How to File a Complaint About a Retirement Plan or Its Insurer

Send a retirement-plan problem first to the plan administrator named in your Summary Plan Description (SPD), and send an insurer claim-handling problem first to the insurer. If the plan does not respond or mishandles an ERISA-covered claim, contact the U.S. Department of Labor’s Employee Benefits Security Administration (EBSA). If an insurer still delays, denies, cancels, or mishandles a claim after you complain, file with the insurance department in the state that regulates the policy. These are separate channels: an insurance-department complaint does not replace a plan’s required internal claim and appeal process.

The correct route depends on who made the decision, what document or benefit is at issue, and whether the plan is covered by the federal Employee Retirement Income Security Act (ERISA). The steps below show how to document the problem, preserve appeal rights, meet the key deadlines, and escalate without losing evidence.

Choose the complaint route before you write

Retirement benefits can involve an employer plan, a third-party administrator, and an insurer. Start by matching the problem to the entity that controls the decision.

Problem First recipient Next escalation Governing rules
Missing SPD, account records, contributions, benefit calculation, or plan administration Plan administrator, using the SPD’s claim or document procedure EBSA when the plan fails to respond, provide documents, or follow required procedures Plan terms and, for covered private plans, ERISA
Denied retirement-plan benefit claim Plan administrator’s internal claims and appeals process EBSA for procedural or ERISA problems; legal advice after a final denial SPD, claims-procedure booklet, and ERISA where applicable
Insurer delay, denial, cancellation, failure to honor policy, or poor communication The insurer Insurance department in the state with jurisdiction over the policy Policy or certificate and state insurance law
Plan and insurer both involved Use the plan appeal process and insurer complaint process at the same time when appropriate EBSA for plan or ERISA administration; state insurance department for insurer-regulated conduct Potentially ERISA and state insurance law

Keep the two tracks distinct. A state regulator generally cannot decide whether an ERISA plan calculated your benefit correctly, while EBSA is not the substitute for filing an appeal required by the plan.

Confirm what kind of plan you have

Private-sector plans and ERISA

ERISA is a 1974 federal law that establishes minimum standards for most voluntarily established private-industry retirement plans. It requires plan information, fiduciary standards, claims and appeals procedures, and specified enforcement rights. A private employer’s 401(k) or pension is often, but not automatically, an ERISA plan; the plan documents and legal sponsor control.

Government and church plans

Federal, state, and local-government plans, and some church plans, may be outside ERISA. Do not assume that an EBSA complaint is the only or correct regulator for one of these plans. Identify the sponsoring government body or church organization, read the plan’s governing documents, and follow the appeal or grievance office named there. The plan’s legal status affects deadlines, available remedies, and which agency has authority.

Find the controlling documents

The SPD is the starting point. It explains eligibility, how benefits are calculated, where to submit a claim, what information is required, and how to appeal. Some plans provide a separate claims-procedure booklet. If you do not have the SPD or booklet, request it in writing from the plan administrator and save your request and any response. Do not rely on a summary from a human-resources representative when the written plan says something different.

Build an evidence file before filing

Create one dated folder, either paper or electronic, and preserve originals. Organize documents in chronological order so a reviewer can understand what happened without reconstructing it from memory.

  • The SPD and any separate claims-procedure booklet.
  • Plan statements, contribution records, vesting information, distribution forms, and account screenshots.
  • The insurance policy or certificate, policy number, and claim number when an insurer is involved.
  • Claim forms, bills, requests for information, denial letters, explanation-of-benefits documents, and appeal submissions.
  • Proof of delivery for every submission, such as certified-mail tracking, a portal confirmation, fax receipt, or an email showing transmission.
  • A log of calls and portal messages with dates, names, job titles, what was promised, and the promised follow-up date.
  • A one-page timeline listing each event, the person or entity involved, and the document that proves it.
  • The precise remedy you want, such as a corrected contribution, a recalculated benefit, release of a document, payment of a covered claim, or a written explanation.

Send copies rather than irreplaceable originals. Redact unrelated personal information when the filing system permits it, but leave identifiers needed to match your account or claim. Keep a complete copy of everything you submit, including attachments.

How to complain about plan administration

1. Read the SPD’s filing instructions

Follow the delivery method and address in the SPD. It may require a particular department, form, portal, or mailing address. Use the plan’s definition of a claim and include every item the procedure requests. Plans cannot charge a fee for filing a claim or appeal.

2. Write a focused claim or correction request

State the relevant facts in date order. Identify the benefit, contribution, document, or calculation at issue; quote the plan provision that supports your position when you can; attach the evidence; and state the correction you seek. Avoid accusations that you cannot prove. A clear request gives the administrator a specific decision to make and creates a record for an appeal.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Preserve delivery proof

Submit by the method the SPD requires and save the confirmation. If you mail the package, use a service that records delivery. If you use an online portal, save the confirmation page and download the uploaded files. Note the date the plan received the claim because the decision clock runs from receipt under the plan’s procedure.

4. Demand a written decision

For a covered benefit claim, the normal maximum period for an initial decision is 90 days. The plan may take an additional 90 days only when it gives the required extension notice, making the potential total 180 days. A proper denial must explain the specific reasons, identify the plan provisions relied on, describe any additional appeal levels, explain how to obtain relevant claim documents, and state the rights concerning judicial review.

5. Ask for missing documents separately

If the administrator has not supplied the SPD, claim file, plan provision, or calculation worksheet you need, make a written document request and keep it separate from the benefit claim. Identify each document and the date you first requested it. Failure to provide required plan information is a reason to contact EBSA and may affect your ability to prepare an appeal.

Appeal a denied 401(k) or pension claim

Watch the appeal deadline

The Department of Labor guide says a claimant generally has 60 days to request a full and fair review of a denied claim. The SPD controls the exact deadline and delivery method, so read the denial letter and claims booklet immediately. If you miss the stated deadline, explain the reason and ask whether the plan will accept a late appeal, but do not assume it will.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Submit all supporting evidence at once

Address each reason in the denial. Include corrected records, payroll evidence, beneficiary forms, medical or other documents required by the plan, witness statements where relevant, and a copy of the denial. Ask for the documents and information relevant to the claim if they were not provided. Explain the calculation you believe is correct and show the result you seek.

Know how long the appeal review can take

An appeal decision can take up to 60 days. The plan may use an additional 60 days only if it gives the required extension notice, so the possible total is 120 days. Keep checking the deadline and save every status message. A decision that arrives without the required explanation, documents, or notice may itself indicate a procedural failure.

Do not abandon the internal appeal

Contacting EBSA does not replace the plan’s appeal process. File the appeal even while asking EBSA for assistance unless a qualified lawyer advises a different strategy. The appeal creates the record the plan and, potentially, a court will use to evaluate the claim.

Escalate a plan problem to EBSA

Contact the Department of Labor’s Employee Benefits Security Administration through Ask EBSA or by telephone at 1-866-444-3272 when the plan does not respond, fails to provide a written decision, withholds required documents, mishandles a claim or appeal, calculates benefits incorrectly, or may violate ERISA. EBSA benefits advisers may help obtain benefits and seek an informal resolution.

Give EBSA a concise package: the plan’s name and sponsor, your contact information, the issue, the dates of your submissions, the SPD provision involved, copies of responses or proof that none arrived, and the remedy you want. Explain whether an appeal is pending and state its deadline. EBSA assistance is an informal federal intervention; it is not a substitute for filing the claim or appeal required by the plan.

EBSA is the federal contact for ERISA administration and procedural failures. If your plan is a government plan or a church plan outside ERISA, tell the adviser that status and ask which authority handles the dispute instead of assuming ERISA applies.

Complain about the insurer handling retirement benefits

1. Start with the insurer

Ask the insurer for a written explanation and correction. Use the policy or certificate number and claim number on every communication. Describe the delay, denial, cancellation, payment error, or communication failure and state the outcome you want. Keep the policy, bills, letters, portal messages, call dates, representative names, and promised follow-up dates together.

2. Prepare a regulator-ready timeline

The National Association of Insurance Commissioners (NAIC) advises gathering the policy number, supporting documentation, bills, and the communication record. Write a factual timeline with dates and quote policy language where it helps. Separate what the policy says from what a representative told you. Explain the specific remedy sought, such as reconsideration, payment under the policy, a corrected explanation, or a response within the policy’s process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. File with the correct state insurance department

Use the NAIC state insurance-department directory to identify the jurisdiction and its online, mail, or telephone process. State procedures vary. The department may investigate unfair claim delay or denial, failure to honor the policy, possible state-law violations, or poor communication. Submit copies, not originals, and preserve the confirmation number and the version of your complaint.

4. Cooperate with follow-up

A regulator may send your complaint to the insurer for a response or request additional records. Answer each request by the stated date and keep a copy. If the insurer’s response omits a document or misstates the timeline, identify the specific discrepancy and attach the record that resolves it. A regulator’s investigation does not necessarily award every amount you seek, so continue using any contractual review or appeal process in the policy.

When the plan and insurer are both involved

A pension annuity, insured benefit, or other arrangement can create two different disputes. For example, the plan may have supplied an incorrect benefit amount while the insurer may have delayed payment under an issued certificate. File the plan claim or appeal under the SPD and separately complain to the insurer about its own handling. Tell each recipient that the other matter exists, provide only relevant documents, and track the deadlines independently.

Use EBSA for the plan’s ERISA administration, fiduciary, document, or claims-procedure issues. Use the state insurance department for insurer-regulated conduct under state insurance law. Neither filing automatically substitutes for the other, and one regulator may not have authority over the other entity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Protect yourself from retaliation

ERISA protects participants who exercise rights under a plan or provide information in an ERISA inquiry. The Department of Labor states: “Employers are prohibited by law from firing or disciplining employees to avoid paying a benefit, as a reprisal for exercising any of the rights provided under a plan or Federal retirement law (ERISA).”

Keep evidence of any adverse employment action, including dates, changed duties, warnings, termination notices, and statements connecting the action to your benefit request or inquiry. Report suspected retaliation when you contact EBSA and obtain legal advice promptly because different claims can have different filing limits.

After a final denial

Once the plan has completed the required appeal and issued a final denial, consider advice from a lawyer experienced in ERISA benefits. Depending on the facts and the plan’s coverage, ERISA may allow an action to recover benefits, obtain requested plan documents, clarify future benefits, or address fiduciary-duty breaches. A lawyer can evaluate the denial, the administrative record, the plan’s review standard, and any deadline that applies before you file in court.

Bring the complete evidence folder to the consultation: the SPD, claim and appeal, denial letters, proof of delivery, account records, communications, and your timeline. Do not discard originals or assume a later phone call extends a court deadline.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common mistakes and practical fixes

  • Sending the complaint to the wrong entity: Check whether the disputed decision came from the plan administrator or the insurer, then use the matching procedure.
  • Skipping the SPD: Request it in writing and follow its address, form, and delivery requirements exactly.
  • Relying on phone promises: Ask for a written decision and record the date, name, and promised follow-up after every call.
  • Appealing without addressing the denial: Respond point by point, cite the plan language, and attach evidence for each disputed fact.
  • Missing a deadline while waiting for records: Submit a timely appeal with the documents available and explain what additional records you are requesting.
  • Sending originals: Keep originals and submit legible copies unless a rule expressly requires an original.
  • Using one regulator for everything: Keep EBSA and state insurance-department complaints focused on the authority each agency actually has.
  • Overloading the reviewer: Lead with a one-page timeline, a short statement of the error, and the exact remedy; put supporting records behind it.

A filing checklist

  1. Identify the decision-maker and determine whether the plan may be covered by ERISA.
  2. Locate the SPD, claims booklet, policy or certificate, and any applicable appeal instructions.
  3. Create a dated evidence folder and one-page timeline.
  4. Submit the plan claim or insurer complaint using the required method.
  5. Save proof of delivery and calculate the response and appeal dates.
  6. Request a written explanation and all relevant documents.
  7. Appeal a plan denial within the SPD’s deadline, generally 60 days under the DOL guide.
  8. Contact EBSA at Ask EBSA or 1-866-444-3272 for ERISA administration or procedural failures.
  9. After an insurer’s inadequate response, file with the appropriate state insurance department through the NAIC directory.
  10. After a final plan denial, obtain advice from an ERISA benefits lawyer before deciding whether to bring a court action.
