You can buy a home without a traditional bank mortgage in four broad ways: pay the full price in cash, arrange seller financing, use a rent-to-own or purchase-option contract, or share the purchase with a partner. These routes do not have the same legal protections or total cost. A seller-financed contract for deed, for example, can leave you paying taxes, insurance, repairs, and maintenance before you receive the deed—and a missed payment can threaten both your housing and the money you have invested.
The safest approach is to compare the complete payment obligation, title arrangements, property expenses, default procedure, and exit rights before signing. State law controls many details, so have the actual documents reviewed by a qualified local attorney and consult a HUD-approved housing counselor when appropriate.

What “without a mortgage” actually means
A mortgage is a loan secured by the home. Avoiding one can mean that no bank lends against the property, but it does not necessarily mean that no credit exists. If a seller accepts installment payments, the transaction may still be credit under federal law. The Consumer Financial Protection Bureau (CFPB) says, “Contracts for deed are loans where the seller keeps the legal title of a home until the borrower makes all the payments.” Its consumer guidance was last reviewed September 13, 2024.

Option 1: Buy the home with cash
A cash purchase is the most direct way to avoid borrowing. You pay the agreed price from savings or other available funds, and the seller conveys the property through the normal closing process. There is no mortgage loan, monthly principal-and-interest payment, mortgage underwriting, or lender-required appraisal.
Costs that still apply
Cash does not make the home free to acquire or own. Budget for:
- Inspection and, where appropriate, specialized inspections such as termite, sewer, roof, or environmental reviews.
- Title examination, title insurance, recording charges, and deed preparation.
- Settlement and other closing costs required by the contract or local practice.
- Homeowners insurance, property taxes, and any prepaid amounts due at closing.
- Immediate repairs, moving expenses, utilities, and ongoing maintenance.
IRS Publication 530 (2025) explains that a home’s tax basis generally starts with the amount paid and can include certain acquisition costs. It distinguishes costs that may be deductible from costs that are added to basis. The tax result depends on the specific expense and your circumstances, so retain the closing statement and obtain individualized tax advice.
How to decide how much cash to use
Paying cash removes borrowing costs but commits liquid assets to an illiquid property. Before making an offer, set aside a reserve for closing, repairs, taxes, insurance, and ordinary living expenses. The available federal guidance does not determine whether using your savings is financially prudent; that decision depends on your income stability, other debts, emergency reserve, investment alternatives, and tolerance for housing risk.

Cash-purchase process
- Confirm the source and availability of funds and preserve a separate reserve for ownership costs.
- Make an offer that states the price, inspection rights, closing date, included items, and who pays specified closing charges.
- Order an independent inspection and review disclosures. Do not waive inspection simply because there is no lender.
- Hire a title professional or closing attorney to search for ownership defects, liens, unpaid taxes, easements, and other encumbrances.
- Review the settlement statement, verify wiring instructions independently, and complete the deed transfer and recording.
- Arrange insurance and transfer utilities before possession; calendar property-tax and maintenance obligations.
Option 2: Seller financing
With seller financing, the seller receives payments over time instead of all sale proceeds at closing. The documents may use a promissory note secured by a mortgage or deed of trust, or they may use a contract for deed. Those structures are not interchangeable: the security instrument, title transfer, foreclosure rules, and remedies depend on the document and state law.
Contract for deed (land contract)
In a contract for deed, the buyer usually occupies the home and makes scheduled payments while the seller retains legal title until the contract’s requirements are completed. The buyer may nevertheless be responsible for property taxes, insurance, repairs, and maintenance during the payment period. Economic ownership and legal title can therefore be separated for years.
In an August 2024 advisory opinion, the CFPB stated that a creditor-financed home sale under a contract for deed generally fits the Truth in Lending Act and Regulation Z definition of credit. When the obligation is secured by the buyer’s dwelling, federal protections associated with residential mortgage loans will generally apply. That interpretation does not create identical property, eviction, foreclosure, or recording procedures in every state.

| Purchase price and payment schedule | Installments can cost substantially more than the stated price when interest or fees are added. | What is the annual interest rate, payment amount, due date, late charge, and total of all scheduled payments? |
| Balloon payment | A large final payment can be due before you have the cash or qualify for replacement financing. | When is it due, how much is it, and what happens if refinancing is unavailable? |
| Title and liens | The seller may not be able to deliver clear title, and an existing lien can threaten the transaction. | Who orders the title search, which liens exist, and how are they released or subordinated? |
| Taxes and insurance | You may pay owner-like expenses before holding legal title. | Who pays each bill, when is proof supplied, and who receives insurance proceeds after a loss? |
| Repairs and maintenance | Responsibility for major defects can be shifted to the occupant. | Which repairs require approval, who pays for emergencies, and what standard must the property meet? |
| Default and cure | A missed payment can put both your occupancy and prior payments at risk. | What notice is required, how long is the cure period, and is the remedy eviction, forfeiture, or foreclosure? |
| Recording and equity | An unrecorded agreement can be difficult to enforce against later purchasers or creditors. | Will the contract or memorandum be recorded, and how are credits for principal or improvements documented? |
| Exit and transfer | You may need to sell, refinance, or leave before final payment. | Can you assign the contract, prepay without penalty, sell the home, or obtain a deed early? |
Major contract-for-deed risks
- Balloon risk: A final lump sum can make an apparently affordable monthly payment unaffordable overall.
- Title risk: Seller liens, unpaid taxes, bankruptcy, or an ownership dispute can impair your right to receive the deed.
- Payment-loss risk: Depending on the agreement and local law, default may result in loss of prior payments or improvements.
- Rapid loss of possession: The CFPB warns that a seller may seek to remove a buyer quickly after missed payments or other breaches, subject to applicable law.
- Expense mismatch: You can be responsible for insurance, taxes, repairs, and maintenance without the legal control that normally comes with title.
Due-diligence sequence for seller financing
- Obtain the proposed contract, note, disclosure forms, and every referenced addendum before paying a nonrefundable amount.
- Have an independent real estate attorney licensed in the property’s state explain title transfer, remedies, cure periods, and compliance requirements.
- Order a current title search and verify the seller’s identity, ownership, existing mortgages, tax status, judgments, and liens.
- Get an independent inspection and written insurance quote. Confirm that the property is insurable on the terms required by the contract.
- Calculate the complete payment stream, including interest, fees, taxes, insurance, repairs, and any balloon payment. Stress-test the plan against income loss and higher insurance or tax bills.
- Confirm how payments are received and credited, how receipts are issued, and who holds documents and escrowed funds.
- Check the state’s rules for recording, foreclosure, forfeiture, eviction, disclosures, usury, servicing, and contract cancellation.
- Do not sign until the final version matches the reviewed draft and you have copies of all signed documents.
Option 3: Rent-to-own or a purchase option
In a rent-to-own arrangement, you rent the property while receiving a contractual right—or sometimes an obligation—to buy later. The CFPB identifies rent-to-own transactions as alternative sales arrangements, but there is no single standard contract. The agreement may differ on the purchase price, option period, rent amount, option payment, rent credits, repairs, and what happens if you do not exercise the option.

Questions that determine the economics
- Is the purchase right optional or mandatory?
- How much is paid for the option, and is it refundable or credited toward the price?
- Is any portion of rent credited to the purchase price, and what documentation proves the credit?
- What happens to the option payment and rent credits after a late payment or missed deadline?
- Can the seller sell, refinance, or further encumber the property during the option period?
- Who pays for repairs, taxes, insurance, and major systems while you are still a tenant?
- How is the future purchase price set, and can an appraisal or inspection change it?
A purchase option can be useful when you need time to improve credit or accumulate cash, but it can also combine tenant obligations with buyer-like expenses. Do not assume that an option payment, rent credit, or repair arrangement has the same treatment in every state or contract.
Option 4: Equity-sharing or a purchase partner
The CFPB also lists equity-sharing arrangements among alternative sales transactions. A partner may contribute cash in exchange for an ownership interest or a share of future sale proceeds rather than receiving fixed loan payments. Two people can also buy together as co-owners, with or without a separate loan between them.
Distinguish the legal relationship
- Co-ownership: Each person holds a title interest; the deed and ownership form determine control and inheritance consequences.
- Loan: One person advances money and expects repayment, usually with defined interest and security.
- Equity investment: The contributor shares appreciation and possibly losses instead of receiving a guaranteed return.
- Purchase option: One party has a right to buy later under specified conditions.
These categories have different tax, disclosure, consumer-credit, and liability implications. The available federal guidance does not establish a nationally uniform equity-sharing product or standard terms.
Terms a partner agreement should cover
- Names on the deed, ownership percentages, and each person’s initial contribution.
- Who occupies the home and how use of rooms, parking, and shared spaces is decided.
- How mortgage-free property expenses—taxes, insurance, utilities, repairs, improvements, and reserves—are divided.
- Voting rights for refinancing, remodeling, leasing, selling, or taking on liens.
- How appreciation, depreciation, sale costs, and tax consequences are allocated.
- Buyout valuation, notice periods, mediation, death, disability, bankruptcy, relationship changes, and an owner’s failure to pay.
- What happens if one party wants to sell and the other does not.
Use separate legal and tax advice where interests conflict. A friendly verbal understanding is not a substitute for a signed, recorded agreement.

How the alternatives compare
| Route | Upfront cash | When title normally transfers | Potential extra cost | Primary risks |
|---|---|---|---|---|
| Cash purchase | Most or all price plus closing costs | At closing after deed transfer | Closing costs, taxes, insurance, upkeep; opportunity cost of savings | Liquidity loss, defects or liens if due diligence is skipped |
| Seller-financed note secured by property | Negotiated down payment and closing costs | Usually at closing, with seller’s security interest | Interest, fees, possible prepayment or late charges | Default, affordability, unclear servicing or lien priority |
| Contract for deed | Negotiated deposit and transaction costs | Usually after all required payments | Interest, fees, taxes, insurance, repairs, maintenance, possible balloon payment | Loss of title opportunity, forfeiture, seller liens, rapid possession action |
| Rent-to-own | Deposit or option payment plus rent | Only if and when the purchase is completed | Option cost, rent, purchase-price premium, repairs, possible forfeiture | Expired option, lost credits, unsuitable price, unclear tenant/buyer rights |
| Equity-sharing or co-ownership | Shared contributions | According to deed and agreement | Share of appreciation or sale proceeds; shared expenses | Disputes over control, exit, valuation, losses, and personal changes |
“Not stated” in this comparison is intentional: federal sources do not provide a universal rate, fee, down payment, or total-cost figure for these arrangements. Actual terms are set by the contract and applicable state and local law.

- Identify the legal structure. Ask whether the document is a deed transfer with a secured note, a contract for deed, a lease with an option, a co-ownership agreement, or an equity investment.
- Verify the seller and title. Use an independent title professional to check ownership, liens, unpaid taxes, judgments, easements, and existing loans.
- Inspect the property. Obtain an independent inspection even when buying from someone you know. Price major repairs before signing.
- Confirm insurability. Ask an insurer for a written quote and verify who is named on the policy and who receives claim proceeds.
- Model the full cash flow. Include every scheduled payment, irregular bill, fee, tax, insurance premium, repair, option expiration, and balloon amount.
- Read the default section first. Mark notice, cure, late-charge, acceleration, forfeiture, eviction, foreclosure, and refund provisions.
- Document payments. Use traceable methods, obtain receipts, and reconcile principal, interest, taxes, insurance, and credits.
- Get independent review. A HUD-approved housing counseling agency can help assess a contract-for-deed proposal. A local real estate attorney should review the actual agreement, and a tax professional can address basis, deductions, and sale consequences.
- Check assistance programs. HUD directs buyers to state and local homebuying programs, counseling, inspection information, insurance resources, and rights. Eligibility and availability must be verified with the administering program.
What happens if you cannot make a payment?
Do not assume that a seller-financed deal gives you the same timeline as a conventional mortgage. The contract and state law determine notice, cure, acceleration, foreclosure, forfeiture, eviction, and treatment of prior payments. Contact the seller promptly, preserve proof of every payment, and obtain legal advice before signing a modification or surrender. If the seller threatens immediate removal, consult a local attorney or housing counselor urgently rather than relying on informal promises.
Taxes, records, and closing documents
Keep the purchase contract, note, deed or memorandum, settlement statement, title report, inspection, insurance policies, tax bills, payment ledger, repair invoices, and correspondence. IRS Publication 530 (2025) explains that some settlement fees and closing costs—including certain title-search and deed-related legal fees—may be included in basis, while other costs are treated differently. A seller-financed or shared-equity arrangement can create additional tax questions about interest, installment reporting, basis, depreciation, or sale proceeds. Ask a tax professional to apply current rules to your documents.

When each route may fit—and when it may not
Cash may fit when
- You can pay the price and closing costs while retaining a sensible emergency and repair reserve.
- You value a simple closing and do not need to preserve the cash for another defined purpose.
Seller financing may fit when
- The seller can demonstrate clear title and is willing to use professionally prepared, recorded documents.
- The payment remains affordable without assuming a future refinancing approval.
Rent-to-own may fit when
- You understand the option deadline, price formula, credits, repair duties, and consequences of nonexercise.
- You have a realistic plan for obtaining the eventual purchase funds.
Equity-sharing or co-ownership may fit when
- All parties can agree in writing on control, expenses, valuation, exits, and personal contingencies.
- Everyone understands that appreciation and losses may be shared rather than capped like a loan.
No route is automatically safer because it avoids a bank. The strongest protection is a transparent title search, independent inspection, written allocation of every cost, a workable default remedy, and professional review before money changes hands.

Frequently Asked Questions
Can I buy a house entirely with cash and still need a closing agent?
Yes. A cash buyer should still use a qualified closing attorney or title professional to handle the deed, title search, liens, settlement statement, recording, and funds transfer. Inspections, insurance, taxes, and other ownership costs also remain.
Is a contract for deed the same as a mortgage?
It is not the same document, but a creditor-financed contract for deed generally meets the federal definition of credit. The seller usually keeps legal title until the required payments are complete, while the buyer may carry taxes, insurance, repairs, and maintenance.
Can a seller take the house back after one missed payment?
The result depends on the contract and state law. Notice, cure time, forfeiture, foreclosure, eviction, and treatment of prior payments vary, so read those provisions before signing and obtain local legal advice after a missed payment.
Crashes, No Sound, or Screen Glitches?
Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minutePC Slower Than It Used to Be?

There is no single national rent-to-own form. Rights and disclosures depend on the contract, how the transaction is structured, and applicable law. Confirm the option payment, rent credits, price, repairs, deadline, and default consequences in writing.
Where can I get neutral help reviewing an alternative purchase?
HUD recommends housing counseling and directs buyers to state and local programs. The CFPB specifically advises people considering a contract for deed to contact a HUD-approved housing counseling agency. An independent, locally qualified real estate attorney can review the actual documents.
