File the overdue return as soon as you can, even if you cannot pay the full amount. Filing and paying are separate obligations: submitting the return stops the continuing non-filer problem, while any tax balance, interest, penalty, payment arrangement, waiver request, or appeal must be handled through the rules of the responsible tax authority.
The correct procedure depends on your country, state or province, tax year, return type, and the notice you received. The United States federal, Canadian federal, and UK Self Assessment examples below are separate systems, not interchangeable advice. Confirm current deadlines, filing channels, rates, and appeal instructions with your authority before relying on a precise figure.

What to do first when a tax return is late
Do not wait until you have enough money to pay. A late return can usually be filed independently of payment, and delay can increase late-filing penalties, interest, collection activity, or the risk that the authority prepares an assessment from incomplete information.

Write down the country, state or province, tax year, return type, and whether the authority sent a filing notice, demand, estimated assessment, or penalty notice.
- Prepare that specific year’s return. Use the forms, software, or professional assistance authorized for the overdue year. Do not assume the current year’s form or thresholds apply to an older return.
- Submit through an accepted channel. File electronically if the authority permits that year and return type. If online filing is unavailable for an old return, follow the authority’s official paper or alternate-submission instructions.
- Keep proof. Save the completed return, transmission receipt, confirmation number, delivery evidence, and copies of every schedule and supporting document.
- Deal with the account separately. Check the assessed balance, pay what you can, ask about a payment arrangement if necessary, and review every penalty or interest notice for an error or possible relief.
The Internal Revenue Service summarizes the U.S. approach this way: people who missed the deadline and owe tax should file quickly to minimize penalties and interest. The Canada Revenue Agency similarly tells taxpayers to file on time even when they cannot pay. Those statements are practical direction, not a promise that penalties will disappear.

Establish exactly which return is overdue
A precise answer is impossible until four facts are known. Gather them before choosing a form or payment method.
| Fact to confirm | Why it changes the procedure |
|---|---|
| Country and subnational jurisdiction | Federal, state, provincial, territorial, or devolved authorities can have different filing portals, forms, penalties, and payment arrangements. |
| Tax year and filing deadline | Old-year forms, electronic filing availability, credit rules, interest rates, and refund limitation periods can differ from the current year. |
| Return type | An individual income return, Self Assessment return, amended return, information return, and business return can follow different rules. |
| Authority contact or notice | A demand to file, substitute assessment, penalty notice, or collection letter may impose a response date separate from the original filing deadline. |
Read the notice from the top down. Confirm the taxpayer name, tax year, return type, date issued, filing status, balance, and deadline. If the notice refers to a return you already submitted, compare its submission receipt with the authority’s account before sending a duplicate.
If you are unsure whether a return was required
Do not simply ignore the notice. Ask the authority how to establish that no return was required, or submit the required explanation through the channel stated on the notice. In the UK, HM Revenue & Customs says a person can ask it to cancel a Self Assessment penalty when no Self Assessment return was required. Other authorities use different processes.

Use records for the year being filed, not estimates based on this year’s income. Typical records may include employment or pension statements, interest and dividend reports, business income and expense records, property or investment information, charitable gifts, family or dependent details, and proof of tax already withheld or paid. The exact documents and credits vary by jurisdiction.
When records are missing
Request replacement statements from employers, financial institutions, payroll providers, or the authority’s online account where available. Keep a written record of requests and use the authority’s instructions for reconstructing amounts. Do not omit income simply because a statement has not arrived; if an amount remains uncertain, obtain professional advice or ask the authority how it should be reported.
Use the right old-year form or software
Preparation tools are often year-specific. A current-year program may not support an older return, and a form can change after legislation or administrative updates. Check that the tool accepts the exact tax year and return type before entering data. If the authority does not accept electronic filing for that year, print, sign, and send the return exactly as its current instructions require.

Check withholding, credits, and prior payments
Enter withholding, estimated payments, and credits for the same year. They can reduce the balance used to calculate a late-filing penalty, but they do not automatically prove that the return was filed. Keep evidence for each amount in case the authority asks for verification.

Submit the return and preserve evidence
- Validate the return. Check names, identification numbers, bank details, income totals, withholding, signatures, schedules, and attachments. A rejected electronic return is not a filed return until it is corrected and accepted.
- Use an authorized submission route. Follow the authority’s current instructions for electronic filing, paper mail, in-person delivery, or an approved intermediary. An old return may have fewer available routes than a current one.
- Record the time and result. Save the acceptance message, confirmation number, timestamp, courier tracking, or stamped copy. Keep the original files in a secure location.
- Monitor the account. Check whether the return was posted, whether an assessment was issued, and whether the authority requests additional information.
Sending a return to an unofficial address, omitting a required signature, or assuming that a draft saved in a portal counts as submission can leave the filing late. If a paper return is required, use the address and delivery method specified for that tax year and return type, not an address found in an old booklet.
Filing is not payment
A return calculates an obligation; it does not necessarily pay it. Once the return is submitted, determine whether the account shows tax due, a zero balance, or a refund.
If you owe tax but can pay some of it
Pay the amount you can promptly through an approved method. Partial payment may reduce the amount on which interest or a percentage-based penalty is calculated, but it does not by itself remove a late-filing penalty or close the filing requirement.
If you cannot pay in full
File anyway, then use the authority’s payment-arrangement or collections process. The IRS expressly recommends filing and paying as much as possible. The CRA directs taxpayers who cannot pay in full to contact Collections about an arrangement. Other authorities may offer instalments, time-to-pay agreements, hardship arrangements, or different remedies. Ask what happens to interest, future filing obligations, and enforcement while an arrangement is being considered.
If the account shows a refund
A refund does not mean the return can be ignored. In a current U.S. example, IRS Tax Tip 2026-32 says there is no late-filing penalty when the IRS owes a refund, but a person may have to file to claim the refund or refundable credits. Other countries have their own limitation periods and credit rules, so do not apply the U.S. result elsewhere.

How late-filing penalties and interest differ by jurisdiction
There is no universal “late tax return penalty.” The trigger may be the unpaid balance, the passage of time, a fixed notice, or a combination. Interest can run separately from the filing penalty.
| Jurisdiction and scope | Late-filing framework in the cited guidance | Interest or late-payment treatment | Relief or challenge route |
|---|---|---|---|
| United States federal individual returns | Generally 5% of tax due, after relevant payments and credits, for each month or part of a month late, generally capped at 25%. Reasonable cause can prevent the penalty; the tax year, return type, payment history, and facts matter. | Interest and other charges can continue on unpaid tax. An extension to file does not extend the payment deadline. | Review the IRS notice or account and use the applicable reasonable-cause or other relief procedure. |
| Canada federal personal returns | Generally 5% of the balance owing plus 1% for each full month late, up to 12 months. A higher repeat-failure rule can apply when the statutory prior-penalty and demand-to-file conditions are met. | For unpaid 2025 tax, CRA says interest compounds daily from the day after the balance is due; rates can change quarterly. | CRA accepts requests to cancel or waive penalties or interest in qualifying circumstances beyond the taxpayer’s control. |
| United Kingdom Self Assessment | Initial £100; after three months, daily penalties of £10 up to £900; after six months, a further 5% of tax due or £300, whichever is greater; after 12 months, another 5% or £300, whichever is greater. | Separate late-payment penalties of 5% of tax unpaid at 30 days, six months, and 12 months, plus interest. | Appeal to HMRC, usually within 30 days of the penalty notice. A reasonable excuse may be a ground; the notice and current guidance control. |
The figures in this table are jurisdiction-specific examples from official guidance. They should not be added together, converted into a general rule, or used to estimate a personal balance without the authority’s calculation.
United States: federal individual return filed after the deadline
The IRS’s April 23, 2024 tax tip says to file as soon as possible after missing the deadline. It also states that an extension of time to file is not an extension of time to pay. If you requested an extension but did not pay enough by the payment deadline, the return can still be late for payment purposes even though the filing extension was valid.
What to do
- Prepare the federal return for the missed tax year, including all required schedules and payments or credits.
- Submit it through an IRS-permitted channel for that year. If electronic filing is unavailable, follow the IRS paper-filing instructions for the specific return.
- Pay as much as possible immediately and retain confirmation.
- Read the IRS notice or online account after the return posts. Check the tax due, filing date, payments, penalty, and interest.
- If the failure to file resulted from reasonable cause, follow the IRS instructions for requesting penalty relief and provide supporting facts and records.
The IRS generally describes the failure-to-file penalty for individuals and most businesses as 5% of tax due, after relevant payments and credits, for each month or part-month late, with a general 25% cap. Exceptions and special calculations can apply. The amount shown on the IRS notice or account is the controlling figure for your case.
Canada: federal personal return filed after the deadline
CRA’s consumer guidance says a late filer who owes tax generally faces 5% of the balance owing plus 1% for each full month late, up to 12 months. A repeat-failure penalty can be higher when the conditions in the Income Tax Act apply, including the relevant prior penalty and demand-to-file circumstances. Section 162 of that Act contains the statutory framework; the accessible CRA explanation should be read with the applicable tax year and notice.
What to do
- File the missing federal return for the correct year, even if you cannot pay the balance.
- Check the CRA account for the assessment, balance, interest, and any request for documents.
- Pay what you can. If full payment is not possible, contact CRA Collections about a payment arrangement rather than waiting for further enforcement.
- If circumstances beyond your control prevented compliance, use CRA’s process to request cancellation or waiver of penalties or interest and include evidence of the circumstances and the steps you took to comply.
CRA describes an escalating non-filer process that can include contact, a request or demand to file, and an assessment based on information available to the agency. An assessment prepared without your complete return may not reflect deductions, credits, or other information you could have reported.

For unpaid 2025 tax, CRA says interest compounds daily beginning the day after the balance is due. Interest rates can change quarterly, so use the rate and amount shown for your account rather than an old calculation.
United Kingdom: overdue Self Assessment return
HMRC’s schedule above applies to Self Assessment. It is not a rule for every UK tax type. File the missing return through the current HMRC process for that tax year, then review both the filing penalties and the separate late-payment charges.
What to do
- Confirm that you were required to file a Self Assessment return for the year and identify any notice to file.
- Submit the return and retain the online confirmation or other delivery evidence.
- Pay the tax and any payment on account that is due, or follow HMRC’s current payment-arrangement instructions if full payment is not possible.
- Read the penalty notice carefully. Check the tax year, issue date, filing status, and whether the return was already accepted.
- If you had a reasonable excuse or HMRC says a return was required when it was not, use the appeal or cancellation route stated in the notice.
HMRC says appeals are generally due within 30 days of the penalty notice. A late appeal may need an explanation, and the individual notice can contain different instructions. Do not wait for a payment discussion before submitting an appeal if the deadline is approaching.
Requesting penalty or interest relief
Relief is not automatic merely because the deadline was forgotten, money was tight, or the return was complicated. Authorities usually ask what prevented compliance, when the problem ended, what you did to correct it, and whether you acted promptly afterward.
Build a factual explanation
- State the tax year, return type, original deadline, actual filing date, and notice date.
- Describe the event or circumstance that prevented timely filing, using dates and supporting documents where possible.
- Explain when you regained the ability to comply and the steps taken to file and pay.
- Separate facts from conclusions; do not claim that a penalty is incorrect unless you can identify the calculation or legal error.
Observe the authority’s deadline
Use the reconsideration, waiver, reasonable-cause, or appeal process named by the authority. HMRC’s general Self Assessment guidance gives a usual 30-day appeal period from the penalty notice. IRS and CRA procedures, evidence requirements, and time limits differ. Keep a copy of the request and proof of submission.

Common situations and the safest response
You filed but never received confirmation
Check the authority’s account and search for an acceptance message, receipt, or delivery record. If no evidence exists, contact the authority promptly and ask whether the return is posted or rejected. Do not assume that a saved draft, payment receipt, or preparer invoice proves filing.

You received a demand after filing
Match the demand’s year and return type to your submission evidence. Send the requested proof through the channel on the notice and continue to observe any response date while the account is corrected.
The authority assessed you using its own information
Submit the complete return and supporting documents as instructed. An authority-generated assessment can omit deductions or credits, and filing may be necessary to replace it with an assessment based on your information.
You cannot obtain one document
Request a replacement, preserve evidence of the request, and ask the authority or a qualified tax professional how to report the amount. Do not delay the entire return indefinitely when the remaining information is available.
