It is prescribed by rule 231 of the Income-tax Rules, 2026, and is used under section 440(2). You generally use it only when you accept the order, pay the full tax and interest demand within the permitted time, and do not appeal.
The filing window is tied to receipt of the order, not merely the date printed on it: the Income Tax Department states that the application must be made within 30 days from the end of the month in which the relevant order is received. The form itself requires identity information, order and demand figures, payment particulars, and a truthful verification.

What Form 161 does
Form 161 is an application under section 440(2) of the Income-tax Act, 2025. Its purpose is to ask for immunity from penalty under section 439 and prosecution under sections 478 or 479 where the case involves under-reporting or misreporting of income and follows an assessment or reassessment order. Filing the form does not by itself guarantee immunity. The application is considered subject to the statutory and prescribed conditions.

If another eligible assessment or reassessment order is later passed and you want to seek the same relief, a separate application is required for that event. The application is not a general waiver of every tax consequence, and it does not erase the underlying tax and interest demand.

Current law and the legacy reference
The current form belongs to the 2025 Act and 2026 Rules, which came into force on 1 April 2026. Departmental material maps it to the earlier Form 68 used under section 270AA(2) of the Income-tax Act, 1961 and rule 129 of the Income-tax Rules, 1962. That mapping helps taxpayers recognize the continuity of the relief, but current Form 161 is not simply an old Form 161 under the 1962 Rules.
| Reference | Earlier framework | Current framework |
|---|---|---|
| Application form | Form 68 | Form 161 |
| Act provision | Section 270AA(2), Income-tax Act, 1961 | Section 440(2), Income-tax Act, 2025 |
| Rule | Rule 129, Income-tax Rules, 1962 | Rule 231, Income-tax Rules, 2026 |
Use the current prescribed Form 161 and the 2025 Act and 2026 Rules for a current matter. A historical order governed by the earlier law may require the earlier form and provisions instead; the applicable statute, transition rules and facts determine that question.
Who should file Form 161?
The Department describes the potential applicant as a taxpayer who has received an assessment or reassessment order under the 2025 Act, has paid the full tax and interest payable under the notice of demand, has not filed an appeal and undertakes not to appeal during the period specified in section 440(5), and wants the immunity covered by section 440(2).

Eligibility checklist
- You have received an assessment or reassessment order under the Income-tax Act, 2025.
- The order is the type referred to in section 440(1)(a) for the immunity application.
- You have paid the entire tax and interest payable under the notice of demand within the prescribed time.
- You have not filed an appeal against the relevant order.
- You can truthfully undertake not to appeal before expiry of the period specified in section 440(5).
- You intend to seek the penalty and specified prosecution immunity described in section 440(2).
If you dispute the order and plan to appeal, the no-appeal declaration is inconsistent with that plan. Do not sign the form merely to keep an option open. Check the current Act and Rules or obtain advice from a qualified tax professional before choosing between an immunity application and an appeal.
When to file: calculate the 30-day window
The Income Tax Department’s stated rule is: “The application must be made within 30 days from the end of the month in which the order referred to in section 440(1)(a) is received.” The trigger is the month of receipt. It is not automatically the order date shown on the assessment or reassessment document.
Worked date example
Suppose an order is dated 8 June but is received on 12 June. The relevant month is June. The period is counted from the end of June, so the stated 30-day window runs from 30 June and reaches 30 July, subject to the applicable rules for computation, holidays and the filing channel. Keep evidence of when the order was actually received, such as the department communication or electronic delivery record.

What to record before calculating
- The date printed on the order.
- The date and manner in which you received or were served the order.
- The last day of the month in which receipt occurred.
- The resulting 30-day period and any applicable procedural rule affecting the final day.
Do not substitute the order date for the receipt date. If receipt timing is unclear, preserve every delivery record and obtain advice promptly rather than waiting until the final days.
Documents and figures to assemble first
Form 161 is mainly a transcription and reconciliation exercise. Assemble the documents before entering figures so that the application, demand and payment records agree.
- The complete assessment or reassessment order, including its date and the section under which it was passed.
- The notice of demand showing assessed income, tax, interest, total amount payable and payment due date.
- Proof of service or receipt showing when the order reached you.
- Every challan or payment record for tax and interest paid against the demand.
- Your PAN record and the applicant’s exact legal name and address.
- Details of the person who will verify the form and that person’s authority or capacity.
Do not estimate a figure because it appears close to another document. The form should reproduce the corresponding values from the order, demand notice and challans. If a payment was made in more than one transaction, prepare a separate line for each payment.
How to complete Part A: personal information
Part A identifies the taxpayer and the contact details used for the application. Enter the applicant’s name, PAN, father’s or husband’s name, address, mobile number with country code and email address.
Name and PAN
Use the name associated with the applicant’s PAN and the relevant tax records. Check spelling, initials, punctuation and the PAN character by character. For a non-individual applicant, use the entity’s registered name rather than the name of an employee or representative. The prescribed form contains notes for name and address fields; follow those notes for special cases instead of adapting an old form from memory.
Address and contact details
Enter the complete address in the format requested by the current form. Include the mobile number with its country code and an email address that is actively monitored. These details should be consistent with the taxpayer’s records and the application’s verification. A typographical error can make later correspondence difficult even when the tax figures are correct.
How to complete Part B: order and demand details
Part B connects the application to the specific assessment or reassessment event and the payment obligation arising from it. Transcribe the following fields from the order and notice of demand.
Rank #3
Tax year
Enter the tax year exactly as the prescribed form labels it and as it appears in the order. Do not confuse the tax year with the calendar year in which the order was issued or received.

Section under which the order was passed
Copy the section cited in the assessment or reassessment order. If the order refers to more than one provision, use the formulation required by the current form and verify it against the order rather than selecting a familiar section from a prior year.
Order date and service or receipt date
Enter the order date shown on the document and the date on which it was served or received. These are separate facts. The first identifies when the order was made; the second is central to the filing-window calculation.
Assessed income
Copy the assessed-income figure from the order. Preserve the same units, numerical format and any relevant adjustment shown in the document. Do not replace assessed income with returned income or a rounded amount.
Tax, interest and payment due date
Enter the tax and interest payable under the notice of demand, together with the payment due date specified there. Reconcile the total with the demand notice, including any separate tax and interest components. The eligibility condition described by the Department is payment of the full tax and interest demand, not merely the principal tax.

Payment particulars: record every challan
The payment section allows the particulars to be repeated as required. For each payment, enter the BSR code, deposit date, challan serial number and amount.
Match each entry to the payment record
- Open the challan or bank payment record for the transaction.
- Copy the BSR code exactly, without dropping leading zeroes.
- Enter the deposit date shown on the record.
- Copy the challan serial number exactly.
- Enter the amount paid in that transaction, using the same currency and numerical precision as the record.
- Repeat the process for every payment that makes up the demand.
Add the individual amounts and compare the result with the tax and interest payable under the notice of demand. A mismatch may indicate a missing challan, an incorrect amount, an unapplied payment or a different demand than the one selected for the application. Resolve the discrepancy before verification; do not alter a challan number or round an amount to force the totals to agree.

How to complete the Verification
The verification is a substantive declaration, not a formality. Complete the declarant’s name and PAN, state the capacity in which the person is applying, and enter the date and place of verification.
The declaration represents that the information is true to the person’s information and belief, that no appeal has been filed, and that the applicant undertakes not to appeal before expiry of the period specified in section 440(5). It also states that the person is competent to file and verify the application.
Capacity and authority
State the capacity accurately, such as the taxpayer, authorized representative or the appropriate officer of an entity, as the current form and governing records require. The person signing for a company, LLP or trust should confirm that the required authority exists and that the capacity stated in the form is correct.
Sign only after the factual checks
Before signing, confirm that the order identified in Part B is the same order for which the demand was paid, that all payments are listed, that no appeal has been filed, and that the undertaking not to appeal reflects the applicant’s actual decision. An inaccurate verification can create consequences separate from a simple clerical error.
Final review before submission
Use this sequence to perform a final completeness check:
- Confirm that you are using the current Form 161 prescribed under rule 231 of the Income-tax Rules, 2026.
- Check the applicant’s name, PAN, address, phone number with country code and email address against the taxpayer’s records.
- Match the tax year, order section, order date and service or receipt date to the assessment or reassessment order.
- Match assessed income, tax, interest and payment due date to the notice of demand.
- List every payment with its BSR code, deposit date, challan serial number and amount.
- Reconcile the payment total with the full tax and interest demand.
- Recalculate the filing window from the end of the month in which the order was received.
- Confirm that no appeal has been filed and that the no-appeal undertaking is truthful.
- Check the declarant’s PAN, capacity, date, place and signature or other prescribed authentication.
- Retain the completed application and all supporting records, including proof of receipt and payment.
Common mistakes and how to correct them
Using the wrong legal form
Form 68 belongs to the 1961 Act and 1962 Rules. For a current matter under the 2025 Act, use Form 161 under rule 231 and section 440(2). If the order concerns a transition period, determine which law applies instead of choosing by form number alone.
Counting 30 days from the order date
The stated deadline is based on the end of the month in which the order is received. Record both dates and calculate from the receipt month.

Paying only the tax amount
The Department’s eligibility description requires payment of the full tax and interest payable under the notice of demand. Check the interest component and confirm that every payment has been credited to the relevant demand.
Leaving out a split payment
When the demand was paid in several transactions, list each challan. A single total without the underlying BSR codes, dates and serial numbers does not provide the payment particulars requested by the form.
Signing despite an appeal
The verification includes both a statement that no appeal has been filed and an undertaking not to appeal during the section 440(5) period. Do not submit an application whose declaration conflicts with an appeal already filed or an intention to appeal.

What filing does—and does not—decide
Form 161 asks for immunity from the penalty and specified prosecution consequences identified in section 440(2). It does not cancel the assessment, replace the demand notice or authorize non-payment. The application remains subject to the conditions in the Act and Rules and to the facts of the case.
The Income Tax Department describes its forms guidance and FAQs as educational resources rather than legal advice. Where the amount is significant, the order involves disputed facts, receipt is contested, payments are not credited, or an appeal decision is difficult, consult the current Income-tax Act, 2025 and Income-tax Rules, 2026 or a qualified tax professional.
