Short answer: A patient who pays for personal treatment normally cannot claim that GST as business input tax credit (ITC). ITC is generally available only to an eligible GST-registered person for goods or services used, or intended to be used, in the course or furtherance of business. For hospitals, clinics, employers and other businesses, the result depends on whether the inward medical service or related purchase supports an exempt healthcare supply, a taxable supply, or both, and whether section 17(5) of the Central Goods and Services Tax (CGST) Act blocks the credit.
Healthcare supplied by a qualifying clinical establishment, authorised medical practitioner or paramedic is generally exempt. That exemption usually prevents recovery of input tax attributable to the exempt activity. A narrow set of exceptions can apply, including certain taxable same-category resales and employee healthcare that an employer is legally required to provide. The claim must therefore be analysed supply by supply rather than assumed from GST registration alone.

The decision in one table
| Situation | How the cost is used | Likely ITC treatment |
|---|---|---|
| Patient’s personal treatment | Private consumption, not a business input | No ordinary business ITC claim merely because GST was paid. |
| Hospital or clinic input used for exempt healthcare | Supports healthcare supplied by a clinical establishment, authorised medical practitioner or paramedic | Credit attributable to exempt supplies is restricted under section 17(2), and the section 17(5)(b)(i) block must also be tested. |
| Inward health service resold as a taxable supply of the same category | The registered recipient uses the service to make a taxable outward supply | The same-category exception in section 17(5)(b)(i) may permit credit, subject to all general conditions and apportionment rules. |
| Employee medical benefit required by law | The employer provides healthcare because a law in force makes it obligatory | The proviso to section 17(5)(b) may allow credit; the exact legal obligation and facts must be documented. |
| Shared costs | One input supports both taxable and exempt activities | Only the portion attributable to taxable and zero-rated supplies can be retained; common credit must be apportioned under the prescribed rules. |
| Inpatient food versus visitor food | Food advised by a clinician for an admitted patient versus food sold to non-admitted people | Government GST material treats the former as part of composite healthcare and the latter as taxable; related inputs must be mapped accordingly. |
Who can claim medical-service ITC?
Section 16 entitlement belongs to a registered business
Section 16(1) of the CGST Act, 2017 states:
Every registered person shall, subject to such conditions and restrictions as may be prescribed and in the manner specified in section 49, be entitled to take credit of input tax charged on any supply of goods or services or both to him which are used or intended to be used in the course or furtherance of his business.

This wording requires more than possession of a GSTIN. The recipient must be the registered person named on the tax documentation, the purchase must have a business purpose, and statutory conditions and restrictions must be satisfied. A consumer’s receipt for surgery, consultation or medicines does not become business ITC simply because the receipt shows GST.

Patients paying for their own care
If you are an individual paying for your own treatment, the payment is ordinarily personal consumption. Unless you are acting as a GST-registered business and can establish a genuine business use recognized by the Act, there is no ordinary business ITC route for that medical bill. Personal income-tax deductions, insurance reimbursement and GST ITC are separate concepts; one does not create the other.
Hospitals, clinics and other registered entities
A GST-registered hospital or clinic may receive invoices for rent, equipment maintenance, software, professional services, catering, diagnostic inputs and other costs. Registration permits an analysis of those invoices; it does not make every amount creditable. Each cost must be connected to an outward supply and checked against the exempt-supply restriction and blocked-credit provisions.
Classify the outward supply before looking at the invoice
Exempt healthcare
Official GST material discussing entry 74 of Notification No. 12/2017-Central Tax (Rate), dated 28 June 2017, says: Health care services provided by a clinical establishment, an authorised medical practitioner or para-medics are exempt. The 25th GST Council meeting material from 2018 also describes hospital charges to patients as exempt healthcare in the circumstances discussed and explains that hospital consultant services can remain healthcare even when the consultant is engaged by the hospital rather than employed by it.

1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsWhen an input is used to make that exempt healthcare output, section 17(2) requires the credit attributable to exempt supplies to be restricted. If the same purchase supports taxable and exempt outputs, only the portion attributable to taxable and zero-rated supplies may be retained, using the apportionment method prescribed in the rules.
Taxable ancillary activities
Healthcare premises may also make supplies that are not exempt healthcare. The classification depends on the actual package, recipient and contractual arrangement. A separately supplied taxable item cannot be treated as exempt merely because it is sold inside a hospital.

Inpatient food and food for others
Government GST Council material distinguishes food advised by a doctor or nutritionist for an admitted patient from food supplied to non-admitted patients, attendants or visitors. The former is treated as part of a composite healthcare supply in the circumstances described; the latter is treated as taxable. Keep the menu, billing structure, admission record and clinical advice that support the classification, then attribute food and catering inputs to the corresponding outward supply.
How section 17(5) can block a medical-service credit
Health services listed in the blocked-credit rule
Section 17(5)(b)(i) names health services among categories for which ITC is unavailable, subject to its stated exceptions. Therefore, an invoice that is clearly used for business still requires a separate blocked-credit test. Do not treat the section 16 business-use condition as an automatic override of section 17(5).
Same-category taxable outward supply exception
The provision contains an exception where the inward health service is used by the recipient to make an outward taxable supply of the same category. A registered intermediary or provider that buys a health service and makes a taxable outward supply may therefore have a route to credit, but only after proving the taxable outward classification and satisfying every other section 16 condition. The exception does not turn an exempt hospital service into a taxable one.
Taxable composite or mixed supply exception
The same sub-clause also refers to an inward service used as an element of a taxable composite or mixed supply. The complete bundle must genuinely be taxable under GST classification rules, and the health service must be an element of that bundle. Document the contract, principal supply analysis and invoice trail rather than relying on the label used by the supplier.
Employer-provided healthcare required by law
The proviso at the end of section 17(5)(b) provides an exception where an employer is obliged under a law in force to provide the benefit to employees. The 47th GST Council meeting material from 2022 explains that this proviso is read across clause (b), rather than being confined to only one numbered sub-clause. The exception is tied to a legal obligation, not to a voluntary wellness benefit or a general desire to support staff.

An employer claiming under this route should identify the precise central, state or other applicable law, retain the provision that creates the obligation, show that the supplied benefit corresponds to that obligation, and preserve the related invoices and employee records. If the benefit is optional, the proviso cannot be assumed to apply.

- Identify the claimant and GSTIN. Confirm that the entity taking credit is GST registered and that the invoice or other required document identifies that registered person as recipient. A patient’s personal payment is not converted into a business claim by entering it in an accounting system.
- Collect the complete invoice trail. Retain the supplier’s tax invoice, description of the service, tax charged, date, supplier details and the contract or purchase order where the nature of the service is not obvious. Do not split or re-label an invoice without commercial evidence.
- Describe the inward supply in plain language. Record whether it is a doctor’s service, diagnostic service, equipment lease, catering, consumable, maintenance service, employee benefit or another cost. The description should be specific enough to test section 17(5).
- Map the business use. Link the cost to a department, patient package, contract, taxable ancillary activity or general administration. A cost with no business connection fails the section 16 starting point.
- Classify the outward supply it supports. Mark the related output as exempt healthcare, taxable ancillary supply, zero-rated supply where relevant, or a mixed use. Use the actual recipient and package structure, not the location of the sale alone.
- Run the section 17(5) block test. For an inward health service, ask whether the same-category taxable outward-supply exception, taxable composite or mixed-supply exception, or legally obligatory employee-benefit proviso applies. If none does, treat the blocked amount as unavailable.
- Separate direct and common inputs. Credit directly attributable to taxable or zero-rated supplies is analysed separately from credit directly attributable to exempt supplies. Common inputs supporting both classes must be apportioned using the method prescribed by the current rules; retain the working papers and source figures.
- Check supplier and return conditions for the period. Before filing, verify the live CGST Act, rules, notifications and portal requirements for the relevant tax period, including the conditions governing the document and supplier reporting. The substantive classification alone does not prove that a return-period claim is ready.
- Post the eligible amount and preserve exclusions. Record the credit claimed, the amount restricted for exempt use, the amount blocked under section 17(5), and the reason for each exclusion. A reconciliation that shows what was not claimed is often as important as the amount claimed.
How to apportion shared medical-business costs
Section 17(2) applies when inputs or input services are used partly for taxable or zero-rated supplies and partly for exempt supplies. The law does not permit a business to claim the full common input tax merely because one part of its operations is taxable. Use the prescribed apportionment mechanism in the current rules, apply it consistently for the period, and retain the turnover and other figures used in the calculation.
Examples of costs that commonly need a use map include a building lease for a hospital with taxable cafeteria sales, a software platform serving both exempt patient care and taxable room or amenity packages, and security or housekeeping services covering separate departments. Allocate a cost directly where records support a direct link; classify the remainder as common only when it genuinely serves both activities.
Apportionment does not cure a section 17(5) block. First exclude an amount that is specifically blocked; then apply exempt-supply attribution to any otherwise eligible common credit.
Records to keep for an audit or departmental query
- GST registration details and the legal name of the recipient shown on each invoice.
- Tax invoices, debit or credit notes, purchase orders, contracts and proof of payment or accounting entry.
- A service description explaining why the inward supply was needed for the business.
- Patient-package, admission, department or cost-centre records connecting inputs to outward supplies.
- Evidence supporting the exempt healthcare classification or the taxable ancillary classification.
- Apportionment workings for inputs shared between taxable, zero-rated and exempt activities.
- A section 17(5) review identifying the block, the exception relied on, or the reason no exception applies.
- For employee healthcare, the exact law imposing the obligation, the relevant policy and records showing delivery of the mandated benefit.
- Return-period reconciliations and notes showing restricted or voluntarily unclaimed amounts.
Common scenarios and the correct analysis
A hospital buys consultant services
First determine whether the hospital’s outward patient-care supply is exempt healthcare. The 2018 GST Council material indicates that consultant services can remain healthcare even when the consultant is hired by the hospital rather than employed. The hospital must then test the inward consultant service under section 17(5) and restrict any amount attributable to exempt healthcare under section 17(2). The employment status of the consultant alone does not decide the credit.

A clinic sells a taxable package containing a health service
Obtain the contract and identify the principal supply and tax treatment of the package. If the inward health service is used to make a taxable outward supply of the same category, the section 17(5)(b)(i) exception may be relevant. If the package is actually exempt healthcare, the exception is not created by calling the package a bundle.
An employer buys annual medical check-ups
Determine whether a specific law in force obliges that employer to provide the check-ups. If so, preserve the legal citation and evidence connecting the purchase to the obligation. If the check-ups are voluntary, the employer cannot rely on the proviso merely because the service benefits employees.
A hospital cafeteria serves visitors
Separate visitor or attendant food from clinician-advised inpatient food. The government material treats these supplies differently. Use separate billing, inventory or cost-centre records where practical; otherwise, a shared-cost calculation may be required and the associated input tax may not be fully recoverable.

Why it fails: inpatient food advised as part of care and food sold to visitors or non-admitted people are distinguished in official GST material. Correction: use recipient, admission status, clinical advice and package terms to classify the supply.

Why it fails: section 17(2) restricts credit used for exempt supplies. Correction: apply the prescribed rule-based apportionment and keep the calculation with the return records.

Which sources control the answer?
The CGST Act, 2017 on the CBIC Tax Information Portal is the primary statutory foundation for section 16, section 17(2) and section 17(5)(b)(i). The CBIC ITC Rules material supports the apportionment and distribution framework. The 25th GST Council meeting material from 2018 explains the healthcare exemption and inpatient-food distinction, while the 47th meeting material from 2022 addresses the scope of the employer-obligation proviso. A Telangana Commercial Taxes Department handbook published in November 2025 provides explanatory healthcare examples, and a West Bengal Commercial Taxes Department circular compilation covering central circulars through 31 March 2026 reproduces relevant CBIC healthcare clarification. Explanatory material cannot override the Act, a current notification or a binding rule.
GST law and portal procedures can change. Before filing a return for a particular period, check the current statutory text, applicable notifications, rules and portal conditions. The final amount is fact-specific and cannot be calculated from the general categories alone.
Practical conclusion
To claim GST ITC connected with medical services, begin with the claimant and business purpose, classify the outward supply, test the health-service block in section 17(5), and then restrict any credit attributable to exempt healthcare under section 17(2). Keep a documented exception only where the inward service is used for a qualifying taxable same-category or taxable bundled supply, or where an employer’s provision is legally obligatory. For a personal patient expense, the ordinary business-ITC route does not exist.
