
Consider an Indian tax practitioner when the deed and loan names differ, ownership shares are unclear, a non-owner has claimed deductions, reimbursements are informal, the property changed from self-occupied to let out, more than one return year is affected, or a notice has been issued. Give the practitioner the complete document file and ask for a written explanation of which person claims which component and under what provision. Verify the practitioner’s credentials, scope and current availability before engaging them.
A clean correction has three parts: the ownership record, the lender’s interest-and-principal record and the payment trail. If those three cannot be reconciled for the relevant year and regime, pause the claim and obtain case-specific advice rather than forcing the figures to balance.
