In most cases, you cannot claim GST input tax credit (ITC) on the cost of constructing a commercial building for your own business, even if you will rent it out or use it to make taxable supplies. Section 17(5) of the Central Goods and Services Tax (CGST) Act blocks credit for construction of immovable property on the taxpayer’s own account and for most works-contract services used to construct it. The main statutory exceptions are qualifying plant and machinery and works-contract services used by a contractor for making a further supply of works-contract service.
A commercial property’s eventual use, such as taxable renting, is a separate question from whether the construction input is creditable. Before claiming anything, identify who procured the work, classify each invoice, test the plant-and-machinery definition, and complete the section 16 documentation, payment, reconciliation and time-limit requirements.

The rule that decides whether construction ITC is available
Two provisions usually control construction-related ITC:
The Tool Desk
Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →- Section 17(5)(c): blocks ITC on works-contract services supplied for construction of immovable property other than plant and machinery. The exception applies where that works-contract service is an input service for a further supply of works-contract service.
- Section 17(5)(d): blocks goods or services received by a taxable person for construction of immovable property, other than plant and machinery, on the taxpayer’s own account. The block applies even when the property is constructed in the course or furtherance of business.
The construction explanation covers reconstruction, renovation, additions, alterations and repairs to the extent those costs are capitalised to the immovable property. Therefore, describing an invoice as renovation, fit-out or repair does not by itself avoid the restriction when the amount is capitalised into the building.

The phrase “commercial property” does not create an exception. A building used for a taxable business can still be an immovable property on which section 17(5) blocks credit.
Own-account construction
Own-account construction generally means the taxpayer receives goods or services and builds, expands or capitalises an immovable property for itself. The restriction can apply whether the taxpayer hires a principal contractor, several specialist contractors or buys materials separately. Business use is expressly included in section 17(5)(d), so the fact that the building houses a taxable office, warehouse, hotel or rental complex does not overcome the block.
Works-contract construction
A works contract is treated as a supply of service under GST when it involves construction, erection, commissioning, installation, completion, fitting out, repair, maintenance, renovation, alteration or similar work involving immovable property and includes transfer of property in goods. Section 17(5)(c) generally blocks the recipient’s ITC when the service is used to construct the recipient’s immovable property.

The narrow exception is for a person who receives works-contract service as an input service and then makes a further supply of works-contract service. It is not a blanket permission for a property owner to claim GST charged by its building contractor.
Can I claim GST on a commercial building that I rent out?
Usually, not for the building’s blocked construction costs. Schedule II treats renting of immovable property, including commercial, industrial or residential complexes let for business or commerce, as a supply of services. That classification determines the nature of the outward supply; it does not remove the separate section 17(5) restriction on constructing the underlying immovable property.
For example, a GST-registered company may construct an office block and charge GST on rent to tenants. The rent can be a taxable outward supply while the GST paid on the building’s civil construction remains blocked. Taxable rental income and construction-credit eligibility must be analysed independently.
Construction intended for sale
Schedule II also treats specified construction of a building intended for sale to a buyer as a supply of services, except where the entire consideration is received after the completion certificate is issued or after first occupation, whichever is earlier. This outward-supply rule does not automatically make every construction input creditable. The recipient’s status, the project structure and section 17(5) still have to be tested.

What counts as plant and machinery?
Plant and machinery is the principal construction-related exception. The statutory definition covers apparatus, equipment and machinery fixed to earth by foundation or structural support and used for making outward supplies of goods, services or both. It includes the foundations and structural supports for that apparatus, equipment or machinery.

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
The definition expressly excludes land, buildings and other civil structures, telecommunication towers, and pipelines laid outside factory premises. A building cannot be relabelled as plant and machinery merely because it is essential to the business or earns taxable revenue.
Why asset-level classification matters
A single project can contain both blocked building work and potentially eligible machinery. The GST treatment must therefore follow the individual asset and supply, not the project’s commercial name. Keep separate invoices, contracts, purchase orders, completion records and fixed-asset registers for civil construction and machinery.
Lifts, HVAC, electrical systems and similar equipment
Lifts, heating, ventilation and air-conditioning systems, electrical installations, fire-safety equipment, generators, refrigeration systems and other building equipment cannot be declared eligible or ineligible solely from their labels. Ask the statutory questions for each item:
- Is it apparatus, equipment or machinery rather than a building or civil structure?
- Is it fixed to earth by a foundation or structural support?
- Is that foundation or support identifiable and separately documented?
- Is the equipment used for the taxpayer’s outward supplies?
- Does another exclusion, such as the exclusion for a building or civil structure, apply?
- Has the cost been capitalised into the immovable property, and is the GST component treated consistently for income-tax depreciation?
Technical drawings, specifications, installation contracts, asset registers and evidence of operational use can be important. Where an integrated installation is inseparable from the building, obtain a project-specific GST opinion instead of assuming that every mechanical or electrical component qualifies.
Own-account construction versus onward works-contract supply
| Project position | Typical section 17(5) question | General direction |
|---|---|---|
| Owner or occupier constructs its own building | Are goods or services received for construction of immovable property on its own account? | ITC on the building and capitalised civil work is generally blocked, even when used in business. |
| Owner receives a contractor’s works-contract service for its building | Is the service used to construct immovable property other than plant and machinery? | ITC is generally blocked under section 17(5)(c). |
| Works contractor receives an input service and makes a further supply of works-contract service | Is the received works-contract service an input service for onward works-contract supply? | The statutory exception may apply, subject to the actual contracts and other section 16 conditions. |
| Separate qualifying machinery is installed for outward supplies | Does the asset satisfy the plant-and-machinery definition and avoid the exclusions? | Potentially eligible, but classification must be supported asset by asset. |
This table shows the statutory framework, not an automatic result for a particular project. The contracts, ownership, capitalisation and use of each supply determine the analysis.
A step-by-step method for assessing a claim
1. Identify the claimant and its role
- Confirm the GST registration of the person seeking credit and the state or Union Territory registration to which the invoice belongs.
- Record whether the claimant is the owner, developer, tenant, occupier, special-purpose vehicle or works contractor.
- Establish who signed each contract, who received each invoice and who paid the supplier.
- Confirm whether the claimant itself makes the outward supply or merely provides premises to another entity.
A tenant paying for alterations to leased premises can still face the own-account construction restriction if the work creates or capitalises an immovable improvement for the tenant. The lease, accounting treatment and handover rights need to be reviewed rather than assumed.
2. Build an invoice and asset classification schedule
List every invoice and divide the costs into at least these categories:
- Building structure and civil works, such as foundations, slabs, walls, roofing and structural additions.
- Capitalised renovation, alteration, repair or fit-out of the immovable property.
- Works-contract services received from a contractor.
- Equipment and machinery that may satisfy the plant-and-machinery definition.
- Ordinary repairs, consumables or movable business assets that are not part of the blocked construction.
Do not decide eligibility from the supplier’s invoice description alone. Match the invoice to the purchase order, scope of work, engineering records, commissioning certificate and fixed-asset register.

3. Test the outward use
For an otherwise eligible input, determine whether it supports taxable supplies, zero-rated supplies, exempt supplies or non-business activity. Sections 17(1) and 17(2) restrict credit to the attributable portion where use is mixed. This apportionment test comes after the section 17(5) test: a blocked construction item does not become eligible merely because it supports taxable rent.
4. Verify the section 16 conditions
Section 16 generally requires all of the following:
- A tax invoice, debit note or other prescribed document.
- Supplier-furnished invoice details communicated to the recipient through the GST system.
- Actual receipt of the goods or services.
- The recipient’s return filed under section 39.
- Use or intended use in the course or furtherance of business.
Rule 36 sets out documentary requirements. Reconcile the supplier’s invoice data with the monthly GSTR-2B statement before treating a potentially eligible amount as claimable.

If the recipient does not pay the supplier the value of the supply plus tax within 180 days from the invoice date, the Act requires reversal of the credit with applicable interest, subject to the statutory treatment of reverse-charge supplies. The credit can be re-availed after payment. Maintain bank records, vendor ledgers and payment references so the 180-day review is auditable.
Do not claim ITC on a GST component for which depreciation has been claimed under the Income-tax Act. Align the GST credit ledger with the income-tax fixed-asset register and depreciation schedules.
6. Apply the time limit and claim through the return
The general section 16(4) deadline is 30 November following the end of the financial year to which the invoice or debit note relates, or the filing of the relevant annual return, whichever is earlier. The exact annual-return interaction and any later legislative change should be checked for the period concerned.
Claim eligible credit in the prescribed GST return and retain the supporting records. A late discovery of an invoice does not extend the statutory deadline.

Common mistakes and how to correct them
Claiming because the property earns taxable rent
Mistake: treating GST charged on the building as eligible because commercial rent is taxable.
Correction: classify the construction input under section 17(5) first. Analyse the rental supply separately under Schedule II and apply section 17 apportionment only to credit that is not already blocked.
Treating every contractor invoice as an ordinary service
Mistake: claiming the contractor’s GST because the invoice says “service,” “interior work” or “project management.”
Correction: determine whether the supply is a works contract or another service used for construction, whether it is capitalised and whether a statutory exception applies.
Calling the building plant and machinery
Mistake: arguing that a factory, warehouse or office is plant because it is essential to production or leasing.
Correction: apply the statutory definition. Buildings and other civil structures are excluded. Only qualifying apparatus, equipment or machinery, including eligible foundations and structural supports, can be considered under that exception.
Relying on GSTR-2B as proof of eligibility
Mistake: treating an invoice appearing in GSTR-2B as automatically claimable.

How different project uses affect the analysis
Self-occupied office or warehouse
Own-account construction of the building is generally blocked. Separate movable assets or qualifying machinery require their own classification and documentation.
Commercially rented building
Taxable renting does not by itself unlock construction ITC. The building and civil-structure costs remain subject to section 17(5), while separate eligible inputs must be tested under sections 16 and 17.
Property used for both taxable and exempt activities
First remove items blocked by section 17(5). For any remaining eligible input, apportion credit between taxable or zero-rated and exempt use under section 17 and the applicable rules.
Developer selling units
Review whether the outward transaction is treated as construction intended for sale and whether consideration is received before or after completion certificate or first occupation. The outward classification does not, on its own, decide every inward-credit question.
Works contractor serving another customer
A contractor may rely on the onward works-contract exception where the received works-contract service is an input service for a further supply of works-contract service. The contracts must show that onward supply, and all section 16 conditions still apply.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesA practical decision checklist
- Who is claiming? Owner, tenant, developer or works contractor.
- What was bought? Building/civil work, works-contract service, machinery, equipment or an ordinary business input.
- Who owns and capitalises it? Match the invoice to the asset and accounting records.
- Is the item immovable property? If yes, test section 17(5)(c) or (d).
- Could it be plant and machinery? Verify apparatus, equipment or machinery, attachment, outward use and exclusions.
- Is there onward works-contract supply? If not, the section 17(5)(c) exception is unlikely to apply.
- Is the supplier’s invoice reported? Reconcile with GSTR-2B and correct discrepancies.
- Was the supply received and paid within 180 days? Document both facts.
- Was GST excluded from income-tax depreciation? Check the fixed-asset and tax records.
- Is the claim within section 16(4)? Track 30 November and the annual-return deadline.
- Is use mixed? Apportion only credit that remains eligible after section 17(5).
When professional advice is warranted
Obtain a project-specific GST opinion when the arrangement involves a leasehold improvement, a build-operate-transfer structure, multiple entities, a developer and contractor in the same chain, composite equipment installations, pre-completion property sales, or both taxable and exempt outputs. The official statutory framework cannot determine a fact-specific result without the contracts, invoices, ownership evidence, technical descriptions and accounting treatment.
Also verify the CGST Act, applicable state or Union Territory GST provisions, current rules, notifications, amendments and commencement dates for the relevant invoice period. A conclusion that was correct for one financial year or project structure may not carry over unchanged to another.
Quick Recap
Key takeaways
- Own-account construction of a commercial building is generally blocked from ITC, even when the building is used in business or rented out.
- Works-contract services used to construct immovable property are generally blocked, except for the statutory onward works-contract situation.
- Buildings and civil structures are excluded from plant and machinery; equipment must be tested individually.
- Taxable commercial rent and construction-credit eligibility are separate analyses.
- GSTR-2B appearance, a tax invoice and business use do not override section 17(5).
- Any otherwise eligible credit still requires receipt, supplier reporting, return filing, payment within 180 days, no depreciation on the GST component and a claim within the section 16(4) deadline.
