How to claim input tax credit on foreign SaaS and cloud subscriptions in India

Short answer: An Indian GST-registered business generally has to treat a subscription bought directly from a supplier outside India as an import of services when the supplier is outside India, the recipient is in India and the place of supply is in India. The business then reports and pays IGST under reverse charge, and may claim input tax credit (ITC) only to the extent the tax and the underlying service satisfy the normal GST eligibility rules.

Paying the foreign vendor in Indian rupees does not, by itself, remove the reverse-charge obligation. The contracting entity, recipient establishment, place of supply, service classification, business use and filing-period rules all matter. This guide sets out a defensible process for checking those facts, reporting the liability and claiming only the credit the law permits.

When a foreign SaaS subscription is an import of services

The starting point is the statutory import-of-services test. A direct subscription is ordinarily within that test when all three conditions are met:

  • The supplier is located outside India.
  • The recipient of the service is located in India.
  • The place of supply is in India.

CBIC’s FAQ uses foreign software purchased for use by a GST-registered Indian firm as its example of a reverse-charge transaction. It also answers the specific question of whether the result changes when the foreign supplier accepts payment in Indian rupees: “The factum of which currency was used to pay the consideration is immaterial.” Currency, a card payment, a bank transfer or a local-currency invoice cannot substitute for checking the three statutory facts.

Identify the real supplier, not just the product name

Use the legal entity named in the order form, master subscription agreement, invoice and payment records. A familiar software brand may have an Indian subsidiary, an Indian distributor or a foreign contracting company. Those arrangements can produce different GST results. If an Indian entity is the supplier on the contract and invoice, do not automatically apply the foreign-supplier import analysis. If the foreign entity contracts directly with the Indian business, document that relationship even when an Indian sales representative or payment processor is involved.

Identify the GST recipient and establishment

The recipient should be the GST-registered business or establishment that receives and uses the service. Confirm the GSTIN shown in your internal procurement and accounting records, the location of the office or team using the subscription, and whether another registration or group company is the actual recipient. A central procurement team paying for several registrations should not assume that one GSTIN can claim every subscription without an allocation and supportable business-use basis.

Check the service and place-of-supply rules

Cloud computing is expressly included in the Integrated Goods and Services Tax Act’s definition of online information and database access or retrieval (OIDAR) services. Many hosted applications, storage products, platform services and similar subscriptions will therefore require an OIDAR analysis. The label is not a shortcut, however: classify the actual service and apply the place-of-supply rule that fits the transaction.

Why place of supply is decisive

An overseas supplier and an Indian customer are not enough by themselves. The import test also requires the place of supply to be in India. For a typical business-to-business service, the recipient’s location is an important starting fact, but special rules, recipient establishments and the nature of the service can affect the conclusion. Record the rule applied and the facts supporting it for each material subscription.

Questions to answer before calculating tax

  • Which entity issued the legally operative invoice or billing record?
  • Where is that entity located for GST purposes?
  • Which Indian GST registration receives the service?
  • What exactly is supplied: software access, cloud infrastructure, storage, support, implementation or a bundled service?
  • Where is the service actually received and used?
  • Does a specific place-of-supply provision apply instead of the general rule?

Keep the answers together with the agreement and invoice. A payment statement alone rarely establishes all of these facts.

Choose the correct reporting treatment

Once the transaction meets the import-of-services conditions, determine the applicable classification and rate for the relevant tax period. There is no single universal rate that can safely be stated for every SaaS or cloud arrangement. A bundled platform, a separately billed support service and a cloud-infrastructure contract may require different classification analysis. Verify the current rate notification and any exemption before filing.

Question Why it changes the treatment
Is the contracting supplier outside India? A foreign supplier is one element of the import-of-services test; an Indian contracting supplier requires a different analysis.
Is the recipient registered under GST? The registered-business reverse-charge and ITC process described here is aimed at a GST-registered recipient. A non-registered or non-business recipient should not assume the same result.
Is the place of supply in India? Import status depends on this condition in addition to supplier and recipient locations.
Is use exclusively for eligible business activity? Business use supports ITC; non-business, exempt-use and blocked-credit restrictions can reduce or eliminate it.
Is the use mixed between taxable, exempt and non-business activity? The eligible amount must be apportioned under the applicable rules rather than claimed in full.
Which service classification and rate apply? The tax amount and return reporting depend on the facts and the notification in force for the filing period.

Step-by-step process for paying RCM and claiming ITC

1. Assemble the transaction file

Collect the subscription agreement or order form, invoice or billing record, renewal notices, payment confirmation, vendor tax details and the internal purchase request. Record the supplier’s legal name and address, the Indian GSTIN receiving the service, the service period, currency, amount and the users or business unit. If the invoice is generated by a platform or payment intermediary, identify which entity is actually contracting with you.

2. Confirm import status

Write a short transaction memo applying the three-part test: supplier outside India, recipient in India and place of supply in India. Note the place-of-supply provision used and why it fits the service. Retain evidence if the supplier has more than one regional entity or if the subscription is shared across establishments.

3. Classify the supply and verify the rate

Describe the actual deliverable rather than relying only on a marketing label such as “SaaS” or “cloud.” Check the current tariff classification, rate notification and any exemption applicable to the service and tax period. Where a single invoice bundles software access, storage, support or implementation, determine whether the components are treated together or separately under the applicable rules.

4. Convert the consideration and compute IGST

Use the valuation and foreign-currency conversion method applicable to the transaction and the relevant tax period. Your calculation should show the invoice amount, conversion basis, taxable value, rate used, IGST payable and any allocation between GST registrations. Do not use the fact that the vendor charged or collected Indian rupees as a reason to omit reverse charge.

5. Report the liability in GSTR-3B

The prescribed GSTR-3B includes table 3.1(d) for inward supplies liable to reverse charge. Report the import-of-services liability in the appropriate current field for the filing period, with the taxable value and IGST calculated from your working papers.

GSTR-3B area What it is used for
Table 3.1(d) Inward supplies liable to reverse charge, including the RCM liability for a covered import of services.
Table 4(A)(2) ITC relating to import of services.
Table 4(A)(3) Other inward-supply RCM ITC, where that field is the appropriate one for the transaction and current return instructions.

Return formats and portal guidance can be amended. The GST portal’s GSTR-2B advisory also directs taxpayers to report RCM liability in table 3.1(d) and explains that credit is taken in the relevant ITC field after the covered RCM tax is paid. Follow the return and portal instructions applicable to your filing period rather than copying an old template.

6. Pay the reverse-charge tax as required

RCM tax is the recipient’s liability. Complete the payment and ledger steps required for the return, and retain the challan, electronic liability register and filing acknowledgement. Reconcile the amount paid with the calculation and the figure reported in table 3.1(d). Do not treat a foreign vendor’s invoice as proof that the Indian liability has been discharged.

7. Test ITC eligibility before taking credit

Section 16 conditions apply even though the tax was paid under reverse charge. Confirm that the service is received, used or intended for the registered business, the tax has actually been paid, the return and other statutory conditions are satisfied, and the claim is within the applicable time limits. CBIC has stated that tax paid by the recipient under reverse charge can be credited, including in the same month, when the conditions are met. “Same month” is a possibility, not a blanket entitlement to full credit.

8. Claim and reconcile the eligible amount

Enter the eligible ITC in the appropriate GSTR-3B field, distinguish import-of-services credit from other inward RCM credit, and reconcile the claim to the RCM calculation and proof of payment. If only part of the tax is eligible, claim only that part and document the apportionment. Preserve a schedule showing the invoice, tax paid, amount claimed, amount deferred or reversed and the reason for any restriction.

How much ITC can be claimed?

Exclusive taxable-business use

Where the subscription is used exclusively for the registered business’s eligible taxable activities and no blocked-credit rule applies, the reverse-charge IGST can generally be considered for credit after payment and satisfaction of the statutory conditions. “Generally” matters: the agreement, actual receipt, tax calculation and filing records still have to support the claim.

Mixed business and non-business use

Section 17 restricts credit attributable to non-business use. For example, a company-wide productivity platform used partly for personal activity, a director’s private project or an unrelated group entity cannot be claimed in full merely because the invoice is addressed to the company. Identify the users and usage basis, apply the prescribed apportionment method and retain the computation.

Taxable and exempt supplies

If the same subscription supports both taxable and exempt outward supplies, the portion attributable to exempt turnover is restricted under the relevant section 17 rules. Update the allocation when the business mix changes; a percentage fixed at purchase may not remain accurate for the whole tax period.

Blocked categories and other statutory restrictions

Section 17 also blocks or restricts specified categories of credit. A SaaS or cloud invoice does not become eligible simply because it is digital or necessary for management. Check whether the underlying use falls within a blocked category, whether the service is actually received by the claimant and whether any other section 16 or 17 condition applies.

Worked examples without assuming a tax rate

Direct foreign subscription used for taxable operations

An Indian GST-registered company signs directly with a foreign software supplier. The invoice shows a subscription fee of ₹100,000, the service is used by the company’s taxable business team and the place-of-supply review concludes that the supply is in India. The company should:

  1. Document the supplier, recipient and place-of-supply facts.
  2. Apply the notified classification and rate for the filing period. If the applicable rate is represented by r, the IGST working is ₹100,000 multiplied by r, after applying the required valuation and currency rules.
  3. Report the resulting liability in GSTR-3B table 3.1(d) and pay it under reverse charge.
  4. Claim the paid tax in the import-of-services ITC field, subject to section 16 and section 17 conditions.

The example demonstrates the sequence; it does not establish that every SaaS invoice attracts the same rate.

Subscription shared with an exempt activity

A company uses one cloud platform for both taxable consulting and an exempt activity. The RCM tax is not automatically wholly creditable. The company must identify the common-use portion and apply the prescribed restriction or apportionment, claiming only the eligible amount and retaining the calculation.

Foreign invoice paid in rupees

A foreign supplier accepts INR through an Indian bank account or payment gateway, but the contract remains with the foreign entity. Payment currency does not change the supplier-location or place-of-supply analysis. The company still applies the import and RCM tests to the legal transaction.

Records to retain for an audit trail

The following file is practical support for the factual and eligibility tests; it is not a claim that this list replaces every prescribed record requirement:

  • Executed subscription agreement, order form and renewal terms.
  • Invoice, billing statement or other vendor record showing the contracting supplier.
  • Evidence of the supplier’s location and the recipient GSTIN.
  • Description of the service, user list, business unit and internal business purpose.
  • Payment advice, bank or card statement and foreign-currency conversion working.
  • Place-of-supply memo and classification or rate analysis.
  • RCM tax computation, approval and proof of payment.
  • GSTR-3B acknowledgement and a reconciliation to table 3.1(d) and the ITC field used.
  • Apportionment, reversal or restriction workings for mixed, exempt or non-business use.

Common mistakes and how to correct them

Assuming INR payment means no RCM

Correct the file by applying the statutory import test to the supplier and recipient, not to the currency. CBIC’s FAQ expressly treats currency as immaterial in its foreign-software example.

Using the vendor’s marketing label as the GST classification

Replace a generic “cloud” or “SaaS” description with the actual contractual deliverable and the classification supporting the rate used. Recalculate if the invoice combines multiple services.

Claiming credit before paying the RCM tax

Match the ITC claim to proof that the reverse-charge liability was paid and to the return instructions for the filing period. If payment, reporting and credit appear in different periods, keep a reconciliation explaining the timing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Claiming 100% credit for mixed use

Separate taxable, exempt, non-business and blocked portions. Apply the relevant apportionment and reversal rules instead of treating the full invoice as eligible.

Ignoring a change in contracting entity

Check every renewal and invoice. A supplier migration from a foreign entity to an Indian entity, or the reverse, can change the GST treatment even when the product and user interface remain the same.

Copying old GSTR-3B instructions

Use the current return form and portal advisory. Table 3.1(d) is the RCM liability location identified in the prescribed form, while the ITC fields distinguish import of services from other inward RCM. Confirm the field mapping for the relevant period before filing.

Special situations

Indian reseller or marketplace in the chain

If an Indian reseller issues the invoice and is the contracting supplier, the transaction may not be an import of services by the customer. Examine the reseller’s invoice, agreement and GST treatment rather than paying RCM on the foreign vendor’s name alone. If the foreign entity remains the supplier and the Indian intermediary only processes payment, the import analysis may still apply.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Recipient is not GST-registered

This article’s RCM-and-ITC workflow is for a GST-registered business. A person who is not registered, or who is not receiving the service for a business, should not assume that the same ITC claim is available. OIDAR supplies to non-taxable online recipients have separate statutory provisions that require a separate review.

Multiple registrations or group companies

Allocate the subscription to the registration that actually receives and uses it. If a central team buys access for several registrations, maintain an allocation method based on documented use and consider whether the contracting recipient and invoicing arrangement support the proposed distribution. Do not duplicate the same RCM liability or ITC across registrations.

Refunds, cancellations and credits from the vendor

If the supplier refunds, cancels or changes the consideration after RCM was reported, revisit the taxable value, liability and any ITC already claimed. Preserve the credit note, refund evidence and adjustment working, and make the correction in the return period permitted by the applicable rules.

Pre-filing checklist

  1. Supplier’s legal entity and location are confirmed from the contract and invoice.
  2. Indian GSTIN and receiving establishment are identified.
  3. Service description, OIDAR relevance and place-of-supply rule are documented.
  4. Classification, rate and any exemption are checked for the filing period.
  5. Taxable value, currency conversion and IGST calculation are approved.
  6. RCM liability is reported in GSTR-3B table 3.1(d).
  7. Reverse-charge tax is paid and the payment evidence is retained.
  8. ITC is tested under sections 16 and 17, including business use, exempt-use apportionment and blocked credits.
  9. Eligible credit is entered in the appropriate import-of-services or other RCM field.
  10. Invoice, agreement, use evidence, calculations, payment proof and return figures reconcile.

What to verify for each filing period

GST treatment can change when the supplier entity, contract, service bundle, recipient registration, place-of-supply facts, rate notification or return format changes. Reperform the factual checks for material renewals and new subscriptions rather than carrying forward an old conclusion. Where the facts are unusual or the credit is material, obtain transaction-specific professional advice before filing.
