How to Estimate Inheritance Tax Before Accepting an Inheritance

Start with the country whose tax law governs the deceased’s estate. “Inheritance tax” and “estate tax” are not worldwide terms for one calculation. In the United Kingdom, tax is generally paid from estate funds by the executor or administrator before beneficiaries receive assets. A beneficiary normally does not owe tax merely for accepting an inheritance. The United States uses a federal estate-tax system that calculates tax on the estate and lifetime taxable gifts, with separate state and cross-border rules.

To estimate the liability, establish the jurisdiction and date of death, list every potentially taxable asset at its date-of-death value, subtract allowable debts and expenses, account for lifetime gifts and property passing to a spouse or charity, apply the correct threshold and reliefs, and then check filing and payment deadlines. The result is an estimate of the estate’s liability—not automatically a bill you must pay personally.

What “before accepting an inheritance” actually means

Accepting inherited property is usually not the event that creates an inheritance-tax bill. The tax is generally assessed on the deceased person’s estate, and the personal representative deals with the tax before distributing what remains. In the UK, HM Revenue & Customs (HMRC) says, “You do not usually owe any tax on an inheritance at the time you inherit it.”

There are exceptions. HMRC may contact a beneficiary about tax connected with certain gifts made in the seven years before death, an unpaid liability of a trust, or an estate representative who failed to pay. Those exceptions are different from a general rule that every heir pays tax on receipt.

Tax that arises after you inherit is a separate question. Interest, rent or dividends produced by inherited assets can be taxable income. If you later sell an inherited house, shares or another asset for more than its relevant tax value, capital-gains rules may apply. An inheritance-tax estimate does not answer either of those later questions.

Identify the governing jurisdiction before doing any arithmetic

Record these facts before opening a calculator:

  • Where the deceased lived and, where the law uses it, their domicile or residence.
  • The deceased’s citizenship and whether they were a citizen or resident of another country.
  • The location of each asset and any property outside the home country.
  • The date of death.
  • Where the estate is being administered and which personal representative is responsible.

These details can change what is included, which deductions are available and whether a state, local or nonresident return is required. The UK figures below are a headline screen, not a universal rule. The US figures are federal rules for the relevant year; a US state may impose its own estate or inheritance tax, and a nonresident estate can follow different filing rules.

Who normally pays?

United Kingdom

The executor or administrator normally arranges the UK estate’s Inheritance Tax payment from estate funds, often before assets are distributed. A beneficiary who simply receives cash, a home or investments usually does not pay tax merely because they accepted them. The beneficiary can become involved if a qualifying exception applies or if the representative did not settle the estate’s liability.

United States

US federal estate tax is computed against the estate. The executor files Form 706 when required and uses estate assets to pay the tax. The person inheriting property is not automatically the taxpayer for federal estate tax, but state inheritance taxes, state estate taxes and later income or gains can create separate obligations.

Build a defensible estate inventory

An estimate is only as reliable as the inventory and values behind it. Create a schedule for each asset with its owner, ownership percentage, beneficiary, location, valuation date and supporting document.

Assets to investigate

  • Homes, land and other real estate.
  • Bank and savings accounts, including joint accounts.
  • Shares, bonds, funds, pensions and brokerage accounts.
  • Life-insurance policies and death benefits that the governing law includes.
  • Business interests, partnership interests and agricultural property.
  • Personal property of significant value, such as vehicles, collections or jewelry.
  • Trust interests and assets the deceased could control or benefit from.
  • Debts owed to the deceased and assets held partly rather than wholly by them.

The US Internal Revenue Service describes the gross estate as property owned wholly or partly at death and certain other interests. UK estate-estimation guidance likewise requires valuations for assets such as housing. Do not use an old purchase price or an informal guess when a professional valuation, account statement or market evidence is available.

Use the date-of-death value

Value assets at the legally relevant date—normally the date of death for the rules discussed here—not the date you accept them or a later sale date. Keep bank statements, investment statements, property appraisals, business accounts and insurance documents. If a value is uncertain, record a reasonable range and identify what evidence would narrow it; a property or private-company valuation can materially change the tax result.

Record debts, expenses and transfers

Liabilities and administration costs

List mortgages, credit balances, personal loans, unpaid bills and other enforceable debts outstanding at death. Also identify administration expenses and funeral costs, because the governing law may allow some of them as deductions. A debt secured on a property should be shown separately from the property’s gross value so that you can see both figures and avoid subtracting it twice.

Property passing to a spouse or charity

Mark every asset that passes to a surviving spouse or civil partner and every qualifying charitable gift. UK rules generally provide that no Inheritance Tax is normally due on the part passing to a spouse or civil partner or to charity, subject to the law’s conditions. US federal estate-tax rules allow deductions that can reduce the gross estate to the taxable estate, including qualifying transfers to a spouse or charity.

Lifetime gifts

Ask for a seven-year history of gifts and transfers. For a UK estimate, gifts made during the seven years before death can affect the calculation and may create the exception in which HMRC contacts a beneficiary. Record the date, recipient, amount or asset, value when given and any relief claimed.

For US federal estate tax, adjusted taxable gifts are brought into the computation even though they are no longer owned at death. A lifetime-gift file should therefore include prior gift-tax returns, split-gift elections and records of gifts made on behalf of another person.

Apply UK headline thresholds and reliefs

GOV.UK states that the standard UK threshold is £325,000 and the standard rate is 40% on the part above the applicable threshold. This is a screening calculation only; the actual threshold can be higher or the taxable amount lower after exemptions, reliefs, deductions and transferred allowances.

Residence-related allowance

A residence-related allowance can raise the effective threshold to £500,000 where a qualifying home is left to direct descendants, including children, adopted, foster or stepchildren, or grandchildren. Confirm that the home, recipient and estate meet the current eligibility rules. The allowance is not a blanket £175,000 addition for every estate.

Transferred unused threshold

Unused threshold from a deceased spouse or civil partner can transfer to the survivor. The personal representative must establish what percentage was unused and provide the evidence required to claim it. Do not simply add two £325,000 figures without checking the first spouse’s estate and any prior gifts.

Other UK reliefs

  • Transfers to a spouse or civil partner, where the exemption applies.
  • Qualifying charitable gifts. In some cases, giving the required proportion to charity can reduce the rate on the relevant estate to 36%.
  • Business relief for qualifying business interests.
  • Agricultural relief for qualifying agricultural property.
  • Reliefs affecting lifetime gifts or particular types of property.

Eligibility depends on ownership, holding periods, the nature of the business or land and other conditions. Treat each relief as a fact-checking exercise, not an automatic deduction.

Simplified UK illustration

Suppose an estate’s relevant taxable amount is £500,000, the applicable threshold is £325,000, and no spouse, charity, residence, gift or other relief changes the result. The amount above the threshold is £175,000. At 40%, the simplified estimate is £70,000. This mirrors the arithmetic in the official example; it is not a personalised calculation and does not establish that a real estate qualifies for the same threshold or rate.

Understand the US federal comparison

The US federal calculation follows a different structure:

  1. Identify the gross estate, including property owned wholly or partly at death and other interests included by federal law.
  2. Subtract allowable deductions to reach the taxable estate. Deductions can include qualifying transfers to a spouse or charity and certain debts and expenses.
  3. Add adjusted lifetime taxable gifts to the computation.
  4. Apply the unified credit and other available credits to determine federal estate tax due.

For a US citizen or resident who dies in 2026, the IRS lists a $15,000,000 filing threshold based on the gross estate plus adjusted taxable gifts and the specific exemption. That figure is not a universal statement that every estate below it has no filing obligation. An executor may file to elect portability of a deceased spouse’s unused exclusion, and nonresident estates can face different rules.

Home and family treatment Residence-related allowance may raise the threshold to £500,000 when a qualifying home passes to direct descendants; unused allowance may transfer from a spouse or civil partner. Federal results depend on deductions, credits, marital status, citizenship or residence and lifetime gifts; state rules may differ.
Charity and spouse Transfers to a spouse or civil partner or qualifying charity can remove value from the taxable amount under the applicable conditions. Allowable marital and charitable deductions can reduce the taxable estate.
Other reliefs Business and agricultural reliefs may apply if detailed conditions are met. Federal and state treatment must be checked separately for business, farm and other assets.
Filing and payment timing Where full details are required or tax is due, IHT400 is reported within 12 months of death under the 7 April 2026 Commons Library briefing; payment should begin by the end of the sixth month to avoid interest on later payments. Separate the estimate from reporting and payment

UK administration

Some UK estates must be reported even when no tax is ultimately payable. The 7 April 2026 House of Commons Library briefing states that where full details are required or tax is due, the IHT400 should be sent within 12 months of death. It also reports that payment should start by the end of the sixth month after death to avoid interest on subsequent payments. Confirm the current HMRC route for the particular estate, because reporting requirements depend on the assets, gifts, reliefs and circumstances.

US federal administration

The IRS July 2026 Form 706 instructions generally require filing within nine months after death. Estate and generation-skipping transfer taxes are generally due within nine months, although an extension to file and special payment elections may be available. An extension to file does not automatically eliminate interest on tax that remains unpaid.

A practical worksheet you can complete before accepting assets

  1. Write the jurisdiction at the top. Note residence or domicile, citizenship, asset countries, date of death and the estate’s administration location.
  2. Create an asset ledger. For every item, enter owner, percentage, date-of-death value, beneficiary, location and evidence.
  3. Create a liability ledger. Record mortgages, debts, funeral costs and administration expenses, identifying which are potentially deductible.
  4. Mark transfers. Separate spouse or civil-partner transfers, charitable gifts, trust interests and assets with named beneficiaries.
  5. Request gift records. Gather seven-year UK gift information and US lifetime-gift returns or schedules where relevant.
  6. Test reliefs one by one. Check the qualifying home, transferred allowance, business or agricultural property, charity rate and any other relief under the governing law.
  7. Run the jurisdictional formula. Keep gross values, deductions, gifts, allowances, rates and credits in separate lines so another person can audit the arithmetic.
  8. Check filing before distribution. Ask the personal representative which return is required and whether tax must be paid before a particular asset can be released.
  9. Keep a tax reserve. Do not distribute or spend disputed cash, sale proceeds or uncertain relief amounts until the representative has allowed for tax, interest and professional costs.

When a professional review is especially important

  • The deceased owned property, accounts or a business in more than one country.
  • Property is jointly owned, held in trust or subject to a life-interest arrangement.
  • There were substantial gifts, transfers into trust or family loans during the seven years before death.
  • A home, farm or business-relief claim is central to the estimate.
  • The estate includes a private company, valuable collection or land without a recent arm’s-length valuation.
  • The executor is considering a US portability election or a nonresident filing.
  • Beneficiaries disagree about values, ownership or who should bear a tax payment.

The personal representative remains responsible for obtaining the estate information and meeting the applicable filing duties. A qualified adviser in the governing jurisdiction can test valuations, relief eligibility and cross-border credits; an heir should not assume that accepting an asset transfers the estate’s administrative role to them.

How much work is involved?

Estate administration can be a substantial project even when the final tax is zero. The House of Commons Library briefing dated 7 April 2026 reports an Office of Tax Simplification 2018 survey finding that 38% of respondents who did not use an adviser spent 50 hours or more administering an estate. That statistic describes administration time, not a typical tax bill or a prediction for every estate.

Final decision before you accept

Do not make an acceptance decision based on a headline threshold alone. First obtain the date-of-death inventory, liabilities, gift history and proposed relief claims from the executor or administrator. Then identify whether the estate is being handled under UK rules, US federal rules or another system, and ask which return and payment deadline applies. If the estimate depends on an uncertain property value, a cross-border asset or a relief claim, treat the number as provisional until the representative or a qualified local adviser confirms it.
