HRA exemption is tied to rent you actually pay for the residential accommodation you occupy. If you rent your own home and separately pay for a home occupied only by your parents, calculate the exemption using only the rent for your own residence. A different, fact-specific question arises when you live in a home owned by a parent and pay that parent genuine rent.
The rule behind an HRA claim
House Rent Allowance (HRA) exemption is governed by section 10(13A) of the Income-tax Act, 1961, read with Rule 2A. The statutory wording refers to an allowance paid by an employer to meet expenditure actually incurred for rent “in respect of residential accommodation occupied by the assessee.” In practical terms, three facts must line up: you receive HRA from your employer, you actually pay rent, and the rented residence is occupied by you.
As an Amazon Associate I earn from qualifying purchases.
The same provision excludes a case in which the accommodation occupied by you is owned by you or you have not actually incurred rent expenditure. Paying money as informal family support, paying someone else’s housing costs, or recording a paper rent without a genuine tenancy does not satisfy the actual-rent requirement.
What this means when there are two homes
If you occupy one rented home and your parents occupy another, the parents’ home is not the “residential accommodation occupied by the assessee” for your HRA calculation. The fact that you transfer the money, sign the lease, or bear the household cost does not turn your parents’ residence into your residence.

Only the rent for the accommodation you occupy can be used in the HRA computation. Keep the two arrangements separate in your records and in any explanation to your employer or the tax department.
How the exempt amount is calculated
Under section 10(13A) and Rule 2A, the exempt HRA is the least of the following three amounts:
| Component | How to determine it |
|---|---|
| Actual HRA received | The HRA shown in your salary for the relevant period. |
| Rent minus 10% of salary | Rent actually paid for the residence you occupy, less 10% of salary. |
| Location percentage of salary | 50% of salary when the residence is in Mumbai, Kolkata, Delhi or Chennai; 40% of salary everywhere else. |
For this formula, the Income Tax Department’s salary guidance defines “salary” as basic salary plus qualifying dearness allowance and commission based on a fixed percentage of turnover. Do not automatically add every allowance, bonus or reimbursement to the salary figure used for HRA.

Illustrative calculation
Suppose an employee receives annual HRA of ₹240,000, pays ₹300,000 rent for the home they occupy, and has annual salary for HRA purposes of ₹600,000. The three amounts are:
- Actual HRA: ₹240,000.
- Rent minus 10% of salary: ₹300,000 − ₹60,000 = ₹240,000.
- Location limit: ₹300,000 in a 50% city, or ₹240,000 in another location.
The exempt amount is the lowest applicable figure. In this illustration it is ₹240,000, before considering any period-of-year changes in salary, rent or HRA. If your parents’ separate rent was ₹120,000, that amount is not added to the ₹300,000 used above.
Can you include your parents’ rent in your HRA claim?
No, not when your parents are the only occupants of that separate property. The occupancy condition is decisive. The following scenarios show how to classify the most common arrangements.
| Arrangement | Rent considered for your HRA | Why |
|---|---|---|
| You rent and occupy your own home; your parents live in another home whose rent you pay. | Rent for your own occupied home only. | The parents’ residence is not occupied by you. |
| You and your parents share the same rented home and you genuinely pay rent. | The rent for that shared residence, subject to the normal formula. | You occupy the accommodation; the ordinary HRA conditions still apply. |
| You live in a home owned by a parent and pay that parent rent. | Potentially the rent for the home you occupy, but the relationship makes the facts important. | The cited statutory wording focuses on actual rent and your occupied residence; it does not expressly provide a parent-specific answer. |
| You pay a parent’s mortgage, maintenance or household expenses without a real rent arrangement. | Not treated as rent for HRA. | Those payments are not necessarily rent actually incurred under a genuine tenancy. |
Your own rented home plus a parents’ separate home
Use only your own rent in the “rent minus 10% of salary” limb. Do not combine both leases, average the payments, or claim the total because you are the person making the bank transfers. If your employer asks for rent receipts, submit documents for the residence you occupy and identify the address consistently across the lease, receipts and payment records.

A home shared with your parents
When you actually live in the same accommodation as your parents, the separate-home problem does not arise. You still need to have received HRA, paid genuine rent, and satisfy the formula. The amount is capped by the least-of-three calculation; sharing the home does not create an extra exemption or allow rent above the amount you actually pay.
Can you pay rent to your parents and claim HRA?
This question is different from paying for a separate home occupied only by your parents. If a parent owns the home in which you live and you pay that parent rent, the general wording of section 10(13A) looks to the residence you occupy and the rent you actually incur. The cited official material does not expressly exclude a parent as landlord, but it also does not provide a parent-specific interpretation that guarantees the exemption.
Any claim therefore depends on the real facts. A defensible arrangement should reflect an actual landlord-tenant relationship rather than a label created solely to reduce tax. Before claiming, check that:
- You genuinely live at the property during the period for which exemption is claimed.
- The rent amount and payment schedule were agreed in advance and are commercially credible for the property and location.
- Payments were actually made through traceable means, not merely recorded in a spreadsheet or adjusted informally.
- The parent reports the rental income as required under the applicable tax rules and the ownership details are accurate.
- The address, rental period, receipts, bank records and employer declaration all match.
The absence of a specific official interpretation means you should not describe this arrangement as automatically eligible or automatically disqualified. If the amount is material, the ownership is shared, or the arrangement has unusual terms, obtain advice from a qualified tax professional who can review the documents and the tax year involved.

Old regime versus new regime
HRA exemption under section 10(13A) is available under the old tax regime. The Income Tax Department’s regime FAQ states that the new tax regime does not allow this HRA exemption. Select the regime for the relevant assessment year before planning the claim; a calculation prepared under the old regime cannot simply be carried into a new-regime return.
Tax forms, thresholds and procedural instructions can change by tax year. The tax year you are filing, the assessment year shown on your return and the regime chosen in the return must all be consistent with the documents supplied by your employer.
How to report HRA exemption in your return
If your employer has already considered the exemption
Your employer normally reflects the exempt portion in Form 16 after reviewing the declaration and supporting documents requested during the year. When you prepare the return, report the exempt amount under the section for allowances exempt under section 10 and select section 10(13A), using the form and field applicable to your tax year and return type.

Check that the amount in Form 16 agrees with your own least-of-three calculation. Differences can arise when rent, salary or HRA changed during the year, when you changed homes, or when you worked in locations with different city percentages.

Do not assume that an employer omission permanently removes the exemption, but do verify the current return procedure before entering a different amount from Form 16. The official guidance confirms the disclosure category—allowances exempt under section 10, section 10(13A)—while the exact correction process and form fields depend on the tax year and return form. Reconcile the salary information with Form 16 and the information shown in your Annual Information Statement before filing.
Documents and records to keep
The ITR-1 help guidance advises taxpayers to retain Form 16, the Annual Information Statement (AIS) and house-rent receipts where applicable. For a genuine rental arrangement, keep a fuller file even if the return does not require attachments to be uploaded:
- Lease or rent agreement showing the property address, parties, rent and rental period.
- Rent receipts covering the months for which exemption is claimed.
- Bank or other payment evidence showing that rent was actually paid.
- Breakdowns of basic salary, qualifying dearness allowance, turnover-based commission, HRA and any changes during the year.
- Employer declarations, payroll confirmations or other evidence submitted during the HRA proof process.
- For a parent-owned home, ownership information and records supporting the parent’s reporting of rental income.
These records are practical evidence to preserve; they are not a statement that every item must be uploaded with every return. Follow the current instructions for the specific ITR form and year.
Landlord PAN information
The department’s salary guidance says the landlord’s PAN must be reported to the employer when annual rent exceeds the applicable threshold. The threshold and reporting process can vary with the tax year and current rules, so use the amount and format stated in the instructions for the year being filed rather than relying on an old checklist. If the landlord is a parent, obtain the correct PAN and ensure the name and ownership details are entered accurately.
What if you do not receive HRA?
Section 80GG is a separate deduction for eligible individuals who do not receive qualifying HRA under section 10(13A). It concerns rent for accommodation occupied for the individual’s own residence and is subject to conditions and statutory limits. It is not a way to claim HRA on a house occupied only by your parents.
Check the current-year eligibility tests, declarations and limits before calculating section 80GG. Do not claim both an HRA exemption and a section 80GG deduction for the same period unless the applicable law specifically permits the combination; the provisions are designed for different circumstances.

How the Income-tax Act, 2025 affects the analysis
The Income-tax Act, 2025 contains a separate rent-deduction provision at section 134. That provision is distinct from HRA under section 10(13A), and its application depends on the tax year, commencement provisions and rules in force for that year. Keep it separate from the HRA calculation instead of treating a new statutory section as an additional HRA category.
Common mistakes and how to correct them
Adding both homes’ rent
Mistake: entering your own rent plus the rent of a separate parental home in the rent-paid figure.

Claiming under the new regime
Mistake: carrying an old-regime HRA exemption into a new-regime return.
Correction: confirm the selected regime and the assessment year before completing the exemption schedule.
Using a paper-only rent arrangement
Mistake: showing rent to a relative without actual payments, a real rental period or consistent records.
Correction: claim only amounts actually paid under a genuine arrangement and retain supporting evidence.

Treating family support as rent
Mistake: calling mortgage instalments, utilities, groceries or general support “rent” without a tenancy and rent payment trail.
Correction: separate household support from rent and use only qualifying rent in the formula.
Using the wrong salary base
Mistake: applying the percentage limit to total gross pay, including allowances that are not part of the HRA salary definition.
Correction: use basic salary plus qualifying dearness allowance and turnover-based commission, then apply the least-of-three test.
Ignoring a mid-year move
Mistake: applying one annual rent or city percentage when the employee changed residence or city during the year.
Correction: calculate the relevant periods separately using the rent, salary, HRA and location applicable to each period, then follow the current payroll and return instructions for combining them.
A practical decision process
- Identify the tax year and regime. Confirm whether you are filing under the old regime, because section 10(13A) HRA exemption is not available under the new regime.
- List every residence. Record the address, occupants, owner and rental period for your home and your parents’ home.
- Mark the home you occupy. Only rent for accommodation you occupy belongs in the HRA calculation.
- Verify actual payments. Match receipts and bank records to the lease and months claimed.
- Calculate the three limits. Use actual HRA, rent less 10% of the defined salary, and the 50% or 40% location percentage.
- Take the least amount. Do not exceed the smallest of the three figures.
- Reconcile payroll records. Compare your result with Form 16, employer declarations and AIS.
- Report the exemption correctly. Use the allowance-exempt-under-section-10 schedule and select section 10(13A) in the applicable ITR form.
- Retain evidence. Keep Form 16, AIS, receipts, payment proof and any parent-landlord documents for the period required under the applicable rules.
Bottom line for the two-home question
Paying rent for yourself and separately paying rent for your parents does not let you combine both amounts for HRA. Claim the exemption, if otherwise eligible, on rent for the home you occupy and apply the least-of-three formula under the old regime. If you live in a parent-owned home and pay that parent genuine rent, the general rule may be relevant, but the official material does not provide an automatic answer for that family relationship; document the arrangement carefully and obtain case-specific advice where the amount or facts are significant.
