How to dispute a HELOC balance or payment error after a servicing transfer

If your HELOC moved to a new servicer and the balance or a payment looks wrong, first reconcile the old and new statements, then send a written billing-error notice to the creditor at the billing-error address disclosed in your account documents when the problem is a statement error. Do not assume that the mortgage-servicing procedures in Regulation X automatically apply: an ordinary open-end HELOC (a home-equity plan) is excluded from that definition.

Regulation Z may provide the relevant federal billing-error process for a payment that was not credited, an incorrect payment allocation, or a computational or similar accounting error shown on a periodic statement. Your HELOC agreement and state law may add rights, and the correct procedure depends on the account, creditor, statements and transfer facts.

Start by separating a transfer problem from an actual balance error

A servicing transfer changes the company that receives payments and maintains the account. It does not, by itself, rewrite the HELOC agreement, change the approved credit limit, alter the interest-rate formula or prove that the new displayed balance is inaccurate. The first useful comparison is the final statement and transaction history from the former servicer against the transfer notice, first statement and transaction history from the new servicer.

Look for the earliest statement on which the figures diverge. A difference that appears immediately after the transfer could be a missing payment, a posting-date problem, a transferred opening balance that does not match the old closing balance, a fee or advance entered during the handoff, or a legitimate rate or interest change required by the agreement. The date the statement first showed the alleged error matters because it controls the federal billing-error notice window when Regulation Z applies.

Important scope correction: an ordinary HELOC is not automatically covered by Regulation X mortgage-servicing rules

The CFPB’s Regulation X mortgage-servicing subpart defines a covered mortgage loan as a federally related mortgage loan subject to stated exemptions, but expressly excludes open-end lines of credit (home-equity plans). An ordinary open-end HELOC therefore should not automatically be treated as if it were a closed-end mortgage for purposes of the Regulation X Notice of Error or Request for Information procedures.

That distinction is important because Regulation X has detailed servicing-transfer, error-notice and response rules for loans within its scope. Those rules can be useful background, but citing the Regulation X process as the guaranteed federal remedy for every HELOC would be too broad. Confirm the type of account you have, read the agreement and billing-rights disclosure, and consider state-law or contract rights that may apply even when the Regulation X mortgage-servicing subpart does not.

Gather the records before contacting either company

Create one file for the account. Include copies of:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The HELOC agreement, amendments and any rate or fee schedule.
  • The last complete statement and transaction history from the former servicer.
  • The transfer notice, including the effective date, new account number and payment instructions.
  • The first statement and transaction history issued by the new servicer.
  • Bank statements, cancelled checks, bill-pay confirmations or electronic-payment receipts showing the payment date, amount and destination.
  • Records of calls, secure messages and letters, with dates, names or identification numbers and what was promised.

Keep originals in your possession. Send copies of supporting records with a written notice, and retain a complete copy of everything submitted. If you speak by phone, follow up with a short written description so the account record does not depend on memory.

Reconcile the balance line by line

Use a simple worksheet with the final old-servicer balance as the starting point and the new-servicer opening balance as the comparison point. Check each item against the agreement and the transaction records:

  • Opening and closing balances: Confirm that the amount transferred equals the former servicer’s closing principal, subject to transactions posted around the effective date.
  • Payment received date: Compare the date your bank or bill-pay provider sent the money, the date the former servicer received it and the date either servicer posted it.
  • Principal and interest allocation: Verify how each payment was divided and whether the agreement specifies an order of application.
  • Interest rate or index changes: Check the index, margin, adjustment date and rate shown on the statement against the contract. A rate change can alter interest without being a transfer error.
  • Fees: Identify annual, late, transaction or other charges and check whether the agreement authorizes them and whether a payment dispute caused a charge.
  • Advances and credits: Look for new draws, refunds, reversals, insurance or other credits that may explain a balance movement.

Write down the exact transaction date, amount, statement date and line description for every disputed item. State whether the issue is a missing credit, wrong allocation, arithmetic or interest calculation, fee, or a mismatch in transferred history. A precise description makes it easier to select the correct notice address and for the creditor to investigate.

Choose the procedure that matches the error

What you see What to verify Potential route
Payment or credit absent from a periodic statement Payment amount, date sent, date received, posting date and statement on which it should appear Written Regulation Z billing-error notice if the account and statement are covered; use the billing-error address in the disclosure
Payment posted but allocated incorrectly Contractual payment-application order and the principal, interest and fee entries Regulation Z notice when the allocation or resulting amount is a statement billing error; describe the precise correction requested
Math, interest or similar accounting error Rate/index, number of days, balance used and calculation on the statement Regulation Z billing-error notice for a covered statement error; attach your calculation
Fee that appears unsupported or caused by the transfer Agreement authorization, timing, amount and whether the fee is tied to the alleged error Raise it in the billing-error notice if it is a covered statement error; contract or state-law remedies may also matter
Missing transfer history or an unexplained opening balance, with no identified statement error Transferred balance, payment ledger, posting records and effective-date entries Send a separate, narrow written records request to the new servicer and, if useful, the former servicer. Do not assume Regulation X request deadlines govern an open-end HELOC

One account can present both issues. For example, a missing payment credit may be a billing error, while the absence of the old transaction ledger is a records problem. Describe and send each request separately so the creditor can identify what must be investigated and what records must be produced.

Use Regulation Z’s billing-error process when the statement is wrong

Regulation Z defines billing errors to include a payment or other credit that was not properly reflected on a periodic statement and a computational or similar accounting error. If your HELOC is a covered open-end credit plan and the alleged problem appears on a statement, the federal route is a written billing-error notice to the creditor.

1. Find the correct address and submission method

Use the billing-error address and any required submission method in the account’s billing-rights disclosure or periodic statement. A general payment address, branch address or customer-service email may not be the address designated for billing-error notices. If the disclosure gives special instructions, follow them exactly. When the creditor’s address has changed, use the address shown on the most recent disclosure and retain a copy of that page.

2. Meet the federal notice window when it applies

The creditor must receive the notice no later than 60 days after it transmitted the first periodic statement showing the alleged error. Send it as soon as you identify the discrepancy rather than waiting for a later statement. The deadline is tied to the first statement that reflects the error, not necessarily to the date you first called the servicer or to the date the transfer became effective.

3. Identify the account and the exact error

Your notice must enable the creditor to identify you and the account. Include your name, mailing address, account number or other identifier, the statement date, the transaction date and amount, and a clear explanation of what is wrong. Explain why the payment should have been credited, why the allocation conflicts with the agreement, or how the arithmetic does not work. State the correction you request, such as crediting a specified payment on a specified date, reversing a related charge or issuing a corrected statement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Attach useful evidence, not originals

Include copies of the relevant statement pages, payment confirmation, bank record, transfer notice and the portion of the agreement that supports your position. Mark the disputed line on the statement and, if useful, provide a short calculation showing the expected balance. Keep the originals and a complete copy of the notice.

5. Preserve proof of delivery

Use a submission method permitted by the disclosure that produces a dated confirmation or other delivery record. Save the receipt, tracking information, electronic confirmation and the exact documents sent. The issue is not resolved merely because a call-center representative says a note was added; preserve evidence that the written notice reached the designated address.

Sample notice structure

Subject: Billing-error notice for HELOC account [account number]
I am [name], the consumer responsible for account [account number]. The periodic statement dated [statement date] first showed the following alleged billing error: [payment not credited, incorrect allocation, computational error or other covered error].
Payment or entry at issue: [date], [amount], sent to or received by [entity]. The statement shows [what it says]. The correct treatment should be [specific correction], because [brief factual reason].
Please investigate and send a written response. Enclosed are copies of [list of records]. I request correction of the account and a corrected statement showing the result.

Use the bracketed text only as a drafting guide; replace it with your own account-specific facts before sending.

Know the creditor’s response timetable

Event Regulation Z timing for a covered billing error What it means for you
Notice received No later than 60 days after the creditor transmitted the first statement showing the alleged error Send early and to the disclosed billing-error address
Acknowledgment Generally within 30 days, unless the creditor completes the applicable resolution procedure within that period Keep the notice and delivery proof even if no acknowledgment arrives
Investigation and resolution Within two complete billing cycles, but never more than 90 days Watch for a written explanation, corrected account or other stated result

While a covered billing-error dispute is pending, you may withhold the amount you believe is related to the error, including related finance or other charges. That protection is limited: you remain responsible for undisputed amounts, and the dispute is not a general permission to stop paying the account. Follow the HELOC’s payment instructions for the undisputed portion and keep proof of each payment.

Send a separate records request when the ledger is missing

If you cannot determine the error because the transfer omitted transaction history or the new servicer cannot explain the opening balance, make a narrow written request for the records needed to reconcile the account. Ask for the transferred principal balance, payment-posting dates, payment amounts, allocation entries, reversals, fees, advances, credits and the effective-date ledger. Identify the exact period and entries; a broad demand for every document can delay a useful answer.

You may send the request to the new servicer and, if it still holds relevant records, to the former servicer. Label it as a records request rather than relying on a Regulation Z billing-error notice to obtain documents. For an open-end HELOC, do not promise that Regulation X’s formal Request for Information deadlines apply. The companies’ response obligations may instead come from the agreement, another federal rule, state law or their own procedures.

Do not assume the Regulation X 60-day transfer grace rule protects every HELOC

For mortgage-servicing transfers that are within Regulation X’s scope, the CFPB’s model transfer notice states: “Under Federal law, during the 60-day period following the effective date of the transfer of the loan servicing, a loan payment received by your old servicer on or before its due date may not be treated by the new servicer as late, and a late fee may not be imposed on you.”

That statement is a contrast, not an automatic HELOC answer. Because the Regulation X mortgage-loan definition excludes open-end home-equity plans, you should not rely on the 60-day grace rule without confirming that the account falls within the rule’s scope or that another contract or law supplies similar protection. Preserve proof that you paid on time and ask the creditor to remove any fee or delinquency entry you believe resulted from the transfer, but frame the request around the actual account and governing documents.

What to do if the response is incomplete or the balance still looks wrong

  1. Compare the written response with your worksheet. Check whether it addressed each disputed transaction, the posting date, allocation, fees and resulting balance. A response that discusses only one payment may not resolve the entire discrepancy.
  2. Request a corrected statement or itemized explanation. Identify the unresolved line and explain the remaining difference in dollars and dates. Attach the earlier notice and the new evidence rather than restarting the story from scratch.
  3. Keep paying undisputed amounts. Continue following the current payment instructions while preserving proof. If the creditor changes the payment address or account number, use the latest written instructions and keep the transfer notice.
  4. Escalate with the complete record. If the creditor or servicer does not address the issue, you can consider a complaint to the Consumer Financial Protection Bureau, the appropriate state regulator or advice from a qualified consumer-law attorney. The best venue depends on the institution type, state, contract terms, amount, collection activity and facts.

Escalation is especially important when the disputed amount is large, a deadline is close, collection calls continue, a credit consequence is threatened or foreclosure risk is involved. A lawyer can determine whether state statutes, contract provisions or remedies beyond the federal billing-error process apply to your particular HELOC.

Common transfer scenarios and the practical response

The payment was sent to the old servicer before the transfer

Collect the bank or bill-pay confirmation, the transfer effective date and both statements. Determine when the old servicer received and posted the money. If the first new statement omits the payment, describe that specific statement error in a Regulation Z notice when the account and facts are covered, and separately request the transferred ledger if necessary.

The payment appears, but the principal barely changed

Do not assume the allocation is wrong until you check accrued interest, the contractual order of application, rate changes and fees. If the entries still conflict with the agreement or the arithmetic on the statement, identify the exact allocation or calculation error and provide your calculation with the written notice.

The new opening balance is higher than the old closing balance

Compare effective-date advances, interest accrued through the transfer, fees, reversals and credits. Ask both companies for the ledger covering the handoff. If a particular statement contains an unexplained accounting entry, treat that entry as the potential billing error rather than alleging that every transfer difference is unlawful.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A late fee was added after the transfer

Verify the due date, the date and destination of your payment, the agreement’s late-fee terms and whether the account is covered by any transfer protection. Request reversal with the evidence you have. Do not state that the Regulation X 60-day grace period automatically applies to an open-end HELOC.

The rate changed at the same time as the transfer

Servicing changes and rate adjustments can occur close together. Check the index, margin, adjustment date, notice and calculation required by the HELOC agreement. A lawful variable-rate adjustment can explain a higher balance; an incorrect rate or calculation shown on a statement can be raised as a billing error when Regulation Z applies.

Final checklist before you send anything

  • Have you identified the first statement showing the alleged error?
  • Can you state the transaction date, amount, posting date and correction requested?
  • Did you compare the old closing balance with the new opening balance and account for interest, fees, advances and credits?
  • Are you sending a billing-error notice to the address and by the method disclosed for that purpose?
  • Are you sending copies, retaining originals and saving proof of delivery?
  • Did you make a separate, narrowly worded records request if transfer history is missing?
  • Will you continue paying undisputed amounts under the current instructions?
  • Have you considered state law or qualified legal advice if the amount, collection activity or foreclosure risk makes the issue urgent?
