If you believe a California bank or mortgage lender treated you differently because of a protected characteristic, you can report the conduct to the federal Consumer Financial Protection Bureau (CFPB), the U.S. Department of Housing and Urban Development (HUD), California’s Civil Rights Department (CRD), or the California Department of Financial Protection and Innovation (DFPI). The correct route depends on what happened, the type of institution involved, and whether the issue is credit discrimination, housing discrimination, or another regulated-financial-business complaint. File promptly: HUD and CRD generally describe a one-year administrative deadline for housing-discrimination allegations.
Where should you file?
Mortgage discrimination can fit more than one agency’s jurisdiction. You do not have to decide the legal theory perfectly before reporting the facts, but choosing the most relevant intake channel can reduce delays. The agencies may coordinate or refer a complaint, yet you should not assume that filing with one agency automatically preserves every separate deadline.

| Agency | Best fit | How to start | Important routing detail |
|---|---|---|---|
| CFPB | Suspected discrimination in a credit transaction, including a mortgage application, underwriting decision, loan terms, or account action. | Online complaint portal or 855-411-2372. | CFPB asks for dates, amounts, and other details and lets consumers monitor status. |
| HUD Office of Fair Housing and Equal Opportunity (FHEO) | Housing discrimination involving mortgage lending, home-equity lending, servicing, advertising, appraisals, or related housing services. | Online report, 800-669-9777, or HUD’s form by mail to the regional office. | HUD may investigate, refer the matter, facilitate an agreement, or involve the Department of Justice where appropriate. |
| California Civil Rights Department (CRD) | Violations of California housing protections, including discrimination by mortgage lenders and related providers. | California Civil Rights System (CCRS) online, or intake by email or mail. | A HUD housing complaint is automatically filed with CRD in the described process; a CRD complaint alleging Fair Housing Act facts is automatically filed with HUD. |
| California DFPI | Complaints about California-regulated residential mortgage lenders, mortgage loan originators, and California Fair Lending Law issues. | DFPI’s online complaint process. | DFPI can redirect a complaint to a more appropriate regulator. DFPI says national banks are handled by the Office of the Comptroller of the Currency (OCC). |
Start with the agency that most closely matches the conduct, and consider filing with more than one when the facts involve both a credit decision and housing discrimination. Keep copies of every submission and confirmation number.

What can count as fair-lending discrimination?
A bad lending outcome is not automatically illegal discrimination. The useful question is whether the lender’s action differed because of a protected characteristic or because you exercised a protected right. The CFPB’s credit-discrimination guidance identifies warning signs such as being denied credit despite qualifying, being discouraged from applying, receiving less favorable terms, or having an account closed. These signs become more persuasive when you can connect them to statements, comparisons, documents, or timing showing different treatment.

Protected grounds in credit transactions
The federal Equal Credit Opportunity Act (ECOA) protects applicants against discrimination based on race, color, religion, national origin, sex, marital status, age when the applicant can legally enter a contract, receipt of income from public assistance, or exercising in good faith a right under the Consumer Credit Protection Act. ECOA can apply to a wide range of credit activity, not only a first mortgage.
Protected grounds in housing-related lending
The federal Fair Housing Act covers mortgage, home-equity, and other housing-related lending discrimination based on race, color, national origin, religion, sex, disability, and familial status. California’s Fair Employment and Housing Act (FEHA), enforced by CRD, applies to most housing providers and related services, including mortgage lenders, and recognizes additional characteristics such as sexual orientation and gender identity. Federal and state coverage is not identical, so describe every relevant fact rather than trying to select only one label.
Stages where discrimination may occur
HUD explains that Fair Housing Act protections can apply during approvals and denials, setting interest rates and fees, advertising, broker services, appraisals, servicing, and requests for loan modifications. Examples include charging a higher rate because a property is in a majority-minority neighborhood, steering a borrower toward less favorable terms because of a protected characteristic, or refusing to consider disability-related income. The HUD explanation of its complaint process describes how allegations are evaluated and handled.

- Gather the core facts first. Write the lender’s name, branch or online channel, application or loan number, dates, amounts, property address, and names or job titles of people involved.
- Describe the conduct in chronological order. State what you requested, what the lender said or did, and how the result differed from what you expected or from a comparable applicant’s treatment. Separate what you personally observed from what you infer.
- Identify the suspected protected ground. Explain why you believe race, national origin, sex, disability, marital status, age, family status, or another protected characteristic affected the treatment. If you do not know the lender’s motive, say what facts led you to suspect unequal treatment instead of asserting an unproven conclusion.
- Upload or reference supporting records. Include application copies, rate quotes, loan estimates, adverse-action notices, emails, texts, call notes, and screenshots. Keep originals and redact unnecessary account numbers or Social Security numbers.
- State the outcome you seek. You can ask for an explanation, correction of an error, review of the decision, reimbursement, or another specific remedy, while recognizing that CFPB does not guarantee a particular result.
- Submit and monitor. Save the confirmation and use CFPB’s status-monitoring feature. Respond promptly if the agency requests clarification.
CFPB specifically asks consumers to have dates, amounts, and other complaint details ready. A precise timeline is more useful than a long narrative without dates.
How to report housing discrimination to HUD FHEO
HUD’s FHEO route is designed for housing discrimination, including mortgage lending. Use HUD’s Report Housing Discrimination page to submit online, call 800-669-9777, or mail HUD’s form to the appropriate regional office. HUD’s Fair Housing: Rights and Obligations material explains the protections and obligations that may apply.
Information HUD requests
- Your name, mailing address, telephone number, and other contact information.
- The name and address of the lender, broker, servicer, appraiser, or other organization involved.
- Information about the home, loan, housing program, or transaction.
- A short, factual description of what happened.
- The dates of the alleged discriminatory acts and any continuing conduct.
After intake, HUD may investigate, refer the allegation to another agency, or try to help the parties reach an agreement. HUD or the Department of Justice may pursue legal action when the facts and applicable law warrant it. Keep your own complete file; submitting a report does not transfer responsibility for preserving evidence.
How to file with California CRD
CRD enforces California housing protections, including claims involving mortgage lenders. Its Housing Discrimination page and How to File a Complaint instructions direct most people to the California Civil Rights System (CCRS). CRD says, “The fastest and easiest way is online via the California Civil Rights System (CCRS) portal.”

- Create a CCRS account. The portal requires an account so you can manage the intake and receive communications.
- Complete the housing-discrimination intake. Enter the parties, property or loan information, dates, protected characteristics, and a factual narrative.
- Upload documents. CCRS supports document uploads. Use clearly named files and keep an unaltered copy of everything submitted.
- Use portal appointments if needed. CRD’s system supports appointment scheduling for assistance with the intake.
- Submit by another method if necessary. CRD also accepts intake by email or mail; follow the current contact instructions on its filing page.
CRD explains that, in the described process, a HUD housing complaint is automatically filed with CRD, and a CRD housing complaint alleging facts that would violate the federal Fair Housing Act is automatically filed with HUD. Even with that coordination, save both agencies’ notices and track each case number.
When DFPI or the OCC is the better route
DFPI handles complaints involving businesses and products within its authority, including California residential mortgage lenders and mortgage loan originators, and it receives complaints concerning the California Fair Lending Law. Use DFPI’s Submit a Complaint page when the institution appears to be state-regulated or when the issue concerns a California financial-services business under DFPI’s remit.
Do not assume every bank is regulated by DFPI. DFPI says national banks are handled by the OCC and provides the OCC complaint phone number as 800-613-6743. If the institution’s charter or regulator is unclear, check DFPI’s routing guidance, use the federal CFPB channel, and identify the bank’s regulator from its disclosures or official correspondence. DFPI may direct your complaint to another agency if it concludes that agency is better placed to address it.
Do these 3 things before closing this tab:

HUD states that a Fair Housing Act allegation must generally be filed within one year of the last alleged discriminatory act. CRD states that a housing-discrimination complaint generally must be filed within one year of the alleged act. Treat these as administrative filing periods, not as a universal answer for every claim.

CRD also describes a two-year period for filing a housing case in court and explains that time spent in CRD processing is excluded from that period. Whether a particular tolling rule, exception, or separate statute applies depends on the facts. If the one-year date is approaching, file promptly and obtain case-specific legal advice rather than waiting for a complete record.
A CFPB, HUD, CRD, or DFPI submission may overlap with another agency’s jurisdiction, but coordination does not guarantee that every independent deadline is satisfied. Record the date of the last alleged act and the date each complaint was submitted.

Preserve communications and transaction records
- Completed applications and preapproval letters.
- Loan estimates, rate-lock documents, closing disclosures, and fee worksheets.
- Adverse-action or denial letters and any stated reasons.
- Emails, text messages, portal messages, and letters.
- Call logs and contemporaneous notes identifying who said what.
- Appraisal reports, servicing notices, modification requests, and payment histories when relevant.
- Screenshots showing advertisements, online forms, or changing terms, with the date captured.
CRD’s online system supports file uploads. Keep originals, back up digital files, and avoid posting account numbers, identity documents, or private communications publicly. Send copies unless an agency specifically requests an original.
Use the lender’s denial notice
If a credit application was denied, the lender generally must provide the principal reasons or explain how to obtain them. When the adverse-action notice says you may request the reasons, CFPB says to make that request within 60 days. Send the request in a trackable way and keep a copy.
If the denial relied on a credit report, additional notices about your credit score and the reporting agency may apply. Review the report for inaccurate information and preserve both the report and the lender’s notice. The stated reason can help organize your evidence, but it does not by itself prove or disprove discrimination; a seemingly neutral reason can still be applied inconsistently.
A practical complaint outline
You can adapt this sequence to any of the agencies’ forms:
- Parties and transaction: identify yourself, the lender or broker, the property, loan type, application number, and contact channel.
- Chronology: list each material event with dates and participants.
- Unequal treatment: explain the decision, term, communication, or service that differed and the protected characteristic or other protected activity you believe is relevant.
- Evidence: match each important statement to a document, message, witness, or call note.
- Impact: state additional cost, lost opportunity, delay, denial, or other harm.
- Requested response: identify the explanation, correction, review, or other outcome you want.
- Certification and contact: provide accurate contact information and remain available for follow-up.
Common mistakes to avoid
- Waiting for perfect proof. Agencies can evaluate allegations; file within the applicable period and supplement when permitted.
- Sending only a legal conclusion. “They discriminated” is less useful than the date, words, terms, comparator, and document supporting your concern.
- Ignoring neutral explanations. Include the lender’s stated reason and explain why you believe it was inaccurate, inconsistently applied, or a pretext.
- Using the wrong regulator without checking. National-bank complaints are an OCC routing issue, while DFPI focuses on entities within its authority.
- Submitting originals or exposing sensitive data. Use copies, redact unnecessary identifiers, and secure your records.
- Assuming one filing ends every obligation. Continue meeting existing loan and court deadlines unless a qualified attorney advises otherwise.
What happens after filing?
Each agency may acknowledge receipt, request documents, seek a response from the lender, investigate, refer the matter, or close it without a finding. Read every notice for response dates and instructions. Update the agency if your address, telephone number, loan status, or contact person changes.
An agency complaint is an administrative reporting and investigation route, not a guarantee of compensation or a substitute for individualized legal advice. A fair-housing or consumer-law attorney, legal-aid office, or housing counselor may help you evaluate remedies, litigation deadlines, or urgent foreclosure issues. Seek advice quickly when a sale, rate-lock expiration, eviction, or other irreversible event is near.
