Start with the CFPB’s state-by-state attorney-finding guidance, then contact a local legal-aid office, law-school clinic, or bar-association referral service that handles your type of student-loan problem. Free help is not limited to lawsuits: your loan servicer can handle routine federal-loan administration at no charge, while legal-aid organizations and volunteer attorneys may provide legal advice or representation if you meet local eligibility rules. If the problem involves default, wage garnishment, a disputed debt, or possible misconduct, identify your loan type and seek qualified help promptly.
Decide whether you need a lawyer or routine loan assistance
Many borrowers pay for help they could have received free from the official servicer or Federal Student Aid. A servicer works for the loan holder and can explain account information, process payments, discuss repayment plans, help with eligible consolidation, and identify available forgiveness programs. That is administrative assistance, not independent legal advice. A servicer generally cannot act as your advocate against the loan holder, interpret every legal consequence of a contract, or represent you in court.

Legal help becomes more important when you believe a law or contract was violated, when collection activity is disputed, or when you need someone to advocate for you. The right route depends on the issue, loan type, urgency, location, income, and remedy you are seeking.

Free places to look for a student-loan attorney
1. Use the CFPB’s state-based attorney-finding guidance
The Consumer Financial Protection Bureau’s “How do I find an attorney in my state?” guidance is the most direct starting point for the question, “How do I find an attorney in my state?” It points borrowers to state or local bar-association lawyer-referral services and to free legal-aid programs organized by state. The page was reviewed August 28, 2026.

Follow the state link and look for organizations that list consumer law, debt, bankruptcy, education debt, or student-loan services. Call the intake number rather than assuming that a website description means the office will take your case. Ask whether the organization handles your loan type and problem, whether it offers advice only or full representation, and whether there is an income, asset, geographic, age, disability, or other eligibility test.
2. Contact a nonprofit legal-aid office or legal clinic
Legal-aid offices and clinics may provide free services when you meet their criteria. The service could be a brief consultation, help drafting a letter, assistance preparing an administrative complaint, negotiation with a collector, or representation in a legal proceeding. “Free” does not mean every service is available to every applicant; offices set their own priorities and may have capacity limits.
During intake, give a concise description: the loan type, who currently services or collects it, what happened, important dates, and the result you want. Ask these questions before sending a large file:

- Is there any fee, court cost, filing fee, or expense I would still have to pay?
- What is the safest way to transmit documents?
3. Ask nearby law schools about consumer-law or debt clinics
The U.S. Department of Justice identifies law schools and pro bono volunteers as civil legal-aid providers. A law-school clinic may let supervised students assist with consumer-debt or financial-law matters. Clinics commonly limit the kinds of cases they accept, the geographic area they serve, and the stage of a dispute they can handle. Ask whether a supervising attorney reviews the work, whether the clinic can appear for you, and when its next intake period opens.
4. Use a state or local bar-association referral service carefully
A bar referral service can identify lawyers with relevant experience, but the referral itself is not necessarily free and the lawyer may charge for a consultation or later work. Before accepting a referral, ask about an initial consultation fee, fee waivers, reduced-fee panels, sliding-scale arrangements, and nonprofit alternatives. Tell the service that you are specifically seeking free or low-cost student-loan help and ask whether the lawyer handles the particular issue rather than general consumer matters.

5. Servicemembers can ask a local JAG legal-assistance office
The CFPB lists local Judge Advocate General (JAG) legal-assistance offices as a possible route for servicemembers. Eligibility, appointment availability, and the scope of advice depend on the installation and the servicemember’s status. Call the local office, explain that the matter concerns a student loan, and ask whether it can provide advice, correspondence help, or a referral for representation.

What a federal-loan servicer can do
For federal student loans, Federal Student Aid says borrowers can work with their servicer to discuss repayment choices, switch plans, consolidate eligible loans, and explore forgiveness without charge. Use the servicer shown in your official Federal Student Aid account or on a statement you have independently verified. Keep copies of requests, confirmation numbers, and responses.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsA servicer is useful when the question is “What options are available on this account?” It is not a substitute for a lawyer when the question is “Did the collector violate my rights?” or “How should I respond to a lawsuit or garnishment?”
When to file a CFPB complaint
The CFPB recommends contacting the servicer first for many repayment problems. If the response does not resolve a federal- or private-student-loan issue, you can submit a CFPB complaint. Include dates, the disputed transaction or statement, the resolution you requested, and copies of relevant correspondence. A complaint creates a formal record and seeks a company response; it does not itself provide legal representation, guarantee a particular result, or replace a lawyer where legal advice is needed.
For suspected fraud or identity misuse, Federal Student Aid identifies Federal Student Aid, the Federal Trade Commission, and the CFPB as complaint routes. If money was pulled from a bank account or charged to a card, contact the financial institution immediately and ask what payment-stop or dispute options are available.

A step-by-step plan for finding help
- Write a one-page problem summary. State the loan type if known, current servicer or collector, balance shown, key dates, notices received, payments made, and the outcome you want. Separate facts from assumptions.
- Verify the loan and contact information. Check your official Federal Student Aid account for federal-loan details. Private loans may appear on a lender’s verified statement. Do not rely on a caller’s phone number, email signature, or a search advertisement alone.
- Ask the servicer for an account review. Request a written explanation of the balance, payment history, status, and available options. Save the request and response.
- Preserve evidence. Download statements, save letters and envelopes, record call dates and representative names, and keep proof of payments. Do not edit originals; make copies for an intake packet.
- Search the CFPB state guidance. Identify your state or local bar referral service and listed legal-aid programs. Contact more than one qualifying provider if the first has no capacity.
- Ask law schools and, if applicable, JAG. Use the same short summary and ask about subject-matter coverage, eligibility, intake dates, and the level of help offered.
- File an official complaint when appropriate. If the servicer has not corrected a documented problem, submit a CFPB complaint. If you suspect a scam, report it through the official Federal Student Aid, FTC, or CFPB channels.
- Confirm the engagement before sharing sensitive records. Ask who will represent you, what is free, what remains your responsibility, and how the provider protects documents. Never provide a StudentAid.gov password.
Match the help to the problem
Repayment-plan or forgiveness questions
Start with the servicer and official Federal Student Aid information. A nonprofit credit-counseling organization may help you make a debt budget. Consider legal aid if the problem involves a disputed contract term, an alleged misrepresentation, a denial that appears inconsistent with the rules, or consequences you cannot evaluate without legal advice.
Incorrect balance, payment history, or loan status
Ask the servicer for a written account review and correction. If the issue persists, file a CFPB complaint and give the documents to legal aid or a clinic. A lawyer can assess whether the error caused fees, credit-reporting harm, collection activity, or another legally actionable loss.
Default and collection notices
Do not ignore a notice because the balance looks wrong. The official resolution route depends on who holds the debt. Department-held defaulted loans are handled by the Default Resolution Group, which does not charge for its services. Some commercially held Federal Family Education Loan (FFEL) accounts instead go to a guaranty agency. Verify the loan type and the official contact information before sending documents or money.
Federal Student Aid’s default guidance says borrowers can request documents related to the debt and describes rights connected with wage garnishment. A legal-aid provider can help you understand deadlines, challenge inaccurate information, or determine whether representation is appropriate. If you have received a lawsuit, administrative hearing notice, or garnishment notice, tell intake the response deadline on the first call.
Private student-loan disputes
Private loans do not use the same federal servicing and default pathways. Gather the promissory note, amendments, billing history, collection letters, and any private lender complaint response. Ask a legal-aid office, clinic, or referral lawyer whether it handles private education debt and the law governing your agreement. You can also submit a CFPB complaint about a private student loan, but a complaint is not a substitute for representation in court.

Credit reporting or identity-related problems
Bring the credit-report entry, dispute correspondence, account statements, and proof of identity theft or payment. Ask legal aid whether it handles credit-reporting or identity-related claims in addition to student-loan matters. Use secure transmission and provide only the information necessary for intake.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to bring to intake
A well-organized packet helps an office decide quickly whether it can assist. Include:
- The promissory note or loan agreement and later modifications, if available.
- Recent account statements showing the balance, status, interest, fees, and payment allocation.
- Collection notices, wage-garnishment materials, court papers, or deadlines.
- Payment confirmations, bank records, tax forms, or employer notices relevant to the dispute.
- Emails, letters, chat transcripts, and notes from calls with the lender, servicer, collector, or government agency.
- Copies of complaints and the responses you received.
- A timeline with dates and a specific description of the remedy you want.
Redact unnecessary account numbers and do not email your StudentAid.gov username, password, one-time codes, or a full Social Security number to an unverified person. A legitimate provider will tell you how to submit sensitive documents securely.
How cost and eligibility usually work
There is no single national income cutoff, acceptance rate, or guaranteed waiting period for student-loan legal aid. Each organization sets its own criteria and priorities. Some services are limited to people below an income or asset threshold; others prioritize older adults, people with disabilities, servicemembers, tenants facing related hardship, victims of fraud, or people with an imminent legal deadline. Geography and the kind of loan also matter.
Ask whether the provider offers:
- A free brief advice appointment.
- Limited-scope help, such as reviewing a letter or preparing a response.
- Negotiation without appearing in court.
- Full representation.
- A reduced-fee or pro bono referral when free representation is unavailable.
Clarify any costs that are not attorney fees, such as filing, service, copying, transcript, or court fees. Do not assume a bar referral or an initial consultation is free until the lawyer confirms it.

Scam warning signs and account recovery
Federal Student Aid warns about companies that promise immediate or total cancellation, pressure you to act, demand upfront or recurring fees for routine federal-loan help, or ask for your StudentAid.gov login credentials. The U.S. Department of Education and its partners—including loan servicers—state: “The U.S. Department of Education and our partners—including loan servicers—will never ask for your StudentAid.gov username and password.”
Federal Student Aid reported 2.6 million fraud reports to the Federal Trade Commission in 2023. That figure covers fraud reports generally, not a count of student-loan legal-aid scams, but it illustrates why unsolicited promises deserve scrutiny.
Using a private, unaffiliated debt-relief company does not automatically mean you were scammed. The safer approach is to verify the provider, understand exactly what it will do, and first check whether the task can be completed free through your servicer or a trusted legal-aid organization.
Recommended Free Tools
If you shared credentials with a suspected scammer:
- Change your StudentAid.gov password immediately and do not reuse it elsewhere.
- Review account contact details, linked banking information, and pending requests for unauthorized changes.
- Contact your financial institution if money was taken or a payment is scheduled, and ask about stopping or disputing it.
- File reports through Federal Student Aid, the FTC, and the CFPB as appropriate.
- Tell a legal-aid provider what happened, especially if the scammer submitted forms or changed your account.
Choosing among the available routes
| Route | Advice or representation? | Eligibility and cost | Urgency and availability | Best fit |
|---|---|---|---|---|
| Nonprofit legal aid | May provide advice, limited-scope help, negotiation, or representation | Local rules; often free if criteria are met | Capacity and wait times vary; disclose deadlines | Low-income borrowers with a legal dispute or collection problem |
| Law-school clinic | Supervised student assistance; scope varies | Clinic-specific eligibility; generally no attorney fee | Intake periods and academic schedules vary | Consumer-law or debt matters accepted by the clinic |
| Bar referral service | Connects you with a private attorney | Referral and consultation may have fees; ask about waivers or reduced-fee panels | May locate a lawyer faster, but acceptance is not guaranteed | Borrowers who need a lawyer with a particular specialty |
| JAG legal assistance | Advice or referral within the office’s authority | Generally limited to eligible servicemembers and families | Appointment and scope depend on the local office | Servicemembers with qualifying legal-assistance needs |
| Servicer or government complaint channel | Administrative help or a documented response, not legal representation | Free | Use promptly for account errors; complaint handling times vary | Repayment administration, servicing disputes, and escalation |
When to seek help immediately
Contact legal aid, a clinic, or a qualified attorney as soon as possible if you have a lawsuit, a wage-garnishment or administrative-hearing notice, a foreclosure or employment consequence tied to the debt, a deadline to appeal a decision, or evidence that someone changed your account without permission. Put the date and response deadline in the subject line or first sentence of your intake request.
If no legal provider can accept the matter, still use the official servicer and complaint channels, request the debt documents available to you, and keep a complete record. An unanswered phone call is difficult to prove; a dated written request and preserved response create a usable record for the next provider.
Bottom line
Free, qualified help is available, but the right source depends on the problem. Use your servicer for routine federal-loan administration, the CFPB’s state guidance to locate legal-aid and attorney-referral options, law-school clinics or JAG assistance when eligible, and official complaint channels when a lender or servicer does not resolve an issue. Treat guaranteed forgiveness, pressure, recurring fees for routine help, and requests for StudentAid.gov credentials as serious warning signs. Verify your loan type, protect your information, and act before a collection or court deadline expires.
