How to Find Out Whether a Foreclosure Sale Is Scheduled for Your Home

By TheFinanceBase Team 12 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The fastest reliable way to find out whether a foreclosure sale is scheduled is to call your mortgage servicer and then verify the information with the government office or trustee conducting the sale. Ask for the exact date, time, location or auction platform, responsible sale official, and whether the sale has been postponed, cancelled, withdrawn, or rescheduled.

Do not rely on a single online listing. Foreclosure procedures differ by state and county, and a calendar entry can change after it is posted. Check the official court docket, sheriff or court sale calendar, county clerk or recorder records, and any trustee-sale notice that applies to your property. If the sale may be close or the information conflicts, contact a HUD-approved housing counselor or a foreclosure lawyer immediately.

Start with the mortgage servicer

Your servicer has the loan-specific information that public records may not show, including whether a sale has been assigned to a trustee or sheriff and whether a postponement was entered after a notice was published. Use the telephone number on your most recent mortgage statement or the servicer’s official website, not a number from an unsolicited message.

Have the right identifiers ready

Before calling, gather the property’s complete street address, county and state, your name exactly as it appears on the loan documents, the mortgage account number, and any foreclosure case or parcel number. Also have the name of a trustee, substitute trustee, sheriff, court, or law firm shown on a notice. A representative may need more than the address to locate the correct file.

Ask for the complete sale status

Use direct questions rather than asking only whether foreclosure has “started.” Ask:

  • Has a foreclosure sale been scheduled for this loan?
  • What is the current sale date and time?
  • Where will it occur, or what online auction platform will be used?
  • Which sheriff, trustee, public trustee, clerk, or other office is conducting it?
  • Has the sale been postponed, cancelled, withdrawn, or rescheduled?
  • What is the name and contact information for the sale official?

Request written confirmation through the servicer’s secure message system, letter, or other channel it identifies. Record the call date, representative’s name or identification number, reference number, and every date discussed. A periodic mortgage statement can indicate whether the servicer made the first foreclosure notice or filing, but that statement alone may not provide a sale date. Confirm the date with the authority holding the sale calendar.

Use the servicer’s error-resolution process when appropriate

If you believe the servicer reported the wrong status, failed to credit a payment, ignored a loss-mitigation application, or sent an incorrect foreclosure notice, send a written notice of error to the special address designated for that purpose. Use the address in the servicing notice or the servicer’s published instructions; an ordinary payment address may not qualify. Keep a copy and proof of delivery.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Consumer Financial Protection Bureau says errors involving a foreclosure notice, judgment, or sale generally require a response before the sale date. When a complaint arrives within seven days of the sale, the servicer generally must make a good-faith effort to respond, but that timing is not a guaranteed postponement. A written dispute does not by itself stop a sale.

Identify which foreclosure process applies

The records you need depend on whether the foreclosure is judicial or nonjudicial. Terminology varies, so use the notices in your file and ask the local clerk or servicer if the classification is unclear.

Judicial foreclosure

A judicial foreclosure proceeds through a court case. The lender or servicer files a complaint, the court enters orders or a judgment, and a sheriff, clerk, or other designated official normally conducts or lists the sale. Look for a case number, docket, judgment, order of sale, or sheriff-sale reference in the papers you received.

Nonjudicial foreclosure

A nonjudicial foreclosure generally uses a trustee or substitute trustee rather than a full lawsuit. The trustee’s sale notice may be recorded with the county, posted, or published under state and local rules. The notice commonly names the trustee, gives a date and time, and identifies a location or auction method. A recorded notice is evidence of a scheduled event, not proof that the event remains active; confirm its current status with the trustee or sale office.

Search the official local records

Use government sources for the county where the home is located. Search with your full legal name and, where the system permits, the property address, parcel number, or court case number. Each county chooses its own search fields, update schedule, and terminology.

Check the court docket for a judicial case

  1. Open the official state or county court case-search page. Avoid private data aggregators when an official docket is available.
  2. Enter the case number from the complaint or other court papers. If you do not have it, try the borrower’s or lender’s name, or the address if the court system supports address searches.
  3. Read the newest docket entries for a judgment, order of sale, sale confirmation, stay, dismissal, or other order that changes the case.
  4. Write down the court, division, case number, assigned judge if shown, and the date of every relevant order.
  5. Use the docket information to locate the sheriff, clerk, or court auction calendar, then ask that office whether the listed sale remains active.

A docket entry can authorize or refer to a sale without being the final calendar entry. Cuyahoga County, Ohio, for example, directs residents to its Clerk of Courts docket for current filings while its sheriff publishes sale and status information. That division of responsibilities is common, but the names and offices are not universal.

Review the sheriff, clerk, or court sale calendar

Search the official county sheriff, clerk of court, or court-sale page for the property, case number, or defendant’s name. Some systems list only upcoming sales; others retain cancelled, withdrawn, or postponed entries in separate sections. Read the status field and any attached notice rather than relying on a date in a search-result summary.

If the calendar provides a telephone number, call and ask whether the sale is still scheduled as of that day. Ask what event would change the listing and how a new date will be posted. Keep a screenshot or printout showing the search date because the online page may change.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Search county clerk or recorder records for a trustee notice

For a nonjudicial foreclosure, use the county clerk, recorder, register of deeds, or public-trustee records identified by local instructions. Look for titles such as Notice of Sale, Notice of Trustee’s Sale, Notice of Substitute Trustee’s Sale, or a similar filing. Open the document image when available and capture:

  • the recording number and recording date;
  • the borrower and property description;
  • the trustee or substitute trustee’s name and contact details;
  • the announced date, time, and place or platform; and
  • any language about postponement, continuation, withdrawal, or a new notice.

One county portal may not include every notice. Dallas County, Texas, for example, directs users to its public search system for newer notices, illustrating why the county’s own instructions matter. Ask the recorder which database is current and whether notices are also posted or published elsewhere.

Check posted or published notices when no portal helps

Some jurisdictions require posting at a courthouse or other public location, publication in a newspaper, or use of a separate trustee calendar. If an online search returns nothing, call the clerk, sheriff, trustee, or court and ask where legally required notices are posted or published. A missing web result does not establish that no sale is scheduled.

The Texas State Law Library notes that no single website lists every foreclosure sale across Texas and directs readers to local county resources. That is a Texas example of local variation, not a nationwide rule; other states and counties may use different offices and notice systems.

Verify that a listed date is still current

Foreclosure sales can be postponed, cancelled, withdrawn, or rescheduled after the original notice. A lender and borrower may be negotiating, a court may issue a stay, or the sale official may move the event for an administrative reason. None of those possibilities can be inferred from the original notice alone.

Contact the office conducting the sale shortly after finding a date and again as the date approaches. Ask, “Is this sale active as of today?” and request the current date, time, location or platform. Confirm the answer with the trustee, sheriff, or clerk named in the notice, not only with a third-party website or an old letter. Save written replies, updated notices, and screenshots showing when each status was checked.

Official county pages demonstrate why this step matters: some display separate postponed or withdrawn lists, while others repost a notice with a new date. If two official sources disagree, treat the status as unresolved and call both offices until you know which one controls the sale.

Can you search by address or case number?

Sometimes, but not always. Court dockets commonly work best with a case number or party name. Recorder systems may index a parcel number, legal description, borrower name, or recording number rather than a street address. Sheriff calendars may use the defendant’s name or case number and omit address searches for privacy or technical reasons.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Try the identifiers in this order:

  1. Use the case number exactly as printed, including letters, prefixes, or year digits.
  2. Search the borrower’s full legal name and common spelling variations allowed by the portal.
  3. Use the parcel or tax-account number from a property-tax bill or county assessor record.
  4. Try the street address only if the official system supports it, entering the number, street name, and directional abbreviations in the format the county specifies.
  5. Call the office and ask which identifier it accepts when no result appears.

Do not conclude that a property is clear because an address search failed. The record may be indexed under a former owner, a business entity, a legal description, or a trustee’s name, or it may be held in another county system.

How to interpret the documents you find

Notice of sale

A notice of sale announces an intended auction and usually supplies the first date, time, and place. It may be recorded, posted, or published. It does not answer whether a later postponement or cancellation occurred.

Judgment or order of sale

A court judgment or order authorizes the next stage of a judicial foreclosure. It may precede the sheriff’s calendar by days or weeks. Use the order to identify the case and responsible sale office, then verify the calendar directly.

Postponement, withdrawal, or cancellation entry

These entries show that the original event changed, but they may not give a replacement date. Ask the sale official whether a new date has been set and how it will be announced.

Servicer statement that foreclosure has begun

A mortgage statement can disclose that the servicer made a first foreclosure notice or filing. It may not identify the sale date, and it does not replace the court, sheriff, trustee, or recorder’s current information.

What to do when a sale may be imminent

Move immediately if the verified date is near, if you received a sale notice, or if official sources conflict. A phone call, loan-modification request, or dispute does not automatically stop a scheduled sale.

Understand the federal timing rules in general terms

The CFPB says a complete loss-mitigation application received more than 37 days before a scheduled sale can trigger specified federal servicing procedures. The protections depend on completeness, timing, the type of request, and other requirements; they are not a promise that the sale will be cancelled. Ask the servicer what it considers complete and what action, if any, it will take on the sale calendar.

The CFPB also states: “Except in rare cases, your servicer can’t start the foreclosure process until at least 120 days after you become delinquent on your loan.” This is a general rule about when the process may begin, not a calculation of your sale date and not a substitute for state-law advice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Contact housing counseling and legal help

Ask a HUD-approved housing counselor to review the notices and help you communicate with the servicer. The CFPB lists the housing-counseling line at 1-800-569-4287 and provides mortgage-help resources. A local foreclosure attorney or legal-services provider can assess whether a filing, payment history, loss-mitigation application, bankruptcy, court order, or state rule affects your particular deadline.

Bring the counselor or lawyer a complete file: the mortgage and servicing statements, every foreclosure notice, court papers, payment records, loss-mitigation submissions, tracking numbers, and your notes of calls. Tell the adviser the verified sale date first so the review can be prioritized.

Troubleshooting common search problems

The servicer says foreclosure started but gives no sale date

Ask whether a complaint, notice of default, notice of sale, judgment, or order of sale has been filed. Request the case number, trustee name, and sale office. Then search the official docket or recorder and confirm with the sale authority. “Foreclosure started” describes a stage, not necessarily a scheduled auction.

The online calendar shows a date but the trustee says it changed

Follow the current statement from the official conducting the sale and request it in writing. Keep the older listing and the newer communication. Ask where the revised date will appear and check that source again.

No record appears under the address

Search by case number, borrower name, parcel number, legal description, or trustee name. Confirm that you are using the county where the property sits, not the servicer’s headquarters or the county where a lender’s law firm is located. Call the clerk or recorder if the index is incomplete.

You received a notice from a company you do not recognize

Compare the notice with your mortgage statement and public records. Do not send money or personal information to an unverified caller. Contact the servicer using the number on your statement and the trustee or sheriff using contact information from the official record.

The sale date is within days

Call the servicer, sale official, housing counselor, and lawyer the same day. State the date and ask what, if anything, is pending. Do not assume that submitting an application, mailing a dispute, or leaving a voicemail creates a stay; obtain professional advice about your jurisdiction and facts.

Which source should you use?

Method Useful when What to verify Limitation
Mortgage servicer You need loan-specific information or confirmation Sale date, responsible trustee or sheriff, postponement or cancellation, written status A statement that foreclosure began may not provide a sale date; verify with the sale authority.
Court docket The foreclosure is judicial Case filings, judgment or order of sale, case number, later orders A docket entry may not be the final current sale calendar; confirm with the sale office.
Sheriff, clerk, or court sale calendar The county conducts or lists judicial sales Current sale roster and cancellation or postponement status Search fields and update practices differ by county.
County clerk or recorder notice search A trustee notice is recorded or published locally Notice of sale, named trustee, date, time, and place Nonjudicial procedures and filing systems vary; one portal may not cover every sale.
Trustee or sale official by phone Search results are missing, stale, or unclear Whether the sale is active and the currently scheduled details Get the answer in writing where possible; the official may direct you to another office.

A practical record-checking checklist

  • Write down the property address, county, state, borrower name, account number, parcel number, and every case or recording number.
  • Call the servicer and obtain the date, time, location or platform, responsible official, and current status.
  • Search the official court docket if the matter is judicial.
  • Search the sheriff, clerk, or court sale calendar.
  • Search county clerk or recorder records for a trustee-sale notice if the matter is nonjudicial.
  • Ask where posted or newspaper notices are maintained when no online result appears.
  • Confirm the active status directly with the office conducting the sale.
  • Save notices, docket entries, screenshots, call notes, reference numbers, and proof of delivery for written disputes.
  • Contact a HUD-approved counselor or local legal-services provider immediately if the sale is close or disputed.

Limits of a records search

A search can tell you whether an event is listed and which office appears responsible. It cannot, by itself, determine whether the foreclosure is legally valid, whether the lender complied with every notice rule, whether a payment or application creates a defense, or whether a court order protects the property. Those questions require the actual documents, timing, loan facts, and law of the state and county where the home is located.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Because procedures and calendars are local, continue checking the responsible office until the matter is resolved. Treat an unverified internet listing, an old notice, or a failed address search as incomplete information rather than proof that no sale is scheduled.
