Do not deposit until you can identify the exact legal entity you are contracting with, confirm it may offer perpetual derivatives where you live, understand what happens to customer assets if it fails, and calculate the complete cost of your intended trade and withdrawal. A brand name, a corporate registration, or a proof-of-reserves page is not enough.
- Verify the entity, jurisdiction, regulator register and permitted activity.
- Read custody, reuse, withdrawal, suspension and insolvency terms.
- Treat proof-of-reserves as limited, point-in-time evidence—not an audit or solvency guarantee.
- Check perpetuals mechanics, executable liquidity, security controls and outage procedures.
- Price trading, funding, spread, slippage, transfer and custody costs together.
1. Identify the counterparty and its legal perimeter
Find the legal name in the terms of service, not merely the exchange’s domain, app name or logo. Record the entity that contracts with customers in your country, the stated location of custody and operations, governing law, dispute forum and the date you checked them. If several entities appear, determine which one accepts deposits, operates the derivatives venue and holds or arranges custody.

Map every role to an entity
A single brand can use separate companies for the website, derivatives trading, payments and custody. Make a simple map: the company named in the customer agreement, the company named in the privacy policy, the entity shown on invoices or transfer instructions, and any disclosed custodian or sub-custodian. If those names do not match, ask which company owes you the balance and which one can freeze or release it. Save the answer in writing.
Check authorization for the specific service
Search the relevant regulator’s current public register and read the activities attached to the entry. A money-laundering registration, company filing or permission for spot services does not automatically authorize perpetual derivatives, custody or every other exchange function. The SEC warns that crypto entities may not be registered for securities activities and that protections depend on the regulated activity. Authorization in one country does not establish authorization or customer protection in another.

Perpetual contracts may be restricted by location, client category, leverage or margin rules. Confirm that you are legally eligible to trade them where you live and which entity’s rules apply. The evidence here does not determine the derivatives law for any particular country or any unnamed exchange, so those questions remain unresolved until you check current local records.
Save the operative documents
Download or screenshot the terms, fee schedule, market rules, privacy policy and risk disclosures. Look for clauses covering account suspension, forced liquidation, unilateral rule changes, governing law, dispute resolution and insolvency. Keep the versions and the date reviewed; online terms can change after you fund an account. Note whether the documents identify a complaints process and a regulator or ombudsman, but do not assume that a complaints channel guarantees reimbursement.
2. Establish who controls and protects customer assets
An account balance is an accounting entry, not proof that you own segregated coins that can be recovered in a failure. Determine whether the exchange holds keys directly or uses a custodian and sub-custodian, how balances are recorded, and whether customer assets can be lent, pledged, rehypothecated or otherwise reused.
Read the custody and insolvency language
- Does the customer retain a property interest, or only an unsecured claim against the operator?
- Are client wallets and records segregated from the operator’s own assets?
- Can the operator use assets as collateral or transfer them to affiliates?
- Who bears losses from a custodian failure, hack or shortfall?
- What priority do customers have if the operator enters insolvency?
- Which law governs the custody relationship if the custodian is in another country?
Do not infer answers from marketing language such as “institutional custody” or “100% backed.” For providers within the scope of the European Union’s Markets in Crypto-Assets Regulation (MiCA), Article 75 describes a custody policy, a client-position register and custody-agreement details including the service, security systems, fees and applicable law. Those are jurisdiction-specific requirements, not a universal rule for every exchange.
Ask how a perpetuals position is represented in the records. Your collateral may be shown as margin while the exchange separately records an obligation to you. That distinction matters if assets are pooled, if a custodian fails, or if the operator claims a right of set-off. A clear explanation should identify the asset, quantity, wallet or ledger treatment, and the party responsible for reconciliation.
Confirm the withdrawal path before sending a material balance
Read withdrawal limits, review holds, supported networks, address-change controls, approval delays, fees and suspension rights. Confirm the exact asset and network you would use; sending through an unsupported network can make funds unrecoverable. Check whether withdrawals require extra identity review after a password, device or address change, and whether the terms allow the operator to delay a withdrawal for security or compliance checks.
A low-value trial can test the documented process, but it cannot prove that a platform will remain solvent or available during stress. Record the destination address, selected network, requested amount, fee shown at confirmation, transaction identifier and arrival time. Do not treat a successful small withdrawal as evidence that larger withdrawals will be processed under every market condition.

Understand what self-custody changes
A hardware wallet or other self-custody wallet protects assets only after you withdraw them. You then control the private keys and assume responsibility for backup, signing and recovery. It does not protect coins left on the exchange, alter the exchange’s insolvency obligations or prevent a withdrawal halt. Losing the recovery material can permanently prevent access, so self-custody replaces exchange risk with key-management responsibility; it does not remove risk.
3. Treat proof-of-reserves as one narrow disclosure
Record the report date, included assets and wallet addresses, liabilities included or excluded, methodology, provider independence and qualifications, and the level of assurance. Check whether customers can verify that their balances were included and whether the liabilities population is complete. A cryptographic inclusion proof can show that a balance was in a snapshot; it cannot by itself show that all obligations were disclosed.
Ask what the report actually covers
Determine whether the report covers the derivatives entity, a parent company, a custody affiliate, or only selected wallets. Check whether borrowed assets, assets posted as collateral, customer claims, pending withdrawals, contingent obligations and related-party balances are included or excluded. Ask how the provider obtained wallet control, whether liabilities were supplied by management, and whether any qualifications or limitations appear in the report.

Know what a snapshot cannot establish
A proof-of-reserves report may show assets at one point in time while omitting movements between snapshots, contingent obligations, affiliate exposures or creditor priority. It is not a financial-statement audit unless it actually is one performed under stated auditing standards. Look separately for audited financial statements and read their scope and qualifications. Even repeated snapshots are observations at selected dates, not continuous confirmation that withdrawals can be met.
The Tool Desk
Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →The SEC’s Investor.gov alert cautions: “In sum, investors should exercise extreme caution when relying on proof of reserves to conclude that a crypto asset entity has sufficient reserve assets to meet customer liabilities.” Use the report as one input alongside custody terms, liabilities information, legal status and withdrawal evidence—not as a solvency certificate. If an operator publishes assets but will not explain liabilities, that is an unresolved gap rather than a favorable assumption.
4. Examine security and operational resilience
Look for dated, specific descriptions of account authentication, withdrawal approvals, address whitelists, key-management architecture, incident response, system availability, backups and business-continuity arrangements. A badge or general statement that funds are “secure” is not evidence of how controls work.
Read whether the platform separates login permission from withdrawal permission, supports strong multifactor authentication, and imposes a cooling-off period after changing security settings. Confirm who may approve withdrawals for institutional or managed accounts and whether the exchange can reverse or freeze a transfer. These details should appear in operational documentation, not only in promotional copy.
Assess communication during failures
Check how the operator announces maintenance, halted markets, liquidations, delayed withdrawals and security incidents. Search regulator notices and independent disclosures using the exact legal entity name. Pay attention to whether notices explain affected assets, customer actions, restoration criteria and post-incident findings. A long history of frequent status changes is not automatically proof of misconduct, but unexplained interruptions and contradictory notices increase uncertainty.
Ask how the venue preserves order and position records during an outage and how it handles orders submitted immediately before a halt. Find the stated channel for urgent withdrawal or security complaints and keep copies of responses. No exchange-specific security audit, incident record or uptime history is established here for an unnamed new venue. Do not treat an unverified certification, social-media claim or marketing statistic as an assessment of that platform.
Use a safe account test
- Create an account only after reading the terms and jurisdiction restrictions.
- Enable the strongest available authentication and withdrawal protections.
- Deposit an amount you can afford to lose, if you proceed.
- Place no material trade until you have tested a small withdrawal over the intended network.
- Record the request time, review messages, fees and arrival time, then compare them with the published policy.
- Close the test position and confirm that the final balance, fees and withdrawal records reconcile with your own ledger.
5. Evaluate the perpetuals contract and market rules
Perpetuals are not interchangeable. For every contract you might trade, record the collateral asset, maximum leverage, margin mode, maintenance-margin formula, mark and index price sources, funding interval and settlement method. Note whether collateral can be cross-margined across positions or isolated per position, and whether unrealized gains can be withdrawn before settlement.
Understand funding and pricing inputs
Funding payments transfer value between long and short positions according to the venue’s published mechanism. Record the interval, calculation reference, payment timestamp, cap or floor, and which side pays under positive or negative funding. A displayed annualized estimate can change rapidly; model the actual intervals during your planned holding period. Compare the mark price used for margin with the index constituents and fallback process, because liquidation can depend on the mark rather than the last traded price.
Read liquidation and outage provisions
- What price or margin condition triggers liquidation?
- Can the venue partially liquidate, apply auto-deleveraging or use an insurance fund?
- Who bears losses if the insurance fund is insufficient?
- How are prices and liquidations handled during an oracle failure, market halt or extreme volatility?
- Can orders be cancelled, trades reversed or settlements delayed?
- Are bankruptcy prices and remaining collateral calculated per position, account or insurance pool?
Review asset-admission, trading-halt, order-cancellation, settlement and conflict-of-interest rules. MiCA Article 76 describes transparent operating rules, fair and non-discriminatory fees, and procedures for orderly trading and settlement for covered EU platforms. Its existence does not prove that a particular exchange complies.

6. Calculate the total cost of a real trade
Model the complete entry, holding period and exit rather than comparing one advertised fee. For the intended position size and duration, estimate:
- Maker and taker commissions.
- Bid/ask spread and expected slippage at your order size.
- Funding payments for each interval, including the direction in which you pay or receive.
- Conversion, deposit and withdrawal charges.
- Blockchain network fees and any custody, inactivity or account charges.
Use a simple worksheet: total cost = entry commission + entry spread and slippage + funding paid − funding received + exit commission + exit spread and slippage + conversion and transfer charges + withdrawal fee and network charge. Keep estimates separate from amounts that are fixed in the published schedule. If you may use different collateral or convert between assets, calculate each conversion path rather than assuming the quoted pair is frictionless.
Repeat the calculation for the expected exit and withdrawal route. Include the possibility that a network is temporarily suspended or that a fee changes by congestion. A low maker fee can be outweighed by a wide spread, poor depth, unfavorable funding or an expensive transfer. SEC custody guidance specifically identifies transaction and asset-transfer fees as costs to ask about; MiCA Article 76 addresses transparent fee structures for in-scope trading platforms.

Create one dated record for each candidate. Use “not stated” where the operator has not disclosed a material fact instead of filling the gap with an assumption. Keep links or copies of the exact page because fee schedules, supported networks and market availability can change.
| Axis | Evidence to compare |
|---|---|
| Legal status | Contracting entity, your jurisdiction, permitted activity and current regulator entry |
| Customer-asset rights | Key control, segregation, reuse or lending, custodian chain and insolvency treatment |
| Financial transparency | Report date and scope, assets and liabilities, assurance provider and audit status |
| Perpetuals mechanics | Collateral, leverage, funding, margin, liquidation and outage rules |
| Market quality | Spread, depth at your order size, execution and settlement evidence |
| Security and continuity | Authentication, withdrawal controls, incident disclosures, recovery and availability evidence |
| Access to funds | Supported networks, limits, delays, fees and suspension policy |
| Total cost | Trading fees, spread, slippage, funding, conversion, transfer and custody charges |
Do not collapse these dimensions into a single “safe exchange” score unless the scoring method, weights and evidence are explicit. Low fees do not compensate for opaque custody, and a license in one jurisdiction does not establish protections in yours. A platform can rank well on execution while remaining weak on insolvency disclosures; show those trade-offs instead of averaging them away.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.8. Decide whether unresolved risk is acceptable
Stop before depositing if you cannot identify the contracting entity, verify authorization for the service in your location, determine your rights to assets on insolvency, obtain a credible withdrawal route or calculate the main costs. Also stop if the platform refuses to explain leverage, liquidation, funding or outage rules, or if its disclosures conflict with the legal terms.
Unresolved facts should be written down separately from verified facts. Examples include an unnamed custodian, incomplete liabilities in a reserves report, no stated treatment of customer assets in insolvency, unsupported withdrawal networks, or unclear authority to suspend or reverse trades. Do not convert silence into a favorable interpretation.

If the remaining uncertainty is acceptable for your circumstances, limit exposure, keep only trading collateral on-platform, maintain independent records and reassess when terms, fees, ownership, regulators or market conditions change. Set a personal trigger for reducing exposure, such as a material change in custody terms, a prolonged withdrawal suspension or a change in the legal entity. These checks reduce uncertainty; they cannot guarantee continued solvency, liquidity or availability.
9. A practical pre-deposit workflow
- Identity: Copy the contracting legal name, registration details, jurisdiction and regulator-register result.
- Eligibility: Confirm that perpetual derivatives are offered lawfully to your location and client category.
- Documents: Save the terms, custody agreement, fee schedule, market rules and risk disclosures with their dates.
- Asset rights: Answer who controls keys, whether assets may be reused, and what happens in insolvency.
- Evidence: Evaluate reserves reports, liabilities disclosures, audit scope and provider qualifications.
- Market test: Observe the intended contract’s spread, depth, funding and liquidation documentation.
- Withdrawal test: Use a small amount and the exact network you expect to use later.
- Cost model: Calculate entry, holding, exit and transfer costs for the actual position size.
- Review: Record unanswered questions and decide whether the residual risk fits your loss tolerance.
This sequence prevents a common mistake: opening with a low advertised fee, depositing first, and only later discovering that the counterparty, withdrawal rights or liquidation process is unclear.
Frequently Asked Questions
Is a proof-of-reserves report enough to show that an exchange is safe?
No. It may be a point-in-time asset snapshot, omit liabilities or movements between snapshots, and say nothing about creditor priority. Check its scope, methodology, assurance level and liabilities coverage, then review custody terms, legal status and withdrawal evidence as well.

Does registration as a money-services or anti-money-laundering business authorize perpetual futures?
Not automatically. Verify the exact regulator entry and the activities it permits. A corporate filing or permission for spot services does not establish authorization for derivatives, custody or every exchange function.
What should I learn about custody before depositing?
Identify who controls private keys, whether a custodian or sub-custodian is used, how balances are recorded, whether assets may be lent or pledged, whether assets are segregated, and what claim and priority customers have if the operator fails.
Can a hardware wallet protect funds held on an exchange?
No. A hardware wallet protects assets only after withdrawal to an address you control. It transfers private-key, backup and recovery responsibility to you and cannot prevent an exchange from freezing or failing to return assets left on-platform.
How can I test withdrawals without taking unnecessary risk?
Read the limits, holds, supported networks and address-change rules first. If you proceed, use an amount you can afford to lose, send over the intended network, record the request and transaction details, and compare arrival time and fees with the published policy.
What perpetuals rules deserve the closest review?
Check collateral and margin mode, leverage limits, maintenance-margin calculation, mark and index prices, funding interval and direction, liquidation triggers, partial liquidation, auto-deleveraging, insurance-fund treatment, and procedures for oracle failures, halts and extreme volatility.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsWhy is headline trading volume not enough?
Volume does not show the price available for your order. Inspect spread and order-book depth at your expected size, estimate entry and exit slippage, and record the date because liquidity and funding conditions change.
What costs should be included in a comparison?
Include maker or taker fees, spread, slippage, funding payments, conversion, deposit and withdrawal fees, network charges, and any custody, inactivity or account fees. Model the complete entry, holding and exit path.
Does an EU MiCA reference prove that an exchange complies?
No. MiCA Articles 75 and 76 describe requirements within their legal scope, including custody policies, client-position records and transparent operating rules. You still need to verify the particular entity, authorization and current disclosures.
When should I refuse to deposit?
Refuse when you cannot identify the contracting entity, verify authorization where you live, determine asset rights in insolvency, obtain a workable withdrawal route, calculate major costs, or understand leverage, liquidation, funding and outage rules.

The Bottom Line
Deposit only after you can name the liable entity, verify the relevant authorization, explain custody and insolvency treatment, evaluate reserves and liabilities critically, understand perpetuals and outage rules, test a withdrawal route, and calculate total costs. Keep exposure limited and reassess whenever the exchange changes its terms, ownership, fees, markets or withdrawal conditions.
