How to Dispute an Incorrect Mortgage Balance or Payment History

If your mortgage balance, payment history, fees, or payment allocation is wrong, send the servicer a written notice of error to the special address it designates for error notices or information requests. Identify the loan, describe each disputed transaction, attach copies of your records, request a specific correction, and keep making scheduled payments while the servicer investigates. If the same mistake appears on your credit report, dispute that entry separately with the credit reporting company and the company that supplied the information.

First identify which record is wrong

Mortgage disputes often involve more than one record. A servicer’s internal ledger controls how it calculates your balance and reports your account. A credit report is a separate record maintained by a credit reporting company. A servicing transfer can create a third issue: the payment may have been sent to the wrong company or posted around the transfer date. The correct route depends on the record you need changed.

Problem Primary action Evidence to organize
Servicer ledger shows a missing, late, misapplied, or short payment; an unsupported fee; an escrow mistake; or an incorrect balance Send a written notice of error or information request to the servicer’s designated address Bank statement, canceled check or electronic confirmation, mortgage statements, escrow notices, and correspondence
Credit report shows a wrong balance, late payment, or other inaccurate mortgage status Dispute the entry with the credit reporting company and the furnisher that supplied it Credit-report page, payment timeline, statements, and proof of payment
Payment was made during a servicing transfer or sent to the former servicer Check the effective transfer date and contact the former and current servicers as appropriate Transfer notices, payment destination, payment date, and confirmation
Foreclosure is imminent, a sale is scheduled, or you have been served legal papers Obtain qualified legal advice promptly rather than relying only on ordinary correspondence All notices, court papers, statements, and your payment records

The federal procedures described here are U.S. consumer guidance for mortgage servicing. Regulation X procedures generally concern closed-end mortgage loans and do not apply in the same way to home equity lines of credit. State law, the loan type, and court deadlines can change the analysis.

Reconcile the account before writing

Start with a transaction-level timeline instead of a general statement that “the balance is wrong.” Mortgage statements normally show the payment due, amounts applied to principal, interest, escrow and fees, and other transaction information. Compare those entries with your own records.

  • List every disputed payment date and amount.
  • Record the account or payment destination used for each payment.
  • Note when your bank withdrew the money and when the servicer says it received or applied it.
  • Compare the servicer’s allocation among principal, interest, escrow and fees with the loan terms and statement.
  • Mark unexplained fees, an unexpected balance change, or a payment that appears in the bank record but not in the servicer history.
  • Check escrow analyses, insurance notices, tax records and servicing-transfer notices when the monthly payment changed.

Keep the original records. Send copies with the notice. A simple table in your file can include payment date, amount, bank withdrawal date, destination, servicer posting date, servicer allocation and the correction you seek.

Find the servicer’s designated address

Do not assume the address printed for monthly payments is the correct address for a notice of error. Statements, coupon books, the servicer’s website and servicing notices may list a separate address for “notices of error,” “qualified written requests” or “information requests.” Use that designated address when one is provided. A notice mailed to a payment address may not receive the formal treatment you expect.

A phone call can help you understand what happened, but it is not a substitute for the written notice. If you call first, write down the date, representative’s name or identification number, and the explanation given. Then send the letter to the designated address and do not put it on a payment coupon or other payment form.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Write a notice of error the servicer can investigate

Federal rules require a covered written notice to include your name, information that enables the servicer to identify the mortgage account, and the error you believe occurred. Specific facts make it easier for the servicer to locate the transaction and harder for the response to become a generic balance explanation.

Include these identifying details

  • Your name as it appears on the mortgage.
  • The property mailing address.
  • The mortgage account number, or enough information for the servicer to identify the loan.
  • Your mailing address, telephone number and email address if you want those used for contact.
  • The date of the letter and a subject such as “Notice of Error under Regulation X.” The label is a useful convention; the substance and identifying information control.

Describe each error separately

For every disputed item, state the date, amount and servicer entry, then explain what should have happened. For example: your bank withdrew $2,150 on a stated date; the servicer’s history omits the payment; and you request that the payment be credited as of the appropriate receipt date and that the transaction history and balance be corrected. If a payment was allocated incorrectly, identify the allocation shown and the allocation you believe the loan terms require. If a fee is unsupported, identify the fee, date and reason it appears improper.

Attach organized copies

  • Bank statements showing the withdrawal, canceled checks or electronic payment confirmations.
  • Mortgage statements before and after the disputed transaction.
  • Escrow analyses, insurance or tax notices relevant to a payment change.
  • Servicing-transfer notices and proof of where a payment was sent.
  • Prior correspondence, call notes and any servicer explanation.
  • The relevant page of a credit report if you are also preparing a credit-report dispute.

Number the attachments and refer to them in the letter. Keep a complete copy for yourself. Do not send irreplaceable originals.

Ask for a defined result

Request the action that would resolve the specific error: correct the payment history, apply a missing payment, reverse an unsupported fee, recalculate the balance, explain the allocation among principal, interest, escrow and fees, or provide a specified transaction history. You can request written confirmation of the correction. A broad demand to “fix everything” gives the servicer less information to work with.

Sample notice of error

Adapt the following structure to your facts. Replace the bracketed fields inside the letter and attach only relevant records.

[Date]

To: [Servicer’s designated address for notices of error or information requests]

Re: Notice of Error under Regulation X
Borrower: [Name]
Property: [Property mailing address]
Loan number: [Account number]

I believe the following servicing error occurred:

1. On [payment date], I paid [amount] from [payment method/account]. The funds were withdrawn on [withdrawal date], as shown in Attachment 1, but the account history [omits the payment / credits it late / applies it incorrectly].
2. The statement or history shows [servicer’s entry]. The records show [what should have occurred].

Please investigate and [credit or reapply the payment / correct the payment history / reverse the fee / correct the balance / provide the requested transaction information]. Please send a written response and an updated account history showing any correction.

I have enclosed copies of [list attachments]. Please contact me at [mailing address, phone and email].

Sincerely,
[Borrower name]

If you have several errors, number each one and give each its own supporting documents. Do not combine unrelated disputes into vague allegations.

Send and document the notice

  1. Print or save the final letter and every attachment.
  2. Address it to the special error-resolution or information-request address shown on your statement, coupon book, website or notice.
  3. Use a delivery method that gives you a mailing record and, where available, tracking or delivery confirmation. Keeping proof of delivery is practical recordkeeping that helps establish when the servicer received the notice.
  4. Store the copy of the letter, attachments, tracking record, delivery confirmation and a calendar reminder for the expected response.
  5. Continue sending regular payments to the normal payment address or through the established payment method. Do not put the notice on a payment coupon.

The servicer cannot charge a fee or require you to make a payment as a condition of responding to a covered notice. That protection does not cancel your ordinary obligation to pay the mortgage.

12 CFR § 1024.35(h), current Regulation X text hosted by the Consumer Financial Protection Bureau

Keep paying while the dispute is pending

A notice of error does not pause the loan, waive a payment, or guarantee that a late fee will be removed. Pay the scheduled amount by the normal deadline unless the servicer gives you a different written instruction that you have evaluated carefully. If you cannot make the payment, contact the servicer about available assistance; do not deliberately withhold payments to force a correction.

The CFPB says that after receiving a mortgage-payment error notice, the servicer may not send negative information to a credit reporting company about the disputed payment for 60 days. This is a narrow protection concerning negative furnishing about that payment; it is not a promise that all credit reporting is frozen or that other account information cannot be reported.

Know the response periods

Timing depends on the type of error, whether the notice contains the required information, and exceptions in Regulation X. The CFPB describes the following general periods:

Event Period Qualification
Acknowledgment of most covered notices Generally within 5 days Weekends and legal public holidays are excluded
Substantive response to most covered notices Generally within 30 days Specified extensions may apply; the servicer must give required advance notice
Possible extension Up to an additional 15 days Available only in specified cases and with the required notice
Certain payoff-balance errors 7 days under Regulation X Category-specific timing applies rather than the general period
Restriction on negative furnishing about the disputed payment 60 days after receipt of the notice Applies narrowly to negative information about that payment

These are legal and regulatory process periods, not guarantees of a favorable correction. Foreclosure-related errors can have special timing rules. Do not treat the ordinary 30-day period as permission to wait when a sale or court deadline is near.

Review the servicer’s written response

The response may state that the account was corrected, explain why the servicer believes no error occurred, ask for more information, or invoke an allowed extension. Compare every statement with your timeline and attachments.

  • Check whether the missing payment appears with the correct effective date.
  • Confirm that principal, interest, escrow and fees now add up to the stated balance.
  • Look for reversal of the disputed fee and any related late charge.
  • Confirm that a corrected statement or transaction history was actually issued.
  • If the servicer says there was no error, identify which document or calculation conflicts with that explanation.
  • Calendar any promised follow-up and preserve the response with your original notice.

A servicer’s explanation is not a court ruling. If the records still conflict, prepare a focused follow-up or escalation rather than restarting with a general complaint.

Common mortgage errors and how to frame them

Payment was not credited or was credited late

Compare the bank withdrawal date, payment confirmation, servicer receipt or posting date, and the statement period. State the amount, the date funds left your account, and the date the servicer recorded. Request correction of the payment date, removal of any resulting late fee, and an updated payment history if those outcomes follow from the records.

Payment was applied to the wrong category

Ask for the payment allocation among principal, interest, escrow and fees. Compare the allocation with the note, mortgage terms and statement. Identify the exact amount assigned to the wrong category and state the allocation you believe is required.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Balance changed unexpectedly

A monthly payment or principal balance can change because of escrow, insurance, taxes, fees or other permitted adjustments. Gather the statement showing the change, the prior statement, escrow analysis and related notices. If the calculation or posting does not match those records, request the calculation and send a notice of error describing the disputed entry rather than alleging only that the balance “looks wrong.”

An unsupported fee appeared

Name the fee, date and amount. Explain why the loan documents, statement history or payment record do not support it, and request reversal plus a corrected balance. Keep the request tied to the servicing entry; a disagreement with an original loan term may not be a servicing error under Regulation X.

Servicing-transfer disputes

Find the effective transfer date and the payment instructions in the transfer notices. Match each payment to the company that was authorized to receive it on that date. CFPB guidance says a borrower may send an information request or notice of error to both the former and new servicers when appropriate.

There is also a 60-day transfer protection: generally, the new servicer may not impose a late fee or treat a payment as late when the borrower sent it on time to the old servicer or within the applicable grace period. Keep the transfer notice, proof of payment destination and delivery records. Describe the dates precisely because the protection depends on when the transfer occurred and when the payment was sent.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Dispute a wrong credit-report entry separately

A corrected servicer ledger does not automatically correct every credit report. If a credit reporting company shows a late payment, wrong balance or other inaccurate mortgage information, send a dispute to that company and to the furnisher that supplied the information. Include a copy of the relevant report page and the same payment timeline used in your servicer notice.

State exactly what is inaccurate, such as “the report lists a 30-day late payment for May, but the payment was withdrawn on May 2 and the servicer’s records show receipt.” Request deletion or correction of the specific entry and attach readable copies of the supporting records. Keep proof of delivery and each response. Continue the servicer dispute separately; the two processes address different records.

Escalate when the issue remains unresolved

Submit a CFPB complaint

If the servicer misses the applicable response period, fails to address the identified transaction, or leaves the account incorrect, submit a complaint to the Consumer Financial Protection Bureau. Attach the notice of error, proof of delivery, statements, payment confirmations, transfer notices and the servicer’s response. Explain the remaining discrepancy in a short timeline. A CFPB complaint requests a response and review; it does not itself change the loan balance or stop collection activity.

Get legal help for urgent deadlines

Contact a qualified attorney promptly if you have been served foreclosure papers, a sale is scheduled, or another court deadline is approaching. Ordinary notice-of-error correspondence may not protect you from missing a litigation or foreclosure deadline. A HUD-approved housing counselor may also help you organize records and communicate with the servicer, but counseling is not a substitute for legal advice when court rights are at stake.

Errors that weaken a dispute

  • Sending the notice only to the payment address when a designated error address exists.
  • Describing the problem as “my balance is wrong” without dates, amounts and the servicer’s entries.
  • Mailing original bank records or statements you cannot replace.
  • Putting the notice on a payment coupon or mixing it into a regular payment envelope.
  • Stopping scheduled payments while waiting for an answer.
  • Assuming a phone promise is the same as a written correction.
  • Disputing the servicer ledger but not the separate credit-report entry.
  • Waiting for the general response period when a foreclosure or court deadline is imminent.
  • Assuming every disagreement about the original loan contract is covered by servicing-error procedures.

Final checklist

  • Have you identified the exact payment, fee, allocation or calculation at issue?
  • Does your timeline match bank records, statements and transfer notices?
  • Are your name, property address and loan-identifying information included?
  • Did you use the servicer’s designated notice address?
  • Did you send copies, retain the originals and keep delivery proof?
  • Did you request a concrete correction or specific account information?
  • Have you continued scheduled payments?
  • Did you calendar the acknowledgment and response periods, allowing for exceptions?
  • Is the same error on a credit report, requiring a separate dispute?
  • Is there a foreclosure, sale or court deadline requiring legal advice now?

The strongest mortgage dispute is a documented transaction-by-transaction record sent to the correct servicer address, followed by continued payment, careful review of the written response and separate correction of any credit-report error. Use the current Regulation X text and the servicer’s latest instructions for the address and timing that apply to your account.
