In India, a private-sector employee generally looks to the Payment of Gratuity Act, while a government employee may receive retirement gratuity under service rules. The eligibility test, pay base, service-counting method, maximum and tax treatment can differ substantially. Once the governing scheme is confirmed, obtain the employer or pension authority’s written calculation and check it against your service and pay records.
First identify which gratuity scheme covers you
The phrase “gratuity after retirement” does not describe one universal benefit. The calculation depends primarily on your employer category and the legal rules that applied to your employment.

| Employment situation | Likely governing framework | What must be checked |
|---|---|---|
| Employee of a private employer or another establishment covered by the statute | Payment of Gratuity Act framework | Continuous service, definition of wages, service-year rounding, statutory maximum and any applicable scheme conditions |
| Central-government employee | Retirement-gratuity provisions in the applicable government service rules | Qualifying service in completed six-month periods, emoluments at retirement, applicable dearness allowance and the prescribed ceiling |
| State-government employee, statutory corporation employee or another public body employee | The service rules or statute applicable to that employer | The authority’s own formula, qualifying-service rules, pay definition, ceiling and tax category |
Do not apply the Payment of Gratuity Act formula to a government retiree merely because both benefits are called gratuity. Ask the personnel, establishment or pension section to identify the exact rule and version used for your case. If you changed employers, had breaks in service, took an approved absence or moved between employment categories, request a service statement showing how those periods were treated.
When a Payment of Gratuity Act employee becomes eligible
Income Tax Department guidance describes the general statutory condition as five years of continuous service before employment ends through retirement, resignation or superannuation. The five-year condition does not apply when employment ends because of death or disablement. The operative statute and the facts of the employment still control, so verify that your establishment and employment are covered.

What “continuous service” means for your calculation
- Use the service period accepted by the employer under the applicable statute and records, not an informal estimate from joining and leaving dates.
- Ask for a written explanation if unpaid leave, suspension, lay-off, interruption, transfer or a break in service has been excluded.
- Check whether the employer has counted the final partial year as a completed year or as a period exceeding six months, as required by the governing rule.
- For death or disablement cases, do not reject a claim solely because five years has not been completed; the general condition is removed in those circumstances.
How to calculate gratuity under the statutory framework
The statutory basis stated in Income Tax Department guidance is 15 days’ wages based on last-drawn wages for each completed year of service, or for a part of a year exceeding six months. The exact amount depends on the statutory definition of wages and the calculation method used for a daily or 15-day wage. Confirm those details against the operative law and your employer’s calculation sheet.
Use this calculation sequence
- Confirm coverage and eligibility. Establish that the Payment of Gratuity Act applies, that the employment ended in a qualifying way and that the five-year condition is met or is waived because of death or disablement.
- Identify last-drawn wages. Ask the employer to show each pay component included in the statutory wage definition. Do not automatically substitute total gross salary, take-home pay or cost-to-company figures.
- Determine eligible service units. Count completed years and treat a remaining period exceeding six months as an additional year where the applicable rule requires that treatment.
- Calculate 15 days’ wages for one service unit. The payroll calculation must use the wage-period conversion and wage definition required by the operative statute.
- Multiply the 15-day wage by the eligible service units. Compare the result with the current statutory maximum and any more favourable employer or award provision that legally applies.
- Request the calculation in writing. The statement should show the wage base, service dates, rounding of the final period, gross gratuity, deductions if any and the rule used.
Illustrative arithmetic example
Suppose the employer’s verified calculation sheet shows a 15-day wage of ₹25,000 and 13 eligible service units. The unadjusted estimate would be ₹25,000 × 13 = ₹3,25,000. This is an arithmetic illustration, not a determination of what your 15-day wage is. Your actual result may differ because the statutory wage definition, daily-rate conversion, service record, ceiling or scheme terms may be different.
Why “last salary” can produce the wrong result
Readers often ask, “How do I calculate gratuity on my last salary?” The relevant figure is not necessarily your final payslip total. A payslip can include reimbursements, bonuses, overtime, allowances or deductions that are not all treated alike under the governing gratuity rule. Have the employer identify the legally included wage components and retain the payslip, appointment terms and wage revisions supporting that figure.

The CRPF’s retirement guidance describes a different formula for the central-government retirement-gratuity framework: one-quarter of emoluments last drawn for each completed six-month period of qualifying service. The same guidance states a maximum of 16.5 times emoluments or ₹20 lakh, whichever is lower. Confirm that these provisions apply to your service and that no amendment or department-specific rule has changed the result.

What counts as emoluments
The CAG pension FAQ says last basic pay is used as emoluments for pension and that the applicable dearness allowance on the retirement or death date is included for retirement or death gratuity. Your pension-sanctioning authority should confirm the exact pay and allowance entries used in your case, especially if you were on a special pay arrangement, had a pay fixation shortly before retirement or were drawing a non-standard allowance.
Central-government calculation steps
- Obtain the qualifying-service statement. The relevant unit is a completed six-month period, not simply the number of calendar years rounded informally.
- Verify the emoluments at the relevant date. Check last basic pay and the applicable dearness allowance identified by the pension authority.
- Calculate one-quarter of emoluments. Divide the verified emoluments by four.
- Multiply by completed six-month periods. This gives the amount before the ceiling is applied.
- Apply the ceiling. Compare the result with 16.5 times emoluments and ₹20 lakh; the maximum payable under the cited guidance is the lower figure.
- Reconcile with the pension authority’s sanction order. Any difference should be traced to service periods, pay entries, allowance treatment or the rule version used.
Illustrative central-government example
Assume verified emoluments of ₹80,000 and 30 completed six-month periods. One-quarter of ₹80,000 is ₹20,000; multiplied by 30, the preliminary gratuity is ₹6,00,000. The stated ceiling is then tested: 16.5 times ₹80,000 is ₹13,20,000, while the other stated ceiling is ₹20,00,000. The lower ceiling is ₹13,20,000, so the illustrative ₹6,00,000 result is below it. This example does not decide whether a particular employee has 30 qualifying periods or whether ₹80,000 is the correct emolument figure.
Does gratuity include dearness allowance?
There is no single answer for every retiree because “wages” under the statutory framework and “emoluments” under government service rules are different concepts. For central-government retirement or death gratuity, the CAG FAQ identifies the dearness allowance applicable on the retirement or death date as included in the emoluments used for that benefit. For an employee covered by the Payment of Gratuity Act, ask the employer to identify which components qualify as wages under the applicable statutory definition; do not assume that every allowance or every form of dearness allowance is included.
Ask for a component-by-component schedule. It should state the basic or wage amount, each allowance included or excluded, the relevant date and the legal provision supporting the treatment. This is more reliable than comparing the gratuity figure with the gross amount printed on a final payslip.

How to compare two different gratuity estimates
If your employer, adviser or own spreadsheet produces two figures, compare the assumptions rather than only the totals. Use the following checklist.
| Comparison point | Questions to ask |
|---|---|
| Governing rule | Is the estimate based on the Payment of Gratuity Act, central-government service rules or another scheme? |
| Eligibility | Was the five-year condition applied, waived for death or disablement, or replaced by a qualifying-service test? |
| Service measure | Were completed years and a period exceeding six months counted, or were completed six-month periods used? |
| Pay base | Does the figure use statutory wages, basic pay plus applicable dearness allowance, or an incorrect gross or take-home figure? |
| Ceiling | Was the applicable statutory or service-rule maximum applied after the preliminary calculation? |
| Tax treatment | Is the estimate a gross entitlement or an amount after a category-specific tax calculation? |
Write down the assumptions beside each estimate. A lower result may be correct because it uses a different legal scheme or cap; a higher result may be wrong if it includes pay components or service periods that the governing rule excludes.
How to claim gratuity after retirement
The official material reviewed for these rules establishes eligibility and calculation principles but does not establish one universal form, submission address, electronic channel or deadline for every Indian retiree. Claim instructions vary by employer and scheme. The safest process is to obtain the applicable instructions from the employer or pension-sanctioning authority and keep proof of every submission.

Private-sector or statutory-scheme claim workflow
- Ask the employer to identify the scheme. Request the rule relied on, your recorded date of joining, date of exit, qualifying service and last-drawn wage components.
- Request a written gratuity calculation. Ask for the service-unit count, 15-day wage, preliminary amount, applicable ceiling and any proposed deduction.
- Compare it with your records. Check appointment and confirmation documents, relieving or retirement letter, payslips, wage-revision orders and approved leave or service records.
- Submit the claim using the employer’s stated channel. Follow the form or portal instructions supplied by the employer or the authority responsible for the scheme. Keep a dated copy, acknowledgement, email receipt or portal confirmation.
- Respond to discrepancies in writing. Identify the exact date, wage component or service period you dispute and attach the supporting record.
- Escalate through the responsible authority if the employer does not resolve it. Ask the employer which designated officer or statutory authority handles gratuity disputes in your establishment. Obtain independent legal or labour advice when the amount is substantial or records conflict.
Government-service claim workflow
- Contact the department or pension-sanctioning authority. Request the retirement-gratuity calculation and the qualifying-service statement.
- Check the emolument entries. Reconcile last basic pay and the dearness allowance applicable on the retirement date with the service book and pay-fixation records.
- Check completed six-month periods. Ask how any incomplete period, suspension, extraordinary leave, transfer or break was treated.
- Check the ceiling. Ensure the preliminary amount was tested against 16.5 times emoluments and ₹20 lakh where the cited central-government rule applies.
- Use the department’s prescribed correction or representation route. Keep copies of the sanction order, correspondence and acknowledgements.
Documents to assemble before making the request
- Appointment, confirmation, transfer and retirement or resignation orders
- Service book extract or employer service statement
- Final payslips and recent pay-fixation or promotion orders
- Evidence of basic pay and applicable dearness allowance at retirement, where government rules apply
- Leave, suspension, break-in-service or qualifying-service records that could affect the count
- Bank details and identity documents if the employer’s procedure asks for them
- Previous gratuity calculations, acknowledgements and correspondence
Do not send original records unless the responsible authority formally requires them and provides a receipt. Redact unrelated personal information when sharing documents with an adviser or representative.

What to do when gratuity is unpaid or the calculation is disputed
Start with a focused written request, not a general complaint. State the date employment ended, the gratuity amount claimed or the calculation error, the records supporting your position and the action you want: a corrected calculation, a written reason for exclusion or payment under the applicable procedure. Ask the employer to identify the responsible officer and the rule used.
If the service period is wrong
Attach joining, confirmation, transfer and exit records and show the exact dates you believe should be counted. Ask the authority to explain each excluded interval. For a government claim, request the qualifying-service statement used for pension sanction; for a statutory claim, request the employer’s continuous-service computation.
If the wage or emolument base is wrong
Mark each disputed component on the employer’s calculation sheet. Distinguish basic pay, dearness allowance, reimbursements, bonus, overtime and other allowances. Ask which legal definition supports inclusion or exclusion. A disagreement over the gross salary printed on a payslip is not by itself proof that the gratuity wage base is wrong.
If no calculation is supplied
Request the calculation and scheme instructions in writing, using the employer’s recorded contact channel. Preserve delivery evidence. If the employer does not respond, ask the applicable labour, personnel or pension authority what complaint or representation route covers your category. Because a universal form and deadline cannot be stated for every Indian retiree, rely on the instructions for your establishment rather than a generic online template.

Tax treatment: do not assume every gratuity payment is tax-free
Income Tax Department guidance distinguishes employee categories. It describes full exemption for government employees other than employees of statutory corporations in the category covered by that guidance. For non-government employees covered by the Payment of Gratuity Act, it describes a conditional least-of calculation. The taxable amount therefore depends on employment category, the governing gratuity law and the facts of payment.
| Category described in the tax guidance | Tax point | Practical action |
|---|---|---|
| Government employee, other than a statutory-corporation employee, within the described category | Guidance states full exemption | Retain the retirement order, gratuity sanction and tax statement supporting the category. |
| Non-government employee covered by the Payment of Gratuity Act | Exemption is determined by a conditional least-of calculation | Provide the gratuity amount, qualifying service, wage details and payment date to the tax preparer; do not treat the gross payment as automatically exempt. |
| Other employees or employees whose category is unclear | The reviewed guidance does not establish a universal result | Confirm the applicable tax provision with the employer’s tax team or a qualified tax professional. |
Tax exemption is separate from the employer’s calculation of gross gratuity. First establish the correct benefit under the employment scheme; then determine how much of that payment is exempt for your tax category and year.
Common mistakes that reduce or delay a claim
- Using one formula for everyone: the statutory 15-days-per-service-unit approach and the central-government one-quarter-per-six-month approach are not interchangeable.
- Counting total tenure without checking the rule: service rounding differs between the statutory and government frameworks.
- Using gross salary or take-home pay: the legally relevant wage or emolument base may be narrower or differently defined.
- Ignoring dearness allowance where government rules require it: the applicable allowance on the retirement or death date may be part of retirement-gratuity emoluments.
- Applying a cap too early: calculate the preliminary amount first, then apply the ceiling specified by the governing scheme.
- Assuming a tax-free result: exemption depends on employee category and statutory conditions.
- Relying on an online form without checking the employer: there is no single universal submission route established for every Indian retiree.
- Failing to preserve proof: keep the calculation, service statement, claim acknowledgement and all replies.

Questions to resolve before accepting the payment
- Which statute or service rule was applied?
- What dates and intervals make up the qualifying service?
- Why was the final partial period rounded in that way?
- Which wage or emolument components were included?
- Was dearness allowance included where the government rule requires it?
- Which ceiling was applied, and was it applied after the preliminary calculation?
- Is the figure gross gratuity or the amount after tax withholding?
- Where should a correction or unpaid-amount representation be filed?
Do not sign a full-and-final acknowledgment that contains an unexplained figure. Ask for the calculation and record any reservation in writing before accepting or disputing the payment.
Bottom line
To claim the correct gratuity, identify the governing employment scheme first, then verify service, pay base, formula, ceiling and tax category separately. For Payment of Gratuity Act coverage, the general statutory basis is 15 days’ wages for each eligible service year or qualifying part-year, with a five-year condition that does not apply to death or disablement. For the central-government formula described by CRPF, the amount is one-quarter of qualifying emoluments for each completed six-month period, subject to 16.5 times emoluments or ₹20 lakh, whichever is lower. Your employer or pension authority should provide the operative calculation and claim route for your specific records.
