Document gender discrimination as it happens: keep a dated, factual incident log; preserve original records and their context; identify comparable employees and observable differences; and maintain a separate timeline for every report and any retaliation. Then submit a short, evidence-based complaint through the channel in your employer’s policy, retain proof of delivery, and check the filing deadline for your jurisdiction immediately.
What gender discrimination can look like
Gender discrimination is unfavorable treatment because of sex, pregnancy, gender identity or sexual orientation, depending on the law that applies to your workplace. It can arise in hiring, pay, promotion, scheduling, assignments, discipline, performance reviews, termination, leave, accommodations or access to training. Sexual harassment is also a form of sex discrimination. Punishing someone for opposing discrimination or participating in a complaint can be unlawful retaliation.

A strong record does not have to prove your entire case by itself. Its purpose is to preserve what happened, when it happened, who was involved and how the employer responded so that an investigator, agency or court can test the facts later. A contemporaneous, factual record is generally more useful than a narrative reconstructed months afterward.

Use a contemporaneous incident log
Create one private log and update it promptly after each event. A spreadsheet, dated document or bound notebook can work. For every entry, record:
#1 Best Overall
- Date and time: include the time zone or shift when relevant.
- Location and setting: office, video call, text message, meeting, worksite or hiring process.
- People involved: identify the decision-maker, participants and anyone who was present.
- Exact words or conduct: quote words you remember and describe actions without embellishment.
- Decision or consequence: for example, a schedule change, denied opportunity, disciplinary warning or pay decision.
- Why sex or gender may be relevant: connect the event to an explicit statement, a pattern, a comparator or a policy—not a guess about someone’s private motive.
- Witnesses and records: list people who observed the event and documents that could verify it.
- Effect on your work: note missed shifts, lost pay, reassigned duties, performance impact, health effects or other concrete consequences.
Separate what you personally saw or heard from what another person told you. Label the latter as information received from that person, and identify when and how you received it. The U.S. Equal Employment Opportunity Commission (EEOC) recognizes notes made after a harassment incident as potentially relevant evidence, especially when they are reliable and consistent.
Preserve originals and their context
Keep the original file whenever possible and make a read-only copy for reference. Record when and how you obtained each item. Preserve the surrounding context rather than saving only a cropped excerpt.
- Emails, text messages, chat messages and calendar invitations.
- Schedules, time records, pay statements and bonus or commission information.
- Job descriptions, hiring criteria, performance reviews and disciplinary notices.
- Relevant handbook pages, anti-harassment policies, grievance procedures and accommodation policies.
- Medical or accommodation communications that you are lawfully entitled to keep.
- Meeting invitations, agendas, notes and follow-up messages confirming what was decided.
Do not alter screenshots. Keep the full message thread, sender and recipient information, date and time, and any attachments. The EEOC’s evidence guidance emphasizes preserving original documents and reliable business records.

Use a secure personal location only when lawful and consistent with your employer’s policy. Do not remove trade secrets, privileged communications, customer information or another person’s sensitive data merely to build a file. Keep only material you are permitted to access and retain. Do not secretly record a conversation until you have checked the consent law where the conversation occurs; recording rules differ by location. A local employment adviser can explain the rule that applies to your situation.
Build evidence that can be checked
Document comparators carefully
A comparator is a coworker or applicant whose role, qualifications, conduct or circumstances are sufficiently similar to make a treatment difference meaningful. Record observable facts:
Rank #2
- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
- Role, level, location, shift and reporting line.
- Relevant qualifications, performance history, attendance or stated policy violations.
- Pay, schedule, assignments, opportunities, discipline or promotion decisions.
- The decision-maker and the stated reason for each decision.
- Documents or witnesses who can verify the comparison.
Avoid declaring that two people are identical or assigning a motive you cannot support. Explain the difference you observed and why the comparison may be relevant. Comparative evidence, suspicious timing and evidence that an employer’s stated reason is false can matter in a retaliation analysis, according to EEOC guidance.
Keep a reporting timeline
Make a second timeline for every report, separate from the incident log. For each contact, record:
- Date, time, channel and recipient.
- What you reported, including the protected characteristic or policy at issue.
- Any case, ticket or reference number.
- Promises about investigation, interim measures or follow-up.
- The response, lack of response and date of the response.
Check the employer’s anti-harassment or grievance policy and use its listed reporting options when doing so is safe. If the alleged wrongdoer is your manager, use another channel named in the policy, such as HR, an ethics line, another manager or a union representative.
Track retaliation as its own case
Start a retaliation log immediately after you oppose discrimination, participate in an investigation or otherwise make a protected report. For each later event, record the date, decision-maker, exact words, change from your prior treatment, comparator information, witnesses and supporting records. Examples include:
- Sudden schedule changes, exclusion from meetings or removal of duties.
- Threats, hostile comments, discipline or unusually negative reviews.
- Lost assignments, reduced hours, pay changes or blocked opportunities.
- Warnings about termination or an actual termination.
Note the timing between your report and the adverse action, any statement referring to your complaint, different treatment of comparable employees and explanations that conflict with earlier records. EEOC identifies timing, retaliatory statements, comparative evidence and false explanations as possible evidence; none is automatically conclusive, so preserve the underlying facts.

Write an effective internal complaint
A useful complaint is short enough to read and specific enough to investigate. Put incidents in date order and distinguish facts you observed from conclusions. Include:
- Purpose: state that you are reporting possible sex or gender discrimination, harassment or retaliation under the policy or law you believe applies.
- Incidents: give dates, people, exact words or conduct and the decision or harm that followed.
- Pattern or comparison: identify similarly situated people and the observable difference in treatment.
- Evidence: list documents and witnesses, and explain where originals are preserved.
- Work impact: describe lost pay, opportunities, duties, schedule, safety or performance effects.
- Requested action: ask for an impartial investigation, preservation of relevant records, correction of the decision or another specific remedy supported by the facts.
- Anti-retaliation request: ask for protection from retaliation and a contact for reporting any further incident.
Use neutral language. Instead of writing that a manager is sexist, write what the manager said or did, who received an opportunity, what policy or criterion was cited and how the treatment differed. Attach a concise index of evidence rather than sending an unorganized archive.

1. Incident (date, time, location): [facts, exact words or conduct, people involved]
2. Decision or impact: [pay, schedule, assignment, discipline, opportunity or other effect]
3. Related comparison or pattern: [observable treatment of a similarly situated person]
4. Witnesses and documents: [names and file descriptions; originals preserved at a lawful location]
Additional incidents are listed below in date order: [brief entries].
I request an impartial investigation, preservation of relevant records, and written information about next steps. Please confirm receipt and identify the investigator or contact person. I also request protection from retaliation and instructions for reporting any further concern.
Name, job title, work location and preferred contact method
Submit, confirm and follow up
- Send the complaint through the channel named in the policy. If that channel is controlled by the alleged wrongdoer, use the alternative listed in the policy.
- Keep the exact version you submitted, attachments, delivery confirmation and any automated ticket.
- Ask for the investigator’s name, the expected next step and how to provide additional evidence securely.
- Continue the incident and retaliation logs while the matter is pending.
- After meetings, send a brief factual confirmation of decisions or disputed points and retain the reply.
Do not assume that an informal conversation starts or stops a legal deadline. An internal complaint can be important evidence, but external filing rules are separate and may run while the employer investigates.
Use witnesses without putting them at risk
Ask witnesses to preserve what they personally saw or heard rather than coordinating stories. A witness may report directly, support the affected person or be asked to provide evidence. Acas guidance explains that witnesses can support affected people, give evidence and, in some circumstances, make a harassment complaint themselves. Do not pressure a witness to access records they are not authorized to see or to copy confidential information.
Choose a reporting route
The best route may be parallel rather than sequential, but local law can require a particular filing first. Consider these options and ask how each handles confidentiality, independence from the manager, access to records or remedies, deadline protection, cost, accessibility and retaliation safeguards.

Internal HR or ethics channel
This is usually the employer’s designated process and may provide policy-based investigation or corrective action. Follow the written procedure, use an alternate recipient when the manager is involved, and keep proof of submission. Confidentiality is normally limited to those who need the information to investigate; ask how information will be shared.
Union or employee representative
A union representative or other representative can help you understand a grievance process, attend meetings where permitted and preserve a parallel record. Ask about filing windows in a collective agreement and any requirement to raise the issue through a particular step.
Government agency
An agency outside the employer may provide an independent intake process and statutory remedies. Agency deadlines are strict and are not replaced by an internal complaint. Confirm the correct agency for the work location and the type of employer.
Lawyer or advocacy clinic
A qualified employment lawyer or worker-advocacy clinic can assess jurisdiction, evidence, limitation periods and strategy before you disclose sensitive material. Ask about fees, conflicts, confidentiality and whether contacting the adviser protects any filing deadline; do not assume that it does.

Private, state or local employers
For most federal discrimination laws enforced by the EEOC, a person generally must file a charge before bringing a discrimination lawsuit. The standard deadline is 180 calendar days from the alleged discriminatory act. It is extended to 300 calendar days when a state or local agency enforces a comparable law prohibiting discrimination on the same basis. These are calendar-day limits, and the correct deadline depends on the work location and applicable law. Contact the EEOC promptly and verify the date rather than relying on a general rule.
Best Value
- It can be a gift option
- Comes with secure packaging
- Helpful in various ways
EEOC filing guidance treats sex discrimination as including pregnancy, transgender status and sexual orientation. Preserve evidence of each separate act; do not assume that a continuing pattern automatically makes every older event timely.
Federal employees and applicants
Federal employees and applicants use a different process. EEOC generally requires contacting an agency Equal Employment Opportunity counselor within 45 days of the alleged discrimination. Follow the federal agency’s procedure and confirm the applicable deadline immediately.
What to take to an EEOC intake
- Your incident and retaliation timelines.
- Employer name, worksite, job title and key decision-makers.
- Dates of each act and the date you reported internally.
- Comparator information and a list of witnesses.
- Copies of relevant records, retaining originals separately.
EEOC employee guidance states: “The law protects you from retaliation (punishment) for complaining about harassment.” That protection does not make every later workplace dispute retaliation, so continue documenting the facts and timing.
United Kingdom: use Acas and preserve the record
UK workers can raise a complaint with the employer and use the employer’s grievance process. Keep the complaint, evidence, investigation findings, actions taken, outcome, appeal and any hearing records. Acas specifically recommends retaining this set because an informal issue may later become formal.
Tribunal limitation periods and early-conciliation requirements are jurisdiction-specific. Check current Acas guidance or obtain qualified advice before any deadline expires. An internal grievance does not automatically extend a tribunal limitation period.
Other countries
Outside the United States and United Kingdom, identify the national equality, labor or human-rights authority and its limitation period. Rules about protected characteristics, mandatory internal steps, recording conversations, confidentiality and remedies vary. Do not apply the U.S. 180- or 300-day rules to another country without confirming local law.
After the investigation or decision
Retain the complete case file: your complaint, evidence index, delivery proof, investigator communications, findings, corrective actions, outcome, appeal and hearing records. Compare the outcome with the facts you reported and note unresolved issues in a new dated entry. If retaliation occurs after the decision, open a separate retaliation entry and report it through the stated channel while checking external deadlines again.

Quick Recap
Common mistakes and practical fixes
- Writing only a long narrative: convert it into dated entries with exact words, decisions, witnesses and records.
- Saving cropped screenshots: keep the original thread, metadata and attachments.
- Guessing motives: describe observable treatment, criteria and comparisons.
- Relying on a verbal report: send a factual confirmation and retain proof of delivery.
- Mixing retaliation with the original complaint: maintain a separate retaliation timeline.
- Taking confidential data: preserve only material you are authorized to access and keep.
- Secretly recording: check local consent law before recording any conversation.
- Waiting for an internal outcome before checking deadlines: identify the external filing date as soon as possible.
Final documentation checklist
- Every incident has a date, time, location, people, exact words or conduct and work impact.
- Direct observations are separated from information received from others.
- Original records and read-only copies are preserved with acquisition notes.
- Comparators are described by role, qualifications, treatment and verifiable records.
- Internal reports, recipients, reference numbers and responses are on a separate timeline.
- Retaliation indicators—timing, statements, changed treatment and explanations—are logged separately.
- Your complaint names the policy or protected characteristic, requests an investigation and asks for anti-retaliation protection.
- You retained the submitted complaint, delivery confirmation and all responses.
- You checked the deadline for your work location: commonly 180 or 300 calendar days for covered U.S. private, state or local employers, 45 days for many U.S. federal employees and applicants, and a separate Acas-managed timetable in the UK.
