Do not value an immigration promise as if it were already approved. Before accepting a U.S. job, identify the exact immigration category, the filings the employer will make, the trigger date for starting them, and what has actually been filed. Then value the offer on two separate tracks: ordinary employment terms and the credibility and downside risk of the immigration plan.
An offer letter or recruiter assurance can describe an intention, but it does not prove that a petition, labor-certification application, or adjustment filing exists. Your current status, expiration dates, filing history, job duties, worksite, and the employer’s policies determine what a job change or delay means. Use this guide to build a written record and to decide when you need advice about your individual case.

What “sponsorship” can mean
Employers and candidates often use “sponsorship” as a catch-all term. In practice, it can mean temporary work authorization, an employment-based path to permanent residence, or both. Those paths use different government filings, timelines, eligibility rules, and employer commitments.

|---|---|---|
| What the employer is trying to obtain | Authorization for you to work in a specified role and circumstances for a temporary period. | An immigrant petition and, when required, a labor-certification and adjustment or consular process leading toward permanent residence. |
| Typical employer action | A petition and supporting filings for the particular nonimmigrant category; wage and worksite details may be material. | For an applicable employer-sponsored route, a permanent full-time job, prevailing-wage process, recruitment and notice steps where required, a labor-certification filing, and an immigrant petition. |
| Can the employee ever self-petition? | Rules depend on the category and personal circumstances. | USAGov describes five employment-based preference categories and notes that requirements differ; some routes require an employer job offer and labor certification, while particular categories or exceptions allow self-petitioning. |
| What a promise is worth | Only as much as the identified category, filing plan, timing, and your eligibility support. | Only as much as the employer’s stated process and stage support; future permanent residence is also affected by statutory visa limits and government processing. |
USAGov’s permanent-worker overview was updated March 17, 2026. It identifies PERM and Form I-140 as steps in applicable employer-sponsored routes, but it does not make every worker eligible for those steps. A job offer is not itself an immigration approval.
Separate a filed case from a future intention
The most important question is not “Does the company sponsor?” It is “What will this company file for this role, when, and what has already been filed?” A statement such as “we sponsor employees” may describe a policy, a past practice, or a plan subject to budget and management approval. It does not establish that your case has begun.

Ask for the commitment in writing
- Category: Which immigration category would the company support for this specific role? Is the commitment for temporary work authorization, permanent residence, or both?
- Current stage: Has any petition, labor-certification application, labor-condition application, adjustment application, or other filing for you already been submitted? If so, request the filing date, receipt information, and the entity that filed it.
- Start point: What is the earliest date the company will begin the process? Is that date contingent on a probationary period, tenure, performance, manager approval, budget, a future business review, or another condition?
- Employer steps: Which government filings, recruitment activities, notices, legal work, and internal approvals will the employer undertake?
- Employee obligations: Which documents, fees, translations, medical steps, or other costs does the company expect you to handle? A verbal statement does not settle the legal allocation of fees or case costs.
- Role details: What job title, duties, compensation, work location, and reporting structure will be used in the immigration process?
- Change management: What happens if the manager, worksite, duties, title, compensation, or business need changes before or during filing?
- Counsel access: Will the employer’s immigration counsel explain the proposed path directly to you and, if appropriate, coordinate with your own lawyer?
Ask the recruiter or hiring manager to answer these questions by email. A clear written answer is useful evidence of what was promised; it is still not a government determination of eligibility.
Evidence that a process is real
Credible answers normally identify a category, an owner inside the company, a defined trigger for starting, and the next filing or preparation step. A receipt notice or other filing record is stronger evidence that a case exists than a general statement about company policy. Ask whether the employer has sponsored people in the same role, business unit, and work location, and how that process operated. Treat that history as context, not a guarantee: a prior case may have involved different duties, wages, funding, or employee circumstances.
Check the job details that drive immigration filings
Immigration eligibility is tied to the actual job, not just the employer’s brand or a broad occupational label. Before relying on a promise, compare the offer letter with the information the employer says it will use in filings.
- Duties and occupational classification: The day-to-day work must match the classification and petition description.
- Worksite and remote arrangement: The intended employment area can affect wage obligations and filing requirements. A move to another office or a material change in remote work may require a new analysis.
- Compensation: Confirm base pay, guaranteed components, variable pay, and the amount that will appear in immigration documents.
- Title and reporting line: A title change or a different manager can signal a substantive change in the role.
- Start date and employment continuity: Ask what happens if a filing is delayed, denied, withdrawn, or not selected under a category’s process.
The Department of Labor explains that a prevailing wage is based on the occupation and the intended employment area. For H-1B, H-1B1, and E-3 programs, the employer must pay the higher of the prevailing wage or the actual wage paid to similarly skilled and qualified workers. A salary that looks attractive in an offer comparison can therefore create a problem if the immigration description, location, or wage basis changes.
Understand the main process stages before you price the offer
Temporary work authorization
Temporary categories have their own eligibility and filing rules. Do not assume that an employer’s willingness to sponsor one category means it can sponsor yours, or that a petition for a new employer can be filed immediately. Ask counsel to map your current status, expiration date, prior approvals, and the proposed role to the specific category.

For H-1B workers, the Department of Labor’s portability fact sheet says an eligible worker may begin with a new employer after that employer files a nonfrivolous petition and submits an unexpired, approved labor-condition application covering the work, subject to the fact sheet’s other conditions. That fact sheet was revised in November 2016. Because it is not a complete statement of current law, do not treat it as permission to start work in every transfer situation; obtain current USCIS guidance and case-specific legal advice before changing jobs.

PERM and an employer-sponsored immigrant petition
For an applicable employer-sponsored permanent-worker route, the Department of Labor generally requires a prevailing-wage determination before the employer files PERM. The employer identifies a permanent, full-time job, obtains the wage determination, completes required recruitment and notice steps, and submits the application. If the labor-certification stage is required, it is an employer process tied to the offered position, not a box that an employee can complete alone.
Ask which of these stages the employer will support and when it will begin. “We will start your green card” could mean a future promise to request a wage determination, an active recruitment plan, a filed PERM application, or a later immigrant-petition step. Those are materially different positions for financial planning.
Visa availability and government timing
The Department of State describes five employment-based immigrant-visa preference categories and approximately 140,000 employment-based immigrant visas available annually under U.S. law. Availability is numerically limited, and the Department says an individual case’s duration varies and cannot be predicted accurately. An employer can control some preparation and filing decisions, but it cannot guarantee a visa number or a government processing date.
Adjustment-of-status portability after 180 days
USCIS says certain employment-based adjustment applicants with an approved employment-based petition may change employers when the adjustment application has been pending for 180 days or more and the new job is in the same or a similar occupational classification, subject to the provision’s limitations. This AC21 portability rule is not a general “green card transfers with you” rule. The petition, adjustment filing, job classification, timing, and other case facts matter.

Build a sponsorship-credibility worksheet
Use a personal worksheet rather than treating sponsorship as a guaranteed part of compensation. The categories below are decision aids, not a government scoring system.
| Factor | Higher-confidence evidence | Warning sign |
|---|---|---|
| Category specificity | The employer names the category and explains why it fits the role and your current status. | “We sponsor” without identifying a category or eligibility assumptions. |
| Written commitment | An email or offer addendum states the intended process, timing, and conditions. | Only a verbal recruiter assurance, with no owner or date. |
| Filing status | Receipt information or a documented preparation stage exists for your case. | The company cannot distinguish a filed matter from a future plan. |
| Start conditions | The trigger is objective, such as a stated start date or defined employment milestone. | Indefinite language such as “when the business is ready” or repeated discretionary reviews. |
| Internal dependencies | The immigration team, manager, and budget owner are identified. | Approval depends on an unnamed committee, future funding, or a manager who has not confirmed it. |
| Role and worksite match | The title, duties, wage, location, and reporting line are consistent across the offer and immigration plan. | The offer is remote or flexible, but the filing description assumes a different location or job. |
| Contingency plan | The employer explains what happens after a denial, delay, reorganization, or worksite change. | You are expected to absorb all disruption without a written alternative. |
Do not convert the worksheet into a pretend probability of approval. Its purpose is to expose missing facts and compare offers consistently.
Compare the offer on two separate tracks
First evaluate the job as if no sponsorship promise existed. Compare guaranteed compensation, benefits, role quality, manager, stability, location, commute or remote requirements, and opportunities for advancement. This prevents an uncertain immigration benefit from masking a weak employment package.
Then evaluate the sponsorship plan separately. Record the category, stage, earliest start date, prerequisites, employer obligations, employee obligations, role and worksite assumptions, and the consequences if the plan changes.

| Decision area | Questions to answer before accepting | Financial consequence of uncertainty |
|---|---|---|
| Compensation | What pay is guaranteed, and what portion depends on bonus, equity, or future promotion? | You may need to fund living costs and immigration expenses without counting on variable pay or a future raise. |
| Employment continuity | How long can you remain employed if filing is delayed or denied? | A gap, forced move, or hurried job search can create relocation and income risk. |
| Process timing | What is the earliest filing date, and which events could move it? | A later start can postpone work authorization or permanent-residence milestones. |
| Employer dependence | Is the plan tied to one manager, budget, business unit, or location? | Reorganization or a change in leadership may remove the expected support. |
| Role flexibility | Can duties, title, location, or hours change without a new immigration review? | A seemingly better assignment may not be usable if it creates filing or status problems. |
| Exit options | What is your lawful path if you resign, are laid off, or accept another offer? | You may face legal fees, travel, unemployment, or a constrained search window. |
For personal budgeting, model at least two scenarios: the job with the promised process proceeding on schedule, and the job with no employer-sponsored filing. Include only income and benefits you can reasonably rely on in both scenarios. Keep cash reserves for ordinary transition costs and any employee expenses the employer has clearly assigned to you, without assuming a particular fee amount.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What to do in common job-change situations
You are joining a new employer before any filing has started
Ask whether the employer will file for your current status, whether work authorization exists independently of that employer, and what happens if the company changes its mind before the filing date. Do not resign from a current job solely because a recruiter described sponsorship as likely.
Your H-1B transfer is pending
The portability concept may allow an eligible worker to begin after a qualifying petition and labor-condition application are filed, but the Department of Labor fact sheet cited above is from November 2016 and lists additional conditions. Confirm the current USCIS position, the filing’s accuracy, and your personal status history with counsel before starting work. A pending filing is not the same as an approval, and a mistake in the petition can affect the result.
Your employer has started PERM but has not filed an immigrant petition
Ask for the exact stage: prevailing-wage request, recruitment and notice, PERM filing, or a later step. Confirm whether the offered job, wage, and worksite remain the same. A new employer cannot simply inherit an unfinished employer-specific process without analyzing the legal consequences.
Your employment-based adjustment application has been pending for 180 days or more
Ask whether your case has an approved employment-based petition and whether the new job is in the same or a similar occupational classification. USCIS’s AC21 portability discussion has limitations; the 180-day threshold alone does not make every job change safe. Obtain a case-specific review before resigning or accepting materially different duties.

Your role, manager, or location changes
Notify the employer’s immigration team before the change takes effect. Because wage calculations and filings depend on occupation and intended employment area, a transfer to another site, a new set of duties, or a substantial title change can require a new analysis. Get the answer in writing rather than relying on a manager’s assurance.
The employer is acquired, restructures, or eliminates the role
Ask immediately which legal entity employs you, whether the petitioning entity remains the same, and what happens to pending filings. Separate the company’s business-continuity plan from your immigration options. If the employer cannot provide a prompt explanation, consult independent counsel before signing a separation agreement or starting a new job.
Documents to request and keep
- The signed offer letter and every written sponsorship statement.
- A description of the proposed immigration category and filing sequence.
- The intended job title, duties, compensation, worksite, and start date.
- Any filing receipt, approval notice, labor-condition application information, or PERM-stage confirmation the employer is willing and permitted to share.
- The employer’s written policy on legal fees, government fees, reimbursements, repayment clauses, and employee documents.
- The name and contact details of the immigration team or outside counsel responsible for the case.
- Your own records of current status, expiration dates, prior petitions, adjustment filings, and employment history.
Store copies outside the employer’s systems. Keep a dated log of material conversations and follow up by email when an answer affects your decision.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteWhen to obtain independent immigration advice
General offer evaluation cannot determine whether you are eligible for a category or allowed to change jobs. Obtain advice from a qualified immigration attorney when your status is expiring, a petition is pending or denied, you have an adjustment application, your duties or worksite will change, you have a complicated status history, or the employer’s plan depends on facts not covered in its written explanation.
Give counsel the current status and expiration date, petition and adjustment filing history, approval and receipt notices, proposed duties and worksite, compensation, and the employer’s written sponsorship answers. Ask counsel to distinguish three things: what the law may permit, what the employer is willing to do, and what has actually been filed. That distinction is the foundation of a financially sound decision.
A decision rule for accepting the offer
Accept the job only if the ordinary employment terms work without treating uncertain sponsorship as guaranteed compensation. Give additional value to the immigration plan only when the category is identified, the employer’s process is documented, the start conditions are acceptable, and you understand the downside if the filing is delayed, denied, or made impossible by a role change. If those facts are missing, negotiate for written clarity or continue your search rather than making an irreversible move on a promise.
