The deadline printed in your IRS notice controls. Do not substitute the tax-return filing deadline or a date you calculate from memory. Read every page, identify whether the letter directs you to IRS Appeals or gives you Tax Court rights, and submit the required protest or petition with reliable proof of timely filing. IRS Appeals protests are generally due within 30 days; Tax Court deficiency petitions are generally due within 90 days (150 days for an address outside the United States), while a collection petition is generally due within 30 days. A Tax Court deficiency deadline generally cannot be extended.

Start with the notice, not the tax-return deadline

This guide addresses disputes with the U.S. Internal Revenue Service. State income-tax agencies use different forms, forums and deadlines.

An IRS notice should identify the adjustment or collection action being proposed, the office to contact, the available appeal route and the last day to act. Read the notice and all enclosures from beginning to end before deciding what to file. Keep the envelope, because its postmark and delivery date can help establish when the notice was sent. Make a complete scan or photocopy of every page.

Write the stated deadline on a calendar and set earlier internal dates for preparing, reviewing and sending the filing. The notice’s instructions govern if they differ from a general rule. The controlling date is not the due date for your original tax return and is not automatically the date you received the letter.

Choose between IRS Appeals and Tax Court

These are separate routes. IRS Appeals is an administrative review within the IRS. The U.S. Tax Court is a court proceeding that uses a petition rather than an Appeals protest. A notice can direct you to one route, give you a choice, or provide different instructions for different issues. Follow the route and address named in the notice.

Issue IRS Appeals U.S. Tax Court
Typical document A small-case request or a formal written protest, as the letter requires. A petition responding to the notice that grants Tax Court rights.
General deadline The time stated in the letter, generally 30 days under current IRS Appeals guidance. Generally 90 days after a deficiency notice was mailed, or 150 days when addressed outside the United States; a collection petition is generally due within 30 days of the notice of determination.
Forum Administrative Appeals review. Judicial review in the U.S. Tax Court.
Payment before filing The cited IRS Appeals instructions do not state a prepayment requirement; follow the notice. The Court describes its process as a prepayment forum, so payment of the underlying tax is ordinarily postponed while the case is pending. Confirm the rule for your specific case.
Review scope The disputed adjustments or collection issues identified in the protest and supporting explanation. The issues placed before the Court by the petition and the notice to which it responds.
Representation You may represent yourself or appoint an attorney, certified public accountant or enrolled agent authorized to practice before the IRS. You may represent yourself or obtain an authorized representative; Low-Income Taxpayer Clinics may provide free help to qualifying taxpayers.

If the letter does not clearly tell you which route applies, contact the office listed on the notice promptly and seek advice from a qualified tax professional. Do not let uncertainty consume the filing period.

Filing an IRS Appeals protest

Confirm whether a small-case request is enough

IRS Appeals generally uses a small-case request when the tax, penalties and interest for each tax period are $25,000 or less. If the amount for a period is above $25,000, a formal written protest is generally required. The letter controls: it may specify a different document or additional information. Treat the $25,000 figure as a per-period threshold, not a single total across every year.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When the notice covers several periods, calculate each period separately and check how the IRS has grouped the proposed amounts. If you are close to the threshold or cannot determine the amount, ask the named IRS office or a representative before choosing the form. Filing the wrong type of request can create avoidable delay during a short deadline.

Observe the protest date in the letter

IRS Appeals guidance says, “Be sure to send the protest within the time limit specified in the letter you received, which is generally 30 days.” The 30-day figure is a general guide, not permission to ignore the date printed in your notice. Count from the date and instructions the letter specifies, and leave time for delivery or electronic confirmation if that option is provided.

Build the written protest around facts and law

A useful protest lets an Appeals officer see exactly what you dispute and why. Include all of the following:

  • Your name, current address and telephone number.
  • A copy of the proposed-adjustment letter and any other notice the instructions require.
  • A clear statement that you want review by IRS Appeals.
  • A list of each disputed item, tied to the tax period and line, transaction or adjustment described in the notice.
  • Your explanation of why the IRS position is incorrect, separating factual disagreements from legal arguments.
  • Organized supporting records, with a short description of what each document proves.
  • Citations to relevant law or documents when they support your position.

Use numbered sections that match the notice. For example, label an income adjustment, deduction issue and penalty issue separately rather than placing every argument in one narrative. If a record covers multiple issues, identify each page or section that matters. Keep the original documents and send copies unless the notice specifically requires an original.

Send it to the office named by the IRS

Use the mailing address, submission method and any signature instructions in the notice. A protest sent to a different IRS address can be delayed even when its content is complete. Assemble one final package, verify that the notice copy and attachments are legible, and make a list of every enclosure before sending it.

Retain the signed protest, the complete attachment set, the envelope or shipping record and any delivery or receipt confirmation. If the IRS offers an electronic submission method for your specific letter, save the confirmation page or message showing when it was accepted. The evidence should let you demonstrate both what you sent and when it was sent.

Filing a Tax Court petition

Identify the type of notice

A notice of deficiency generally gives you 90 days after the mailing date to file a petition. When the notice is addressed outside the United States, the general period is 150 days. A notice of determination concerning collection is generally petitioned within 30 days. The exact notice language and date control, so read the first and last pages and every instruction about Tax Court rights.

The Tax Court states: “The Tax Court cannot extend the time for filing a petition in response to a notice of deficiency.” Treat that statement as a hard stop. If you are unsure whether a document is a deficiency notice, a collection determination or another type of notice, obtain professional advice immediately rather than assuming the longest period applies.

File through DAWSON or on paper

The Court generally permits a petition to be filed electronically through its DAWSON system or on paper. It does not accept petitions by fax or ordinary email. Use the filing method you can complete and document reliably, and follow the Court’s current petition instructions for account setup, attachments, signatures and payment-related information, if any applies to your case.

For an electronic filing, the Court says it must receive the petition by 11:59 p.m. Eastern Time on the last date to file in most cases. Your local clock may show a different time. Do not wait until the final minutes to create an account, upload files or correct an error; a failed upload is not proof of receipt.

For a paper petition, certified or registered U.S. Postal Service mail or a designated private delivery service provides stronger timing evidence than ordinary postage. Keep the mailing receipt, tracking record and a copy of the exact package. Confirm that the delivery service you use is one the Court designates for filing purposes.

Account for weekends and District of Columbia holidays

If the final day falls on a Saturday, Sunday or District of Columbia holiday, the Court says the next business day applies. Check the Court’s current holiday calendar and preserve a screenshot or printout of the applicable date calculation with your case records. This adjustment does not mean you should postpone preparation; it only changes the last permissible filing day when the rule applies.

A deadline-first filing plan

Use this sequence as soon as an IRS notice arrives:

  1. Preserve the package. Save the notice, envelope and enclosures; scan them and record the date shown on the letter.
  2. Mark the controlling date. Copy the exact deadline and the time zone or mailing instruction into your calendar. Add earlier dates for drafting, review and transmission.
  3. Classify the route. Decide whether the notice calls for an IRS Appeals request or protest, a Tax Court petition, or another response.
  4. Calculate the amount and period. For Appeals, determine whether each period is at or below the $25,000 small-case threshold. For Tax Court, identify whether the notice is a deficiency or collection determination.
  5. Collect proof. Gather records that address each disputed item, then arrange copies in the same order as your numbered arguments.
  6. Draft the required document. Use the notice’s requested format and include your contact information, the notice copy, the relief or review requested, factual explanation, legal support and exhibits.
  7. Obtain a quality check. Ask a qualified representative to verify the route, deadline, periods and attachments when the amount or issue is significant.
  8. Submit with time evidence. Use the named IRS address for Appeals, or DAWSON or an accepted delivery method for Tax Court. Save confirmation, tracking and receipts.
  9. Preserve the final record. Keep the exact filed document, every attachment, proof of receipt or postmark and your deadline calculation together.

What to do when the deadline is today or nearly over

If the notice directs you to IRS Appeals

Finish the smallest complete protest you can support, following the letter’s required elements, and send it through the specified channel immediately. Do not omit your name, contact details, the notice copy, the statement requesting Appeals review or the explanation of each disputed item merely to make the package shorter. If a supporting record cannot be obtained before the deadline, identify the missing record and explain its relevance rather than silently leaving a factual gap. Preserve evidence of transmission.

If the notice gives Tax Court rights

Prioritize filing the petition over perfecting a full argument. The Court’s nonextendable deficiency deadline makes a timely petition the critical step. If the deadline is close, file a protective petition promptly and obtain professional advice about the case and any later amendments or required responses. Use DAWSON only if you can complete and confirm the filing before the 11:59 p.m. Eastern cutoff; otherwise use a permitted paper-delivery method with verifiable timing. Never rely on fax or ordinary email.

If you miss the stated date

Contact a tax attorney, certified public accountant or enrolled agent immediately and keep the notice, envelope and any attempted-filing records. A missed date can affect which forum is available and whether the IRS may proceed with collection. Do not assume that an explanation, a phone call or an ordinary mailing automatically restores a Tax Court right; the Court specifically says it cannot extend a deficiency-petition deadline.

Make the record easy to review

Appeals and court filings are easier to evaluate when every assertion can be traced to a document. Create an index with the exhibit name, date, tax period and disputed issue. Use filenames that identify the period and issue, and redact information that the filing instructions do not require while preserving enough detail to authenticate the record. Keep a separate master folder containing the unaltered originals.

For factual disputes, state what happened, when it happened and which record proves it. For legal disputes, state the rule you believe applies and connect it to the facts. Avoid unsupported conclusions such as “the IRS is wrong” without identifying the adjustment, evidence and legal reason. If a penalty is disputed, address the penalty separately from the underlying tax adjustment so the reviewer can see the requested resolution.

Representation and low-cost help

You may represent yourself before IRS Appeals or appoint an attorney, certified public accountant or enrolled agent authorized to practice before the IRS. Representation can be particularly valuable when several years are involved, the amount approaches the small-case threshold, collection action is pending or the deadline calculation is uncertain.

The Tax Court directs petitioners to Low-Income Taxpayer Clinics. Many clinics provide free legal services to qualifying taxpayers. Eligibility and capacity vary, so contact a clinic as soon as you receive the notice rather than waiting for the final week. A clinic or other representative can help identify the forum, prepare a petition or protest and preserve evidence of timely filing.

Frequent mistakes and their fixes

Mistake Why it creates risk Fix
Using the tax-return due date An appeal deadline comes from the notice, not the original return calendar. Copy the date and instructions printed in the notice.
Assuming every dispute has 90 days IRS Appeals protests are generally due in 30 days, and collection petitions generally in 30 days. Identify the notice type and route before counting.
Sending a Tax Court petition by email or fax The Court does not accept those methods. Use DAWSON or an accepted paper-delivery method.
Waiting until the last hour to use DAWSON Receipt, not merely starting an upload, must occur by the cutoff. File early and save the electronic confirmation.
Using ordinary postage without proof You may be unable to show when the paper filing was sent. Use certified or registered USPS mail or a designated private delivery service and retain the receipt.
Submitting a protest without exhibits or issue labels The reviewer cannot readily connect evidence to each adjustment. Number each issue, cite the supporting record and include an exhibit index.
Confusing a $25,000 threshold with a total for all years The IRS Appeals guidance describes the threshold for each tax period. Assess tax, penalties and interest separately for every period.
Discarding the envelope or confirmation Delivery and timing may later be disputed. Keep the notice package, filed copy and all postal or electronic proof.

After submission

Save a calendar entry showing the filing date, method and confirmation number or tracking code. Monitor the address, telephone number and electronic account associated with the case for follow-up requests. If the IRS or Court asks for additional information, compare the request with your indexed records and answer by the new deadline stated in that communication.

Do not throw away working papers after filing. Keep calculations, source documents, correspondence and proof of transmission together for the entire dispute. If you change address or appoint a representative, follow the applicable notice or case instructions so future communications reach the right person.

Key deadlines at a glance

Action General timing Important qualification
IRS Appeals small-case request or formal protest Generally within 30 days. The date and instructions in the IRS letter control.
Tax Court deficiency petition 90 days after mailing. 150 days when the notice is addressed outside the United States; the Court generally cannot extend this deadline.
Tax Court collection petition Generally within 30 days of the notice of determination. Confirm the exact notice and date.
Electronic Tax Court filing By 11:59 p.m. Eastern on the last filing date in most cases. The Court must receive the petition; save the confirmation.
Weekend or District of Columbia holiday Next business day for the Tax Court deadline. Check the applicable Court calendar.

The safest practice is simple: read the notice, select the correct forum, prepare the document it requires, file before the stated date and keep objective proof that the filing was received or properly mailed.
