The safest way to find a buyer’s agent is to interview several candidates, verify each person’s active license and disciplinary history with your state regulator, ask exactly whom the agent represents, and compare a written agreement before you sign. The agreement should spell out the services, term, properties or geography covered, compensation, and how either side can amend or end the relationship.
Do not assume that the person who opens a door at a showing represents you, that a commission is legally fixed, or that every state uses the same agency and timing rules. Representation, required disclosures, tour requirements, and termination rights depend on the law where the property is located.

What a buyer’s agent actually represents
A buyer’s agent is a real-estate professional engaged to work for the buyer’s interests. A seller’s agent works for the seller. Those duties are not interchangeable, and an agent’s presence at a showing does not by itself establish an agency relationship. Ask directly who the professional represents and read the agency disclosure required in your state. The National Association of REALTORS® (NAR) explains the main agency and non-agency models in its Consumer Guide: Agency and Non-Agency Relationships.

Agency law is state-specific. Depending on the jurisdiction, a transaction can involve single agency, dual agency, designated agency, subagency, or a non-agency arrangement such as transaction brokerage. In a dual-agency arrangement, one brokerage or license holder may represent both sides, creating potential conflicts. Where dual agency is permitted, the parties generally must receive disclosures and provide informed consent under local law. Designated agency may assign different agents in one firm to the buyer and seller, but the exact duties and safeguards also vary by state.

Questions that establish the relationship
- Who would represent me in this purchase?
- Could you, another agent in your firm, or your brokerage represent the seller in the same transaction?
- What duties do you owe me, and what information must you keep confidential?
- Which agency disclosure form will I receive, and when must I acknowledge it?
- If a conflict develops, who handles it and what choices would I have?
For example, the Texas Real Estate Commission (TREC) says a license holder serving a client must put the client’s interests above others, provide material transaction information, answer questions, present offers and counteroffers, and treat all parties honestly and fairly. TREC also requires an Information About Brokerage Services form the first time a consumer communicates with a license holder about a specific property. Those are Texas requirements, not a nationwide description of every state’s rules. The TREC consumer information page is at trec.texas.gov/public/consumer-information/.
Build a short list of candidates
Start with three or more plausible candidates rather than hiring the first person recommended to you. A referral is a useful lead, not proof that the agent fits your market, budget, property type, schedule, or preferred working style.
Use experience-based referrals
Ask friends, relatives, neighbors, and colleagues who bought in the same area or faced a similar situation. A first-time buyer, an investor, a relocating household, and a buyer seeking a condominium may need different expertise. Ask the referrer what the agent actually did, how quickly the agent responded, and how disagreements about price or strategy were handled.

Use online profiles, brokerage pages, professional directories, and public reviews to identify additional candidates and questions to ask. Treat marketing claims as starting points. A profile that says “local expert” does not establish recent experience with your neighborhood, price range, financing type, or property condition.
Verify the license with the regulator
Before an interview, find the person in the licensing database for the state where you plan to buy. Confirm that the license is active and note any public disciplinary record, required education, and the supervising or sponsoring broker. Texas’s lookup and consumer resources illustrate the kind of information a regulator may publish; other states maintain their own systems and may display different fields. If you cannot match a person to an active license or identify the supervising brokerage, pause before sharing documents or signing anything.
Interview candidates before you agree to representation
Schedule conversations with multiple agents and give each the same basic information about your target area, budget, financing status, property type, timing, and constraints. Consistent questions make the answers easier to compare.
Ask what service is included
Have the agent describe the work from the initial search through closing. Clarify whether the agent will set up a search, screen listings, arrange and attend showings, analyze comparable sales, prepare offer terms, negotiate inspections and repairs, coordinate with the lender and title company, attend the final walk-through, and handle closing questions. Ask which tasks are performed personally and which are delegated to an assistant, transaction coordinator, or another license holder.

Ask who will be available
Find out who your day-to-day contact will be, the normal response window, evening and weekend coverage, and what happens when the agent is unavailable. Ask whether another agent can show properties or negotiate on the agent’s behalf and how you would be notified. A strong rapport is useful, but a clear coverage plan matters more when a listing appears or an offer deadline is short.
Test relevant experience
Ask for examples of work in your intended neighborhoods, price range, and property type. If you need a condominium, historic home, new construction, rural property, or a purchase with unusual financing, ask how the agent handles the specific disclosures, inspections, or contract timelines involved. The goal is not a sales pitch; it is to learn whether the agent recognizes the risks that matter to your purchase.
Discuss conflicts before they arise
Ask whether the agent or brokerage also lists homes in your target area, how an in-house listing would be handled, and what choices you would have if the brokerage represents both sides. Request a plain-language explanation of confidentiality, disclosure, and consent requirements under your state’s law.
Ask for the agreement in advance
Request a blank or proposed buyer representation agreement before you decide. Read it outside the meeting and ask the agent to explain every term. The NAR Consumer Guide to Negotiating Written Buyer Agreements identifies services, duration, and compensation as negotiable subjects. You do not have to sign terms you do not accept, and either side can decline to proceed while negotiations continue.

Use a written comparison rather than relying on memory or personality. The following framework combines the practical issues that determine whether an agent can represent you effectively.
| Comparison area | What to record | Why it matters |
|---|---|---|
| Agency relationship | Who represents you; possible dual or designated agency; disclosure and consent process | Clarifies duties, confidentiality, and conflict handling |
| Local and property experience | Neighborhoods served, recent work in your price range, relevant property types and financing | Shows whether the agent understands the decisions your purchase requires |
| Services | Search, showings, market analysis, offer preparation, negotiation, inspections, coordination, and closing support | Prevents assumptions about work that is not promised |
| Communication | Primary contact, response expectations, coverage when absent, preferred channels | Sets expectations during time-sensitive listings and negotiations |
| Agreement scope | Exclusive or nonexclusive; term; geographic area; property types; any excluded properties | Defines when the contract applies and whether you can work with another agent |
| Termination and amendment | Notice method, fees or obligations on termination, amendment procedure, broker involvement | Shows how you can leave or change the relationship if it is not working |
| Compensation | Flat fee, percentage, hourly fee, or another objective amount; due date; treatment of seller-paid amounts; cap on total payment | Lets you estimate your maximum out-of-pocket cost |
Compare the commitments written in each proposal, not just the agent’s brand, online rating, or confidence during the interview. If an answer is vague, ask for the term to be written into the agreement or an attached service description.

Parties and authority
Check the legal names of the brokerage, agent, and buyer, the agent’s license information where required, and the supervising or managing broker. Know whether you are contracting with an individual license holder, the brokerage, or both.
Services and standards
Look for a concrete description of the agent’s obligations. “Assist with the purchase” is less useful than a list covering searches, showings, offer preparation, negotiation, transaction coordination, and closing support. Confirm whether the agreement promises a particular level of availability or merely describes general assistance.
Term, area, and exclusivity
Record the effective date and expiration date. Determine whether the agreement covers a defined geographic area, a property type, or every property you might buy. An exclusive agreement may restrict you from engaging another agent during the term; a nonexclusive agreement may operate differently. Ask what happens if you find a property independently or speak with another brokerage.
Compensation and payment events
Compensation is negotiable. NAR identifies flat fees, percentages, and hourly fees as possible forms, and Texas states that TREC does not regulate fees; the fee is set in the professional’s agreement. Do not treat any percentage as customary or legally required.
Under the settlement practice changes described in NAR’s September 5, 2024 NAR Settlement FAQs, a covered written agreement must state compensation specifically and conspicuously, or explain objectively how it will be determined. It cannot leave payment open-ended, and compensation received from all sources cannot exceed the amount agreed with the buyer. The document must also state that fees and commissions are negotiable and are not set by law. Whether a particular professional or transaction is covered depends on the applicable rules and circumstances, so confirm the current requirements locally.

A seller may agree to pay some or all of the buyer agent’s compensation, but that is not automatic. Ask how a seller-paid amount would be offered and documented, what you would owe if the seller contributes less than the amount in your agreement, and whether the contract credits seller-paid compensation against your obligation. NAR’s FAQ says offers of buyer-agent compensation cannot be shared on a multiple listing service under the covered settlement practices, while seller concessions such as help with closing costs remain possible. Your offer and agreement should make the payment source and any remaining balance unambiguous.
Amendment and termination
Find the exact procedure for changing or ending the agreement: written notice, a specific form, broker approval, a fee, or a protection period after expiration. A verbal promise that you can “cancel anytime” is not a substitute for contract language. Mutual amendments may be possible, but the existing contract and state law govern whether a change or termination is effective. If a clause is unclear or appears unusually restrictive, ask a real-estate attorney to review it before signing.

When must you sign before touring a home?
There is no single nationwide answer. NAR says many professionals covered by its settlement practice changes require a written buyer agreement before an in-person or live virtual tour. Under that guidance, independently attending an open house or asking an agent about services does not itself require signing. The specific professional, brokerage policy, state law, and transaction circumstances still control.
State statutes can impose an earlier or different trigger. Oregon’s official Buyer Representation Agreement FAQs, published in March 2025, say an agreement is required before, or as soon as practicable after, an agent begins assisting with a covered residential purchase or search. The Oregon rule exempts commercial transactions and properties containing five or more residential dwellings. Oregon agreements must address whether the relationship is exclusive, the agent’s obligations, license and supervising-broker details, effective and expiration dates, search criteria, compensation, and termination rights; the term is limited to 24 months.
Because these triggers differ, contact the real-estate regulator where the property is located before scheduling a tour or signing a long-term agreement. Ask the agent to identify the rule or brokerage policy that requires a signature and what activities are covered.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Understand the agency choices in your state
Ask the candidate to explain the available relationships using the legal names used in your state. The main possibilities described by NAR include:
- Single agency: the agent represents one side of the transaction, such as the buyer, subject to state duties and disclosures.
- Dual agency: one agent or brokerage represents both buyer and seller where permitted, creating conflicts that require disclosure and informed consent.
- Designated agency: different agents in the same firm are assigned to the buyer and seller, with duties determined by local law.
- Subagency: an agent may act through another brokerage under an arrangement recognized in some states.
- Transaction brokerage or another non-agency model: the professional facilitates the transaction without owing the full fiduciary duties of an agent; the exact obligations vary by state.
Do not select an option based on its label alone. Ask what information is confidential, whom the professional must obey, how offers are presented, and what happens if the brokerage is also involved with the seller.
Model your possible out-of-pocket cost
Start with the objective compensation stated in the agreement. If it is a percentage, multiply the stated rate by the purchase price; if it is a flat or hourly fee, identify the amount and any conditions that change it. Then subtract any seller-paid amount or other credit that the agreement says counts toward your obligation. The remainder is the amount you may need to fund, subject to the contract and the final transaction price.

Ask these questions before making an offer:
- What exact amount or formula appears in my agreement?
- When is payment due: at closing, upon termination, or at another event?
- Can the seller pay some or all of it, and how will that be documented?
- If the seller pays less than the agreed amount, do I owe the difference?
- Does compensation from every source count toward a stated cap?
- Are there separate charges for administrative work, photography, travel, showings, or cancellation?
Request a written illustration using your likely price range and a scenario in which the seller contributes nothing. This is not a prediction of what a seller will offer; it is a way to see the maximum exposure created by the agreement.

Red flags and ways to protect yourself
Pressure to sign immediately
An agent may explain why a signature is needed before a tour, but pressure to sign a long, exclusive agreement without time to read it is a warning. Ask for a copy, take time to review it, and compare another candidate.
Unclear representation
Statements such as “I work with everyone” do not tell you whether the professional is your agent, a seller’s agent, or a transaction facilitator. Require the agency relationship and disclosure process to be stated plainly.
Open-ended compensation
A blank, range, or phrase such as “whatever the seller offers” does not give you an objective maximum. Ask for a specific amount or an objective calculation and a statement addressing payment from all sources.
Promises absent from the contract
If an agent promises daily updates, unrestricted showings, or extensive negotiation help, ask that the service be included in writing. A marketing brochure is not a substitute for the signed agreement.
No license or disciplinary verification
Do not rely solely on a profile or referral. Confirm the active license and available public record with the state regulator and identify the supervising broker.
Conflicts dismissed instead of explained
An agent who avoids questions about in-house listings, dual agency, or confidentiality may not be prepared to protect your interests. Ask for the state-required disclosure and consider another candidate if the answers remain evasive.
A practical selection process
- Define your needs: write down the target area, price range, financing status, property type, timing, accessibility requirements, and communication preferences.
- Gather candidates: obtain several referrals and add candidates through online research.
- Verify credentials: check each active license, disciplinary information, education details, and sponsoring or supervising broker with the relevant regulator.
- Interview consistently: ask the same questions about representation, services, experience, availability, conflicts, agreement scope, termination, and compensation.
- Request the agreement: obtain the proposed document before a tour or other activity that may trigger a state or brokerage requirement.
- Compare in writing: use the comparison areas above and note any unanswered question or promised revision.
- Negotiate: request changes to services, term, exclusivity, geographic scope, compensation, seller-paid treatment, and termination language that do not fit your needs.
- Review the final version: confirm that every agreed change appears in the document, all dates and amounts are complete, and the agency disclosure is attached or delivered as required.
- Sign only when understood: keep a fully executed copy and record the notice method for amendments or termination.
What to do if the relationship stops working
First read the termination and protection-period clauses. Follow the required notice method and send the notice to the person or broker specified in the agreement. Ask for written confirmation of the effective date and any continuing obligations. Do not assume that simply stopping communication ends an exclusive contract. If the agent disputes the termination, a fee, or an alleged commission, consult the supervising broker and a local real-estate attorney; state law determines your rights.

If the problem involves licensing conduct, disclosure, or professional rules, the state regulator may provide a complaint process. A regulator’s process is separate from obtaining legal advice about a contract or recovering money.
Final checklist before you commit
- I verified the agent’s active license and checked the public disciplinary information available in the property’s state.
- I know whether the agent, brokerage, or another license holder could represent the seller.
- I received and understood the required agency disclosure.
- The agreement lists the services, contact arrangements, term, geographic or property scope, and exclusivity.
- The compensation is objective, negotiable, and clear about payment sources, seller contributions, caps, and any shortfall.
- The amendment and termination procedures are written and realistic for my situation.
- I know whether a signed agreement is required before a showing or other assistance under local law.
- I compared at least one alternative candidate and am choosing based on written commitments rather than pressure.
A buyer’s agent earns your commitment by making the relationship understandable before the search begins. Interview more than one candidate, verify the license, insist on a clear agency relationship, and sign only an agreement whose services, timing, exit terms, and maximum possible payment you can explain in your own words.
