How to Claim Home-Loan Tax Deductions When Construction Is Delayed (India, AY 2026–27)

If construction of your house is delayed, you generally do not claim the qualifying interest paid during the pre-construction period as an ordinary deduction in each year you pay it. Under the section 24 framework of the Income-tax Act, 1961, that accumulated interest is divided into five equal annual instalments. The first instalment is claimed in the year the property is acquired or construction is completed, followed by one instalment in each of the next four years.

A delay therefore usually postpones the year in which the five-instalment sequence begins. Your result also depends on whether the property is self-occupied or let out, whether you use the old or new tax regime, when the loan was borrowed, whether the statutory completion condition is met, and which law and return form apply to your filing year.

What delayed construction changes

Interest on a housing loan falls into two broad periods:

  • Current interest: interest for the previous year in which the property has already been acquired or construction has been completed.
  • Pre-construction interest: qualifying interest for the period before the previous year in which acquisition or construction takes place.

Under the cited section 24 text, pre-construction interest is not claimed year by year merely because the lender charged it. Instead, the eligible amount is deducted in five equal instalments for the year of acquisition or completion and the four immediately succeeding previous years.

“Where the property has been acquired or constructed with borrowed capital, the interest, if any, payable on such capital borrowed for the period prior to the previous year in which the property has been acquired or constructed … shall be deducted under this clause in equal instalments for the said previous year and for each of the four immediately succeeding previous years.”

This is statutory wording from section 24 of the Income-tax Act, 1961, as displayed by the Income Tax Department. Confirm that this version and numbering govern the tax year for which you are filing.

How the delay affects the start year

Suppose construction is completed in a later financial year than originally expected. The five-instalment sequence described above starts in the year of actual acquisition or completion recognized under the applicable law, not in the year the builder originally promised to finish. Keep evidence of the legally relevant milestone and do not assume that a possession date is always the controlling event for every fact pattern.

An illustration of the five-instalment calculation

If your lender’s records show ₹5,00,000 of eligible pre-construction interest, the section 24 method would produce five equal instalments of ₹1,00,000. One would be associated with the acquisition or completion year and one with each of the next four years, subject to the applicable property-use, regime and statutory limits. This example explains the timing mechanism; it is not a determination that every ₹5,00,000 balance is deductible in full.

Establish the dates before calculating anything

Make a timeline from your loan documents and property records. The key dates are:

  • the date on which capital was borrowed, including the sanction and drawdown information shown by the lender;
  • the financial year in which the property was acquired or its construction was completed for purposes of the governing law;
  • the financial year for which you are filing the return;
  • the date and financial year in which each interest charge arose.

The cited statutory explanation refers to the previous year before the year in which acquisition or construction occurs. A buyer’s possession letter can be useful evidence, but the reviewed official material does not establish a universal rule that possession is always the decisive legal date. If possession, completion, registration and occupancy dates differ, obtain advice based on the documents and the law for that year.

Check how the property is used

Return guidance distinguishes a self-occupied property from a let-out property. Make that classification for the relevant return year before applying a limit.

Classification What to examine Practical consequence
Self-occupied Whether the property is treated as your self-occupied house under the return rules The cited section 24 ceiling and the old-versus-new regime rules become critical.
Let out Whether the property is reported as let out for the year Apply the rules for income from a let-out house; do not substitute the self-occupied ceiling without checking the applicable provision.

A property that was under construction for part of the year may require careful classification when it becomes usable or is acquired. Use the return form’s property schedule and the instructions for the actual assessment year rather than selecting a category solely from the builder’s expected handover date.

Understand the self-occupied limits in the cited section 24 framework

The Income Tax Department’s section 24 text states a ₹2,00,000 ceiling for qualifying interest on a self-occupied property when the stated condition is satisfied: acquisition or construction is completed within five years from the end of the financial year in which the capital was borrowed. The same text states a ₹30,000 ceiling where that completion condition for the higher limit is not met.

Self-occupied outcome in the cited text Ceiling Timing condition
Higher ceiling ₹2,00,000 Qualifying acquisition or construction completed within five years from the end of the financial year in which capital was borrowed.
Other stated ceiling ₹30,000 Apply where the condition for the higher ceiling is not met, after checking the governing statutory version.

These are statutory figures from the Income-tax Act, 1961 text and AY 2026–27 departmental guidance, not a general estimate of tax saved. The relevant limit can affect both the instalment of pre-construction interest and other interest claimable for the year; do not assume that the five-instalment mechanism automatically creates an extra deduction outside every annual ceiling.

Choose the correct tax regime

For a self-occupied property, the Income Tax Department’s new-versus-old-regime FAQ says that interest on borrowed capital is not allowed as a deduction from income from house property under section 115BAC’s new regime. The department’s AY 2026–27 guidance describes the section 24(b) deduction under the old regime, subject to the statutory conditions and limits.

Regime Self-occupied home-loan interest in the cited guidance What to do
Old regime Section 24(b) deduction is described, subject to conditions and limits. Calculate current and pre-construction interest separately, then apply the relevant ceiling and reporting rules.
New regime The FAQ says self-occupied-property interest is not allowed under section 115BAC. Do not claim the self-occupied section 24(b) deduction merely because the lender issued an interest certificate.

Regime selection should be based on your full tax position, including deductions and income from other sources. The amount of interest shown by the lender is not itself the amount of tax saved.

Separate current-year interest from the accumulated pre-construction amount

Ask the lender for a year-wise interest statement. Identify the interest that relates to the year in which the property was acquired or construction was completed, and identify the earlier interest that belongs to the pre-construction period. The earlier amount is the balance that may enter the five equal instalments under the cited section 24 explanation.

  • Do not claim every year’s pre-completion interest as a normal annual deduction when it was paid.
  • Do not divide the balance by five until you have confirmed the acquisition or completion year.
  • Do not treat pre-construction interest as a section 80C principal deduction.
  • Check whether any part of the interest has already been allowed under another provision; the statutory wording reduces the amount by such a part.

Step-by-step process for filing the claim

  1. Collect the lender’s statement. Obtain the interest certificate or annual statement showing the loan account, interest charged and, where available, the split between periods before and after completion.
  2. Build the date timeline. Record sanction date, first drawdown, subsequent disbursements, the financial year of acquisition or construction completion, and the return year.
  3. Confirm property status. Decide whether the property is self-occupied or let out for the return year, using the return instructions and your actual facts.
  4. Confirm the regime. If the property is self-occupied, check whether you are filing under the old regime or the new regime. The cited FAQ excludes the self-occupied interest deduction under the new regime.
  5. Compute the pre-construction instalment. Add eligible pre-construction interest, divide the qualifying total into five equal instalments, and assign the first instalment to the acquisition or completion year and the next four to the immediately succeeding years.
  6. Apply the annual rule and ceiling. Combine the relevant current-year and instalment amounts only as permitted by the law for that year. For self-occupied property, test the ₹2,00,000 or ₹30,000 ceiling described in the cited section 24 text, including the five-year completion condition.
  7. Complete the house-property schedule. Use the return form’s fields for property type, income or loss from house property and interest on borrowed capital. Follow the instructions for your assessment year.
  8. Retain the evidence. Keep the lender certificate, sanction and disbursement records, construction or acquisition documents, completion or possession evidence, and your calculation of the five instalments.

Do not confuse section 24 interest with section 80C principal

AY 2026–27 return guidance states a combined ₹1,50,000 section 80C limit. Qualifying housing-loan principal repayment or specified purchase or construction payments may fall within section 80C when all conditions are met. Pre-construction interest is not converted into an 80C deduction simply because construction was delayed.

Track principal and interest separately in the lender’s statement. A repayment that qualifies under section 80C follows the conditions and timing rules for that provision; the five-instalment method discussed here applies to qualifying pre-acquisition or pre-construction interest under the cited section 24 framework.

Worked scenarios

Scenario 1: Completion occurs after the original promised date

You borrowed capital in one financial year, expected completion the following year, and construction was completed later. The relevant five-instalment sequence begins in the year recognized as the acquisition or construction year under the applicable law. The original builder schedule does not, by itself, start the sequence. Recalculate the first claim year from the actual legally relevant milestone and preserve the evidence.

Scenario 2: The five-year condition is missed

If a self-occupied property’s qualifying completion does not occur within five years from the end of the financial year in which capital was borrowed, the cited section 24 text points to the ₹30,000 ceiling rather than the ₹2,00,000 ceiling. Verify the governing statutory version and whether any facts alter the result before filing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Scenario 3: The property is self-occupied but the new regime is selected

Even with a lender-issued interest certificate and a calculated five-instalment amount, the department FAQ says the self-occupied-property interest deduction is not allowed under section 115BAC’s new regime. A regime comparison must consider all deductions and income, not just the housing-loan amount.

Scenario 4: The property is reported as let out

Do not carry the self-occupied ₹2,00,000 or ₹30,000 ceiling into a let-out calculation without checking the let-out rules. Report the property category and interest in the house-property schedule required for the return year, then apply the provisions governing that category.

Carrying old section numbers into a later year

Error: assuming section 24(b), section 80C or section 115BAC numbering and rules automatically continue unchanged for tax years beginning on or after 1 April 2026.

Correction: consult the current primary legislation and updated official return instructions for the relevant assessment year. The official material summarized here is framed around the Income-tax Act, 1961 and AY 2026–27 and does not establish the successor provision or complete operative rules for later years.

Records to keep until the claim is no longer reviewable

  • sanction letter and loan agreement;
  • disbursement schedule and bank statements;
  • annual interest certificates and lender calculations;
  • builder, registrar or other documents showing acquisition or construction completion;
  • possession or occupancy documents, while recognizing that possession is not universally the controlling legal date;
  • calculation sheet showing the total pre-construction interest and each of the five instalments;
  • filed return, computation and acknowledgement for every year in which an instalment is claimed.

These records allow you to explain why the first instalment begins in a particular year, how the amount was divided, and why the chosen property classification and regime were used.

Which law applies to your filing year?

The official materials used for this explanation include AY 2026–27 guidance and text from the Income-tax Act, 1961. They do not settle the exact successor section numbering or all operative rules for tax years beginning 1 April 2026. Before filing a later return, verify the current Act, notifications, assessment-year instructions and return schema. Treat the figures and section references above as the cited framework, not as permission to carry legacy wording forward without checking.

When professional review is worthwhile

A tax-return preparer or chartered accountant can be useful when the loan has multiple disbursements, construction spans several years, completion and possession dates differ, the property changes from self-occupied to let out, or the five-year condition is close to expiring. Give the adviser the complete timeline and lender statement rather than only the latest interest certificate. The decision depends on dates, property treatment, regime and filing year, so a generic percentage or calculator cannot replace fact-specific review.
