In the United States, you can contact the U.S. Department of Housing and Urban Development (HUD) through its Fair Housing and Equal Opportunity process, submit a separate complaint to the Consumer Financial Protection Bureau (CFPB), and consider legal advice about a private lawsuit. These routes have different purposes and do not guarantee a particular result.
Start by preserving your records and writing a dated timeline, but do not wait to report simply because you are still gathering documents. HUD generally requires a Fair Housing Act allegation within one year of the last alleged discriminatory act, and other legal deadlines can apply.

What to do first if you suspect mortgage discrimination
Take four practical steps as soon as possible:
- Record the events. Write down when you applied, who you dealt with, what was said, what documents you supplied, the terms offered, and how the matter ended.
- Preserve evidence. Keep applications, rate sheets, loan estimates, closing disclosures, denial notices, emails, text messages, call records, advertisements, appraisal documents and servicing correspondence. Save original files and note when you received them.
- Identify the decision-makers. List the lender, loan officer, mortgage broker, appraiser, servicer, investor or modification company involved. Include office addresses and names of employees when available.
- Report promptly. HUD accepts housing-discrimination reports online, by telephone and by mail. The CFPB has a separate consumer-complaint channel for suspected creditor discrimination. A report is an allegation; filing it does not establish that a violation occurred or guarantee compensation.
If you face a near-term filing deadline, a pending foreclosure, a scheduled closing or another urgent loss, contact a qualified attorney or legal-aid provider in the relevant state while you report the matter. Agency intake does not automatically preserve every possible court deadline.
What counts as mortgage discrimination under federal law
The federal Fair Housing Act prohibits discrimination in residential real-estate-secured lending because of race, color, religion, sex, familial status, national origin or disability. HUD describes coverage across the mortgage process, not merely at the approval stage.

Mortgage activities covered by the Fair Housing Act
- Approving or denying a mortgage, refinance, home-equity loan or home-improvement loan
- Setting rates, points, fees, other costs or other loan terms
- Advertising mortgage products
- Providing mortgage-broker services
- Ordering or conducting a property appraisal
- Servicing an existing loan
- Providing help with a home-loan modification
- Providing homeowners insurance connected with the housing transaction
The Act reaches loans used to purchase, construct, improve, repair or maintain a dwelling. It therefore can apply to more than a standard purchase mortgage.
Examples HUD identifies
HUD gives examples of conduct that may raise a discrimination issue. They are illustrations, not a complete legal test or a finding about any individual case:
- A lender denies a loan or charges a higher rate because the property is in a majority-minority neighborhood.
- A lender provides a different level of service to applicants in a protected class.
- A lender refuses to consider disability-related income such as Supplemental Security Income (SSI) or Social Security Disability Insurance (SSDI).
- A borrower is steered toward less favorable terms because of a protected characteristic.
- A company targets a minority community with fraudulent home-loan-modification assistance.
- A lender refuses to provide a mortgage to someone who is on parental leave.
Context matters. A higher rate, denial or delay can have lawful explanations, such as documented credit, income, collateral or program requirements. The complaint process is where the facts, comparisons and explanations are examined.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsHow the Equal Credit Opportunity Act fits
The Equal Credit Opportunity Act (ECOA) applies to creditor decisions on credit applications, including mortgages, refinancing and home-equity loans. CFPB guidance lists race or color, religion, national origin, sex, marital status and age (when the applicant is old enough to enter a contract) among protected bases under ECOA. CFPB also describes Fair Housing Act protections for mortgage and home-improvement-related loans. State law may add protected categories or remedies.
The two statutes overlap but are not identical. A housing allegation handled by HUD’s Fair Housing and Equal Opportunity (FHEO) process and a creditor complaint submitted to the CFPB are different channels with different authorities.
Choose the right complaint channel
You may decide to contact HUD, the CFPB or both, depending on what happened. Do not assume that submitting to one agency automatically submits the same matter to the other or extends a separate legal deadline.
| Route | Main authority or focus | How to submit | Information to have ready | What the route may do |
|---|---|---|---|---|
| HUD/FHEO | Fair Housing Act allegations involving housing opportunities and mortgage-related conduct | HUD’s online Report Housing Discrimination service, 1-800-669-9777, or a printed form mailed to the appropriate regional FHEO office | Your name and address; the respondent’s name and address; the housing or program address or other identifying information; a short description of events; and dates | Intake, formal allegation processing, investigation or referral to a state or local partner, and a written finding |
| CFPB | Consumer complaints about creditors, including suspected discrimination under ECOA and related mortgage protections | CFPB’s online complaint system or 855-411-2372 | Dates, amounts and other details about the lender or creditor and the transaction | Complaint handling and status monitoring through the CFPB process |
HUD’s route is the one to understand when you want a formal Fair Housing Act allegation considered by FHEO or a partner agency. The CFPB route is useful for reporting a creditor problem and receiving a way to monitor the complaint’s status. Neither route is a substitute for speaking with counsel about a private claim.

Gather evidence without missing the filing window
Organize material in a way an investigator or lawyer can follow. A complete file is helpful, but HUD specifically asks for a concise account and dates at intake; you do not need to prove the entire case before making the report.
Build a dated timeline
Begin with your first contact with the suspected violator. For each event, record:
- Date and location, including whether the contact was by phone, email, online portal or in person
- Names and job titles of people involved
- Exactly what was requested, offered, denied or changed
- Any reference to race, color, religion, sex, familial status, national origin, disability, marital status or age
- Loan amount, rate, points, fees, down payment, appraisal value and other relevant numbers
- Comparable treatment of another applicant, if you know it
- Witnesses and how they can be reached
Preserve the paper trail
Keep both favorable and unfavorable documents. Useful records can include a preapproval, application, underwriting requests, adverse-action notice, rate-lock information, loan estimates, closing disclosures, appraisal reports, modification applications, servicing payment histories and call notes. If a conversation occurred by phone, write a contemporaneous summary and identify everyone on the call. Do not alter screenshots or original files; make a separate copy for annotations.
Describe the harm precisely
State what you lost or were required to pay: a denied application, a higher rate, additional points or fees, a delayed closing, a rejected modification, a lower appraisal, different servicing treatment or another concrete consequence. Avoid guessing at a motive when you can describe observable differences. Explain why you believe the difference relates to a protected characteristic and identify any comparable applicant or property information you have.
How to file with HUD, step by step
- Choose an intake method. Use HUD’s online Report Housing Discrimination page, call 1-800-669-9777, or print the report form and mail it to the regional FHEO office.
- Provide identifying information. Give your name and address, the name and address of the person or organization you are reporting, and the address or other identifying information for the housing or program.
- Summarize the allegation. Explain what happened in plain language and include the dates. Identify the mortgage stage involved and the protected characteristic you believe is relevant.
- Respond to intake questions. An intake specialist may interview you. HUD’s process guidance says, “When an individual reports possible discrimination, we check whether a formal allegation can be filed under one of the laws we enforce.”
- Review and sign a formal allegation when asked. Where appropriate, HUD prepares a formal allegation for your review and signature, then notifies the parties.
- Keep your submission record. Save confirmation messages, copies of what you sent, mailing proof and the date of each contact. Continue tracking the one-year HUD deadline and any other deadlines independently.
HUD can accept allegations involving mortgage lenders and other actors whose conduct affects housing opportunities. It may refer a matter to a state or local Fair Housing Assistance Program partner; the partner’s procedure and timing can differ from HUD’s.
How to file a CFPB complaint
- Use the CFPB online complaint system or call 855-411-2372.
- Identify the creditor and transaction. Include the lender, broker or other creditor, the property or loan, application dates and account information you can safely provide through the official process.
- Describe the suspected difference in treatment. Give dates, amounts, terms, communications and the reason you believe a protected basis may have affected the decision or service.
- Upload or reference supporting records. Include the clearest documents first, such as an adverse-action notice, competing terms, appraisal, modification decision or written explanation.
- Monitor status. CFPB says its process provides a way to monitor status and progress. Save the complaint number and agency messages.
A CFPB complaint can alert the bureau to a creditor issue, but the CFPB channel is not the same as filing a Fair Housing Act allegation with HUD. If a HUD deadline may apply, report to HUD separately and promptly.
What happens after a HUD report
Intake and formalization
HUD first determines whether the facts may fit a law it enforces. An intake specialist may ask follow-up questions and prepare a formal allegation for your review and signature. Once the formal allegation is filed, HUD notifies the respondent—the lender, broker, appraiser, servicer or other reported party—and gives that party an opportunity to respond.

Investigation or referral
HUD may investigate itself or refer the allegation to a state or local partner. Investigators may request:
- A timeline starting with your first contact with the suspected violator
- Locations where events occurred
- People present at each event
- Other people who may have relevant information
- Relevant documents
Evidence gathering can include interviews, document requests and property inspections. Cooperate, answer accurately and tell the investigator if a requested record is unavailable. Keep copies of every response. The published process describes stages but does not promise a general investigation duration, so do not rely on a fixed completion date.
Voluntary resolution efforts
HUD says it makes efforts to reach an agreement during the investigation. A voluntary resolution may address compensation, policy or procedure changes, training or other relief. Read any proposed agreement carefully before signing, particularly if you may want to pursue a private lawsuit.
Written findings
After the investigation, HUD says, “After completing the investigation, FHEO will send you a written report of its findings.” The report may result in a reasonable-cause determination or a dismissal for no reasonable cause. A finding is not the same as an automatic payment or guaranteed court victory.
What a reasonable-cause charge means
If HUD finds reasonable cause, it issues a Determination of Reasonable Cause and a Charge of Discrimination. Each party has 20 days after receiving notice of the charge to choose a trial in federal district court.

If neither party chooses federal court within the 20-day period, the case is heard by a HUD administrative law judge. Follow every notice and deadline; missing an election or response date can affect how the matter proceeds.

If HUD finds no reasonable cause
HUD dismisses the allegation when it finds no reasonable cause. HUD says there is no formal appeal process, although you may submit a written request for reconsideration. A reconsideration request should identify specific factual or legal errors and attach material that addresses them. It does not create a new guarantee of investigation or relief.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Deadlines, court options and agreements
| Action | General timing described by HUD | Important qualification |
|---|---|---|
| HUD Fair Housing Act allegation | Within one year of the last alleged discriminatory act | Report promptly; state and local procedures and deadlines may differ |
| Private federal civil lawsuit | Generally two years from the most recent alleged discriminatory action | Time HUD processes the allegation is excluded from that period under HUD’s guidance; other legal limits can apply |
| Election of federal district court after a HUD charge | 20 days after receiving notice of the charge | If neither party elects federal court, the matter goes to a HUD administrative law judge |
The one-year HUD period runs from the last alleged discriminatory act, not necessarily from the date you first noticed a problem. Keep a record of each later act that may be part of the allegation, such as a subsequent denial, servicing decision or modification refusal. Do not assume that contacting an agency pauses every deadline.

HUD also describes a private civil lawsuit deadline of two years from the most recent alleged discriminatory action, with the time HUD processes the allegation excluded from that period. A person may be unable to file a federal private civil suit after signing a HUD conciliation agreement or after a HUD administrative law judge has begun a hearing. Because the interaction among federal, state and local rules can be complicated, consult a qualified attorney or legal-aid provider before signing a settlement or relying on an agency filing to protect a court claim.
Common mistakes and how to avoid them
Waiting for a complete file
Do not postpone a report while trying to obtain every document. Submit a clear account with dates and explain which records you are still seeking. Continue gathering evidence after intake.
Using only verbal accusations
Describe the specific difference in treatment, the terms or service you received, the comparable treatment you observed and the resulting harm. A chronological, fact-based account is more useful than a conclusion without supporting details.
Confusing a complaint with a legal finding
Use “allegation” and “if you believe” when describing the situation. HUD or another agency must evaluate the evidence; the lender’s explanation may be disputed, accepted or partly accepted.
Recommended Free Tools
Assuming agencies share one filing
HUD/FHEO and the CFPB have different authorities and intake systems. If both routes are relevant, submit each complaint separately and keep the confirmation for each.

Ignoring state and local protections
State or local fair-housing agencies may offer additional protected categories, procedures or deadlines. A HUD referral to a local partner does not mean every local rule is identical to the federal process.
Signing a resolution without advice
A conciliation or voluntary-resolution agreement can affect later claims. Read releases, confidentiality provisions, payment terms and policy commitments carefully and obtain legal advice when the stakes justify it.
Examples of how the process may apply
A rate or fee difference
Suppose two applicants with comparable credit and loan profiles receive materially different rates or fees, and communications suggest the difference relates to race, national origin, sex, marital status or another protected basis. Preserve both sets of terms if available, identify the dates and decision-makers, and explain the comparison in a HUD or CFPB complaint. A difference alone does not prove discrimination; the agencies examine the full underwriting and pricing record.

If a lender refuses to consider SSI or SSDI without a lawful, documented reason, note exactly what income was disclosed, what policy or explanation the lender gave, and how the refusal affected approval or terms. HUD specifically identifies refusal to consider disability-related income as an example that may raise a Fair Housing Act issue.
Modification assistance aimed at a minority community
If a company advertises or sells fraudulent modification help by targeting a minority community, preserve the advertisements, payment records, scripts and communications. Identify the property, the promised service and the dates. The conduct may involve housing-discrimination concerns as well as other consumer-protection issues.
What outcomes are realistic
Possible relief identified by HUD includes compensation, changes to policies or procedures and training. The outcome depends on the evidence, the respondent’s position, the agency’s findings, any negotiated agreement and, if applicable, a court or administrative-law-judge decision. Neither HUD nor the CFPB promises a particular award, a finding of discrimination or a fixed investigation time.
Government enforcement actions do not charge individuals alleging discrimination fees or costs, according to HUD. That statement does not mean private legal representation is free, so ask any attorney or legal-aid provider about fees and eligibility before retaining them.

Practical filing checklist
- Confirm the last date of the alleged discriminatory act and calendar the one-year HUD deadline.
- Write a timeline from first contact through the latest event.
- List every organization and employee involved, with addresses where known.
- Collect applications, loan estimates, disclosures, denials, appraisals, modification records and correspondence.
- Record rates, points, fees, amounts, dates and any comparable offer or applicant information.
- Identify witnesses and what each person can establish.
- Submit to HUD through its online service, 1-800-669-9777 or the regional FHEO mail process.
- Submit a separate CFPB complaint online or at 855-411-2372 when creditor conduct is also at issue.
- Save confirmation numbers, copies and mailing or upload proof.
- Ask a qualified attorney or legal-aid provider about state deadlines, a private lawsuit and any proposed agreement.
Bottom line
Mortgage discrimination can occur in approval decisions, pricing, appraisals, servicing, advertising and modification assistance—not only when a lender says no. Report promptly to HUD when a Fair Housing Act allegation may apply, use the CFPB route for a separate creditor complaint, preserve a dated record and track court deadlines independently. Filing starts an evaluation; it does not itself establish liability or guarantee a remedy.
