How to File a Belated Income Tax Return in India—and Check Which Losses Can Be Carried Forward

In India, you may generally file an income-tax return after the section 139(1) due date as a belated return, but late filing can remove the right to carry forward several kinds of current-year loss. For Assessment Year (AY) 2026-27, the Income Tax Department says a belated return may be filed by 31 December 2026 or before assessment is completed, whichever is earlier. The published delayed-filing fee is ₹1,000 when total income does not exceed ₹5,00,000 and ₹5,000 in other cases. Those dates and amounts are specific to AY 2026-27; do not apply them automatically to another year.

The practical answer depends on five facts: the assessment year, whether the return was filed by the original due date, the head and origin year of each loss, whether assessment has finished, and whether a condonation or updated-return route is available. A belated return does not normally preserve every current-year loss. Under the AY 2026-27 ITR-3 validation rules, a return filed after the section 139(1) deadline cannot carry forward current-year losses other than house-property loss and specified-business loss. Business, speculation and capital losses therefore require particularly careful timing checks.

Start with the correct assessment year

Indian income-tax deadlines, forms and validation rules are assessment-year specific. First identify the financial year in which the income or loss arose and the corresponding assessment year. Then confirm whether any return has already been filed, whether it was verified, and whether an assessment has been completed.

AY 2026-27 remains governed by the Income-tax Act, 1961, even though the Income-tax Act, 2025 applies from 1 April 2026. The transition does not turn an AY 2026-27 return into a return under the new Act. Use the form, instructions and validation rules displayed for the particular assessment year rather than relying on a form or deadline from a different year.

  • Financial year: the year in which the income, transaction or loss occurred.
  • Assessment year: the year in which that income is reported and assessed.
  • Original due date: the section 139(1) deadline applicable to your taxpayer category, audit status and year.
  • Belated-return date: the later-filing limit under section 139(4), which can differ by year and can end earlier if assessment is completed.

Keep the acknowledgement number and verification status for every filing. A return that was submitted but not verified is not treated the same way as a completed, verified return for practical compliance purposes.

AY 2026-27 belated-return deadline and fee

The Department’s AY 2026-27 FAQ states that a belated return under the 1961 Act may be furnished “on or before 31st December 2026, or prior to the completion of the assessment, whichever occurs earlier.” Thus, 31 December is not a guaranteed final day if the assessment has already been completed.

Item AY 2026-27 position Qualification
Belated-return deadline 31 December 2026 Earlier completion of assessment cuts off the ordinary belated route.
Delayed filing fee where total income does not exceed ₹5,00,000 ₹1,000 Figure stated in the Department’s AY 2026-27 FAQ.
Delayed filing fee in other cases ₹5,000 Figure stated in the Department’s AY 2026-27 FAQ.

These are administrative figures for AY 2026-27, not universal amounts. Before paying or submitting, check the live e-filing portal for any notification, extension, revised form or year-specific calculation.

How to file the belated return

File the return for the correct assessment year and select the filing section that identifies it as a belated return under section 139(4). The portal labels can change, so follow the year-specific instructions shown during filing.

  1. Collect the records. Assemble salary or professional-income statements, bank and investment statements, property and loan details, tax-deduction evidence, Form 26AS, the Annual Information Statement (AIS), and schedules supporting every loss. If an earlier return exists, keep its acknowledgement and computation.
  2. Choose the correct form. Select the ITR prescribed for your income heads, residential status and eligibility. A return with business or professional income, for example, may require ITR-3 rather than a simpler form. Do not select a form merely because it was used in a previous year.
  3. Sign in to the e-filing portal. Use the Income Tax Department portal’s e-File and Income Tax Returns area, choose File Income Tax Return, and select the assessment year. If the year is not available for online filing, use the utility and submission method specified for that year.
  4. Set the filing status to belated. In the return details, choose the section 139(4) option rather than the section 139(1) original-return option. Enter the correct filing date and disclose income, deductions, taxes paid and losses completely.
  5. Complete loss schedules separately. Identify the head of each loss, the year in which it arose, the amount already set off, and the amount proposed to be carried forward. Do not combine house-property, ordinary business, specified-business, speculation and capital losses.
  6. Reconcile tax information. Compare the return with Form 26AS and AIS. Resolve mismatches in tax deducted, interest, securities transactions, property income and other reported items before submission.
  7. Pay the applicable fee and tax. The portal calculates the statutory tax, interest and delayed filing fee for the selected year and facts. Save the challan or payment reference.
  8. Submit and verify. Complete electronic verification or send the prescribed signed verification within the permitted period. Download the acknowledgement, computation and loss schedules and retain them with the source records.

Submitting a return is not the same as obtaining approval for every loss schedule. Keep evidence showing how each figure was calculated in case the Department asks for clarification.

Separate current-year losses from brought-forward losses

Make two lists before deciding what a late return can accomplish. The first list contains losses arising in the year now being reported. The second contains losses that were validly determined in earlier years and are being brought forward.

The late filing restriction primarily affects the eligibility to carry forward a current-year loss. A previously valid brought-forward loss is a separate question: its original filing conditions, remaining statutory carry-forward period and set-off rules continue to matter. A late return does not automatically validate an old loss, and it does not automatically erase one that was validly established earlier.

Loss category What must be checked Effect of a late current-year return
House-property loss Applicable section, amount, set-off already used and remaining statutory period. AY 2026-27 ITR-3 validation rules list house-property loss as an exception to the general late-return restriction, subject to the governing provisions.
Ordinary business or professional loss Whether the loss return met the original section 139(1) deadline and the section 139(3)/80 conditions. A belated current-year return generally cannot carry this loss forward.
Specified-business loss Whether the activity qualifies as specified business and whether its separate records and statutory conditions are met. The AY 2026-27 ITR-3 validation rules identify specified-business loss as an exception, but the applicable provisions still control.
Speculation loss The nature of the transactions and the special set-off regime. Do not assume it survives a belated filing; check the timely-return condition.
Short-term or long-term capital loss Asset classification, holding period, transactions, set-offs and the year the loss arose. A late return can prevent carry-forward where the statutory timely-filing requirement applies.
Brought-forward loss from an earlier year Whether the earlier loss was validly carried forward and how much of its permitted period remains. It retains its statutory character if the original conditions were met; the current return must still report and set it off correctly.

Why the section 139(3) and section 80 conditions matter

For loss categories that require a loss return by the section 139(1) deadline, filing under section 139(4) is not an equivalent substitute. The Department’s AY 2026-27 ITR-3 validation rules say that a return filed after the original deadline cannot carry forward current-year losses except house-property and specified-business losses. A separate Department FAQ gives the practical warning for AY 2024-25: a belated loss return that did not satisfy sections 139(3) read with 80 cannot carry that loss forward, and the later statutory transition does not revive it.

This is why “I filed a return” is not enough to answer the question. The decisive sequence is whether the return reporting that loss was filed on time, whether the loss is one of the exceptions, and whether all other conditions for that head were satisfied. A return filed late may still report income and tax correctly, but the loss schedule can be denied carry-forward treatment.

How each loss head is set off

Losses are not interchangeable. Under the rules described by the Department, a prior business loss is set off only against business income in the prescribed manner. Capital losses are set off against capital gains under the applicable old-law rules. Speculation and specified-business losses have their own restrictions. The head in which the loss arose therefore determines both the filing requirement and the income against which a valid carried-forward amount can later be used.

Prepare a year-by-year ledger with these columns: origin assessment year, loss head, original amount, amount set off in each later year, amount remaining, original return filing date, and the last year in which carry-forward is permitted. This prevents a capital loss from being used against ordinary salary or business income and makes it easier to identify a loss whose original return was late.

Transition to the Income-tax Act, 2025

The Department’s transition FAQ says that valid brought-forward losses under the earlier law continue into the new-law framework subject to the earlier law’s corresponding conditions and remaining carry-forward period. The character of the loss is preserved: an old business loss remains a business loss, and an old capital loss remains subject to the capital-gains set-off method. A savings provision preserves eligible existing losses; it does not cure a failure to file the original loss return on time.

The Department illustrates this continuity with an eligible AY 2023-24 business loss being adjusted against business income in Tax Year 2026-27, subject to the prescribed conditions. That example demonstrates preservation of a valid loss; it does not make a belated or otherwise ineligible loss eligible.

If the ordinary belated deadline has passed

Once the section 139(4) window closes, do not treat the portal’s other options as an automatic extension. Two different mechanisms may be relevant, and each has separate eligibility rules.

Route When it may be relevant Key conditions and consequences Filing mode
Belated return under section 139(4) The year’s belated deadline has not expired and assessment has not been completed. Delayed filing fee and any applicable interest; current-year loss carry-forward remains subject to the loss-head restrictions. Usually the portal’s online return flow, subject to the year’s instructions.
Updated return (ITR-U) under section 139(8A) A taxpayer needs to make an eligible correction after the ordinary filing window. Subject to statutory exclusions, a time limit and additional tax. It is not a general device for preserving every loss or claiming a refund. Use the route and utility made available for the relevant year.
Condonation under section 119(2)(b), followed by a section 139(9A) return Genuine hardship may justify special relief after the ordinary deadline. Approval is discretionary and not automatic. The condonation order and its conditions control what can be filed. After approval, the Department’s manual directs the taxpayer to use the offline utility.

ITR-U: check eligibility before relying on it

The Department describes ITR-U as subject to a statutory time limit and additional tax. Review the exclusions and consequences for the particular assessment year before preparing it. An updated return should not be described as a late-loss-return remedy: its purpose and permitted outcomes are narrower than an ordinary original or belated return, and eligibility must be tested against the facts.

Condonation for genuine hardship

A condonation request under section 119(2)(b) asks the Department to excuse the delay because of genuine hardship. Explain the cause, provide supporting evidence and identify the exact return and loss involved. Approval cannot be assumed merely because tax is payable or the loss is large.

If the request is approved, the condonation manual lists prerequisites including the unique number of the condonation order, valid bank-account details and Form 26AS/AIS. The resulting return under section 139(9A) is filed through the offline utility, following the order’s conditions. Preserve the application, supporting documents, approval order and final acknowledgement together.

A practical decision checklist

  1. Write down the financial year and assessment year.
  2. Check the section 139(1) due date for your category and whether it was met.
  3. Confirm whether a return was submitted, verified and acknowledged.
  4. Check whether assessment has been completed.
  5. List every loss by head, amount and origin year.
  6. Separate current-year losses from previously carried-forward losses.
  7. Test each current-year loss against the year’s section 139(3), section 80 and head-specific rules.
  8. Check whether the ordinary belated window is still open.
  9. If it is closed, assess ITR-U eligibility and additional tax separately from a condonation request.
  10. Reconcile Form 26AS and AIS, submit the correct form, verify it and save the acknowledgement.

Common mistakes that can cost a loss

  • Using the wrong year: selecting a return form or deadline from the financial year rather than the assessment year.
  • Calling every late filing an ITR-U: a belated return, updated return and post-condonation return are different routes.
  • Combining loss heads: business, speculation, specified-business, house-property and capital losses do not share one set-off rule.
  • Assuming transition law repairs an old default: savings provisions preserve eligible losses but do not cure a missed original filing condition.
  • Ignoring assessment status: the AY 2026-27 belated date is earlier if assessment has already been completed.
  • Failing to verify: an unverified submission can leave the compliance process incomplete.
  • Overlooking records: retain the acknowledgement, computation, loss schedules, Form 26AS, AIS, challans and any condonation order.

When professional review is sensible

Obtain advice from a qualified Indian tax professional when the filing window has expired, the loss is substantial, several years of losses are involved, the assessment status is unclear, or a condonation request may be needed. Give the adviser the year-by-year loss ledger and every acknowledgement rather than only the latest draft return. That allows the adviser to distinguish an otherwise valid brought-forward loss from a current-year loss whose carry-forward was lost through late filing.

Worked decision examples

Example: current-year business loss filed after the due date

A taxpayer has a business loss for AY 2026-27 and files the return under section 139(4). The return can disclose the loss and calculate the year’s tax position, but the AY 2026-27 validation rule generally prevents carrying that current-year business loss forward because it was not reported by the section 139(1) deadline. The taxpayer should not place it in the same bucket as a previously valid business loss from an earlier year.

Example: house-property loss in a belated return

The AY 2026-27 ITR-3 validation rules identify house-property loss as an exception to the general late-return restriction. The taxpayer must still apply the house-property provisions, report the correct amount and respect the statutory carry-forward period. The exception is not permission to carry forward unrelated business or capital losses.

Example: valid old business loss after the law changes

An eligible AY 2023-24 business loss has been carried forward correctly and still has time remaining. The transition guidance preserves its business character, so it may be considered against business income in Tax Year 2026-27 subject to the applicable conditions. The transition does not help a loss whose original return failed the timely-filing requirement.

What to verify on filing day

Check the Department’s current notices for extensions, revised forms and portal availability on the day you file. Reconfirm the assessment year, fee shown by the portal, verification deadline, loss schedules and bank details. Keep a complete digital and offline record of the final submission. If the portal rejects a loss carry-forward entry, read the year-specific validation message rather than overriding it without determining whether the loss is legally eligible.
