Call your bank or credit union immediately using the number on your card, statement, or official app. Tell it the transaction is an unauthorized electronic fund transfer, ask it to block or replace the card, and request a fraud claim number. Then send written notice with the transaction details and keep copies of every document, screenshot, receipt, statement, and call note. U.S. Regulation E gives the institution investigation deadlines and can limit your loss when you report promptly, but the exact protection depends on what was compromised and when you noticed the transaction.
What to do as soon as you see an unauthorized debit-card transaction
1. Confirm that the transaction is truly unauthorized
Check the transaction date, amount, merchant descriptor, and whether a joint account holder or authorized user made the purchase. Some merchants use a parent company, payment processor, or a location different from the store name shown in your account. Contact the merchant only if that helps identify a legitimate purchase; do not delay your bank notice while trying to resolve a disputed transaction with the merchant.

If you still did not authorize the transfer, treat it as fraud even when the amount is small. A test charge can be followed by larger withdrawals, and waiting can affect the liability rules described below.

2. Contact the bank through an official channel
Use the telephone number printed on the physical card or statement, or the secure message or fraud function in the bank’s official app. Do not use a number from an unexpected text message, email, search advertisement, or caller claiming to be your bank. State clearly that you are reporting an unauthorized electronic fund transfer and want to open a formal claim.

Ask the representative to:
- Block the existing card and issue a replacement if the card, card number, PIN, or digital-wallet credential may be exposed.
- Review the account for additional unauthorized transfers and place appropriate restrictions on online, ATM, or card-not-present activity.
- Give you the claim or case number, the date and time the report was logged, and the address or secure upload method for written evidence.
- Explain whether the bank is treating the event under Regulation E and whether it needs a written statement before beginning the investigation.
3. Protect the account while the claim is pending
Change the online-banking password and the email password used for account recovery. Replace a compromised PIN, remove an unfamiliar device or digital-wallet token, and review scheduled transfers and linked external accounts. If checks, a checkbook, or other payment credentials were also exposed, tell the bank; a debit-card dispute does not automatically cover every type of account fraud.
4. Preserve evidence
Download or screenshot the account page showing the transaction, save statements, retain receipts and merchant correspondence, and write down every call’s date, time, representative name or ID, and promised action. Keep originals of documents and send copies. A chronological file makes it easier to prove when you noticed the transfer and what you reported.
Deadlines and how much you could owe
For U.S. consumer accounts, liability is tied to the type of compromise and the timing of your notice. The following limits come from the Consumer Financial Protection Bureau’s Regulation E guidance and the regulation itself. They are maximum exposures under the stated conditions, not an automatic charge that every bank will impose. A bank contract may voluntarily provide more generous protection.
| Situation | Required timing | Potential liability under Regulation E |
|---|---|---|
| Physical debit card or PIN lost or stolen | Notify the bank within two business days after learning of the loss or theft | The lesser of $50 or the amount of the unauthorized transfer |
| Physical card or PIN lost or stolen, but notice is later than two business days | Notify within the applicable statement period | Up to $500 for transfers before notice, subject to the regulation’s conditions |
| Unauthorized transfer shown on an account statement | Report no later than 60 calendar days after the statement was sent | Late notice can make you liable for later transfers if the bank can show that timely notice would have prevented them; after the 60-day period, liability can potentially be unlimited |
| Only the account number was compromised; physical card was not lost | Report immediately | The two-business-day lost-card tier may not be the applicable rule. Ask the bank which Regulation E provision it is applying. |
Business days and calendar days are different. Mark the statement date, the date you discovered the fraud, and the date you notified the bank. If a weekend or holiday is approaching, report first and sort out paperwork afterward. The 60-day period is measured from the statement showing the unauthorized transfer, not necessarily from the day the merchant processed it.
Point-of-sale debit transactions, certain newer accounts, and some foreign transactions can receive extended investigation periods under Regulation E. The bank should identify the extension it is using and the reason it applies to your transaction. Specialized products such as prepaid, payroll-card, and government-benefit accounts can have modified rules, so ask for the rule governing that particular account.

How to give written notice that meets the bank’s needs
Phone or app notice is usually fastest; written notice creates a dated record and supplies the information needed to identify the alleged error. Send the letter or secure message as soon as possible, even if the representative says the bank has already opened a claim. Follow the bank’s stated delivery method and keep proof of submission.
Information to include
- Your name and a safe way to contact you.
- The account identifier, such as the last four digits, and the type of account.
- The transaction date, amount, merchant or ATM name, and any reference number shown on the statement.
- A direct statement that you did not authorize the electronic fund transfer and did not receive the benefit of it.
- When and how you first noticed the transaction, and when you notified the bank by phone or app.
- A request for correction, written confirmation of the claim number, the investigation result, and the documents or information relied on if the claim is denied.
- Copies, not originals, of statements, receipts, police reports, travel records, or other evidence that supports your account.
Regulation E requires notice that enables the institution to identify the consumer and account and, to the extent possible, explains why the consumer believes an error exists and gives the error’s type, date, and amount. A detailed notice reduces back-and-forth and helps preserve the date on which the bank received the report.
Sample wording
Adapt the following model to the facts; do not sign a statement that is inaccurate:
I am writing to dispute a charge of [$______] to my [credit or debit card] account on [date of the charge]. I did not authorize this electronic fund transfer. Please investigate, correct the account, and send me written confirmation of the result. My account ends in [last four digits]. I first reported this matter by [phone/app] on [date], claim number [number]. Copies of supporting documents are enclosed; originals are retained.
The Federal Trade Commission’s sample dispute letter likewise recommends stating the amount and date, requesting correction, and enclosing copies rather than originals. Send the letter to the address or secure channel the bank provides for error notices, not merely to a general branch address unless the bank confirms that route.
What happens during the bank’s investigation
Initial investigation period
For an ordinary Regulation E claim, the bank generally must determine whether an error occurred within 10 business days after receiving notice. The Consumer Financial Protection Bureau describes this as the usual investigation period. The bank may contact you for clarification or documents, but you should not wait for a request before submitting the information you already have.

Provisional credit and a longer investigation
If the bank cannot complete the investigation within 10 business days, it may generally take up to 45 days when it provisionally credits the alleged error within those first 10 business days. Under the regulatory conditions for an unauthorized transfer, the bank may withhold up to $50 from the provisional credit. The account must receive use of the credited funds while the investigation continues.
Specified point-of-sale transactions, newer accounts, and foreign transactions can have longer permitted periods. Ask the bank to identify the applicable time limit in writing rather than assuming that every claim follows the ordinary schedule.
Final decision and correction
After completing the investigation, the bank must report the result within three business days. If it determines that an error occurred, it must correct the account within one business day. If it concludes that no error occurred, it must provide the required written explanation and tell you that it may reverse a provisional credit. A reversal cannot be treated as a surprise withdrawal: the bank must give the notice required by Regulation E before taking back credited funds.
Do not spend a provisional credit as though it were a final award until the bank confirms the claim is resolved. Keep enough money available to cover essential payments in case the credit is reversed, and monitor the account for that notice.
If the bank denies your fraud claim
Request the denial file
Ask for the denial and the information used to reach it in writing. Request transaction records, merchant or ATM data, device or authentication information the bank relied on, and the specific reason it says the transfer was authorized or that no error occurred. Also ask whether the bank analyzed the matter as an unauthorized electronic fund transfer under Regulation E.

Compare the explanation with your records
Look for factual errors such as the wrong transaction date, a card that was already replaced, an ATM location you could not have visited, or a claim that you failed to report on a date when your call log shows otherwise. Supply missing evidence promptly: travel or work records, proof that the card remained in your possession, a police report, screenshots of account alerts, or correspondence showing that a merchant did not receive the goods.
Write a concise reconsideration request that identifies each error in the denial and attaches a numbered exhibit list. Ask for a written response and keep the delivery confirmation. A second review does not reset the statutory notice deadlines, so continue to preserve the original report date.
Escalate outside the bank when necessary
U.S. government consumer guidance recommends contacting the institution first and providing receipts or other proof. If the bank does not resolve the issue, submit a complaint through the Consumer Financial Protection Bureau’s complaint process. The appropriate prudential regulator may also accept a complaint, depending on the bank’s charter. A regulator complaint is an oversight and response channel; it does not replace the bank notice that triggers Regulation E protections.
Describe the timeline, claim number, amount, dates of your notices, documents supplied, and the remedy you want. Attach copies, not originals, and redact unrelated account numbers or passwords.

When the debit-card fraud may be identity theft
A single stolen card number can be limited to one transaction. Other signs—new accounts, address changes, unfamiliar password resets, tax or employment notices, or several institutions reporting activity—suggest that someone obtained broader personal information.

Take parallel recovery steps
- Report the identity theft at IdentityTheft.gov and follow its recovery checklist.
- Review your credit reports for accounts or inquiries you do not recognize.
- Consider a fraud alert or other identity-theft recovery measure appropriate to your situation.
- Tell each affected bank, card issuer, or service provider separately; one debit-card claim does not correct unrelated accounts.
- Report scams to your bank or credit union immediately and ask whether a payment can be recalled or refunded.
These actions supplement, rather than replace, the bank’s debit-transfer notice. Keep the identity-theft report and any police report with your claim file.
Choosing the right response channel
| Option | Best use | Trade-off |
|---|---|---|
| Phone or secure app notice | Stop additional transactions quickly, block the card, and open a claim | Fast, but the conversation can be difficult to prove without notes or a follow-up message |
| Written notice | Provide the required transaction details and create a dated evidence trail | More documentation work; it should follow the immediate phone or app report, not delay it |
| Provisional credit | Maintain access to disputed funds during a longer investigation | It is temporary and can be reversed after the bank gives the required notice |
| Bank reconsideration or executive escalation | Correct factual errors and submit evidence missed in the first review | Internal review may not change a decision based on the bank’s interpretation of authorization |
| CFPB or prudential-regulator complaint | Seek external review when the bank has not resolved the matter | Oversight does not substitute for timely notice or guarantee reimbursement |
| Card-only response | Contain a compromised card or card number | Does not address broader identity theft or unrelated accounts |
| Identity-theft recovery | Protect credit and other accounts after broader personal information exposure | Requires separate reports and monitoring in addition to the debit claim |
Common mistakes that weaken a claim
- Waiting for the merchant first: Merchant contact can clarify a descriptor, but it should not postpone the bank’s fraud notice.
- Using an unverified phone number: A scammer can impersonate the bank. Start with the card, statement, or official app.
- Reporting only by phone: Make the call, then create a written record with the claim number and transaction details.
- Sending original evidence: Provide copies and keep the originals in your file.
- Ignoring later statements: New unauthorized transfers may create a separate notice issue. Review every statement and alert while the claim is open.
- Assuming a provisional credit is final: Read the investigation result and reversal notice before treating the money as permanently recovered.
- Missing the account-type distinction: Prepaid, payroll-card, government-benefit, and other specialized accounts may follow modified rules. Ask which provision applies.
- Failing to secure the underlying account: Replacing a card will not fix a stolen online-banking password, email account, PIN, or linked-account credential.
A practical claim checklist
- Record the transaction’s date, amount, merchant or ATM, and statement date.
- Call the bank through an official channel and state that the transfer was unauthorized.
- Block or replace the card and secure the PIN, online account, email, devices, and digital wallet.
- Obtain the claim number, reporting timestamp, written-notice address, and investigation timeline.
- Send a signed or authenticated written notice with the account identifier, transaction details, explanation, and copies of evidence.
- Save statements, screenshots, receipts, correspondence, delivery proof, and call notes in one chronological file.
- Track the 10-business-day investigation point and ask about provisional credit if the bank needs longer.
- Read the written result; if denied, obtain the information relied on, correct factual errors, and submit a focused reconsideration.
- If unresolved after dealing with the institution, use the CFPB complaint process or the appropriate prudential regulator.
- When personal information may be exposed, complete identity-theft and credit-monitoring steps in parallel.
What recovery can and cannot be promised
U.S. law gives a process for investigating unauthorized debit-card electronic fund transfers and sets liability limits when the consumer reports promptly. It does not guarantee that every disputed transaction will be refunded. The outcome depends on the facts, the evidence, the account type, the timing of notice, and whether the bank determines that an error occurred. No national recovery-rate statistic is established by the official guidance discussed here, so a bank-specific investigation—not a published success percentage—determines whether your money is restored.
Frequently Asked Questions
Does disputing a debit-card transaction cancel the merchant’s contract or return merchandise automatically?
No. A Regulation E claim concerns whether an electronic fund transfer was unauthorized or otherwise erroneous. Handle returns, subscriptions, or service disputes with the merchant separately while preserving the bank claim and its deadlines.

Tell the bank exactly what you recognize and what you did not authorize. A changed tip, duplicate charge, recurring payment, or altered amount may require a different error description, and the bank should explain which procedure applies.
Can I close the account after reporting the fraud?
Ask the bank first. Closing or changing an account can affect pending deposits, automatic payments, and access to claim records. Obtain written instructions and keep the old account statements before taking that step.
