Usually, you do not report a genuine cash gift from a U.S. relative as income on your federal Form 1040. The donor, not the recipient, may have to file a federal gift-tax return. Your main job as recipient is to preserve evidence showing what the transfer was, who sent it, when it arrived, and that you were not expected to repay it or provide services in return.

A different rule can apply when the donor is a foreign individual or foreign estate. If gifts from that donor and certain related foreign persons exceed $100,000 in the tax year, you generally report them on Form 3520, which is separate from your income-tax return. The transfer must also be classified correctly: money expected to be repaid, paid for work, or exchanged for something is not automatically a gift merely because the parties call it one.

What a large cash gift means for your federal income-tax return

For a genuine gift from a U.S. relative, the recipient generally does not include the cash in federal gross income and does not enter it as income on Form 1040. The Internal Revenue Service distinguishes the recipient’s income-tax treatment from the donor’s possible gift-tax filing duty.

The IRS answers a related question about a parent transferring a home’s title to a child this way: “No, but your mother may be required to report this transaction as a taxable gift.” A cash transfer follows the same recipient-versus-donor distinction when it is truly a gift.

The practical question is therefore not simply “Was the amount large?” It is “What was the legal and economic arrangement?” A transfer is a gift only when the recipient gives nothing, or less than full value, in return and is not expected to repay the money. The IRS describes gift tax as “a tax on the transfer of property by one individual to another while receiving nothing, or less than full value, in return.”

Confirm that the transfer is actually a gift

Before preparing records, write down the facts that establish the arrangement. A label such as “gift” is helpful, but the parties’ actual understanding controls the classification.

Facts that support gift treatment

  • The relative transferred money voluntarily.
  • You were not required to provide work, goods, an ownership interest, or another benefit in return.
  • You are not required to repay the principal or interest.
  • The transfer was intended as a one-time gift or as part of a clearly identified series of gifts.

Facts that point to another classification

  • A written or oral promise requires you to repay the money. That points toward a loan.
  • The payment is connected to your work or services. That may be compensation rather than a gift.
  • The money reimburses an expense or settles a debt. It may be a reimbursement or payment, not a gift.
  • You transfer property, services, or another economic benefit back to the relative. The transaction may be an exchange, with different tax consequences.

If the arrangement is mixed—for example, part gift and part loan—document the parts separately. Do not describe the entire amount as a gift if any portion carries a repayment obligation or pays for services.

Build a concise recipient record file

The IRS does not prescribe a special gift letter or dedicated record format for an ordinary domestic cash gift. Nevertheless, a coherent file can explain the transaction if a bank, lender, tax preparer, or tax authority later asks what the deposit was.

1. Save the transfer evidence

Keep the bank statement, wire confirmation, canceled check, or payment-app record showing:

  • the transfer date;
  • the amount and currency;
  • the sender’s name or account identifier;
  • your name or receiving account; and
  • the transaction or confirmation number, when one exists.

Download a durable copy rather than relying only on an app’s history, which may be difficult to retrieve later. If the transfer arrived in several installments, keep the record for each installment and make a schedule totaling them.

2. Obtain a dated statement from the relative

Ask the donor for a short email, letter, or signed statement made close to the transfer date. It is practical substantiation, not an IRS-mandated form. The statement should identify:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the donor and recipient;
  • the date or dates of the transfer;
  • the amount or amounts;
  • that the money was given as a gift;
  • whether it was a one-time gift or part of a series; and
  • that no repayment, interest, services, or other consideration is expected.

Use plain language that matches the real arrangement. Do not ask a relative to sign a gift statement for money that is actually a loan, compensation, reimbursement, or exchange.

3. Preserve context that resolves ambiguity

Keep relevant messages, an agreement, or a contemporaneous note if someone could mistake the payment for a loan, support arrangement, reimbursement, or compensation. For example, a message saying “you can keep this; there is nothing to pay back” helps explain why a large deposit is not loan proceeds. Conversely, messages discussing installments, interest, or repayment should be retained and treated as evidence that the arrangement may not be a gift.

4. Record the donor’s status

Note whether the relative is a U.S. citizen or resident, a nonresident alien, or a foreign estate. That fact determines whether the recipient may have a Form 3520 information-reporting obligation. For a foreign donor, also record the donor’s country and status and maintain a year-to-date total of gifts from that donor and certain related foreign persons.

5. Keep the records together

Use one folder for the transfer confirmation, gift statement, related correspondence, and any foreign-donor calculation. Label each file with the tax year and date. A short index stating the total received and the documents supporting it makes the file easier to use without turning it into a formal tax filing.

Recipient and donor duties are different

Question Genuine domestic gift Foreign individual or foreign estate gift
Does the recipient generally report the cash as income on Form 1040? No, when it is a true gift. Not as income merely because it is a gift, but separate information reporting may apply.
Who may have a federal filing duty? The donor may need Form 709. The donor may have donor-side duties, and the recipient may need Form 3520.
Key threshold in the supplied IRS rules Donor gifts to one person exceeding $19,000 in 2025 or 2026 may require Form 709, subject to exclusions and special rules. Recipient gifts exceeding $100,000 in aggregate during the tax year from a foreign individual or foreign estate and certain related persons generally trigger Form 3520 reporting.
What records matter most? Transfer proof and a statement that no repayment or consideration is expected. The same records, plus donor country/status and an aggregate year-to-date calculation.

A donor’s filing requirement does not turn the recipient’s gift into income. Likewise, the fact that no Form 709 is required does not by itself establish that a transfer was a gift; classification still depends on the actual arrangement.

When the U.S. donor may need Form 709

For gifts made in 2025, a U.S. citizen or resident donor generally must file Form 709 when gifts to one person total more than $19,000, although exclusions and special rules apply. The IRS states that the annual exclusion is $19,000 for both 2025 and 2026.

The $19,000 amount is a donor-side annual exclusion per recipient, not an income threshold for the person who receives the money. Crossing it may create a Form 709 filing requirement; it does not automatically mean gift tax is due. The donor’s complete gift-tax position, including applicable exclusions and other rules, determines whether tax is payable.

Situations that need additional donor analysis

  • Future-interest gifts: Some gifts that are not immediately usable by the recipient do not qualify for the annual exclusion.
  • Gift splitting: A married couple that elects to split gifts can have a filing requirement even when the cash came from one spouse’s account.
  • Multiple transfers: Add gifts to the same recipient during the relevant year when determining whether the threshold is exceeded.

As recipient, you can ask the relative whether a tax professional is handling Form 709, but you do not file Form 709 merely because you received a large domestic gift. Do not sign a donor return unless you understand what it represents and are authorized to do so.

When a foreign gift requires Form 3520

If the donor is a nonresident alien or a foreign estate, the recipient generally must report gifts when the aggregate amount received during the tax year from that donor and certain related persons exceeds $100,000. This is recipient information reporting, not income reporting.

Once the aggregate threshold is crossed, individual gifts over $5,000 must be separately identified. Keep a running total during the year rather than waiting until tax preparation, because the threshold applies to the aggregate of covered gifts.

What to include in your foreign-gift file

  • The donor’s full name and country.
  • Whether the donor is a foreign individual, foreign estate, or another type of entity.
  • The date and amount of every transfer.
  • The names and relationships of certain related foreign persons whose gifts may count toward the aggregate.
  • A calculation showing how the year-to-date total compares with $100,000.
  • Separate identification of each gift over $5,000 after the aggregate threshold is exceeded.

Form 3520 is separate from the income-tax return and is generally due on the 15th day of the fourth month after the tax year. Keep the transfer evidence and your calculation even if you conclude that the threshold was not crossed.

Do not apply the $100,000 rule to every overseas payment

The stated threshold concerns gifts from a foreign individual or foreign estate. Different inflation-adjusted thresholds and classification issues apply to purported gifts from foreign corporations or partnerships. If the sender is an entity, or if the transfer is connected to a trust, covered expatriate, or another special category, obtain tailored advice instead of using the individual-or-estate rule mechanically.

A step-by-step process for documenting the gift

  1. Describe the arrangement in one sentence. State who gave what amount to whom, on what date, and whether any repayment or exchange is expected.
  2. Classify the sender. Identify whether the donor is a U.S. citizen or resident, a foreign individual, a foreign estate, or an entity.
  3. Collect the payment record. Save the bank, wire, check, or payment-app confirmation with the date, amount, sender, and recipient.
  4. Get a contemporaneous gift statement. Ask the relative to confirm the gift terms in a dated letter or email. Keep it with the payment record.
  5. Check for contrary facts. Review messages and agreements for repayment, interest, work, reimbursement, ownership, or another benefit promised in return.
  6. Total the year-to-date amount. For a U.S. donor, total gifts to you for the donor’s Form 709 discussion. For a foreign individual or estate, total covered gifts from the donor and certain related persons.
  7. Apply the correct threshold. Use the $19,000 annual exclusion information for the donor-side 2025 and 2026 rules, or the $100,000 foreign-gift recipient threshold when it applies.
  8. Give the file to your tax preparer if needed. Provide the facts and records without treating the gift as wage, interest, or other income unless the arrangement actually has those characteristics.

Common mistakes and how to correct them

Reporting the gift as wages or other income

A large deposit can look unusual, but size alone does not make it taxable income. If the transfer is a true domestic gift, correct the description in your records and do not place it on Form 1040 as compensation or miscellaneous income. Keep the donor statement and transfer proof in case the deposit is questioned.

Assuming the donor’s Form 709 is your filing

Form 709 belongs to the donor’s gift-tax reporting. Your receipt of the money does not make you responsible for filing that return. Ask the donor to address the donor-side obligation separately.

Treating the $19,000 figure as a tax-free limit for recipients

The $19,000 annual exclusion for 2025 and 2026 is a donor-side figure for gifts to one person. It is not a rule saying that a recipient must report amounts above $19,000 as income, and it is not a guarantee that a donor owes gift tax when the amount is exceeded.

Ignoring foreign-donor aggregation

For a foreign individual or foreign estate, add covered gifts during the tax year and include certain related foreign donors in the calculation. A series of smaller transfers can cross the $100,000 threshold even when no single transfer does.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using a gift letter to disguise a loan

A signed statement cannot change the economics of a repayment arrangement. If repayment, interest, services, or an exchange was expected, preserve the agreement and have the transaction classified on its actual terms.

Applying the individual foreign-gift rule to a foreign entity

Foreign corporations and partnerships can involve different thresholds and classification rules. Do not use the $100,000 individual-or-estate test without first identifying the sender.

Examples of the documentation analysis

U.S. parent sends one large transfer

Your U.S.-resident parent wires money to your account and confirms in a dated letter that it is a gift with no repayment. You keep the wire confirmation and the letter. You generally do not report the cash as income on Form 1040. The parent should consider whether gifts to you during the year exceed the $19,000 annual exclusion and whether Form 709 is required.

Several U.S. relatives contribute

Each relative sends a separate amount as a personal gift. Keep a record for each sender and each date. The donor-side analysis is performed separately for each donor’s gifts to one recipient; do not combine every relative’s money into one unexplained deposit. If the transfers were coordinated for a shared purchase or carried repayment expectations, document those facts instead of assuming every payment is a gift.

Foreign parent sends installments

A nonresident-alien parent sends several transfers during the year. Maintain a running total, donor country and status, and the payment records. If covered gifts from that donor and certain related persons exceed $100,000 in aggregate, prepare the recipient’s Form 3520 information and separately identify gifts over $5,000 after the threshold is crossed.

Relative sends money with an understanding of repayment

Even if the transfer is interest-free, an obligation to repay means the arrangement is not an ordinary gift. Keep the loan terms and payment history, and do not use a gift letter to describe it otherwise. The tax treatment must follow the actual agreement.

When the facts call for tailored advice

Get individualized tax advice when the transfer involves a foreign corporation or partnership, a trust, a covered expatriate, a future interest, gift splitting, multiple legal owners, or a disputed characterization. The same is true when you cannot determine whether the money was compensation, reimbursement, a loan, or a gift.

State-tax rules and reporting for a recipient outside the United States are not resolved by the federal rules described here. A state or non-U.S. filing may apply even when the federal recipient rule produces no income-tax entry. Keep the federal documentation and ask a professional who handles the relevant jurisdiction.

What to hand your tax preparer

  • A one-page chronology of each transfer.
  • Bank, wire, check, or payment-app confirmations.
  • The donor’s dated gift statement and any related correspondence.
  • The donor’s citizenship or residency status and, for a foreign donor, country and entity type.
  • Your year-to-date total, including the method used to count related foreign persons when relevant.
  • A note identifying any repayment, service, reimbursement, trust, future-interest, or gift-splitting issue.

This package lets the preparer decide whether your Form 1040 needs no income entry, whether the donor should address Form 709, and whether you have a separate Form 3520 obligation.
