Form 121 is the nil-tax declaration used for tax years beginning on or after 1 April 2026. It is not an EPF withdrawal form. You give the completed declaration to the EPFO office, exempted provident-fund trust, employer or other actual payer before the EPF amount is credited or paid. The payer can then consider non-deduction of tax if your estimated tax liability for the entire tax year is nil and you meet the applicable taxpayer-category conditions.
What Form 121 does for an EPF withdrawal
Form No. 121 is a statutory declaration under the Income-tax Rules, 2026. By signing it, you declare that tax on your estimated total income for the relevant tax year will be nil. The notified instructions specifically include payment of the accumulated balance due to an employee participating in a recognised provident fund among the payment types for which the declaration may be relevant.

For tax years beginning on or after 1 April 2026, Form 121 is the prescribed replacement for the earlier Forms 15G and 15H declaration framework. The Income Tax Department says the earlier eligibility principles continue under Section 393(6) of the Income-tax Act, 2025. The form does not approve your EPF claim, calculate your service period or determine the amount payable. It only asks the payer not to deduct tax at source when the statutory conditions are satisfied.

Submitting Form 121 does not guarantee that no tax will be withheld. The payer must verify the declaration and apply the current TDS rules to the particular payment. If the declaration is ineligible, incomplete or received after withholding, the payer may deduct tax or decline to act on it.
Check eligibility before you complete the declaration
The central test is not the size of your EPF balance. It is whether your tax on estimated total income for the whole tax year will be zero after the adjustments permitted in the Form 121 instructions and after you satisfy the relevant category and residence conditions.
1. Use the correct tax year
First identify the tax year in which the EPF amount is expected to be credited or paid. For a tax year beginning on or after 1 April 2026, use Form 121. An older 15G or 15H template is not the prescribed declaration for that period.

The transition is based on the start of the tax year, not on the date you joined the provident fund or the date of your original contribution. If the payment falls in an earlier tax year, confirm the form and law applicable to that earlier period with the payer.
2. Estimate all income for the year
Prepare a year-wide estimate of income, not just the EPF withdrawal. Include salary, pension, interest, rent, capital gains, business or professional income and any other taxable receipts expected during the year. Include the EPF payment if it is part of the income relevant to the payer’s TDS decision.
The Form 121 instructions state that estimated total income is worked out after applicable deductions under Chapter VIII, eligible set-off of loss under the head “Income from house property” and the rebate allowable under Section 156. Use the figures and conditions that actually apply to you; do not assume that a deduction or rebate is available merely because you have used it in a previous year.

3. Confirm your taxpayer category and residence
The declaration is subject to taxpayer-category conditions. The Income Tax Department’s explanation of the previous framework describes Form 15G as available to eligible resident individuals below age 60 and certain other eligible persons, excluding companies and firms, while Form 15H was for resident individuals aged 60 or older. The Department says the eligibility criteria continue under Section 393(6).
Those descriptions are a guide to the categories, not permission for every EPF member to file. Residence, age, legal status, estimated income and the specific payment all matter. A non-resident, company, firm or person whose income will produce tax should not submit Form 121 simply because an EPF account exists.
4. Make sure the estimated tax is actually nil
Do not use the amount of tax that has already been deducted from salary, or the amount you hope to recover in a refund, as the test. The declaration says your tax liability for the relevant tax year will be nil after the permitted deductions, loss set-off and rebate. If your calculation produces any tax liability, Form 121 is not the appropriate route for stopping TDS.
Keep your calculation with the declaration. The payer may ask for supporting information, and you remain responsible for the truth of the statement even if the payer accepts it.
| Question to check | Why it matters |
|---|---|
| Does the payment fall in a tax year beginning on or after 1 April 2026? | That is the period for which Form 121 is prescribed under the 2026 framework. |
| Will tax on your estimated total income be nil? | This is the declaration’s core condition; the EPF amount alone does not answer it. |
| Have you applied only permitted deductions, house-property loss set-off and rebate? | The instructions specify these adjustments when estimating total income. |
| Do your age, residence and taxpayer category fit the applicable conditions? | Eligibility is not universal among EPF members. |
| Who is paying the withdrawal? | The EPFO office, exempted trust, employer or another payer controls the intake route and verification. |
Prepare the information the payer will need
There is no single member-facing submission channel established for every EPF payment. Before filling the form, contact the actual payer and ask whether it accepts a paper declaration, an electronic copy, or both. An EPFO-managed account, an exempted company trust and a payment processed through an employer may follow different internal procedures.

The Central Board of Direct Taxes’ Systems notification dated 28 March 2026 says the payer must enable the payee to furnish the declaration on paper or electronically after verification. It also requires the payer to quote the PAN in Part A, allot a unique identification number (UIN) and report the declaration details in Part B and in the quarterly TDS statement, even when no tax is deducted. Those are payer obligations; they do not create a universal online filing screen for EPF members.

How to fill and submit Form 121
Use the current Form 121 issued under the Income-tax Rules, 2026 and follow the version or format supplied by the payer. Do not alter an old Form 15G or 15H into a Form 121 by changing its title.
- Write the relevant tax year. Use the tax year in which the EPF amount is expected to be credited or paid. If the payment date changes across tax years, ask the payer which year belongs on the declaration.
- Enter your identity and contact details exactly as requested. Use the name matching your PAN and provident-fund records. Provide the PAN and other identifying information required by the form or payer, and check every character before signing.
- Describe the declaration truthfully. Form 121 is a statement that tax on your estimated total income for the relevant year is nil. It is not a request to release the EPF balance and should not be presented as an EPF claim form.
- Complete the income and eligibility information requested. Use your full-year estimate, including the EPF-related payment where applicable, and apply only the deductions, house-property loss set-off and rebate allowed by the instructions. Do not enter only the withdrawal amount.
- Sign and date the declaration. A signature confirms that the nil-tax statement is true. If the payer accepts an electronic submission, complete its authentication or e-sign process exactly as instructed.
- Send it to the actual payer before payment or credit. The official manual says it is “Ideally submitted before the income is credited or paid.” Use the paper or electronic route the payer confirms, not an assumed direct upload to a government portal.
- Request proof of receipt. Keep the submitted form, delivery evidence, email or portal confirmation, the name of the receiving office and any reference number supplied by the payer.
If the payer gives you a pre-filled or institution-specific version, check that it is still Form 121 for the correct tax year. Do not sign a form with blank material fields or an incorrect PAN.
What happens after you hand it to the payer
The Income Tax Department’s online manual describes the payer’s reporting workflow, not a member’s direct filing procedure. A payer signs in with TAN credentials, selects Form 121, chooses the filing type, tax year and quarter, enters payer and declarant information, uploads declaration records, confirms and previews the submission, and then e-verifies it. The system assigns a UIN for each declarant. The payer should retain the acknowledgement number and transaction ID.

Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →That workflow explains why you may receive a UIN or acknowledgement after the payer processes your paper or electronic declaration. It does not mean that an EPF member should sign in with the payer’s TAN or attempt to report the form independently. If an office tells you to use an online route, ask for its exact member instructions and confirmation that the route is for receiving Form 121 rather than for the payer’s quarterly reporting.
Timing: submit before the EPF payment is processed
Give Form 121 before the income is credited or paid, preferably near the start of the tax year if you already expect to withdraw. A declaration delivered after the payer has processed TDS may not reverse withholding already made. Ask whether the payer has a cut-off date before the claim is approved or the payment file is generated.
If your withdrawal is urgent, submitting the form and the EPF claim at the same time may still be too late if the payer’s system has already created the payment instruction. Obtain a receipt and ask the payer whether it can link the declaration to the pending claim. Do not assume that a later submission automatically creates a refund or cancels a deduction.

Do not confuse Form 121 with the EPF withdrawal rules
Whether TDS applies to your particular EPF payment is a separate question. Form 121 addresses the nil-tax declaration; it does not replace the current rules governing the provident-fund payment itself. Service history, the type of provident fund, the reason for withdrawal, the payer and your residence can all affect the treatment.
Older EPFO material from 2015 described a framework involving continuous service, the withdrawal amount, PAN, Forms 15G or 15H, transfers and certain involuntary-termination exceptions. It mentioned ₹30,000 as a withdrawal threshold in that historical discussion and ₹2,50,000 and ₹3,00,000 limits in the historical Forms 15G/15H context. Those figures belong to the 4 June 2015 material and have not been established as current thresholds for tax years beginning on or after 1 April 2026.
| Older figure or rule reference | How to treat it now |
|---|---|
| ₹30,000 withdrawal threshold mentioned by EPFO on 4 June 2015 | Historical context only; do not use it as a 2026 threshold without confirmation. |
| ₹2,50,000 and ₹3,00,000 Forms 15G/15H limits in the 2015 release | Historical figures; they do not establish current Form 121 eligibility. |
| Continuous-service, transfer and termination exceptions in older flowcharts | Verify against the current law and the payer’s treatment for your claim. |
Before relying on Form 121, ask the payer to confirm whether TDS applies to your exact claim. This is especially important for an exempted trust, unusual service history, a transfer-related withdrawal, an involuntary termination or a member who is not resident in India.
Worked decision examples
Example: nil tax after the full-year calculation
You expect an EPF payment during the 2026–27 tax year and your estimated salary, interest and other income, after the deductions and adjustments allowed by the Form 121 instructions, produces nil tax. You fit the applicable resident taxpayer category. You give Form 121 to the actual payer before the payment is credited and retain its receipt. The payer can consider non-deduction, subject to its verification and the current EPF TDS rules.
Example: the EPF amount is small but tax is not nil
Your withdrawal is modest, but your salary and investment income produce a tax liability for the year. The small size of the EPF payment does not satisfy Form 121’s nil-tax test. Do not sign the declaration merely to avoid an immediate deduction.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Example: payment already credited
You submit the declaration after the payer has credited the withdrawal and deducted TDS. The payer may be unable to undo that transaction through the declaration process. Keep the TDS evidence and ask the payer or a tax professional how the withholding is reflected in your return; a late Form 121 is not automatically retroactive.

Example: exempted provident-fund trust

Common mistakes and how to correct them
- Using Form 15G or 15H for a post-1 April 2026 tax year: obtain the current Form 121 instead.
- Calculating only the EPF withdrawal: redo the estimate for all income in the tax year.
- Assuming a refund means nil tax: a possible refund is not the same as a nil tax liability.
- Ignoring residence or category rules: verify that you are an eligible taxpayer before signing.
- Sending it to the wrong organisation: submit to the actual payer or deductor, not merely to a former employer or a general EPFO inbox.
- Waiting until after payment: submit before credit or payment and ask about the payer’s cut-off.
- Treating the payer portal as a member portal: the published online steps use TAN credentials and describe payer-side reporting.
- Relying on old threshold charts: the 2015 EPFO figures are not confirmed 2026 limits.
- Leaving a mismatch in PAN or name: correct the form before submission and retain evidence of the corrected version.
If you discover that the declaration was wrong, notify the payer promptly and preserve the correspondence. A signed nil-tax declaration does not remove liability for tax that is actually due.
Records to keep
Keep a copy of the signed Form 121, the income and tax calculation used to complete it, proof of delivery, the payer’s receipt, the UIN or acknowledgement number, the transaction ID if one is issued, the EPF claim documents and the final payment statement. These records show what you declared, when you declared it and which payer handled the form.

When to get individual advice
Obtain advice from the payer or a qualified tax professional before signing if you are non-resident, have several income sources, receive the payment from an exempted trust, have a disputed service history, are withdrawing after an involuntary termination, or cannot determine whether your total tax will be nil. The current treatment of EPF withdrawals and the declaration conditions should be checked against the law and payer procedure applying to your tax year.
