How to Escalate an Insurance Complaint to an Ombudsman in India (with a UK Comparison)

For an India-based complaint, start with a dated written complaint to the insurer or broker. If the reply is unsatisfactory, or there is no reply within 30 days, check the Insurance Ombudsman scheme’s eligibility, ₹50 lakh value ceiling and one-year filing trigger, then submit a complete case to the correct Ombudsman office. The Financial Ombudsman Service in the UK follows a different route, generally using an eight-week wait for a final response.

An Ombudsman is a dispute-resolution channel, not the same as the insurance regulator. In India, the Insurance Ombudsman considers eligible disputes under its scheme; the Insurance Regulatory and Development Authority of India (IRDAI) can facilitate re-examination by an insurer. Keep those routes separate and do not assume that contacting the regulator pauses an Ombudsman deadline.

What to do first

Put the complaint to the insurer or insurance broker in writing before approaching an Ombudsman. Identify the policy, claim and disputed decision; explain the facts and the policy wording you rely on; state the remedy you want; and retain proof that the complaint was sent.

For India, the Council for Insurance Ombudsmen (CIO) procedure requires this prior representation. You can move to the Ombudsman if the insurer rejects the complaint, gives an answer you consider unsatisfactory, or does not respond within one month (30 days). The normal filing period is one year from the relevant rejection or unsatisfactory decision. If there is no response, the period generally runs from the expiry of one month after you sent the representation. Confirm the current CIO rules before filing because amendments and portal instructions can change.

For the UK example covered here, the Financial Ombudsman Service (FOS) says to make a formal complaint to the financial business first. Its private medical and dental insurance guidance allows referral after an unsatisfactory final response or after eight weeks without a final response. That guidance should not be treated as a universal rule for every UK insurance product or for another country.

What an insurance Ombudsman does

An Ombudsman provides an alternative dispute-resolution route for disputes within its legal or scheme rules. It is not automatically a court, an insurer’s internal complaints team or a regulator. Eligibility depends on the complainant, product, subject of the dispute, value and timing.

In India, the Insurance Ombudsman scheme is designed for specified policyholder disputes. The Ombudsman route can address matters such as claim delay, partial or total repudiation, premium disputes, misrepresentation of policy terms, policy servicing, policy issuance that does not match the proposal, and non-issuance after premium payment, along with other matters listed in the applicable rules.

IRDAI’s grievance department has a different role. It can take up a complaint with the insurer, seek re-examination and facilitate resolution. IRDAI guidance says a complainant who remains dissatisfied may approach the Insurance Ombudsman or an appropriate legal authority. A regulator contact does not, on the information available here, replace the Ombudsman’s filing requirements or stop its limitation clock.

India: check whether the Ombudsman scheme covers you

Eligible complainants and policies

The scheme is not a universal forum for every commercial or contractual dispute. The government overview describes coverage for personal-line policies, group policies, sole proprietorships and micro-enterprises, subject to the scheme’s definitions and conditions. Verify that your status and policy fall within the current rules before investing time in a filing.

Eligible types of dispute

Examples of issues identified in the scheme materials include:

  • Delay in settling an insurance claim.
  • Partial or total repudiation of a claim.
  • Disputes over premiums.
  • Misrepresentation of policy terms.
  • Disputes about how a claim-related policy term should be interpreted.
  • Policy-servicing failures.
  • A policy issued on terms inconsistent with the proposal.
  • Failure to issue a policy after premium payment.
  • Other regulatory or policy-contract matters specifically included in the current rules.

Whether a particular complaint qualifies depends on the facts and the current scheme text. An Ombudsman is not a substitute for proceedings that require a court’s powers, nor a general appeal against every commercial decision.

Value ceiling

Current CIO procedure guidance states that the value of the compensation or claim, including expenses, must not exceed ₹50 lakh. Older indexed consumer material may show ₹30 lakh, but the CIO’s current procedure and FAQs state ₹50 lakh. Use the current CIO-published rule and check for a newer amendment at the time you file.

India: step-by-step escalation

1. Send a formal complaint to the insurer or broker

Use the insurer’s grievance-redressal email address, online complaint process or other written channel. Address the complaint to the insurer or broker responsible for the policy or claim. Include:

  • Your name and contact details.
  • Policy number, claim number and relevant dates.
  • The insurer’s branch or office and the name of the product.
  • A short chronology of what happened.
  • The decision, delay or omission being challenged.
  • The policy clauses, proposal information or correspondence supporting your position.
  • The precise outcome requested, such as payment of an admitted claim amount, reconsideration of a repudiation, correction of a policy record or a refund.

Save the sent email, portal confirmation, acknowledgement, complaint number, attachments and every reply. If you speak by telephone, record the date, number called, representative’s name if provided and a factual note of what was said; then confirm the important points in writing.

2. Record the response trigger

For the CIO route, note the date on which you receive a rejection or unsatisfactory decision. If the insurer does not respond, note the date your written representation was sent and the date one month later. The one-year period is tied to the applicable event, so do not calculate it from the date of loss alone unless the current rules say that is the trigger for your case.

Keep a calendar reminder well before the one-year point. Do not assume that an IRDAI complaint, a telephone conversation or an informal promise of review extends the period. Ask the CIO or a qualified adviser if the trigger is unclear.

3. Confirm scope, value and jurisdiction

Check the current CIO procedure, rules and jurisdiction directory. Territorial jurisdiction is linked to the insurer’s office or branch complained against or to the complainant’s residence or place of residence, as provided by the rules. The Department of Financial Services lists 17 Insurance Ombudsman centres in India; the correct office should be selected from the current CIO directory rather than inferred from a general city list.

4. Build an organised evidence file

Prepare a chronological index and name files clearly. A claim dispute may require:

  • Policy schedule, certificate and complete wording, including endorsements and exclusions.
  • Proposal form, declarations and premium receipts.
  • Claim form, acknowledgement and claim number.
  • The insurer’s survey, assessment, query, repudiation or settlement letter.
  • Your original complaint and the insurer’s final or interim response.
  • Receipts, invoices, estimates, photographs, repair records or medical records relevant to the loss.
  • A calculation showing the amount claimed and how each figure is supported.
  • Valid identity and address proof.
  • Proof of submission and any delivery or portal acknowledgement.

Submit readable copies and retain originals. Include only records relevant to the disputed issue, especially where medical, financial or identity information is sensitive. A short timeline helps the decision-maker find the important documents without guessing which version is current.

5. State the loss and remedy

The CIO filing requirements call for the nature and extent of loss and the relief sought. Quantify the amount where possible and separate undisputed amounts from amounts still contested. If you seek a non-monetary correction, describe the exact record, policy term or action that should be changed.

6. File with the CIO

CIO materials describe online and offline routes, including electronic submission, email, post and walk-in communication. Use the current complaint portal or contact instructions and select the office with territorial jurisdiction. A written or electronic complaint should identify both parties, set out the facts, attach supporting documents and be signed or otherwise authenticated as required.

Before submitting, check that the policy number, insurer name, dates and amount are consistent across the form and attachments. Keep the portal acknowledgement, email receipt, postal tracking record or stamped copy and note the reference number. If the CIO asks for clarification, answer each question directly and preserve a copy of your response.

7. Continue to preserve the record

Keep a single folder containing the filed complaint, acknowledgement, subsequent correspondence and any additional evidence. Do not send conflicting versions of the facts. If new information changes the amount or remedy, explain what changed and why.

India filing checklist

  • Prior written complaint to the insurer or broker.
  • Insurer rejection, repudiation or unsatisfactory response, or proof that 30 days passed without a response.
  • One-year deadline calculated from the applicable event.
  • Policy and claim identifiers.
  • Policy wording, schedule, proposal and endorsements.
  • Chronology of events.
  • Relevant correspondence and call notes.
  • Evidence of the loss and a transparent calculation.
  • Valid identity and address proof.
  • Specific remedy requested.
  • Correct CIO office and current filing channel.
  • Proof of Ombudsman submission and reference number.

India: Ombudsman versus IRDAI escalation

These channels can coexist, but they perform different functions.

Point Insurance Ombudsman IRDAI grievance channel
Primary role Dispute resolution for complaints within the Ombudsman scheme Facilitates insurer review, re-examination and resolution
First prerequisite Prior representation to the insurer or broker Follow the current IRDAI grievance guidance and portal process
India non-response threshold in the reviewed guidance One month or 30 days after the insurer representation The published guidance describes escalation where the insurer has not resolved the complaint within the stated period or the consumer remains dissatisfied
Value and eligibility Scheme eligibility applies; current CIO procedure states a ₹50 lakh ceiling including expenses Those Ombudsman value and scope limits do not automatically define the regulator channel
Effect on Ombudsman deadline Calculate under the CIO rules Do not assume an IRDAI complaint pauses or extends the Ombudsman period

IRDAI guidance says that if the insurer does not resolve the complaint to the complainant’s satisfaction, the complainant can escalate to IRDAI and may later approach the Insurance Ombudsman or an appropriate legal authority. Use the current IRDAI portal and contact instructions because response intervals and submission details can change.

India and the UK are not interchangeable

Process point India: Insurance Ombudsman UK example: Financial Ombudsman Service
First step Written or electronic representation to the insurer or insurance broker Formal complaint to the financial business
No-response threshold 30 days or one month in the reviewed CIO guidance Eight weeks without a final response in the reviewed private medical and dental insurance guidance
Timing after a decision Generally one year from the relevant rejection or unsatisfactory decision The reviewed page does not establish a comprehensive limitation rule for every UK insurance complaint
Value and scope Current CIO procedure states a ₹50 lakh ceiling including expenses; scheme and complainant eligibility also apply Eligibility depends on FOS rules and the complainant and business status; the cited guidance concerns private medical and dental insurance
Evidence approach Complaint, policy, insurer response, loss, remedy and supporting documents FOS may consider evidence from the consumer, business and relevant third parties, along with policy terms, law, regulation, guidance, industry codes and good industry practice where appropriate

Do not transplant India’s 30-day threshold, ₹50 lakh ceiling or one-year trigger into the UK. Conversely, do not use the UK eight-week example as an India deadline. If you are elsewhere, identify the ombudsman for your country and verify its jurisdiction, product scope, response threshold, value rules and limitation period.

Common mistakes and how to correct them

Waiting for a telephone promise

A call may help resolve a problem, but it is a weak record for a deadline-sensitive dispute. Send a written confirmation and request a written decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Filing before contacting the insurer

The CIO rules require prior representation. Submit the internal complaint first and retain proof, even if the claim has already been rejected by a claims department.

Using the wrong deadline

Do not count from the accident, hospital discharge or policy expiry automatically. For India, identify the rejection or unsatisfactory decision, or the end of the one-month no-response period, and calculate from the applicable trigger.

Relying on an outdated value limit

Older material may state ₹30 lakh. The current CIO procedure and FAQs cited here state ₹50 lakh including expenses. Check the live rules before filing.

Sending an incomplete bundle

A complaint that says “claim rejected unfairly” without the policy wording, decision letter, amount and requested remedy forces the reviewer to reconstruct the case. Use an index and a short chronology.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choosing an office by guesswork

The existence of 17 centres does not mean any centre can hear any complaint. Use the current CIO jurisdiction instructions based on the insurer’s office or your residence.

Treating the regulator as an appeal court

IRDAI can facilitate insurer review, but its process is distinct from the Ombudsman’s dispute-resolution route. Keep both reference numbers and deadlines separate.

Submitting irrelevant sensitive data

Provide records that prove the disputed issue and amount. Redact or omit unrelated personal information where the filing rules permit, while preserving documents needed to establish the claim.

A practical complaint structure

Use a clear subject line such as Request for Insurance Ombudsman referral — policy [number] — claim [number] only when you are filing with the Ombudsman. Organise the document in this order:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Parties: your name and address, insurer or broker name and office, policy and claim numbers.
  2. Chronology: policy purchase, loss, claim notification, insurer requests, decision and internal complaint dates.
  3. Issue: the exact delay, rejection, premium dispute or servicing failure.
  4. Policy basis: the clause, schedule entry or proposal statement that supports your position.
  5. Evidence index: numbered attachments with short descriptions.
  6. Loss calculation: each amount, source and total, including any expenses counted under the applicable rules.
  7. Relief sought: the payment, correction, reconsideration or other specific result requested.
  8. Declaration and signature: complete the current CIO form’s required declarations and authentication.

Keep the narrative factual. Explain why the insurer’s stated reason does not fit the policy or evidence, rather than alleging misconduct that you cannot support.

When to obtain legal advice

Consider independent legal advice if the dispute is outside the Ombudsman scheme, exceeds the value ceiling, involves complex liability or fraud allegations, requires urgent court relief, or has a limitation issue you cannot resolve from the current rules. An Ombudsman filing does not guarantee payment, a particular award or a specific resolution time. Preserve all legal and contractual deadlines while exploring the complaint route.

Official scope and freshness notes

The Department of Financial Services page identifying 17 Ombudsman centres was updated on 23 January 2026. The CIO procedure and rules used here were amended through 9 November 2023, and the CIO complaint page supplies the filing-material guidance. The FOS example concerns private medical and dental insurance and was accessed on 13 October 2026. Because portals, contacts and rules can change, verify the current CIO, IRDAI or FOS instructions immediately before submitting.
