A gas royalty is a contingent stream tied to future production under a mineral lease. A one-time access payment compensates you for defined surface rights, such as a pipeline easement or temporary construction access. They are different transactions with different risks, time horizons, tax treatment and effects on how you can use your land.
No universal royalty percentage or access-payment amount can be calculated without the state, title records, proposed agreement, production information and payment terms. The framework below lets you put both offers on a common basis and identify terms that may be worth more than the initial check.

Identify exactly what you would be giving up
Before comparing amounts, determine whether the proposal covers minerals, the surface, or both. A mineral lease gives an operator rights to explore for and produce oil or gas. A surface-use agreement or pipeline right-of-way gives a company specified rights to enter, construct, operate, inspect or maintain facilities on the land. A temporary construction easement may expire after work and restoration; a permanent easement can impose long-running restrictions.

Mineral and surface ownership can be split. The U.S. Department of Agriculture Economic Research Service (USDA ERS) explains that energy firms lease from the oil-and-gas-rights owner, who may or may not own the surface. You cannot evaluate a royalty offer unless the title confirms that you own the minerals being leased.

| Offer type | Interest conveyed | How payment is determined | Main economic exposure |
|---|---|---|---|
| Mineral lease royalty | Right to explore and produce minerals for the lease term | Share of production value under the lease formula, often with a signing bonus or other consideration | No production, low prices, deductions, allocation and shut-in provisions can reduce or eliminate receipts |
| Permanent surface easement | Defined right to place and operate a facility, such as a pipeline, and to enter for inspection or maintenance | Negotiated consideration for the easement, sometimes plus separate damage or restoration payments | Loss of use, construction disruption and restrictions may continue for decades |
| Temporary construction easement | Time-limited access and work area | Negotiated payment for the temporary use and documented damage | Crop, soil, drainage, fence and restoration problems if protections are weak |
How a gas royalty actually produces cash
Royalty is a percentage of a defined value
USDA ERS describes a royalty as a share of production value at a rate specified in the lease. The percentage alone is not a guaranteed return. Your result depends on whether a well produces, the volume sold, the sale price, the point at which value is measured, deductions for gathering or processing, your ownership fraction and the lease’s accounting and reporting language.
A practical model separates the variables:
Royalty received = production volume × contract value × royalty rate × your ownership share − permitted deductions
Use the exact definition in the proposed lease. “Gross proceeds,” “at the wellhead,” and other valuation terms can produce materially different results. Check who bears post-production costs, how sales to affiliates are priced, when statements and payments arrive, and whether you have audit rights.

Do not treat a signing bonus as proof that production will occur. A well may be delayed, never drilled, shut in, decline faster than expected or operate only intermittently. Model timing as well as amount: a dollar received years from now is worth less than a dollar received at signing, and the lease may allow extensions or continued operations that keep your land committed.

Build conservative, middle and optimistic cases only when credible, property-specific information supports them. A forecast without well data, price assumptions and contract terms is not a valuation. If those inputs are unavailable, compare the rights and risks rather than inventing an expected royalty total.
What a one-time access payment buys
Read the easement as a land-use contract
A one-time payment compensates you for the rights written into the access agreement; it does not automatically sell your minerals. For interstate pipeline facilities, the Federal Energy Regulatory Commission (FERC) says the company negotiates a right-of-way easement and compensation with each landowner. FERC also says compensation may cover loss of certain land uses during and after construction, loss of other resources and property damage.
Review the legal description, route, width and maps. FERC’s general landowner guidance describes a permanent right-of-way as usually about 50 feet wide and a construction right-of-way as generally 75 to 100 feet wide, with additional space sometimes required. Those are general descriptions, not guaranteed dimensions for your project.
Duration can outlast the payment
FERC states that a permanent pipeline right-of-way may remain for 20 to 50 years or more, commonly until abandonment is approved. The easement should say whether it is permanent, how abandonment is established, and whether the company must remove facilities and restore the land. Permitted uses, prohibited activities and uses requiring company permission should be listed rather than left to informal promises.

Separate base compensation from damage payments
Determine whether the initial check covers only the easement or also construction impacts. The agreement should address crop loss, timber, soil compaction, drainage and erosion, fences and gates, roads, buildings, trees, wells, septic systems and future improvements. Specify how damage is measured, when it is paid, who performs restoration and what happens if restoration fails.
Put the two offers on a common valuation date
Step 1: Establish the rights and title
- Obtain the deed, title work, mineral reservations, prior leases and recorded easements.
- Confirm whether you own all minerals, a fractional mineral interest, only the surface, or a combination.
- Identify the requested transaction: mineral lease, permanent easement, temporary construction use, access road, or several documents together.
- Map the affected acreage and note existing homes, crops, timber, conservation areas, drainage, wells and planned improvements.
Step 2: List every payment and trigger
For a lease, list any signing bonus, delay rentals, minimum royalties, production royalties, shut-in payments and damage payments. For an easement, list the initial consideration, temporary-work-area payment, construction damages, crop-loss schedule, restoration holdback and payments for additional access or facilities. Record the date and condition for each payment; “one-time” does not mean that every possible damage payment is included, and “royalty” does not mean money arrives immediately.
Step 3: Build a royalty cash-flow schedule
For each credible production case, enter expected start date, annual volume, price basis, royalty rate, ownership fraction, deductions, taxes and the date of receipt. Show gross and net figures separately. Include a zero-production case. A spreadsheet should make each assumption visible so that changing one lease clause does not silently change the result.

Start with the negotiated payment, then quantify the land-use burden: acreage unavailable for buildings or deep-rooted trees, restricted cultivation, extra farm passes, monitoring obligations, disrupted operations and reduced flexibility for future development. Add expected damage and restoration payments only when the contract makes them enforceable. A permanent restriction can have value even when annual damage is hard to predict.

Step 5: Discount future amounts
Choose and disclose a discount rate that reflects time, inflation, counterparty and production risk. Discount royalty receipts and future damage payments to the same date as the access payment. Do not present a single “net present value” as objective if the production, price or discount assumptions are speculative; show a range and explain what drives it.
Step 6: Compare risk allocation, not just totals
Ask which party bears each risk. A royalty owner bears production and price risk but may retain upside. An easement recipient receives more certain consideration but may bear long-term restrictions, restoration disputes and opportunity costs. Insurance, indemnity, bonding, audit rights and default remedies can shift part of that risk.
Contract terms that can change the result
Mineral-lease provisions
- Primary term and extensions: Check the initial term, extension options, delay rentals and what counts as production that keeps the lease alive.
- Royalty base: Define the sale point, affiliate transactions, gathering, processing, compression and other deductions.
- Pooling and allocation: Understand how production from a unit is allocated to your tract and whether the operator can amend the unit.
- Payment and statements: Require clear timing, supporting detail, late-payment remedies and audit rights.
- Surface rights: Specify where roads, pads, pipelines and equipment may go, operating hours, fencing, drainage, reclamation and compensation for damage.
- Assignment and remedies: Review assignment rights, liens, indemnity, insurance, default, termination and dispute procedures.
Access and pipeline provisions
- Route and width: Attach a surveyed exhibit and identify permanent and temporary work areas.
- Construction controls: Set work seasons, topsoil handling, compaction limits, erosion controls, drainage standards, access roads and traffic rules.
- Use restrictions: State where buildings, trees, deep tillage, ponds, blasting and future utilities are prohibited or require permission.
- Inspection and maintenance: Define notice, frequency, emergency entry, gates, escort requirements and responsibility for repeated damage.
- Restoration: Set measurable standards, deadlines, reseeding requirements, weed control, soil testing and a process for unresolved defects.
- Abandonment: Require notice, removal or capping of facilities, cleanup and release of the easement where appropriate.
- Indemnity and insurance: Allocate responsibility for spills, fire, injury, environmental harm and contractor conduct, with proof of coverage.
Tax treatment is not interchangeable
The Internal Revenue Service states that royalties from oil, gas and mineral properties are generally taxable as ordinary income and generally reported on Schedule E, with different rules for an operating interest or business activity. Your depletion treatment and state tax position require review of the actual ownership and lease.

IRS Publication 225, the Farmer’s Tax Guide, says temporary construction-easement income is rental income in its farm guidance. For a permanent right-of-way, its example may treat the payment as a sale that reduces the basis allocated to the affected land, with any excess potentially treated as gain. The IRS also cautions that easement income can result in income, a reduction in the basis of all or part of the farmland, or both. These are federal examples for specified facts, not a determination of your contract.
Before signing, give a tax professional the complete agreement, payment schedule, property basis, ownership percentages and intended use of the land. Ask about federal and state income tax, capital-gain treatment, self-employment tax, depletion, installment reporting and estimated-tax payments.
Useful context—and limits on benchmarks
USDA ERS reported that owners of oil and gas rights typically lease their rights rather than sell them; leasing can provide royalties over time, while selling the rights provides a one-time payment based on estimated future development revenue. Using 2014 survey data, USDA estimated that farm operators and non-operator landlords owned $32.9 billion in oil and gas rights and received $7.4 billion in lease payments that year. Those historical farm-sector figures are not a value for an individual parcel.

The U.S. Department of the Interior says federal onshore oil-and-gas royalty rates are generally set at 12.5 percent, with exceptions. That figure applies to federal public-land leasing examples, not to private-land market offers and not to what you should accept.
Negotiation and due-diligence checklist
- Pause before signing: Request the complete agreement, exhibits, maps, payment schedule and any operating or construction standards.
- Verify authority: Confirm the offeror’s legal entity, operator or pipeline company, assignment rights and authority to bind the project.
- Check title: Have a title professional identify mineral ownership, fractional interests, reservations and existing easements.
- Mark the ground: Walk the proposed route and work area; photograph crops, fences, drainage, trees, structures and soil conditions.
- Separate compensation categories: Negotiate easement consideration, temporary-use payments, crop and timber damages, restoration security and future damage schedules separately.
- Clarify future control: Ask what you may build, plant, drain, excavate or sell, and what consent standard applies to future changes.
- Stress-test the royalty: Model no production, delayed production, low prices, rapid decline, high deductions, shut-in periods and different allocation outcomes.
- Obtain professional review: Use an attorney experienced in oil-and-gas and surface-use agreements, a qualified appraiser when land burden is disputed, and a tax professional for payment characterization and basis.
Decision framework
| Question | Royalty may fit better when… | One-time access payment may fit better when… |
|---|---|---|
| Need for certainty | You can tolerate uncertain timing and production risk in exchange for potential upside. | You value known consideration at signing and do not want income tied to a well’s performance. |
| Land-use impact | The lease can protect surface use and the expected development footprint is acceptable. | The route and restrictions are clearly defined, fully compensated and compatible with your plans. |
| Time horizon | You can keep the mineral interest committed for the primary term and possible extensions. | You understand that a permanent easement may remain for 20 to 50 years or more in the FERC-described pipeline context. |
| Information quality | You have credible geological, production, price and accounting information. | The payment is attractive even without speculative production assumptions. |
| Tax and liquidity | You have planned for recurring ordinary-income treatment and related reporting. | You have reviewed whether the payment is rental income, basis reduction, gain or a combination under the actual facts. |
Common mistakes to avoid
- Comparing a percentage with a lump sum: A royalty rate is not a dollar value until production, price, deductions and ownership are modeled.
- Assuming surface ownership includes minerals: Check reservations and prior conveyances in the title records.
- Treating an easement as a mineral sale: Surface access does not automatically transfer subsurface rights.
- Relying on a federal rate: Federal onshore rates do not establish a private-land market rate.
- Ignoring restrictions: A payment can look generous until prohibited buildings, trees, drainage changes or future development are valued.
- Accepting vague restoration language: “Restore as reasonably practicable” is weaker than measurable standards, deadlines and remedies.
- Overlooking assignment and abandonment: A new owner or an idle facility may still retain rights unless the contract addresses both.
- Assuming tax treatment from a label: “Bonus,” “damages” or “easement payment” does not determine federal or state treatment by itself.
When to get advice
Professional review is especially important when the offer affects a large acreage, a primary residence or farm operation, a fractional mineral interest, a permanent right-of-way, or significant future development plans. Ask counsel to identify every interest conveyed, term, renewal provision, deduction, payment trigger, access right and remedy. Ask an appraiser to analyze the affected parcel and remaining-use burden when compensation is disputed. Ask a tax professional to review the actual payment language and your basis rather than relying on a generic internet example.
The sound comparison is therefore a documented, risk-adjusted cash-flow analysis tied to the exact contracts. If the royalty’s production assumptions cannot be supported, do not manufacture a return; negotiate the access terms and value the certainty and land-use burden on their own merits.
