How to Find a GST Lawyer for a DGGI Investigation or Arrest in India

If the Directorate General of GST Intelligence (DGGI) has sent a summons, started an inquiry, searched premises, or may arrest someone, contact an India-based advocate who handles both GST enforcement investigations and criminal procedure. Send the lawyer the original communication and records, ask who will personally advise and appear, confirm experience at the relevant stage, obtain a written fee scope, and check for conflicts. Preserve records and validate the communication through DGGI’s official identification service before acting on a suspicious message.

A summons is a formal investigative step, not automatically an arrest order. Arrest powers arise under a separate provision and have separate safeguards. The facts, offence category, current statute and local court practice determine what happens next, so a lawyer should review the actual document and timeline rather than relying on a paraphrase.

What a DGGI communication means

DGGI’s role

DGGI describes itself as the apex GST intelligence and investigative organisation under the Central Board of Indirect Taxes and Customs (CBIC). Its mandate is to detect, investigate and dismantle GST evasion across India. Investigations can involve a business, director, employee, tax professional, supplier, customer or another person whose evidence or records may be relevant.

The agency publishes headquarters and zonal-unit information on its official website. Use the current official listing when you need to confirm an office or contact channel; copied phone numbers and old directories can become inaccurate.

A section 70 summons

Section 70 of the Central Goods and Services Tax Act, 2017 gives the proper officer power to summon a person whose attendance is considered necessary to give evidence or produce documents or other things in an inquiry. The statutory wording says the power is exercised in the manner provided for a civil court under the Code of Civil Procedure, 1908. For the provisions cited in the Act, the inquiry is treated as a judicial proceeding.

A summons therefore requires serious, organized attention. It does not, by itself, establish that the recipient committed an offence, and it is not the same legal step as an arrest. The document may seek attendance, records, answers, or all three. The exact wording, issuing office, date, and requested material determine the response plan.

Arrest under section 69

Section 69 addresses arrest in specified offence circumstances. In the specified category described in the Act, the arrested person must be informed of the grounds of arrest and produced before a Magistrate within twenty-four hours. The offence category affects whether the case is bailable and how custody and bail are handled. Do not treat the twenty-four-hour rule as a guarantee of release or as a substitute for advice on the current criminal-procedure law.

An arrest risk can arise during an investigation, but a summons alone does not prove that arrest is intended. Your lawyer should assess the communication, the alleged conduct, the person’s role, prior interactions with investigators, and the available records before advising on attendance or protective court steps.

What to do in the first 24 hours

  1. Secure the original communication. Keep the paper summons, envelope, email with full headers, attachments, text messages, caller details and every identifier exactly as received. Do not edit a PDF, forward only a screenshot, or discard the envelope.
  2. Record the timeline. Note when and how it arrived, the attendance date, the issuing office, the officer’s name and designation, every requested record, and any earlier call, search or notice.
  3. Validate the communication. Use DGGI’s official public service and the identifier appropriate to the document’s origin: a Document Identification Number (DIN), eOffice Issue Number or GSTN RFN. If details do not match, pause and obtain independent advice before sending money, records or personal information.
  4. Contact independent counsel promptly. Choose an advocate experienced in GST intelligence or enforcement work and criminal procedure. Send the actual document securely, not merely your description of it.
  5. Preserve records. Put a hold on routine deletion of emails, accounting data, messaging histories, CCTV, invoices, e-way bills, ledgers, contracts and backups that could relate to the issues. Do not alter, destroy, conceal or backdate anything.
  6. Confirm the next required act. Ask counsel to identify whether the immediate requirement is attendance, production of specified records, a written response, or a court application, and to confirm the deadline and venue.
  7. Plan for urgent availability. If the document, prior conduct or counsel’s assessment indicates a realistic arrest risk, arrange a lawyer who can respond outside ordinary office hours and attend the relevant local court process.

These steps preserve options; they do not tell you what answers to give investigators. Substantive responses should be planned with counsel after the records and allegations are reviewed.

How to check whether a purported DGGI message is genuine

Match the identifier to the channel

Identifier mentioned in the message What to check Safe response if it fails
Document Identification Number (DIN) Enter it in the official DGGI verification service and confirm that the issuing office, date and document type correspond. Do not rely on the sender’s link or phone number. Save the message and ask an independently verified advocate to check it.
eOffice Issue Number Use the official route for communications issued through that platform and compare the returned details with the document. Stop any payment or data transfer until the discrepancy is resolved through an official channel.
GSTN RFN Use the verification route applicable to the GSTN-origin communication and check the registered particulars. Treat an unverified request as suspicious and preserve the original files for counsel.

DGGI cautions users not to act on suspicious communications before validation. A genuine identifier does not answer every legal question, however: it does not determine whether a demand is lawful, whether attendance can be rescheduled, or whether arrest is permissible. Those are matters for your advocate.

What kind of lawyer you need

Look for the combination of practices

A lawyer who mainly files routine GST returns, replies to ordinary departmental notices or handles tax appeals may not be the right lead for an intelligence investigation. Ask specifically about personal work involving GST enforcement investigations, summons, searches and seizures, statements, arrest, remand, bail and related criminal procedure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Conversely, a criminal lawyer who has never dealt with GST records may miss the significance of registration data, input-tax-credit chains, e-way bills, invoices, electronic ledgers or the statutory powers being used. The strongest fit is counsel who can connect the tax facts to the criminal-procedure consequences, or a coordinated team in which responsibilities are explicit.

Match experience to the current stage

Current situation Experience to ask about Immediate work the lawyer should define
First summons Section 70 summons responses and investigative interviews Check authenticity, identify the requested material, prepare attendance and decide what can be produced or explained.
Repeated summons or escalating questions Ongoing DGGI inquiries and statement strategy Map prior answers, preserve consistency, communicate with the officer where appropriate and protect against avoidable procedural errors.
Search or seizure GST search-and-seizure practice and evidence handling Review the search documents, inventory and statements; secure copies and preserve a defensible record of what was taken.
Arrest risk or arrest GST arrest, remand hearings and bail in the local court Prepare an emergency contact plan, advise on custody and seek the appropriate court relief under current law.
Prosecution stage GST prosecution complaints and trial procedure Assess the complaint, evidence, jurisdiction and available defenses after the investigation position is clear.

Ask who will actually handle the matter

Some firms market a senior name but assign the first meeting, agency communication or court appearance to someone else. Ask for the lead lawyer’s name, bar enrolment details, expected availability, and the identity of any junior or local counsel. Confirm who will attend the scheduled appearance and who can be reached if an arrest occurs outside office hours.

Check credentials without demanding confidential client information

Verify enrolment and standing through appropriate professional records and, where relevant, court cause lists or orders. You can ask whether the lawyer has handled comparable DGGI or similar agency matters without asking for client names, confidential pleadings or privileged advice. No official source cited here ranks or endorses private lawyers, so treat marketing claims, testimonials and “inside influence” promises cautiously.

Check conflicts

Give the lawyer enough information to identify connected companies, directors, suppliers, customers and former advisers. A lawyer who represents another party in the same investigation or a materially adverse transaction may not be able to act. Ask how a conflict would be handled before sharing the most sensitive records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How to compare shortlisted lawyers

Use the same questions with each candidate and write down the answers. This makes a high-pressure decision less dependent on advertising or a confident sales pitch.

Decision factor Useful question What a strong answer sounds like
Relevant practice Do you personally handle GST intelligence or enforcement investigations and criminal procedure? A clear description of the lawyer’s own role in summons, search, arrest, remand or bail matters, without revealing client confidences.
Stage knowledge What is the legal and practical stage shown by my document? The lawyer distinguishes summons, inquiry, search, arrest, remand, bail and prosecution instead of treating them as interchangeable.
First actions What do you need today, and what must happen before the stated date? A prioritized document list, deadline plan and explanation of what is known versus still uncertain.
Personal appearance Who will communicate with DGGI and attend court? Named responsibility, backup arrangements and realistic availability.
Fees and scope What does the initial fee cover, and what is billed separately? Written stages, appearance limits, court work, travel, filing costs, taxes and out-of-pocket expenses.
Conflicts Can you act for all relevant people and entities? A conflict check based on the parties and transactions you disclosed.
Communication How will urgent instructions and document sharing work? A secure channel, response expectations and a process for preserving originals.

Do not choose on a claimed guaranteed bail result, guaranteed closure, alleged access to an officer, or a promise that no attendance will ever be required. Outcomes depend on facts, evidence, statutory provisions and court decisions.

What to send before the first consultation

Core documents

  • The complete summons, notice, search memo, arrest memo or other communication, including every page and attachment.
  • The envelope, email headers, originating address, phone numbers and document-identification details.
  • GST registration details, relevant returns, electronic liability and cash ledgers, invoices, e-way bills and credit records.
  • Contracts, purchase orders, delivery records, payment proofs, bank statements and correspondence connected to the questioned transactions.
  • Names and roles of directors, partners, employees, tax advisers, suppliers and customers involved in the relevant period.
  • A chronology of searches, summonses, statements, payments, prior notices, replies and communications with officials.
  • Any inventory, panchnama, seizure list, statement or receipt issued during a search or earlier visit.

How to package the material

Keep an untouched original set and create a clearly labelled working copy. Use a secure transfer method agreed with counsel; ordinary messaging apps and public links can expose confidential tax and identity data. Do not annotate the original communication or rewrite a statement from memory. Mark uncertainties as questions for the lawyer rather than silently filling gaps.

Questions to ask in the first meeting

  • What does this document legally require, and what remains discretionary?
  • What is the attendance or production deadline, and can a different date or format be requested?
  • Which records should be produced now, and which need a relevance, privilege or confidentiality assessment?
  • What facts could increase arrest or remand risk, and what preparation is lawful before the next interaction?
  • Who will communicate with the agency, and how will you approve factual responses?
  • What court applications might be available, at what stage, and what are their limits?
  • What is the fee for each stage, and what happens if the matter expands?

What counsel should do at each stage

Before a summons appearance

Counsel should authenticate the communication, read the exact requests, identify the relevant period and entities, and compare the requested material with the records actually available. The lawyer may help organize a production set, prepare a factual chronology and request clarification or reasonable scheduling where justified. Preparation is not permission to coach a false answer: statements and documents must remain accurate.

Ask how the attendance will be documented and how copies of anything submitted will be retained. If the summons is addressed to a company representative, confirm whether the named person or another authorized person must attend; do not assume that a substitution is valid without confirmation.

During or after a search

Give counsel every search document, inventory and receipt. The lawyer can check whether the listed items match what was taken, identify missing copies, and preserve a record of devices, books and statements. Do not obstruct officers, hide material or interfere with electronic evidence. Record factual irregularities promptly while memories and logs are fresh.

If arrest appears possible

Ask for a written emergency plan: the lawyer’s mobile number, a backup contact, the likely court, family or workplace instructions, and the documents needed for a bail or remand hearing. Keep identification and essential medical information accessible. Do not attempt to evade investigators, move assets to conceal them or delete messages.

After an arrest

Tell counsel immediately where the person is being held and what paperwork was provided. Under the specified section 69 category, the Act requires the grounds of arrest to be communicated and production before a Magistrate within twenty-four hours. The applicable offence classification, current criminal-procedure law and court schedule govern the practical process. Counsel should examine the arrest record, custody request and available bail route rather than promising an outcome.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

During prosecution

An India Code-hosted instruction concerning prosecution sanction after arrest says that, where an arrested person has not been granted bail, efforts should be made to file a prosecution complaint within sixty days. That is a dated procedural instruction, not a general release deadline or guarantee of how a particular case will proceed. Your lawyer must verify the document’s date, current status and applicability, then assess the complaint and court record in the actual matter.

Fees, engagement terms and scope

Ask for an engagement letter before substantive work begins. It should identify the client, the matters covered, the lead lawyer, communication channels, confidentiality arrangements and the fee for each stage.

Scope item Clarify in writing
Initial review Whether it includes document authentication, a conference, a written risk assessment and a response plan.
Investigation representation Number and location of appearances, preparation time, agency correspondence and document-production assistance.
Search or seizure work Attendance, inventory review, applications for copies or return of material, and forensic or technical advisers.
Arrest, remand and bail Emergency availability, drafting, filing, each hearing, travel and briefing of local counsel.
Later court proceedings Whether prosecution, discharge, quashing, trial, appeals or tax adjudication are separate engagements.
Expenses Court fees, copying, travel, accommodation, interpreters, experts, filing agents and applicable taxes.

Ask when invoices are issued, whether unused retainers are refundable, and how a fee changes if additional people or entities become involved. A low initial quote can exclude the court work you actually need; an expensive quote is not evidence of better prospects.

Red flags when choosing counsel or responding to a caller

  • A person demands immediate payment to “stop” an arrest or claims to speak for DGGI without verifiable credentials.
  • The sender refuses to provide a complete document, identifier or official office details.
  • A lawyer promises guaranteed bail, guaranteed closure, a particular officer’s favour or a certain case result.
  • You are urged to delete messages, move funds, change invoices, create replacement records or give a rehearsed false explanation.
  • The proposed representative will not identify the advocate who will appear or provide a written scope and fee.
  • The lawyer discourages independent verification, a conflict check or a second opinion in a high-risk matter.

Save suspicious messages and payment instructions. Validate the communication independently and take them to a lawyer whose contact details you obtained through a reliable professional or court source, not solely from the unsolicited message.

Protecting records and people during the investigation

Preserve, do not curate

Keep accounting databases, cloud folders, email, chat exports, phones, laptops, access logs and backups in their existing state. A preservation hold should cover personal devices used for business. Ask counsel before changing retention settings or handing over a device, and document what was copied or delivered.

Keep internal communications disciplined

Tell staff to preserve records and route external requests to the designated lawyer or company contact. Do not circulate speculation, accuse colleagues in writing, or create a group chat that mixes legal advice with casual commentary. Separate factual collection from legal conclusions and follow counsel’s instructions on privilege and confidentiality.

Protect third parties’ data lawfully

Invoices and ledgers may contain customer, employee or vendor information. Do not redact or withhold material simply because it is inconvenient. Ask counsel whether a lawful protective measure, confidentiality request or staged production is available, and keep a record of what was supplied.

When the official information changes

GST legislation, criminal-procedure rules, court practice and agency systems can change. The statute text retrieved for this guidance may not include every later amendment. Before relying on a section number, deadline or procedural instruction, counsel should check the current consolidated law, the specific communication and relevant court orders.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use DGGI’s current official verification service and contact listings when you act. Do not copy old zonal telephone numbers into internal procedures without checking them. The official sources do not endorse private lawyers, publish a success rate for counsel, or establish that any individual can guarantee bail or prevent arrest.

Choosing between one lawyer and a coordinated team

One advocate may be efficient when the matter is a straightforward summons and the person has both GST and criminal-procedure competence. A coordinated team can be useful when the case involves several entities, extensive electronic records, a search, parallel tax proceedings or an immediate remand hearing. If more than one lawyer is involved, insist on a single lead contact, a written division of responsibility and a shared chronology so that advice and factual statements do not conflict.

For a director, employee or consultant, confirm who is paying and who is the client. A company-funded lawyer may represent the company’s interests while an individual’s interests diverge. Discuss separate representation early rather than waiting until an interview or arrest.

A practical decision rule

Choose the lawyer who can explain, in plain language, what the document requires, what is unknown, what must happen next and what the lawyer will personally do. Give greater weight to verified relevant experience, availability, conflict-free representation and transparent scope than to a large office, dramatic claims or a promised outcome. In a live DGGI matter, prompt review of the actual communication and careful preservation of records are more valuable than a generic online answer.
