If a lender denied your mortgage or offered terms worse than you requested, start by obtaining the written adverse-action reason and preserving every document. If the decision relied on inaccurate credit-report information, dispute the specific entry with both the credit reporting company and the company that supplied it. If you suspect discrimination, document the comparison and consider a complaint or legal advice. A separate process applies when the problem is an error on an existing mortgage account rather than an application decision.
First determine which problem you have
The remedy depends on whether you are challenging an application decision, proposed terms, or servicing of a loan you already have. Do not use the mortgage-servicing error process to challenge a new application denial automatically.

| Situation | What to compare or check | Initial route |
|---|---|---|
| Denial based on credit information | Adverse-action reasons, score factors, report entries and the reporting company named in the notice | Request the reasons, obtain the report and dispute inaccurate information |
| Less favorable proposed loan terms | Requested versus offered rate, fees, loan amount, term, down-payment assumptions and the reason given | Request an explanation and document whether similarly situated applicants received different treatment |
| Error in existing mortgage servicing | Account records, payment history, transaction or balance error and the servicer’s designated address | Send a written notice of error to the servicer using its specified address |
A denial can be disappointing without being incorrect under lending rules. Your first objective is to identify the precise factor used, then test whether the information or process was wrong.

Step 1: obtain and preserve the lender’s actual reason
Find the adverse-action notice
Keep the lender’s adverse-action notice, counteroffer, incomplete-application notice, appraisal-copy notice and every email or portal message. The notice should give the principal reasons for the decision or explain how to obtain them. A generic statement such as “does not meet guidelines” may not tell you which facts were considered; ask for the specific factors actually used in underwriting.

Make a written request within the applicable window
If the notice says you may request the reasons, make that request within 60 days of the notice. Use a channel that creates a record—such as the lender’s secure message system, email address identified in the notice or certified mail—and save the sent message and delivery confirmation. Ask the lender to identify each material factor, the information used to evaluate it and whether the decision was a denial, a counteroffer or a withdrawal for an incomplete application.
Do not rely on a telephone explanation alone. Write down the representative’s name, date and exact statements, then ask the lender to confirm them in writing.
Build a case file immediately
- The complete application and submitted income, asset, debt and employment documents.
- The requested loan amount, rate, term, points, fees, down payment and property information.
- The adverse-action or counteroffer notice and the date you received it.
- Underwriting requests, your responses, appraisal documents and communications.
- A dated log of calls, names, promises and follow-up dates.
Preserving the original files matters because later corrections to a credit report or application can otherwise make it difficult to show what the lender saw when it decided.

Step 2: check the credit information used in the decision
Read the score factors, not just the number
If the lender relied on a credit report, the notice should identify the reporting company and disclose the credit score and key factors where required. A score can be accurate while a factor behind it is not. Review the listed reasons—such as utilization, payment history, account age or recent inquiries—against the underlying report.
Obtain the report within the notice period
Request the report from the reporting company named in the notice within 60 days of the adverse-action notice when that right is provided. Compare the report with your own statements and account records. Look for:

- Accounts that do not belong to you or appear because two consumers’ files were mixed.
- Balances or credit limits that are wrong, duplicated or reported after payment.
- Late payments shown for a month when you paid on time.
- Accounts listed as open, delinquent or in collection when they were closed, paid or disputed.
- Identity details that could have caused another person’s information to be matched to you.
Save a dated copy of the report, including the pages showing the disputed entry and the score factors. Reports can change, so a later version is not a substitute for the one used in the mortgage decision.
Step 3: dispute an inaccurate credit entry with both responsible parties
Send a focused dispute to the credit reporting company
Identify the exact account or field that is wrong, explain why, and request correction or deletion of the inaccurate information. Include legible supporting records, but keep the originals. State your name, current address and any identifier the reporting company requires to locate the file. Avoid sending a broad narrative that does not identify a specific entry.
Send a separate dispute to the information furnisher
Send the same factual dispute to the bank, card issuer, collection company or other business that supplied the information. A reporting company may not have authority to change the furnisher’s underlying records, so notifying both parties gives each one a chance to investigate its part of the error.
Keep proof and evaluate the results
- Retain the report, each dispute, attachments, mailing or submission proof and every response.
- Record when each investigation began and ended and what information was corrected, deleted or verified.
- Obtain an updated report after a correction and check that the change appears consistently.
- Give the lender the corrected report and ask whether it will reconsider the application under its normal procedures.
The Consumer Financial Protection Bureau states that a reporting company must investigate and correct errors it finds. That does not guarantee a mortgage approval: the lender may still apply legitimate underwriting criteria to accurate information.
Step 4: challenge a worse loan term without assuming it proves discrimination
Make the requested and offered terms comparable
Create a side-by-side record of the terms you requested and what the lender offered. Include the annual percentage rate, interest rate, fixed or adjustable structure, loan amount, term, points, lender credits, fees, required reserves, down payment and any conditions. Note whether the loan amount or property value changed during underwriting. A term can worsen because a documented risk factor changed, but you need the lender to identify the factor rather than guess.

Ask what changed and whether the facts are correct
Request the specific reason for the counteroffer or pricing adjustment and ask which application facts drove it. Check that income, employment, debts, assets, occupancy, property type, appraisal information and requested loan-to-value ratio were recorded correctly. Correct factual errors in writing and ask for a review by the lender’s designated underwriting or escalation team.

A rate, fee or loan term that is less favorable than requested can justify questions and documentation, but it does not by itself establish unlawful discrimination. Preserve evidence if the lender made different statements to you and to a comparable applicant, discouraged you from applying, changed requirements without an apparent underwriting explanation or relied on a protected characteristic.
Federal protections can arise under the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act, alongside state protections that may be broader. The Consumer Financial Protection Bureau’s Regulation B materials report 2026 amendments concerning disparate impact, discouragement and special purpose credit programs. Because applicability depends on the current rule text, transaction and jurisdiction, verify the rule in effect and obtain individualized legal advice before asserting a legal conclusion.
Step 5: escalate through the right channel
Ask the lender for reconsideration
After correcting a factual error or receiving the specific reasons, ask the lender whether it accepts a reconsideration, supplement or new application. Attach only material corrections and identify the document supporting each one. Ask for the result in writing and whether the lender is treating the request as a new application with a new decision date.
Submit a consumer complaint when the response is inadequate
If the lender will not provide the required explanation, does not address a documented reporting error or you believe you experienced discrimination, you can submit a complaint to the Consumer Financial Protection Bureau. Include a concise chronology, the application and notice dates, the exact disputed facts, the lender’s response and the remedy you seek. Remove unnecessary financial-account numbers and keep copies of everything submitted.

Use a HUD-approved housing counselor
A HUD-approved housing counselor can review mortgage readiness, credit-report issues, debt-to-income information and possible next steps after a denial. Counseling is different from legal representation: a counselor can help organize the facts and explain options but cannot decide whether a lender violated the law.
Consult an attorney when the stakes or deadline require it
Consider a lawyer experienced in fair-lending, consumer-credit or real-estate law if you see evidence of discriminatory treatment, identity theft, a serious reporting error, a large financial loss or a threatened foreclosure. Bring the complete case file and ask about federal and state deadlines before making a formal claim.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Understand the notice types you may receive
Consumer Financial Protection Bureau model and sample forms include adverse-action notices, counteroffer notices, incomplete-application notices and appraisal-copy notices. Use the form type to understand what decision the lender says it made; a model form is not a substitute for advice about your facts.
Adverse-action notice
This generally communicates that credit was denied or another adverse decision was made and identifies the principal reasons or how to request them. The date controls many follow-up windows.
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Counteroffer notice

Incomplete-application notice
This indicates that the lender believes required information was missing. Check whether you actually supplied the requested item and whether the lender gave a reasonable opportunity to provide it before treating the file as incomplete.
Appraisal-copy notice
This concerns the appraisal or other valuation information provided in connection with the application. Compare the property facts and valuation assumptions with your records and raise factual errors promptly.
Automated underwriting does not remove notice obligations
Some lenders use scoring systems or other automated tools. CFPB Circular 2022-03 states that “the adverse action notice requirements of ECOA and Regulation B, however, apply equally to all credit decisions, regardless of the technology used to make them.” In practical terms, a lender cannot replace the required reasons with an explanation that the computer model simply rejected the application. Ask for the specific principal factors the lender must disclose, while recognizing that a notice need not reveal proprietary model code.

A payment posting, balance, escrow, payoff or account-information error on a mortgage you already hold follows a different route from a denied application or proposed loan terms.
- Find the servicer’s designated address for notices of error in your statements or other servicing communications. Sending the notice to a general payment address may delay or defeat the special process.
- Identify yourself and the mortgage account, describe the specific error, state the payment or transaction date involved and explain what correction you want. Attach copies, not irreplaceable originals.
- Keep proof of delivery and all subsequent responses.
- Continue making scheduled payments while awaiting the servicer’s response unless your attorney gives different advice. A servicing dispute does not automatically suspend the payment obligation.
If foreclosure is imminent or you have been served legal papers, contact an attorney promptly. Do not wait for a complaint response to protect a court deadline.
A practical timeline for disputing the decision
- Day 1: Save the notice, application, offer, appraisal and communications. Write down when you received the decision.
- Within the notice’s 60-day reason-request period, when applicable: Ask for the specific principal reasons and request the identified credit report.
- After receiving the report: Mark each inaccurate entry, gather account records and send disputes to both the reporting company and the furnisher.
- While investigations are pending: Keep a dated log, avoid deleting messages and preserve proof of every submission.
- After a correction or written response: Obtain an updated report, give material corrections to the lender and request reconsideration if available.
- If unresolved: Consider a CFPB complaint, HUD-approved counseling, state remedies and legal advice based on the facts and deadlines.
Common mistakes that weaken a dispute
- Arguing only that the result feels unfair: Tie each objection to a notice reason, report entry, document or comparable treatment.
- Disputing with only one party: Send the factual credit dispute to both the reporting company and the information furnisher.
- Missing the reason-request window: Read the notice on receipt and calendar the 60-day period when it applies.
- Sending originals: Keep originals and submit copies or secure electronic files.
- Mixing an application dispute with a servicing dispute: Use the lender’s application channel for the denial or offer, and the servicer’s designated error-notice address for an existing-account problem.
- Stopping payments on an existing mortgage: Continue scheduled payments while a servicing error is reviewed unless qualified legal counsel instructs otherwise.
- Claiming discrimination without preserving comparisons: Record dates, statements, changed requirements and evidence about similarly situated applicants before drawing a conclusion.
- Assuming a corrected report guarantees approval: A lender may still deny or reprice an application based on accurate, lawful underwriting factors.
What a well-supported dispute should contain
Organize your submission so a reviewer can verify it quickly:
- A one-page chronology with application, notice, request and response dates.
- The exact adverse-action reason or term change you are challenging.
- The disputed report entry or application fact, quoted accurately.
- One document supporting each correction, labeled with the relevant account or date.
- A clear requested remedy: corrected reporting, a written explanation, reconsideration or another specific response.
- Your contact information and a secure way for the recipient to respond.
Keep a separate copy of the complete package. If you later contact a regulator, counselor or attorney, a clean chronology and indexed exhibits will make the review faster and reduce the risk of contradictory accounts.
